Dated 9-10-S0g0 the Chandigarh Whereas the Governor of Punjab is satisfied that the State of Punjab is threatened with the outbreaks of dangerous epidemic disease namely Malaria and ‘Dengue and that the ordinary provisions of law fer the time being in force are insufficient for the purpose. Now, therefore, in exercise of the powers conferred by section-2 of the Epidemic Diseases Act. 1897, the Governor of Punjab is pleased to make the following regulations namely: -
1. Short title and commencement a. These segulations may be called the Punjab Prevention and Control of Malaria, Dengue and other Vector Borne Diseases Regulations, 2020.

3. Definitions-'fh these regulations unless the context otherwise requiresa. “Act” means the Epidemic Diseases Act, 1897 (Central Act 3 of 1897);
b. “Building” means a shop, house, out- house, shed, urinal, hut, wall or any other structure, whether of masonry, bricks, wood, metal or other ‘material and includes a well but does not include any portable shelter;
c. “Controlling Officer” means the District Nodal Officer for malaria, dengue and other vector borne diseases;
d. “Government” means the Government of Punjab in the Department of Health and Family Welfare; Ose e. “Infected area” means any place or area, which is notified by the District ie Magistrate of the district concerned under these regulations to be infected with Mataria, Dengue and other vector borne diseases;
f. “Inspecting Officer” means the Inspecting Officer of the Department of Health and Family Welfare; . Scanned with CamScanner Reg g- “Owner” includes a person who for the time being is receiving or is entitled to receive, the rent of any land or building whether on his own account or account of himself and others or as an agent, trustee, guardian or receiver or any other person who receiving the rent or has been entitled to receive it, if the land or building or part thereof were let to a tenant;
h. “Sanitary Inspector”. means the Sanitary Inspector of the Municipal Corporation or Municipal Committee, as the case may be; and i. “Threatened area” means any place or area, which is notified by the District authorities, to be threatened with infection of Malaria, Dengue and other Vector Borne Diseases.
An Inspecting Officer can be District Health Officer, Senior Medical Officer, District Epidemiologist, Entomologist, Medical Officer, Assistant Malaria Officer, . Assistant Unit Officer, Health Supervisor, Multipurpose Health Supervisor (Male), Multipurpose Health Worker (Male), Insect Collector to discharge such functions.
Every officer/official so appointed shal} so far as such functions are concerned be deemed for the purpose of these regulations to be an Inspecting Officer.
An Inspecting Officer may enter any premises for the purpose of fever surveillance, treatment, anti-larval measures, spray of insecticides or fogging after informing the occupants or owner of the premises. He may also authorize other persons of his team to enter such premises along with him as he considers necessary. The occupants/owner of the premises shall be informed about the purpose of entry.
An Inspecting Officer may put any question as he thinks fit in order to ascertain whether there is any reason to believe or suspect that such person is or may be suffering from Malaria or Dengue and such person shall give answer to him.
Whether as a result of such inspection or examination or otherwise, the Inspecting Officer considers that there is reason to believe or suspect that such person is or may be infected with Malaria or Dengue, Inspecting Officer may direct such person to give his blood slide/ blood sample for examination and to take such treatment as the Inspecting Officer may deem fit. In case of the minor, such order shall be directed to the guardians or any other adult member of the family of the’ minor.

8. The Inspecting Officer may order any premises to be sprayed with the insecticide or order treatment of domestic water collection with suitable larvicides as per the guidelines of Govt, of India.
9. All the private practitioners, clinicians/doctors as the case may be, in charge of nursing homes, medical institutions, clinical laboratories etc. within the jurisdiction of the district shall furnish information pertaining to RDTs done or blood slide collection for Malaria and information regarding the suspected or confirmed ‘cases of Malaria, Dengue and other Vector Borne Diseases to the Controlling Officer.
10. Keeping of household canes and other containers- the owner or the occupier of any house, building or shed or land shall not therein keep any bottle, vessel, canes auto-tyre or many other containers, broken or unbroken, in such a manner that it is likely to collect and retain water which may become breeding site for mosquitoes.
11. Protection of anti-mosquitoes works - Where, with the object of preventing breeding of mosquitoes in any fand or building, the owner or the occupier at his instance has constituted any works in such land or building, the owner or the occupier for the time being of such land or building shall prevent its being used in any manner which causes or is likely to cause, the deterioration of such works, or which impairs or is likely to impair their efficiency.

12. Microscopy is the gold standard for diagnosis of malaria however, quality assured bivalent RDT (Rapid Diagnostic Test) Kits can be used for diagnosis of Malaria as per guidelines of Department of National Vector Borne Disease Control Programme (NVBDCP), Govt. of India New Delhi.
13. The doctors in Government Health institutions and the registered medical private practitioners of the private hospitals/ clinics are required to suspect a fever case as a case of Malaria curing the transmission period:
a. All the Govt health Institutions shall test Malaria by microscopic examination of the blood slide prepared from the capillary sample.
b. Private hospitals and laboratories should preferably do microscopic examination of blood slide for Malaria testing. Wherever, RDT has to be used in a private hospital or laboratory it has to be Antigen based RDT and the same should be approved as per quality assurance from Govt. of India.

i. The private hospital or laboratory using Antigen based RDT for Malaria testing shall be responsible for sensitivity and specificity of . the RDT.
ii. The private hospital or laboratory using Antigen based RDT for Malaria testing shall be responsible for storage of the RDTs as per guidelines.
c. Antigen of Malaria can persist for up to 4 weeks after clearance of asexual parasitaemia resulting in false positive test results. If a patient, who has been treated, is febrile within one month after the treatment and the RDT is positive, the malaria diagnosis should be confirmed by microscopy before treatment is started.
d. Antibody based RDT is not recognized for Malaria confirmation.
The information of the positive case of the Malaria has to be sent to the nearest Government Health institution immediately after the diagnosis. The blood slide of the positive cases should also be submitted to the representative of the ‘Department of Health within 2 (two) days for cross examination.
a. The information of a case of Malaria can be uploaded on web portal of Govt. of Punjab at https://nvbdcp.punjab.gov.in by a private practitioner/private laboratory.
The doctors in Government Health institutions and the registered medical private practitioners of the private hospitals/ clinics should ensure the complete Radical Treatment of the Malaria positive cases with Chloroquine/ACT along with Primaquine as per the Drug Policy of Malaria issued by Government of India and Government of Punjab from time to time.
a. As per GOI guidelines, single dose artemisinine should not be used for treatment of Malaria. Artemisinine has to be used in combination for treatment of falciparum Malaria.
DENGUE:

The doctors in Government Health Institutions and the registered medical private practitioners of the private hospitals/ clinics/ laboratories are required to immediately inform the office of the Civil Surgeon of the concerned district, if a suspected case of Dengue Is reported at their health institution/laboratory.
The blood samples of all Dengue suspected cases tested by RDT kits have to be sent at the Sentinel Surveillance Hospital (SSH) in the Government Health Scanned with CamScanner

Institution of the concerned district, to be tested by ELISA (Enzyme Linked Immunosorbent Assay) technique.
a. A suspected case of dengue has to be tested with NS1 Antigen ELISA technique if the fever is of less than 5 days duration.
b. A suspected case of dengue has to be tested with IgM Mac Antibody ELISA technique if the fever is of more than 5 days duration.
c. That-the Government of India, National Vector Borne Disease Control Programme, (Directorate General of Health Services), Ministry of Health and Family Welfare, Delhi has intimated vide D.O. No. 7-71/2014- 15/NVBDCP/DEN(General)P-1, dated 23rd September, 2015 that the use of RDKs..for confirmation of Dengue is not recommended by the National Vector Borne Disease Control Programme (NVBDCP) due to its low sensitivity and specificity. / d. The information of the positive case of the Dengue has to be_sent to the office of the Civil Surgeon of the respective district or the controlling officer immediately after the diagnosis in order to take remedial measures.
e. The hospital incharge shall be held responsible if the information of a suspected or confirmed case is not sent to the Department of Health and Family Welfare thus delaying the remedial preventive measures.
The management of the Dengue suspected/ confirmed cases need to be done as per the guidelines issued by the Government of India from time to time and available on the website of the Department of NVBDCP, Government of India and the web ‘portal of Department of Health and Family Welfare, Punjab (https://nvbdcp.punjab.gov.in) Prohibition of interference with such worki) No person shall, without the consent of the Sanitary Inspector/inspecting officer interfere with any work executed or any material or thing placed in, under upon any land or building, by or under the.orders of the Inspecting Officer or the Sanitary Inspector with the objective of preventing the breeding of mosquitoes therein.
ii) If any‘person contravenes the provision of clause (19.i), the Inspecting Officer or the Sanitary Inspector may re-execute the wok or replace the materials or things, as the case may be, and the cost along with service change for doing so, shall be recovered from such person, eo Scanned with CamScanner

Notice to owner or occupier to mosquito breedingi) The Irispecting Officer or the Sanitary Inspector may, by notice in writing , require the owner or the occupier of any place in which mosquitoes breed or are likely to breed, with such as may be specified in notice, note being less than twenty four (24) hours, to take such measures, with respect to the same or to treat the same by physical, chemical, biological and other methods, as suggested by the Inspecting Officer or the Sanitary inspector may consider suitable in the circumstances for the prevention and control of Malaria, Dengue and other vector Borne Diseases.
ii) If the person on whom a notice is served under clause (20.i) fails or take measures or refuses to adopt the method of treatment, specified in such notice within the time mentioned therein, the Inspecting Officer or the Sanitary Inspector may impose fine of as per the Municipal Act. He may himself take such measures or adopt the method of such treatment and recover the cost along with service change for doing so, from the owner of occupier of the property, as the case may be.
Cleanliness of burrow pits - All burrow pits required to be dug in the course of construction and repair of roads, raiiways, embankments etc. shall be so cut as to ensure that the water does not remain stagnate therein. Where possible and practicable, the burrow pits shall be left clean, free and, that water shall be drawn off by drainage channels connecting one pit with the other till nearest drainage is met with. No person shall Person shall create any isolated burrow pits which is likely to cause accumulation of water cause. accumulation of water causing breeding of mosquitoes, Application of regulations - These regulations shall be applicable in addition to the regulations, rules or bye-laws, framed by the department of Local Government. and Department of Rural. Development and Panchayats in this regard, Power to enter and inspect the premises - For the purpose of enforcing the provisions of these regulation, the Inspecting Officer or the Sanitary Inspector may, at all reasonable times, after giving such notice in writing as may appear to him reasonable, enter and inspect any land or building within his jurisdiction and the occupier or the owner, as the case may be, of such land or building shall give all facilities necessary for such entry and inspection and supply all such information ‘as may be required by him for this purpose.

24. ~~ Penalty - who so ever contravenes any of the provision of these regulations, disobeys any order or requisition issued there under or fails to takes measures which are required or empowered by the Government of Punjab for which the Controlling Officer has been required or empowered to take action under these regulation , shall be deemed to have committed an offence under sections 188 of IPC1860. |
25. These regulations shall come into force at once and shall remain valid for two years from the date of publication of this notification.
26. Protection to person acting under Act: No suit or legal proceeding shall lie against any person for anything done or intended to be done in good faith under this act unless proved otherwise. , einza, HUSSAN.
