PART Il GOVERNMENT OF PUNJAB EXCISE AND TAXATION COMMISSIONER'S OFFICE, PUNJAB, PATIALA NOTIFICATION The 31st March, 2015 No. GS.R. 12/P.A.1/1914/Ss.21 and 59/Amd. (61)/2015.-In exercise of the powers conferred by clause (d) of sections 21 and 59 of the Punjab Excise Act, 1914 (Punjab Act No. 1 of 1914), read with Government of Punjab, Department of Excise and Taxation, Notification No. S.O. 12/PA.1/1914/S.9/ 2013, dated the 31st January, 2013, and all other powers enabling me in this behalf, I, Anurag Verma, LA.S., Excise Commissioner, exercising the powers of Financial Commissioner, make the following rules further to ame d the Punjab Distillery Rules, 1932, namely: — RULES

1. (1). Theserules may be called the Punjab Distillery (Amendment) Rules,

2015.

(2) They shall come into force on and with effect from the first day of April, 2015.

2. Inthe Punjab Distillery Rules, 1932 (hereinafter referred to as the said rules), in rule 4, in clause (a), for the words “fifty lac rupees”, the words “sixty lac rupees” shall be substituted.

3. Inthe said rules, for rule 5, the following rule shall be substituted namely:- "5. The license shall be in form D-2 and shall not be transferable, except with the prior approval of the Excise Commissioner. The Excise Commissioner may on the request of the licensee, allow lease/sub-lease of the licensed premises, if he deems it appropriate, on payment of a fee equivalent to the fee for grant of new license in Form BWHE-2.?.

4. Inthe said rules, in rule 7,-

(i) forsubrule (1), excepting the proviso relating thereto, the following sub-rule shall be substituted, namely:- “(1) A license granted under these rules, shall be valid for a period PUNJAB GOVT. GAZ. (EXTRA), MARCH 31, 2015 76 (CHTR 10, 1937 SAKA)

(ii) not exceeding one year upto 31st day of March of the financial year following the day of grant unless it is cancelled, determined or surrendered earlier and shall be renewable by the Fin ncial Commissioner on application made by the licensee after a period of three years. Although, the license is renewable after a period of three years, yet a fee of rupees sixty lac shall be deposited by the licensee annually. However, if a license is issued any time during the financial year then the licensee shall have to pay full fee for the license.”.

66,99 in sub-rule (2), in the proviso at the end, for the sign “.”, the si shall be substituted and thereafter the following provisos shall be added, namely:- "Provided further that if fee for the renewal of the license is not deposited before 31st March, the licensee shall pay an interest @ 12 percent per annum on delayed payment for renewal of fee:

Provided further that if the distillery violates any provision of the Punjab Excise Act,1914 and rules made thereunder, the distillery shall be closed immediately for 15 days for first violation and for one month for second violation after following the due procedure.

In case of third violation, the license of the distillery shall be cancelled after following the required and mandatory procedure.” In the said rules, in rule 42, in the fourth line, after the word "wall" the words " of eight feet height with barbed fencing above the wall, "shall be inserted In the said rules, in rule 93,-

(i) in clause (e), for sub clause (1), the following sub clause shall be substituted, namely:- "(1) The Excise Commissioner shall specifically approve the sizes, as are specified in the Table given below. In case any other size is to be introduced in the market, then the same shall specifically be approved by the Excise Commissioner. The pet bottles, mentioned below in the Table, shall only be of Food-Grade type.

(v) 375 ml 180 ml in clause (f), in sub-clauses (1) and (2), for the figure “180”, wherever occurring, the figure “200” shall be substituted;

in clause (ff), for the figure “180”, the figure “200” shall be substituted. s in clause (k), -

(a) for the words, “rupees sixty thousand”, the words, “rupees seventy two thousand”, shall be substituted,

(b) inthe first proviso, for the words, “five thousand rupees”, the words, “six thousand rupee s”, shall be substituted; and

(c) in the second proviso, for the figure, “30000”, the figure, “36000”, shall be substituted.

for clause (kk)and first proviso, relating thereto, the following clause and proviso shall be substituted respectively, namely:- “(kk) Brand registration fee shall be as under :—

(i) Punjab Medium Liquor including Rs. 18,000/- Rum/Gin/Whisky of any degree;

(ii) Wine and cider, Nil

(iii) Indian made Foreign Liquor, Beer and Rs. 72,000/- ready to Drink Beverages,

(iv) Imported Foreign Liquor (bottled in origin); Rs. 36,000/- PUNJAB GOVT. GAZ. (EXTRA), MARCH 31, 2015 78 (CHTR 10, 1937 SAKA)

(v) Subsequent change in all the approved Rs. 6,000/- label during the year; and

(vi) Brand Registration fee for hotels of 3-star Rs. 2,500/- and above category in respect of liquor imported from abroad of which brands are not already approved by the Excise Commissioner.

No separate fee for pints and nips shall be charged where fee has been paid for quarts:

Provided that a licensee, shall be required to pay full brand registration fee as specified above, for approval of labels for export of brand in other States in case such brand is not approved for sale in the State of Punjab. In case of brand registered for sale in Punjab, the brand registration fee shall be charged extra @ Rs.12,000/- per brand meant for export for each State on IMFL/Beer/Country Liquor:”.

(vi) for clause (q), the following clause shall be substituted namely:- “(q) The labels of PML of the proof strength of 50° and Rum/Gin/ Whisky 65° for the year 2015-1 6 where there is no major change in pattern, colour and design, shall be treated as approved automatically after the deposit of fees. The Distilleries shall be bound to follow any instructions regarding change in labels issues by The Excise Commissioner, Punjab and accordingly submit new labels before using the same on bottles to the Excise Commissioner, or any officer authorized by him before 31st March of the year. The Distillery shall also submit labels for Rum/Gin/ Whisky of 75° and for 200 ML bottles of PML for approval.”.

(vii) in clause (s), for the figures “2014-2015”, the figures “2015-2016” shall be substituted.
