Section 38

The Punjab Fire and Emergency Service Act, 2024State Act of Punjab · Act 12 of 2024

(1) The Government may notify the categories of fire incidents in respect of which such Officers, as may be notified, shall conduct an inquiry and send a report to the relevant local authority, the Director and the Government.

(2) Any fire incident involving human death shall compulsorily be inquired by such Officers, as may be notified.

(3) During the inquiry, the inquiry Officer must ensure that all aspects of the fire incident and the lapses in compliance with fire prevention and life safety measures are recorded.

(4) While conducting the inquiry, the relevant Officer shall have the power to call the witnesses, summon testimony on record and any other documents to conduct such an inquiry and the report shall be submitted in a time bound manner.

(5) The relevant Fire Officer may request the local authority maintaining the Fire Brigade at which they are posted, to solicit the assistance of any other authority or organization for the purposes of the investigation.

PART - D IMMUNITIES FROM JUDICIAL ACTION

39. No court shall entertain any suit, application or other proceedings in respect of any notice or order under this Act until the person aggrieved by such notice or order has exhausted all remedies, including the right to showcause and the right to appeal, available to him by or under this Act.

40. No suit, prosecution or other legal proceeding shall lie against any member of the Service for anything which is in good faith done or intended to be done in pursuance of the objectives of this Act or any rules made thereunder.
