(EXTRA), MARCH 28,2013. “129 (CHTR 07, 1935 SAKA) GOVERNMENT OF PUNJAB EXCISE AND TAXATION COMMISSIONER'S OFFICE, PUNJAB, PATIALA NOTIFICATION The 28th March, 2013 No. GS.R.18/P.A.1/1914/Ss. 34 and 59/Amd.(35)/2013.— In exerc be of the powers conferred by sections 34 and 59 of the Punjab Excise Act, 19 14 (Punjab Act No. | of 1914), read with Government of Punjab, Department bf Excise and Taxation, No. S.O.12/PA. 1/1914/S.9/2013, dated the 3 1st Janua y, 2013, and all other powers enabling me in this behalf, I, Anurag Verma, I.A.'}., Excise Commissioner, exercising the powers of Financial Commissioner, ma fe the following rules, further to amend the Punjab Liquor Permit and Pass Rules, 1932, namely :- RULES
1. (1) These rules may be called the Punjab Liquor Permit and Pa js (First Amendment) Rules, 2013.
(2) They shall come into force on and with effect from the first day «if April, 2013.
2. Inthe Punjab Liquor Permit and Pass Rules, 1932 (hereinafter referred to as the said rules), in rule 22, for clause (g), the following clause shall te substituted, namely:- “(g) A permit fee at the rate of rupee two per proof litre on India} Made Foreign Liquor and Imported F oreign Liquor, rupee two pet bulk litre each on Beer, denatured spirit and rupee one and twent} paisa per bulk litre on denatured spirit when imported from othe?
States/Union Territory and rupee ten per bulk litre on rectified spiri} or extra neutral alcohol transferred from D-2 licensee ta D-2 and BWH-2 licensees to be used for the manufacture of Indiat made foreign liquor meant for sale in Punjab shall be recoverec.
from L-1, L-1A, L-1B, D-2, BWH-2, L-17, L-42A,B licensees, as the case may be. The D-2 licensee shall transfer rectified spirit o1 extra neutral alcohol for manufacture of Indian made forei gn liquor | meant for sale in Punjab only against permit or permission given by the department even within its own premises. Permit fee shall be applicable to this transfer. Permit fee shall be recovered at the PUNJAB GOVT. GAZ. (EXTRA), MARCH 28,2013 130 (CHTR 07, 1935 SAKA) | time of issuance of permits. The D-2/B WH-2 licensees shall h ive the option to pay the permit fee in advance on anticipated mont ily use meant for sale of Indian made foreign liquor in Punjab. The amount of advance permit fee shall be reconciled at the end of €very month with the actual Rectified Spirit/Extra Neutral Alcol ol used for manufacture of Indian Made Foreign Liquor meant ior sale in Punjab and exported out of Punjab
Provided that the transfer of Indian Made Foreign Liquor ai \d Imported Foreign Liquor from L-1 licensee of one district to Li licensee of another district shall be allowed only with the approv jl of the Excise Commissioner, Punjab. Permit fee at the normal rae of rupee one per proof litre shall be charged on the said L-] 1p L-1 transfer:
Provided further that the Payment of permit fee shall be mad t through demand draft, banker’s cheque, pay order or other pre! paid Bank instruments, into the account of Excise and Taxation Commissioner, Punjab, out of the receipts on this count, rupee one per proof litre on Indian Made Foreign Liquor and Imported Forei gn Liquor, rupee one per bulk litre each on Beer, denatured spirit and sixty paisa per bulk litre on denatured spirit when imported from other States/ Union Territory shall be transferred to Social Security Corpus every month. The remaining amount of permit fee shall be transferred by him to the Excise and Taxation Technical Service Agency”.
3. In the said rules, for rule 22-B, the following rule shall be substituted, namely:- “22-B. A permit in Form L-50A for purchase, transport and possession of Indian Made Forei gn Liquor, Imported F oreign Liquor and Beer of any quantity may be issued to a person for a specified period not exceeding twenty-four hours, for the celebration of a special occasion ina marriage palace or a banquet hall or at a temporary enclosure at a public place, on the payment as mentioned hereinafter:-
(i) Marriage palace or banquet hall or Rs.2000/- any other place, charging upto Rs. 25000/- per function;

(it) Marriage palace or banquet hall or Rs.5000/.
any other place, charging between Rs. 25001/- to Rs. 50000/- per function;
(iit) Marriage palace or banquet hall or Rs.10000/- | any other place, charging above Rs.50001/- per function; and
(iv) Function organized at a place without Rs.2000/- -any charges:
Provided that L-50A permit holders shall be allowed to purchase liquor and beer from any L-2 vend in the Excise Circle in which the marriage palace is situated. The Asstt. Excise aiid Taxation Commissioners incharge of the district shall fix the rat bs of Indian Made Foreign Liquor/Imported Foreign Liquor brani{s for liquor to be supplied against L-50A permits in various circle6.
Excise and Taxation Commissioner, Punjab shall have the pow ir to revise the rates, fixed by any Asstt. Excise and Taxaticn Commissioner. Any violation of the order passed by the Assit.
Excise and Taxation Commissioner or the Excise and Taxatic} Commissioner in this regard shall attract a penalty of Rupees or lac. In case of repeated violation, the penalty shall be double th amount imposed during the previous violation.”
4. Inthe said rules in rule 22, clause (h) shall be omitted.

(15)/2013.— In exercise of the powers conferred by clause (d) of section 21 and section 59 of the Punjab Excise Act, 1914 (Punjab Act No. 1 of 1914), read with Government of Punjab, Department of Excise and Taxation, Notification No. §.O.1 2/PA.1/ 1914/S.9/2013, dated the 31st January, 2013, and all other powers enabling me in this behalf, I, Anurag Verma, LA.S., Excise Commissioner, exercising the powers of Financial Commissioner, make the following rules further to amend the Punjab Excise Bonded Warehouse Rules, 1957, namely: — RULES
1. (1) These rules may be called the Punjab Excise Bonded Warehouse (First Amendment) Rules, 2013.
(2) They shall come into force on and with effect from the first day of April, 2013.
2. In the Punjab Excise Bonded Warehouse Rules, 1957 (hereinafter referred to as the said rules), in rule 4, in sub rule (1),-
(a) in the first line, the words “or renewed” shall be omitted:
(b) in clause (i) and (ii) for the words “three” and “five” the words “six” and “ten” respectively shall be substituted;
(c) in sub rule (3) , for the words “Although the license is renewable after a period of three years yet a fee,” the words “The license is renewable after a period of three years however a fee” shall be substituted.
3. In the said rules, in rule 5, for the figures and sign “5:00” wherever occurring, the figures and sign “6:00” shall be substituted.
4. Inthe said rules, in rule 49, for the figures and words “12 noon”, wherever occurring, the figures and letters “2.00 p.m.” shall be substituted.
5. In the said rules, in instructions 5, captioned as “Instructions For The Establishment of Bonded Warehouse F or The Storage of Liquor”, given after | | PUNJAB GOVT, GAZ. 2. Inthe Punjab Brewery Rules, 1956 (hereinafter referred to as the said rules), in rule 5, in clause (a), for the words “twenty lakh rupees”, the words “forty lac rupees” shall be substituted.
3. In the said rules, in rule 8, in sub-rule (1), for the words “rupees fifteen lac”, the words “thirty lac rupees” shall be substituted.

2. Inthe Punjab Distillery Rules, 1932 (hereinafter referred to as the said| rules), in rule 4, in clause (a), for the words “twenty lac rupees”, the words) “forty lac rupees” shall be substituted,
3. Inthe said Rules, for rule 5, the following rule shall! be substituted, namely:- “§_ The license shall be in Form D-2 and shall not be transferable, except with the prior approval of the Excise Commissioner. The D-2_ licensee shall be allowed Tie-ups for the bottling of liquor”.
4. In the said Rules, in rule 7, in sub rule (1) for the words “twenty lac rupees”, the words “forty lac rupees” shall be substituted,
5. In the said Rules, for rule 28, the following rule shall be substituted, namely:- “The ordinary working hours of a distillery by day shall be from 8.30) a.m. to 8.00 p.m. in each month from April to September inclusive and from 9.00 a.m. to 7.00 p.m. in each other month except that the Collector | PUNJAB GOVT. GAZ. (EXTRA), MARCH 28, 2013 748 | (CHTR 07, 1935 SAKA) | may permit a distillery to observe different working hours for a specifi f period to meet unforeseen exigencies.”
6. Inthe said tules, in rule 93, | |
(i) in clause (e), in sub clause (1), in the last line, for the words an sign “superior Food-Grade quality and round in shape” and sign “Food-Grade type”, shall be substituted; and
(ii) in clause (s), for the figures and sign “2012-2013” sign “2013-2014” shall be substituted.

8. Inthe said rules, in rule 122-A, after the word and sign “licensee”., the words and signs ‘The third party audit of the CCTV footage shall also be) done. The expenditure on this account shall be borne by the distillers.”, shall. be added.

Inthe said rules, for rule 122-B, the following rule shall be substituted, namely:- “122-B All bottles of Punjab Medium Liquor, Indian Made Foreign Liquor and Imported'Foreign Liquor sold in the State of Punjab, shall be affixed with the Intaglio Printed Security Labels with Hologram at the cost of the licensee. This provision shall also be applicable for liquor to be sold | ito and by Canteen Store Depot, Central Reserve Police Force and Indo- | Tibetan Border Police.
