The Punjab Homoeopathic Practitioners Act, 1965State Act of Punjab · Act 16 of 1965

( 1) Every person, who possesses any qualifica- Registration, tion mentioned in Schedule I, shall. subject to the provisions contained in this Act and on payment of the prescribed fees, be entitled to have his name entered in Part A of the Register subject to such conditions as the Council may by regulations specify.

(2) Every person, who, within a period of six months from the date on which this Act comes into force, proves to the satisfaction of the Re!2'istrar that immediatelv before the commencement of this Act he was not less than twenty-five years of age and had been in continuous practice as a' practitio~er for Rt least five years, shall, on payment of the prescribed 710 PUNJAB HOMOEOPATHIC [19G5 : Pb. Act 16 PRA:CTITIONERS I foes, be entitled to have his hanie entered in Part B of the Register subject to such conditions as the Council may by rregulations specify.

(3) No person,-

(a) who_is re~stered under the Punjab Medical • Reg1strat10n Act, 1916, or the Punjab Ayurvedic and Unani Practitioners Act, 1963, shall be eligible for registration under sub-section (1) or sub-section (2) unless and until he ceases to be registered under those Acts ; or I ·

(b) who is registered under sub-section ( 1) or sub-section (2), shall continue to be a regi­ stered practitioner under this Act iif sub­ sequent to such registration under the Punjab Medical Practitioner Act. 1916, or the Punjab Ayurvedic and Unani Practi­ tioners Act, 1963.

I I '( 4) Where an application for entry in the Register is made bv a ner~on whose case is not clearly covered by sub-section (1) or sub-section (2) or by the rules or regulations made under this Act. the Registrar shall refer his annlication to the Council for such decision as the Council may deem fit.

(5) The Council may dJect that the name of any practitioner who has been convicted of a cognizab]~ offence as defined in the Code of Criminal Procedur!':',

1898. which discloses such defect of a moral character as is. in the oninfon of the C011n<>iL sufficient to make him unfit to practise his profession or. who has been found. after due inauirv. guilty of conduct which is, in the oninion of the Council, infamous in any pro­ fessional resnect, shall be removed from the Register.

'(6) The Council may, on sufficient cause being shown. ah;o direct that the name of the nractitioner so removed shall be re-enter~d in the Register on payment of such fees as may be prescribed.
