Government of Punjab Department of Industries and Commerce Notification Gated © 13 :)] Rol# 1, No.CC/AddL.Dir/ Industrial &Business Development/2017//%83 In pursuance of the provisions of clause 12.4.1 of the Punjab Industrial & Business Development Policy, 2017 notified vide no CC/AddL.Dir/Indl. & Business Development/2017/1369 dated 17.10.17 (hereinafter referred as Policy), the Governor of Punjab is pleased to constitute the Punjab * Industrial and Business Development Board (hereinafter referred as the Board).

2. The Board shall consist of the following:

The Chief Minister shall be the ex officio Chairperson of the Board; The Minister in charge of the Department of Industries & Commerce shall be the ex officio Vice Chairperson of the Board; The Ministers in charge of the Departments of Finance, Agriculture, Health and Family Welfare, Tourism, Labour, Housing and Urban Development, Local Government, Science, Technology and Environment, Power, Employment Generation and Technical Education and Industrial Training, ex officio; The Chief Secretary to Government of Punjab; ex officio; The Administrative Secretaries in charge of the Departments of Revenue, Development, Finance, Forests, Health and Family Welfare, Tourism, Housing and Urban Development, Taxation, Labour, Power, Local Government, Science Technology and Environment, Employment Generation and Technical Education and Industrial Training, ex officio; Five members representing the Industry Associations; Three members of eminence, one each from the fields of economics, industry and science and technology; The Administrative Secretary in charge of the Department of Industries & Commerce, shall be the Member-Secretary of the Board, ex officio.

3. Powers and Functions of the Board

3.1. The Board is empowered to take all the necessary decisions for the smooth implementation of the policy including but not limited

(a).

(b). To interpret and relax any provision of the policy. To frame, amend, relax, interpret any guidelines or schemes under the Policy Page 10f3

(i). To review the progress of initiatives under various strategic pillars of the Policy namely Infrastructure, Power, MSME, Startup, Skill Development, Ease of Doing Business, Fiscal and non-Fiscal incentives by different departments and agencies and give suitable directions towards achieving the vision, mission, goals and objectives envisaged in the policy. To review various measures for enhancing ease of doing business in the State and particularly ensure setting up of BusinessFirst portal for providing online services to the businesses in the State and issue necessary directions to the departments and agencies. To review the performance of departments and agencies in availing and utilising grants from Central Government under various schemes and programs and resolve difficulties, if any. Approval and sanction, on behalf of the Government, of any fiscal incentives or other benefits to an investment proposal or project, falling outside the policies of the Government of Punjab by way of amendment of, addition to, exception to such policy; including relaxation of rules and regulations and provisions of legal, institutional and financial dispensation, as may be the case. No formal examination of proposals put up to the Board will be necessary either in the Administrative Department or in the Finance Department and decisions of the Board would be conveyed to the concerned department. All decisions taken by the Board shall be considered directives of the government. Without prejudice to the above, to generally take up any other issue related with industrial development and economic growth of the State and issue necessary guidelines and directions. The Board will further have a committee on “Revival of Industry and Fiscal Incentives” under the Chairman of the Board and comprising of such other members as may be notified in this regard to consider and approve proposals for revival of industry and fiscal incentives as may be required to be approved by the Board. The term of the non-official members of the Board shall be for three years provided that the term of office of an ex officio member of the Board shall continue so long as he holds the office by virtue of which he is such a member. The Board shall have its headquarter at Chandigarh. The Board shall meet at least once in every three months. Page 2 of 3

10. No act or proceedings of the Board shall be invalid merely by reason of-

(a). Any vacancy in, or any defect in the constitution of, the Board; or

(b). Any defect in the appointment of a person acting as a member of the Board; or

(c). Any irregularity in the procedure of the Board not affecting the merits of the case. The Board may associate with itself, in such manner and for such purposes as it may deem necessary, any person or persons whose assistance or advice it may desire in discharge of its functions and a person so associated shall have the right to take part in the discussions of the Board relevant to the purposes for which he has been associated but shall not have the right to vote. The Board shall devise its own procedure for its functioning. Policy Implementation Unit shall provide the necessary technical and secretarial support to the Board in discharge of its functions.
