https://egazette.chd.gov.in CHANDIGARH ADMINISTRATION EXCISE AND TAXATION DEPARTMENT Notification The 8th May, 2020 No. E&T/ETO(X)-2020/1770.—Whereas the Chandigarh Administration is satisfied that circumstances exist, which render it necessary to take immediate action in public interest, now therefore, in exercise of the powers conferred by Section 58 of the Punjab Excise Act, 1914 (Punjab Act 1 of 1914) as applicable to Union Territory, Chandigarh and all other powers enabling him in this behalf, the Administrator, Union Territory, Chandigarh is pleased to make the following rules, further to amend the Punjab Liquor Licence Rules, 1956, as applicable in the Union Territory, Chandigarh, by dispensing with the condition of previous notice, namely :—
1. These Rules may be called the Punjab Liquor Licence (Chandigarh 2nd Amendment) Rules,
2020.
2. These Rules shall come into force with effect from 04th May, 2020.
3. In Rule 39 of the Punjab Liquor Licence Rules, 1956, as in force in the Union Territory of Chandigarh, for the existing provisions, the following shall be substituted, namely :—
1. "(39) Notwithstanding anything contained in these rules, due to extension of the period of Excise Policy, 2019-20 (originally commencing from 01st April 2019 to 31st March 2020) by another one and half months i.e. from 15.05.2020 to 30.06.2020, the licensees of wholesale and Retail Sale liquor licenses in form BWH-2, D-2, L-1B, L-1C, L-1C1, L-1D, L-1DF, L-1F, L-2, L-2D, L-3/4/5, L-3A/L4A/L5A, L-9, L-10A, L-10AA, L-10B, L-10C, L-11, L-12A, L-12AA, L-12C, L-13, L-14A, L-15, L-16, L-17, L-42, L-52 (Tavern), L-5D, (except those L-2/L-14A, L-3/L-4/L-5, L-3A/L-4A/L-5A, L-10A, L-10B, L-10C & L-12C, who falls within the radius of 500 meters from the National/State Highway, as per the orders passed by the Hon'ble Supreme Court of India dated 15.12.2016) who opted for extension/ renewal of their licences from 01.04.2020 to 15.05.2020 are given an option to get their licences further extended/ renewed for a period of one & half months i.e. from 16th May, 2020 to 30th June, 2020. The retail sale liquor vend licensees i.e. L-2/L-14A licensees under the Excise Policy of 2019-20, who had not earlier opted to get their licenses extended from
01.04.2020 to 15.05.2020 are also be given an option in the interest of Govt. revenue, to get their licenses extended/ renewed from 01.04.2020 to 30.06.2020. Chandigarh) & Rules framed thereunder will be charged for the first extended period i.e. 01.04.2020 to 15.05.2020 on pro-rata basis only for the operational period/days of the liquor vend/establishment etc. by calculating it on the basis of licence fee/bid amount (as the case may be) chargeable for the excise policy year 2019-20 and will be payable on or before 11th May, 2020. The licensees who give their option for extension from 16.05.2020 to
30.06.2020, the licence fee will be charged for the second extended period i.e. 16.05.2020 to
30.06.2020 on pro-rata basis only for the operational period/days of the liquor vend/establishment etc. by calculating it on the basis of licence fee/bid amount (as the case may be) chargeable for the excise policy year 2019-20 and will be payable on or before 16th May, 2020.
Besides, brand registration fee, extension/ renewal fee (wherever applicable) & permit fee for annual possession permit in form L-50 will also be charged on pro-rata basis for the extended period of one complete quarter (i.e. 01.04.2020 to 30.06.2020), by calculating it on the basis of fee chargeable for the excise policy year 2019-20.
The L-2/L-14A retail licences & the other excise licences will comply with the guidelines issued by the Ministry of Home Affairs/Ministry of Health & Family Welfare, Govt. of India and the Chandigarh Administration regarding containment of COVID-19 from time to time. Further all the excise licensees will comply with the directions given with regard to working hours/ time schedule for opening & closing of liquor vends/ establishments etc. announced by the Ministry of Home Affairs, Govt. of India and Chandigarh Administration from time to time to contain the spread of Covid-19 and no compensation of any type whatsoever in licence fee, quota etc. will be given to the licensees on account of reduction in working hours.
The basic quota of each of retail sale liquor vends (L-2/ L-14A) licensee/ Departmental Store for the first extended period from 01.04.2020 to 15.05.2020 will be fixed on pro-rata basis only for the operational period/ days of the liquor vend/ establishment etc. on the basis of quota fixed for the excise policy year 2019-20. The licensees who give their option for extension from 16.05.2020 to 30.06.2020, the quota for the second extended period i.e. 16.05.2020 to 30.06.2020 will be fixed on pro-rata basis only for the operational period/ days of the liquor vend/ establishment etc. on the basis of quota fixed for the excise policy year 2019-20.
The Excise & Taxation Commissioner may extend L-13 licences of existing wholesale suppliers for the extended periods for ensuring regular supply of country liquor.
The Extra Licence Fee on IMFL, Beer and Imported Foreign Liquor will also be charged at the rates applicable during the excise policy year 2019-20. Similarly, the permit fee, assessment fee, import fee and export fee will be charged on different types of licences, at the rates applicable during the excise policy year 2019-20 and other remaining provisions of the excise policy for the year 2019-20 will remain in force unchanged.
The licence fees which have already been paid by the retail sale licensees i.e. L-2/ L-14A for the period 23.03.2020 to 31.03.2020 but could not run their retail sale liquor vends i.e. L-2/L-14A due to National lockdown and curfew imposed by the Chandigarh Administration to contain the spread of Covid-19, will be adjusted in the licence fee to be paid by the licensees for the extended period and those retail sale liquor vend Licensees i.e. L-2/L-14A who have not applied for extension/ renewal of their licences earlier and those L-2/ L-14A Licensees who do not opt now to get their licences extended/ renewed for the extended period, their licence fee for the period 23.03.2020 to 31.03.2020 will be refunded.
Note.—Chandigarh Administration has notified vide notification bearing No. 6/1/1137-FII(9)-2020/1808 dated 30th January, 2020 the levy of Cow Cess on liquor and the same will be applicable for the extended period of the Excise Policy year 2019-20 from CHD. For the grant of extension of such a license, the licence fee/ permit fee for the complete quarter i.e. 01.04.2020 to 30.06.2020 shall be charged on pro-rata (proportionate) basis, from 04.05.2020 by taking into account the licence fee of licensing year 2019-20 (originally commencing from 01st April 2019 to 31st March 2020). In Rule 93 of the Punjab Distillery Rules, 1932, as in force in Union Territory of Chandigarh, for the existing provisions of Clause (J)(B), the following shall be substituted, namely :— “(J)(B) Notwithstanding anything contained in these rules, due to extension of the period of Excise Policy, 2019-20 (originally commencing from 01st April 2019 to 31st March 2020) by another one and half months i.e. from 16.05.2020 to 30.06.2020, the label registration fee for approval of labels of liquor brands for sale in the Union Territory, Chandigarh for the total extended period i.e. 01.04.2020 to 30.06.2020 shall be charged on pro-rata (proportionate) basis, by taking into account the label registration fee of Excise Policy Year 2019-20 (originally commencing from 01st April 2019 to 31st March 2020) for the respective brands.
