[Extract from Punjab Government .Gazette, dated the 22nd December, 2000) DEPARTMENT on AGRICULTURE ’ ‘ ‘ {AGRICULTURE iv BRANCH) Notification The 30th November, 2000 N09 12/29,'s7/Agri:j1wIV)/ss17;_:-In exercise" at the neweré ._canerreug by Section 19 prise Punjab Fruit Nurseries ACt,D1961 (Punjab ACtl3 of 1961), and all other powers enabling him in this behalf, the Governor of Punjabis pleased to make the following rules "further to amendthe Punjab Fruit Nurseries Rules, 1961 n;.mely :_.- _ p p ‘ . " ’- -~ * RULES;

1. (1) These rules may be called the Punjab Fruit-- Nurseries (First Amendment) Rules, 2000,

2.. Inithe Punjab Fruit Nurseries Rules, 1961 (hereinafter: referred .to as the said Rules), for the words N-fngriculture _‘ Inspector”, wherever occurring, the words, “Horticulture rDevelopment Officer” ,shallbejésubstituted.‘ _»- - ' ' i ' - . .

3. In the said rules, in rule 2,—-

(i) for clause (b), the following clause _shall be SUbStltuted,i-name]x :9. ‘ . “(b)" ‘Hortiéulture,DeVeIOpmentOfficer’ means the Horticulture Development Ofiicer_jincharge ; of the horticulture extension works” ;_and'

(ii).f0r clausetc), thefollowing clause shall be Substituted, namely :-—- “(c) ‘Director’ means the Director of Horticulture, Punjab”. '4. In the said rules,in rule 3,——

(i). in "sub-rule (i) l for the words and figures “thirty_~ rupees under Herd :XXlXc—Agriculture-g— \ ‘ Agricultural Research—lncome from Research Sectionsm-General Section,” the words and figures “nine hundred rupees under Head—«0401—Crops Hqumdry” shall be substituted; and

(ii) in sub-rulet3), for the words “Gazetted Officer of the AgriculturerDepr-Jtment,” the words, “Horticulture Development Officer’ of the Horticulture Wing’? shall be substituted.

5. In the saidrules, in rule 15,-—

(i) for sub-rule(i), the following sub-rule shall be substituted, namely i‘“. I “(1) Any person desiring to get his licence renewed shall make an application to the‘ competent authority in Form-IV within a period of not less than thirty days before the date 0f expiry Of the licence. In case the licencee fails-to submit the application within the stipulated period. for the renewal of licence then he shall be liable to payadditional fee of rupees one hundred per month or fraction thereof, in addition to the renewal fee. The application for renewal of licenCe shall be accompanied by a treasurychallan in proof of deposit of the renewal fee alongwith the additional fee, if any, and it shall be made through the Horticulture Development Officer having jurisdiction over theaters in which the nursery is situated. The Hortictdture Development Officershall send application with his comments on the back of the application in form IV‘A within aperiod of fifteen days from the date of receipt of such application to the . I I Assistant Director, Horticulture or Deputy Director, Horticulture, as the case maybe, who shall forward the same to the competent authority with his comments , ' ' on thebaCK Side of the applicationin form IV—A within; a periOd of fifteen days of 'f receipt.”

(ii) in sub-rule (2), for the words “of the Agriculture InspectOr”, “the words , brackets and I figure “of all the authorities specified in sub-rule, (1)” shall be substituted, and

(iii) in sub-rule (3), for the words “ten rupees”, the, words “three hundred rupees’i shall, besubstituted. . 1’ ”M ./ 2 ,.

6. In the said rules,‘~in rule 10 in subPruleififi rupees” shall be substituted. ' _ . - - '7._ In the Said ruleS,in rule 12-, in Sub-rule shall be substituted. - .

8. In the said rules, in rule.1»3, shall be - substituted, namely?— i “any fruit nursery : ' * ‘.

Provided that-the Director may; if satisfied, is of Punjab from any other State or Territory”.

9. In the said rules, in rule 14,—4

(i) in sub-rule (1), for tvhew‘vords “competent authority”, Horticulture or Deputy Director
