GOVERNMENT OF RAJASTHAN TRANSPORT DEPARTMENT No. F 7(3)/Pari/Rules/H.Q./2021/15658 Jaipur, Dated:03-09-2021 NOTIFICATION Whereas the draft of the Rajasthan Motor Vehicles (Amendment) Rules, 2021, amending the Rajasthan Motor Vehicles Rules, 1990, in exercise of the powers conferred by clause (xvi) of sub-section (2) of section 96 and clause (K) of sub-section (2) of section 28 of the Motor Vehicles Act, 1988 (Central Act No.
59 of 1988), was published as required by sub-section (1) of section 212 of the said Act, in the Rajasthan Gazette Extra-ordinary, Part 4(ga) dated 28.06.2021 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of thirty days from the date on which the copies of the said notification as published in Rajasthan Gazette were made available to the public;
And, whereas, copies of the said notification were made available to the public on 28-06-2021;
And, whereas, the objections & suggestions received from the public in respect of the said draft rules have been considered by the State Government.
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 96 and clause (K) of sub-section (2) of section 28 of the Motor Vehicles Act, 1988 (Central Act No. 59 of 1988), the State Government hereby makes the following rules further to amend the Rajasthan Motor Vehicles Rules, 1990, namely:-
1. Short title and commencement.- (1) These rules may be called the Rajasthan Motor Vehicles (Amendment) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Amendment of rule 5.21.- The existing sub-rule (6) of rule 5.21 of the Rajasthan Motor Vehicles Rules,1990, hereinafter referred to as the said rules, shall be substituted by the following, namely:- “(6) Where goods including carriage of general merchandise are carried in a stage carriage in addition to or in lieu of passenger, the goods shall be of such nature and shall be so packed and secured on the vehicle that no danger, inconvenience or discomfort is caused to any passenger. Such number of seats may be specified in the permit which shall be kept free and unimpeded for the use of passenger and the access to the entrance to the exist from the vehicle required under Chapter VII of these rules shall be under unobstructed.”
3. Substitution of rule 5.22.- The existing rule 5.22 of the said rules shall be substituted by the following, namely:- “5.22. Carriage of Goods on Contract carriage.-The Regional Transport Authority may authorise the use of contract carriage for the carriage of goods used for,-
(a) special reasons on particular occasions and subject to condition and restrictions to be specified on the permit,
(b) the carriage of the personal, office or household effects of a hirer or carriage of general merchandise in addition to or in lieu of passenger, if so authorized in the permit.”
4. Insertion of new rule 2.18A.- After the existing rule 2.18 and before the existing rule 2.19 of the said rules, the following new rule 2.18A shall be inserted, namely:- "2.18A. Necessity of Refresher Training Course.- Before renewal of driving licence for transport vehicle applicant shall have to undergo two days refresher training course in a driving training institute established by the State Government or any driving training institute authorised by the Transport Commissioner for the purpose and the licensing authority shall renew the licence only on presenting a certificate of the aforesaid refresher training course along with other formalities.
