Section 59: Modification of the Land Acquisition Act, 1894

For the purpose of acquiring land under the Land Acquisition Act, 1894, for the trust -

(a) the tribunal shall (except for the purposes of section 54 of the said Act) be deemed to be the Court, and the president of the tribunal shall be deemed to be the Judge, under the said Act;

(b) the said Act shall be subject to the further modifications indicated in the Schedule to this Act;

(c) the president of the tribunal shall have power to summon and enforce the attendance of witnesses, and to compel the production of documents, by the same means and (so far as may be) in the same manner as is provided in the case of a Civil Court under the Code of Civil Procedure, 1908 [5 of 1908]; and

(d) the award of a tribunal shall be deemed to be the award of the Court under the Land Acquisition Act, 1894 [1 of 1894] and shall be final.

Section 60 1[ 60. Constitution of tribunal. (1) - The tribunal shall consist of one person as its president to be appointed by the State Government.

(2) The president of the tribunal shall be a person, who,

(a) is qualified to be appointed as a judge of the High Court of Punjab; or

(b) is or has been an officer of the State Government not below the rank of a Financial Commissioner.

(3) The term of the office of the president of the tribunal shall be two years, which may be extended for such further period not exceeding two years:

Provided that no person appointed as the president of the tribunal shall continue as such beyond the age of seventy years.

(4) The president of the tribunal shall receive such remuneration, either by way of monthly salary or by way of fees, or partly in one of those ways and partly in the other, as the State Government may prescribe.]
