MAY 13.3016 4M .~ {VYSK 23. 1938SAKAI --~-------------------------------------------PART In (,OVERNMENT OF PUNJAB DEPARtMENT OF RURAL DEVELOPMEN:r AND PANCHAYATS NOTIFICATION The 6th May, 2016 No. G.S.R.37/Const.iArt.J09/2016.-ln exercise of the powers conferred by the provisio (0Article 309 of'rhe Constitution of India. and all ofher powers enabling him in this behalf. the Governorofl>unjab is pleased to make the following rules, regulating the recruinuent and conditions of services of the persons appointed to the Punjab Rural Development and Panchayats.(Group A) Technical Service, namely:-~ RULES Short title, commencement and application.-( 1) These mles may be called the Punjab Rural Development and Panchayats (Group 'At) Technical Service Rules, 2016.

(2) They shall come into f~1rceon and with effect from the date of their publication in the Official Gazette.

(3) They shall apply ro the postsspetitied inAppendix 'A'.

2 Definitiolls.-In'these rules, unless ~hecontext otherwise requites,--

(a) 'Appendix' means an appendix appended to these rules;

(b) 'Ch ief Engi ncer (Panchayat i Raj)' means Chief Engineer (Panchayati Raj) in the Department of Rural Development and Panchayats;

(c) 'Government' means the Government of the State of Punjab. in the Department of Rural Development and Panchayats; and

(d) 'Service' means the Punjab Rural Development and Panchayats (Group 'A') Technical Service.

3 Number and characterofposts.-The Service shall comprise the posts specified inAppendix 'A':

Provided that nothing in these rules shal! affect the inherent right of the Government to add to or reduce the number of such posts or to create new posts with different designations and scales of pay whether permanently or tern porariIy.

5 Pay of members of tbe Serviee> The members of the Service shaltbeentitled to such scales of pay, as may be authorised by the Department of Finance from time to time. TIle scales of pay, at present, in force in respect of the members:aftheService. are .given in Appendix 'A'.

() Method of appointment. qualificatiOllI and experienee.-( 1) Appointment to the Service shall be made in the manner specified in Appendix '8':

Provided that ifno suitable candidate is available for appointment by ptomotion and by direct appointment, then appointment to the Service shall be Inade by transfer of a person holding an analogous post under a State (JovernmentorOovemment of India,

(2) No ~rson shall be appointed to it post in the Service, unless he possesses the qualilications and experience as specified for such a post in Appendix 'B',

(3) Appointment to the Service by promotion shall be made on seniority.-cum-meritbasis. but no pen>OllShallhaveany right to claim promotion 011 the basis of seniority alone:

Provided thatprolllOtionto the po~t ofCbiefEnginccr, being Head ofthe Department, shall be made 011 the. basis of meriH;um-seniority.

1 pepartmental examination.-Every person appointed to the post of Sub Divisional Officer, unless he has already done so, has 1.0 Departmental examination as may be prescribed by (he Government from timeta.time and as ~l" the provisions laid down in the Punjab Civil Services (General and Common Condition of Service) Rules, 1994, as amended from time totime.

8 I)iscipUnet punishment and appeat. ..(l) In the matters of discipline. punishment and appeal, the members oftbe service shall be governed by the Punj~b Civil Services (Punishment and Appeal) Rules, 1910, as amended from time to time.

(2) 1'heauthority empowered to impose penalties as specified in rule 5 of the PunjabCivil Services (Punishment and Appeal) Rules, 1970, in respect oftbe members oftlre SCTV'ices,.sludl be the Government.

(2) The Punjab Civil Services (GeneraLalld Common Conditions of Service) Rules, 1994, at present in fQI'Ce. areconlaincd in Appendix 'Ct.

to Repeal and saving.-The Punjab Rural Development and Panchayats (Group 'A') Technical Service Rules, 2002, in so far as they are applicable to the members of tile Service, are hereby repealed:

Provided that any order issued or any action taken under the rules.so repealed.

shall be deemed to have been issued or taken under the corresponding provisions of these rules, 11 InterpretationAf any Qtlcstion arises as to the Interpretation of these rules. the Government shall decide the same, in consultation with the Department of Personnel.

(i) thirty three per cent from amongst the Junior Engineers, woddngunder the control of ChiefEngineer. Panehayat; Raj, who possess a diploma in Engineering in CMI from recognised univeJSity or institution andWho have an experience of working as such for a minimum period of ten years;

(ii) fifteen per cent from amongst the J uniot Engineers, working under the control of Chief Engineer, Panchayati Raj, who possess a degree in Engineering inCivil or degree of A.M.I.E. from a recognised university or institution, and who have an experience of working as such for a minimum period of three years after obtaining the aforesaid degrees;

(iii) two per cent from amongst the Circle Head Draftsman and Divisional Head Draftsman, who possess a degree in Engineering in Civil or a degree of A.M.I.E. from a recognised university I,)o or institution and who have an experience of working as such for a minimum period of two years; and

(b) Should have qualified the Departmental .Examination in such papers and syllabi, as may be specified by the Government from time to time.

5 Sub-Divisional Officer .
