(1) If, either upon inspection after receiving a report from the erector of a pandal or after the expiry of the time, as specified in the notice, within which the erector was supposed to ensure compliance with the fire prevention and life safety measures, the Fire Officer discovers that the erector has failed to comply with the notice issued to him, the following procedure shall be followed, namely:-

(i) The Fire Officer shall issue an order temporarily suspending the Fire Safety Certificate of the pandal. If the erector of the pandal was only required to make a declaration, the order shall state that the declaration is invalid and should be removed from public display.

(ii) The Fire Officer shall, in the order issued under clause (i), also direct the erector to shut down the pandal forthwith and ensure that no member of the general public enters the pandal.

However, the Fire Officer shall allow the erector of the pandal to enter the pandal, individually as well as with such other persons as the erector deems fit, only to make arrangements for compliance with the fire prevention and life safety measures.

(iii) After ensuring compliance in the pandal, the erector of the pandal shall inform, in writing, the Fire Officer under whose jurisdiction the pandal is situated. The Fire Officer shall inspect the pandal within twelve hours of receiving such notice and shall, if satisfied with the state of compliance with the fire prevention and life safety measures, permit the erector to resume operations of the pandal. While giving such permission, the Fire Officer shall issue a fresh Fire Safety Certificate.

(2) In case of any violations of an order issued under clause (i) of subsection (1), the pandal shall be dismantled forthwith under the supervision of the Fire Officer or any other member of the Service as may be appointed by the Fire Officer in this behalf.
