Government of Punjab Department of Industries and Commerce (Policy implementation Unit) Corrigendum No. PIU/IBDP-2017/OG-2018/2019/ So72 Date: | 8—]2— 20/9 The Governor of Punjab is pleased to make following amendments in the ‘Detailed Schemes & Operational Guidelines, 2018’ notified vide No. P|U/IBDP-2017/2018/4010 dated 07.08.2018 for availing Fiscal Incentives under Industrial & Business Development Policy, 2017 w.e.f.

02.12.2019:-

1. in Clause 2.2 of Chapter-2, the words," State Empaneled Agency" is replaced by “Punjab State Industrial Development Corporation/ SIDBI/ State empaneled agencies/ CAG empaneled CA's”.

in Clause 5.5.1 of Chapter-5 the words appearing as “as per the notification under MSMED Act, 2006 of GO! from time to time” shall be deleted.

in Clause 6.4(v) of Chapter-6 the words, “service” shall be inserted after the words “Composite Units set up for manufacture/”.

Clause 7.1.6 of Chapter-7 shall be deleted.

in Clause 7.1.11 of Chapter-7, after clause (i),following clause is added:

(ii). After approval by the competent authority of District Level Committee/ State level Committee, Eligibility Certificate or sanction letter as the case may be shall be issued by the convener of District Level Committee and State Level Committee.

In Clause 7.2(i) of Chapter-7after Sr. no. (vi), following are added:

(vii). | Representative of ULB for sites in purview of MC- Member

(viii). Rep. of T & C Planning for sites outside purview of MC- Member.

In Clause 8.2.2(i) of Chapter-8, the words, “three months after commencement of commercial production to seek refund” shall be replaced by the words “three months from the date of approval of ICAF or commencement of commercial production whichever is later to seek refund”.

Clause 8.2.2(ii) of Chapter-8 shall be substituted as under:-

(ii). After approval of reimbursement claim by the competent authority of District Level Committee (DLC) / State Level Committee (SLC) as the case may be the sanction letter shall be issued by the convener of DLC/SLC. Disbursement of the sanctioned claim shall be made by the Department of Industries & Commerce out of the Budgetary Provision as per seniority in accordance with the Clause FAa2.

Clause 12.1(iii) of Chapter-12 under heading "Anchor Units" shall be substituted as under:-

(a) 100% of SGST net paid on intra state sale for first 15 years from the date of commencement of commercial production with cap of 200% of fixed capital investment.

(b) In case of phased investment by the Anchor Unit, the incentive of Anchor category shall be available when it fulfils condition of Anchor Unit as per Policy.

Before that, the unit can claim incentive under its respective category of large or MSME as the case may be as per provisions of the policy.

In Clause 12.2(ii) of Chapter-12, the words, “within three months of closing of the financial year” shall be replaced by the words “within twelve months of closing of the financial year in accordance with the Notification No. PIU/IBDP-2017/ Amendments/2018/4888 dated: 17-10-2018 read with Notification No. PIU/IBDP-2017/ Amendments/ 2019/1203 dated: 07-03-2019”.

Clause 12.2(iii) of Chapter-12 shall be substituted as under:-

(a) After the approval by DLC/SLC as the case may be eligibility certificate shall be issued by the convenor of concerned DLC/SLC.

(b) After approval of incentive claim by the competent authority of DLC/SLC as the case may be the sanction letter shall be issued by the convener of DLC/SLC.

(c) Disbursement of the sanctioned claim shall be made by the Department of Industries & Commerce out of the Budgetary Provision as per seniority in accordance with the Clause 7.1.12.

The following clauses of Chapter-13 shall be amended as under:-

(i) In Clause 13.1.3, the words, “within three months of closing of financial year for which incentive is being claimed” shall be replaced by the words “within three months from the date of approval of ICAF or within three months of closing of financial year whichever is later for which incentive is being claimed”.

(ii) In Clause 13.4(iii), the words, “within three months of date of full and final subscription of public issue” shall be replaced by the words “within three months from the date of approval of ICAF or within 3 months of date of full and final subscription of public issue whichever is later”.

(iii) In Clause 13.5(iii), the Words, “within three months of acquiring technology and before the expiry of period of policy” shall be replaced by the words “within three months from the date of approval of ICAF or within 3 month of acquiring technology and before the expiry of period of policy whichever is later”.

(iv) In Clause 13.7(iii), the words, “within three months from the date of completion of energy audit” shall be replaced by the words “within three months from the date of approval of ICA For within three months from the date of completion of energy audit whichever is later”.

(v) In Clause 13.8(iv), the words, “within three months from the date of completion of water audit” shall be replaced by the words “within three months from the date of approval of ICAF or within three months from the date of completion of water audit whichever is later”.

(vi) In Clause 13.9{iv), the words, “within 3 months of date of installation” shall be replaced by the words “within 3 months from the date of approval of ICAF or within 3 months of date of installation whichever is later”.

(vii) In Clause 13.10(iv), the words, “within 3 months of date of installation” shall be replaced by the words “within 3 months from the date of approval of ICAF or within 3 months of date of installation whichever is later”.

(viii) In Clause 13.11(iv), the words, “within 3 months of the acquiring patent” shall be replaced by the words “within 3 months from the date of approval of ICAF or within 3 months of the acquiring patent whichever is later”.

(ix) In Clause 13.12(iii), the words, “within 3 months of the issue of letter of rating by the credit rating agency” shall be replaced by the words “within 3 months from the date of approval of ICAF or within 3 months of the issue of letter of rating by the credit rating agency whichever is later”.

(x) In Clause 13.13(iv), the words, “within 3 months of acquiring quality certificates” shall be replaced by the words “within 3 months from the date of approval of ICAF or within 3 months of acquiring quality certificates whichever is later”.

(xi) In Clause 13.14{iv), the words, “within 3 months of conducting Awareness Programme” shall be replaced by the words “within 3 months from the date of approval of ICAF or within 3 months of conducting Awareness Programme whichever is later”.

(xii) In Clause 13.15(iii), the words, “within three months of the closing date of the exhibition participated” shall be replaced by the words “within three months from the date of approval of ICAF or within 3 months of the closing date of the exhibition participate whichever is later”.

(xiii) In Clause 13.16(iii), the words, “within a period of 3 months from the date of closing of the financial year in which, the products were shipped for exports” shall be replaced by the words “within 3 months of date of approval of ICAF or within 3 months from the date of closing of the financial year in which, the products were shipped for exports whichever is later”.
