PUNJAB MUNICIPAL CORPORATION (AMENDMENT) ACT, 1978 (Page 1 of 2) Printed For: 19-11-2025 at 12:01:PM PUNJAB MUNICIPAL CORPORATION (AMENDMENT) ACT, 1978 Preamble - PUNJAB MUNICIPAL CORPORATION (AMENDMENT) ACT, 1978 THE PUNJAB MUNICIPAL CORPORATION (AMENDMENT) ACT, 1978 [Act No. 17 of 1978] [19th September, 1978] PREAMBLE An Act to amend the Punjab Municipal Corporation Act, 1976.
Be it enacted by the Legislature of the State of Punjab in the Twenty-ninth Year of the Republic of India as follows:-- Section 1 - Short title and commencement
(1) This Act may be called the Punjab Municipal Corporation (Amendment) Act, 1978.
(2) It shall be deemed to have come into force on the 13th day of July, 1978.
Section 2 - Amendment of section 2 of Punjab Act 42 of 1976 In the Punjab Municipal Corporation Act, 1976 (hereinafter referred to as the principal Act), in section 2, in clause (1), the following words shall be added at the end, namely:-- "and with reference to a local area included in a City means the day on which notification including such area in a City is issued under sub-section (3) of section 3;".
Section 3 - Amendment of section 71 of Punjab Act 42 of 1976 In the principal Act, in section 71, for sub-section (6), excepting the provisos thereto, the following sub-section shall be substituted, namely:-- "(6) Every person who, immediately before the issue of a notification under sub-section (1) of this section, or after the issue of such a notification but immediately before the issue of a notification under sub-section (3) of section 3 including whole of the local area of a municipality in a City, is serving in a City or in a municipality, as the case may be, on a post in relation to which a Corporation Service is or has been constituted, shall, on the issue of such a notification under subsection (1) of this section or sub-section (3) of section 3, as the case may be, become a member of the corresponding Corporation Service if he is found fit by an authority appointed by the Government in this behalf for becoming such a member on the basis of his qualifications and service record and if he is not found fit the post on which he is serving shall be deemed to have been abolished:".
Section 4 - Amendment of section 146 of Punjab Act 42 of 1976 In the principal Act, in section 146, for sub-section (1), the following sub-section shall be substituted, PUNJAB MUNICIPAL CORPORATION (AMENDMENT) ACT, 1978 (Page 2 of 2) Printed For: 19-11-2025 at 12:01:PM namely:-- "(1) An appeal against the levy or assessment of any tax under this Act shall lie to the Divisional Commissioner who shall decide the same after giving to the appellant an opportunity of being heard either within the local area of the City or at his headquarters.".
Section 5 - Amendment of section 428 of Punjab Act 42 of 1976 In the principal Act, in section 428, in clause (d), between the words "which has been constituted to be a City" and "other than those", the words "or under any other local authority the whole of local area whereof has been included in a City" shall be inserted and for the words "if the Corporation had not been established", the words "if the City had not been constituted or the local area had not been included in the City, as the case may be," shall be substituted.
Section 6 - Repeal and saving
(1) The Punjab Municipal Corporation (Amendment) Ordinance, 1978 (Punjab Ordinance No. 10 of 1978), is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.
