1. सकं्षिप्त न राम और प्रारंभ.- (1) इू िूयमों ाा ूाम राजस्ााू िूराव्यसू ाे्र िूयम, 2020 हैं।
(2) ये राजपत्र में इूाे प्रााशू ाी थारीख से प्रवतृ्थ होंगे।
2. पररभाषाएं.- (1) इू िूयमों में जब था का स्िभथ से न्याा नपके्षक्षथ ू हो,-
(i) ‘‘नधििूयम’’ से स्वापा ओषधि और मूःप्रभाव पिााथ नधििूयम, 1985 (1985 ाा ाे्रीय नधििूयम स.ं 61) नलभप्रेथ है ;
(ii) ‘‘नप ि प्राधिाारी’’ से राज्य स्थरीय सलमिथ ाा नध्यक्ष नलभप्रेथ है ;
(iii) ‘‘ाे्र’’ से नधििूयम ाी िारा 71 ाी उप-िारा (1) ाे नि ू स्ाावपथ ओषधि िूराव्यसू और पुू वाथस ाे्र नलभप्रेथ है ;
(iv) ‘‘म्जिा स्थरीय सलमिथ’’ से िूयम 9 ाे उप-िूयम (1) ाे नि ू गदिथ सलमिथ नलभपे्रथ है ;
(v) ‘‘प्ररूप’’ से इू िूयमों से सिंग्ू प्ररूप नलभप्रेथ है ;
(vi) ‘‘सराार’’ से राजस्ााू सराार नलभप्रेथ है ;
(vii) ‘‘नूजु्ञम्तथ’’ से िूयम 7 ाे नि ू जारी नूजु्ञम्तथ-एव-ंरम्जस्रीारण प्रमाणपत्र नलभपे्रथ है ;
(viii) ‘‘नूजु्ञापू प्राधिारण’’ से िूयम 7 ाे उप-िूयम (1) ाे नि ू गदिथ नूजु्ञापू-एव-ं रम्जस्रीारण प्राधिारण नलभपे्रथ है ;
(ix) ‘‘सगंिू’’ से सोसाइटी रम्जस्रीारण नधििूयम, 1860 (1860 ाा ाे्रीय नधििूयम स.ं 21), राजस्ााू सोसाइटी रम्जस्रीारण नधििूयम, 1958 ाे नि ू रम्जस्रीाृथ ाोई 1201 jktLFkku jkt&i=] fnlEcj 18] 2020 Hkkx 4 ¼x½ सोसाइटी, रम्जस्रीाृथ पनथथ ्यास, ांपू नधििूयम, 1956/2013 ाे नि ू िूगलमथ ाोई ांपू , ाे्रीय या राज्य सराार द्वारा पनणथथः िूधिबद्ध और प्रबधंिथ ससं्ाा नलभप्रेथ है; और
(x) ‘‘राज्य स्थरीय सलमिथ’’ से िूयम 3 ाे उप-िूयम (1) ाे नि ू गदिथ राज्य स्थरीय सलमिथ नलभप्रेथ है।
(2) इू िूयमों में प्रयतुथ काये गये का्थ ुपररभावषथ ूहीं काय ेगये शब्िों और नलभव्यम्तथयों ाा वही नाथ होगा जो उ्हें नधििूयम में क्रमशः समूिेुलशथ काया गया है।
3. राज्य स्थरीय सलमिथ ाा गिू.- (1) एा राज्य स्थरीय सलमिथ होग , जो का िूम्ूलिखखथ शासाीय और गरै-शासाीय सिस्यों से लमिार बूेग , नााथथ ः-
(i) शासू सधचव, प्रभारी, सामाम्जा ्याय एव ं नधिााररथा ववभाग नध्यक्ष
(ii) धचकात्सा एव ंस्वास््य ववभाग ाा प्रिथिूधि जो उप-सधचव ाी रैंा से ाम ाा ू हो। सिस्य
(iii) थाू ाी लशक्षा ववभाग ाा प्रिथिूधि जो उप-सधचव ाी रैंा से ाम ू हो। सिस्य
(iv) उच्च लशक्षा ववभाग ाा प्रिथिूधि जो उप-सधचव ाी रैंा से ाम ाा ू हो। सिस्य
(v) स्ान ि लशक्षा ववभाग ाा प्रिथिूधि जो उप-सधचव ाी रैंा से ाम ाा ू हो। सिस्य
(vi) बाि नधिााररथा ववभाग ाा प्रिथिूधि जो उप-सधचव ाी रैंा से ाम ाा ू हो। सिस्य
(vii) दयतुथ/िूिेशा, सामाम्जा ्याय एव ंनधिााररथा ववभाग सिस्य सधचव
(viii) खाद्य एव ं ूागररा दपनिथ थ ववभाग ाा प्रिथिूधि जो उप- सधचव ाी रैंा से ाम ाा ू हो। सिस्य
(ix) ववभागाध्यक्ष, मूोववज्ञाू ववभाग, एसएमएस मेडडाि ाॉिेज, जयपरु सिस्य
(x) ववभागाध्यक्ष, माूलसा नस्पथाि, जयपरु सिस्य
(xi) ववभागाध्यक्ष, मूोववज्ञाू ववभाग, दरयनएचएस ाॉिजे ऑफ मडेडाि साइ्स, जयपरु सिस्य
(xii) राज्य सराार द्वारा ूामिूदिथष्ट िो ख्यािथप्रातथ वाीि सिस्य
(xiii) राज्य सराार द्वारा ूामिूदिथष्ट, राज्य में िूराव्यसू ाे क्षेत्र में ाायथ ारूे वािे गरै-सराारी सगंिू ाे िो प्रिथिूधि सिस्य
(xiv) सधचव, राजस्ााू रेडक्रॉस सोसाइटी सिस्य
(xv) सलमिथ कास ऐसे व्यम्तथ ाो उसाी ववशषेज्ञ राय सलमिथ ाो िेूे ाे लिए दमतं्रत्रथ ार साेग म्जसाो िूराव्यसू ाे क्षेत्र में ववलशष्ट ज्ञाू या नूभुव हो। सिस्य Hkkx 4 ¼x½ jktLFkku jkt&i=] fnlEcj 18] 2020 1202
(2) राज्य स्थरीय सलमिथ,-
(i) व्यसिूयों ाे उपचार और उूाे पुू वाथस ाे सबंिं में पयथवके्षण य, ू िथ िूमाथण और साुर बूाूे वािे िूााय ाे रूप में ाायथ ारेग ;
(ii) ाे्रों ाे प्रचािू ाे लिए नूजु्ञम्तथयां मजंनर ारूे ाे लिए नूजु्ञापू प्राधिारण ाे लिए मागथिशथा लसद्धा्थ ववरधचथ ारेग ;
(iii) ाे्रों में या भारथ सराार या कास ााूनू िूााय या इस सलमिथ द्वारा याा नधिाधाथ िेखभाि ाे ्यनू थम माूाों ाे प्रभाव कक्रया्वयू ाो सिुूम्चचथ ारेग ;
(iv) ाे्रों और सराारी स्वास््य िेखभाि सवुविाओ ंमें सहयोगात्मा उपचार ूेटवाथ स्ाावपथ ारूे ाे लिए सहायथा और मागथिशथू ारेग ;
(v) ाे्रों में नलभिूयोम्जथ ाालमथाों ाे लिए प्रलशक्षण ाायथक्रम ाा सचंािू ारेग ; और
(vi) व्यसिूयों ाे ाल्याण और पुू वाथस ाे सवंिथू ाे लिए न्य कास गिथववधि ाा म्जम्मा िेग ।
4. नन ररर्हताएं.- ाोई व्यम्तथ राज्य स्थरीय सलमिथ ाा सिस्य होूे या िूयतुथ काये जाूे ाे लिए िूरदहथथ होगा, यदि वह,
(i) ऐसे नपराि ाे लिए, म्जसमें राज्य सराार ाी राय में ूिैथा निमथा नथंवथलिथ है, िोषलसद्ध और ाारावास से िंडादिष्ट काया गया है; या
(ii) नू्ुमोधचथ दिवालिया है; या
(iii) ववाृथधचत्थ है और कास सक्षम ्यायािय द्वारा इस प्राार घोवषथ काया गया है; या
(iv) ाे्रीय या राज्य सराार या सराार ाे स्वालमत्व वािे या िूयतं्रणाि ू कास िूगलमथ िूााय ाी सेवा से हटा दिया गया है या पिच्यथु ार दिया गया है।
5. गरै-शासकीय सिस्यों की ्िावधि.-(1) प्रत्येा गरै-शासाीय सिस्य उसाे ूामिूिेशू ाी थारीख से थ ू वषथ ाी ाािावधि ाे लिए पि िारण ारेगा और पुू ःूामिूिेशू ाे लिए पात्र होगा।
(2) ाोई गरै-शासाीय सिस्य कास भ समय राज्य स्थरीय सलमिथ ाी सिस्यथा से नध्यक्ष ाो त्यागपत्र नग्रेवषथ ार पि त्याग साथा है और ऐसा त्यागपत्र उस थारीख, म्जसाो वह स्व ाार काया गया, से प्रभाव होगा।
(3) जहा ंगरै-शासाीय सिस्य ाे त्यागपत्र या न्याा से ररम्तथ उत्प्ू होथ है वहां राज्य सराार उस प्रवगथ में से ूामिूिेशू द्वारा ररम्तथ भरेग और इस प्राार ूामिूिेवषथ व्यम्तथ उस व्यम्तथ ाी शेष पिावधि था ाे लिए पि िाररथ ारेगा म्जसाे स्ााू पर वह ूामिूदिथष्ट हुद है।
(4) जहा ंकास गरै-शासाीय सिस्य ाी पिावधि ाा नवसाू होूे वािा है, वहां सराार ऐसे सिस्य ाी नवधि ाे नवसाू से थ ू माह पनवथ कास उत्थराधिाारी ाो नामननर्दिष्ट ार साेग का्थ ुउत्थराधिाारी उस सिस्य ाी नवधि ाे नवसाू ाे पचचाथ ही पि िारण ारेगा।
6. अन रजु्ञजप्त की आवश्यकता.- राजस्ााू राज्य में कास भ ाे्र ाो सचंािू ाी नूजु्ञा थब था ूही ं लमिेग जब था का उसूे नूजु्ञापू प्राधिारण से नूजु्ञम्तथ प्रातथ ू ार िी हो:
1203 jktLFkku jkt&i=] fnlEcj 18] 2020 Hkkx 4 ¼x½ पर्थ ुजो ाे्र इू िूयमों ाे प्रारंभ से पनवथ राज्य में सचंालिथ हैं, उ्हें इू िूयमों ाे प्रारंभ होूे ाी थारीख से थ ू माह ाी ाािावधि ाे भ थर-भ थर इू िूयमों ाे नि ू नूजु्ञम्तथ प्रातथ ारू होग , म्जसमें नसफि रहूे पर उ्हें सचंािू ाे लिए नूजु्ञाथ ूहीं काया जायेगा।
7. अन रजु्ञा्न र प्राधिकरण.- (1) एा नूजु्ञम्तथ-एव-ंरम्जस्रीारण प्राधिारण होगा जो िूम्ूलिखखथ सिस्यों से लमिार बूेगा, नााथथ ः-
(i) दयतुथ/िूिेशा, सामाम्जा ्याय एव ंनधिााररथा ववभाग, राजस्ााू नध्यक्ष
(ii) िूिेशा (िोा स्वास््य), धचकात्सा एव ं स्वास््य ववभाग, राजस्ााू, जयपरु सिस्य
(iii) दयतुथ/िूिेशा, बाि नधिाार नधिााररथा ववभाग सिस्य
(iv) निथररतथ िूिेशा (सामाम्जा सरुक्षा), सामाम्जा ्याय एव ंनधिााररथा ववभाग, राजस्ााू। सिस्य सधचव
(2) नूजु्ञापू प्राधिारण ाे ाृत्य िूम्ूाूसुार होंगेः-
(i) ाे्रों ाे सचंािू ाे लिए नूजु्ञम्तथ जारी ारूा और नूजु्ञम्तथ ाा ूव ारण ारूा;
(ii) ाे्रों ाे ववरुद्ध और सदंिग्ि/नलभाधाथ नूूजु्ञतथ ाे्रों ाे भ ववरुद्ध प्रातथ होूे वािी लशाायथों ाा न्वेषण ारूा;
(iii) ाे्रों ाे ाृत्यों ाो माू टर, पयथवेक्षण और मनल्यांाू ारूा;
(iv) भारथ सराार, कास ााूनू िूााय या राज्य स्थरीय सलमिथ द्वारा समय-समय पर जारी काय े गये मागथिशथा लसद्धा्थों ाे नूसुार ाे्रों में िेख-रेख ाे ्यनू थम माूाों ाो सिुूम्चचथ ारूा ;
(v) ाे्रों ाो स्ाावपथ ारूे और उूाे कक्रया्वयू ाे लिए राज्य स्थरीय सलमिथ द्वारा जारी काये गये मागथिषथा लसद्धा्थों ाो ाायाथम््वथ ारूा;
(vi) ाे्रों ाा समय-समय पर िूरीक्षण ारूा और इू िूयमों, न्य कास ववधि या कास सक्षम प्राधिाारी द्वारा जारी काय े गये ननदशे, ाे निथक्रमण का दशा में उूाे ववरुद्ध नूजु्ञम्तथ ाे िूिबंू या रद्दारण ाो सम्म्मलिथ ारथ े हुए िण्डात्मा प्रकक्रयाए ं दरंभ ारूा ;
(vii) नधििूयम ाे उपबिंों और इू िूयमों ाे कक्रया्वयू और नपूे ाथथव्यों ाे िूवथहू थाा उदे्दश्यों ाो प्रातथ ारूे ाे लिए नपू स्वय ंाी प्रकक्रया नलभिक्षक्षथ ारूा; और
(viii) समय-समय पर राज्य स्थरीय सलमिथ द्वारा वविूदिथष्ट प्ररूप में नलभिेख सिंाररथ ारूा।
(3) नूजु्ञापू प्राधिारण िूम्ूलिखखथ प्रकक्रया ाा नूसुरण ारेगा, नााथथ :-
(i) कास ाे्र ाी स्ाापूा ाे लिए नूजु्ञम्तथ प्रातथ ारूे ाा आशय रखू ेवािे सगंिू द्वारा िस हजार रुपये ाी फीस ाे सिंाय ाे सबनथ ाे साा प्रारूप-I में एा दविेू नूजु्ञापू प्राधिारण ाो प्रस्थथु काया जायेगा। फीस मांगिेय ड्राफ्ट ाे रूप में या नूजु्ञापू प्राधिारण द्वारा नूमुोदिथ न्य कास रूप में सिंत्थ ाी जा साेग । प्रारूप-I में कास दवेिू ाी प्राम्तथ पर, नूजु्ञापू प्राधिारण यह सुनननश्चर्त ारूे ाे लिए का सगंिू इू Hkkx 4 ¼x½ jktLFkku jkt&i=] fnlEcj 18] 2020 1204 िूयमों ाे नि ू कास ाे्र ाे सचंािू ाे लिए ववदहथ ्यनू थम माूाों ाा पािू ारूे में सक्षम है, ऐस जााँच जो वह उधचथ समझ,े ार साेगा;
(ii) जााँच ाे पश्चार्त ्और सगंिू ाी इू िूयमों में ववदहथ ्यनू थम माूाों ाे नूसुार ाे्र स्ाावपथ ारूे ाी क्षमथा ाे बारे में स्वय ं ाे समािाू ाे पचचाथ , नूजु्ञापू प्राधिारण प्रारूप-II में नूजु्ञम्तथ जारी ार साेगा;
(iii) ाोई नूजु्ञम्तथ, जारी काय ेजाूे ाी थारीख से थ ू वषथ ाी ाािावधि ाे लिए थब था मा्य रहेग जब था वह नूजु्ञम्तथ ाी का्ही ंशथों ाी नूूपुािूा और इू िूयमों ाे नि ू ववदहथ ्यनू थम माूाों ाी पािूा ूहीं ारूे ाे लिए नूजु्ञापू प्राधिारण द्वारा पनवथथर िूितं्रबथ, प्रिथसहंृथ या रद्द ू ार िी जाये;
(iv) नूजु्ञम्तथिारी, पांच हजार रुपये ाी फीस ाे सिंाय ाे सबनथ ाे साा प्रारूप-III में नूजु्ञम्तथ ाे ूव ारण ाे लिए दवेिू ार साेगा। फीस माूिेय ड्राफ्ट ाे रूप में या नूजु्ञापू प्राधिारण द्वारा नूमुोदिथ न्य कास भांिथ सिंत्थ ाी जा साेग । नूजु्ञापू प्राधिारण ऐस जााँच, जो वह उधचथ समझ,े ाे पचचाथ और इू िूयमों में ववदहथ ्यनू थम माूाों ाो बूाये रखू ेाे बारे में स्वय ंाा समािाू होूे ाे पश्चार्त,् नूजु्ञम्तथ ाो ूव ाृथ ार साेगा;
(v) ाे्र या राज्य सराार द्वारा स्ाावपथ ाे्रों ाो नूजु्ञम्तथ फीस ाे सिंाय से छन ट होग ;
(vi) माूलसा स्वास््य िेख-रेख नधििूयम, 2017 (2017 ाा ाे्रीय नधििूयम स.ं 10) या 2017 ाे उतथ नधििूयम द्वारा िूरलसथ नधििूयम और उसाे नि ू बूाये गये िूयमों ाे नि ू म्जू मननश्चकित्सीय पररचयाथ गहृों/नस्पथािों ूे नूजु्ञम्तथ िे रख है और व्यसिूयों ाो उपचार और िेख-रेख उपिब्ि ारवा रहे हैं उ्हें नूजु्ञम्तथ प्रातथ ारूे से छन ट प्रातथ होग । थाावप वे नूजु्ञापू प्राधिारण ाो राज्य में िूराव्यसू ाे डाटा समेाू ाे प्रयोजू ाे लिए िूराव्यसू मामिों ाा डाटा ववदहथ प्रोफामाथ नााथथ ड्रग एब्यनस मॉिूटररगं लसस्टम (ड ए एम एस) में प्रस्थथु ारेंगे।
(vii) प्ररूप-I में नूजु्ञम्तथ ाे लिए दविेू प्रातथ ारूे पर नूजु्ञापू प्राधिारण उस,े ाे्र ाे रख-रखाव और ्यनू थम माूाों ाे नूपुािू ाे सबंिं में ररपोटथ ाी प्राम्तथ ाे थ स दिवस ाे भ थर-भ थर जारी ार साेगा।
8. अ्ील.- नूजु्ञापू प्राधिारण ाे आदशे से व्यधाथ ाोई सगंिू, ऐस फीस जो राज्य स्थरीय सलमिथ द्वारा नविाररथ ाी जाए, ाे सिंाय ाे सबनथ ाे साा, राज्य स्थरीय सलमिथ ाे नध्यक्ष ाे समक्ष प्रारूप-IV में नप ि प्रस्थथु ार साेगा।
9. जजला स्तरीय सममनत.- (1) एा म्जिा स्थरीय सलमिथ होग , जो िूम्ूलिखखथ सिस्यों से लमिार बूेग , नााथथ ः-
(i) म्जिा ाितटर नध्यक्ष
(ii) पलुिस नि क्षा सिस्य
(iii) प एमओ/नि क्षा (नस्पथाि/ धचकात्सा महाववद्यािय) सिस्य
(iv) सहाया िूिेशा, एाीाृथ बाि सरंक्षण इााई सिस्य
(v) उप िूिेशा/म्जिा लशक्षा नधिाारी सिस्य
(vi) उप िूिेशा/सहाया िूिेशा, सामाम्जा ्याय एव ं सिस्य सधचव 1205 jktLFkku jkt&i=] fnlEcj 18] 2020 Hkkx 4 ¼x½ नधिााररथा ववभाग
(2) म्जिा स्थरीय सलमिथ ाे ाृत्य िूम्ूाूसुार होंगःे-
(i) राज्य स्थरीय सलमिथ या नूजु्ञापू प्राधिारण द्वारा समय-समय पर जारी ाी गय नूजु्ञम्तथ ाी शर्तो और मागथिशथा लसद्धांथों ाे नूसुार म्जिे में ाे्रों ाे ाृत्यों ाो ाालिा रूप से माू टर, पयथवेक्षण और मनल्यांाू ारूा।
(ii) यह सिुूम्चचथ ारूा का ाोई ाे्र ववधिमा्य नूजु्ञम्तथ ाे त्रबूा ाृत्य ूही ार रहा हो;
(iii) समय-समय पर राज्य स्थरीय सलमिथ द्वारा ववदहथ प्ररूप में नलभिेख रखूा।
10. न्यनू रतम मान रक.- (1) ाे्र िूम्ूलिखखथ ्यनू थम माूा रखेंग,े नााथथ ः- ा. भौिथा माूाः
(i) नूजु्ञम्तथ प्रातथ ारूे ाे पचचाथ ाे्र नूजु्ञम्तथ जारी होूे ाी थारीख से थ स दिवस ाे भ थर-भ थर प्रचािू प्रारंभ ारेंग ेऔर नूजु्ञापू प्राधिारण ाो प्रचािू प्रारम्भ होूे ाे बारे में सनधचथ ारेंगे।
(ii) नूजु्ञापू प्राधिारण ऐसे ूये ाे्र ाा िूरीक्षण ारवायेगा जो म्जिा स्थरीय सलमिथ द्वारा काया जायेगा।
(iii) ाे्र ाे पास नपेक्षक्षथ सखं्या में पिगं होंग े (प्रत्येा मरीज ाे लिए एा), पयाथतथ वास- सवुविा और पिगंों ाे ब च उपयतुथ नथंर उपिब्ि ाराया जायेगा।
(iv) ाे्र में पयाथतथ सवंाथू होगा और भथी मरीजों ाे स्वास््य ाे लिए नदहथार हो साूे वािे कास भ थरह ाे प्रिनषण से मतुथ होगा।
(v) ाे्र ाे पास पेय जि और िुिाई, स्ूाू और सफाई ाे प्रयोजूों ाे लिए प्रवाही जि होगा।
(vi) ाे्र ाे पास, सफाई ाे िूबिंूों ाे नूसुार उपयतुथ स्वच्छथा सवुविाएं होंग और पयाथतथ सखं्या में स्ूाूगहृ, शौचािय और लसां होंगे।
(vii) ाे्र मरीजों ाी व्यम्तथगथ स्वच्छथा ाे लिए स्वच्छ चािर, बथथू और वस्थएंु उपिब्ि ारवायेगा।
(viii) ाे्र भथी काय ेगये मरीजों ाो थाजा, पोषा और पयाथतथ भोजू उपिब्ि ारवायेगा।
(ix) ाे्र ाे पास मरीजों ाे लिए पयाथतथ दमोि-प्रमोि सवुविाएं होंग ।
(x) ्यनू थम पांच व्यम्तथयों ाे लिए बिैूे ाी व्यवस्ाा ाे साा स्वागथ ाक्ष मे, जााँच/रम्जस्रीारण ााउंटर/प्रथ क्षा ाा स्ााू होगा।
(xi) व्यम्तथगथ परामशथ, समनह रोगोपचार और पररवार परामशथ उपिब्ि ारवाूे ाे लिए िघ ु ाक्ष/ामरा।

(ii) ाे्र ाे उपचार प्रोटोााि में स्ाावपथ और साक्ष्य दिाररथ धचकात्सा पद्धिथ और समय- समय पर समधाथथ नपहािू ्यनू ारण पद्धिथ ाो सम्म्मलिथ ारथ े हुए ववचव स्वास््य सगंिू, भारथ सराार, भारथ य मूोववज्ञाू सोसाइटी द्वारा प्राालशथ मागथिशथा लसद्धाथंों ाा पािू काया जायेगा।
(iii) ाे्र में िूयोम्जथ ूलसिंग और न्य स्टाफ उूाे ाायथ ाी दवचयाथा ाे नूसुार सम्या रूप से नदहथथ होंग ेऔर सौंपे गये ाायथ ाो ारूे में सक्षम होंगे। मनि स्टाफ (धचकात्सा और ूसथ) मा्यथाप्रातथ ससं्ाा से िूराव्यसू उपचार में प्रलशक्षण प्रातथ काय ेहुए होंगे।
(iv) ाे्र ाा प्रभारी नधिाारी सम्या रूप से नदहथथ मूोधचकात्सा या िूराव्यसू उपचार में थ ू माह ाा प्रलशक्षण प्रातथ धचकात्सा (एम.ब .ब .एस.) होगा।
(v) जब ाोई एम.ब .ब .एस. धचकात्सा ाे्र ाा प्रबिंू ारथा है थो सतथाह में एा बार ाे्र ाे िूरीक्षण ाे लिए उसाी ूामाविी में एा मूोधचकात्सा होगा।
(vi) प्रत्येा ाे्र, यदि दवचया हो थो, नथंः रोधगयों ाो सहायथा और दपाथाािीू सेवाए ं उपिब्ि ारवाूे ाे लिए इंथजाम ाो सनचूा पट्ट पर प्रिलशथथ ारेगा।
(vii) ाे्र द्वारा मरीजों ाे लिए पयाथतथ पररवहू/रोग वाहू सिुूम्चचथ काया जायेगा।
(viii) ाे्र द्वारा मरीजों/व्यसिूयों ाी दिू-राथ िगाथार धचकात्सा पररचयाथ िेख-रेख सिुूम्चचथ ाी जायेग ।
(ix) शारीररा और मूोधचकात्स य सह-रूग्णथा ाे लिए आवश्यि और उससे सबंधंिथ औषि ाा पयाथतथ और सगुमथा से उपिब्ि स्टाा होगा। (ग) स्टाफ ाी दवचयाथाः
(1) िूराव्यसू ाे्र ाे लिएः

(iv) थ ू वाडथ पररचारा, म्ज्होंूे मािा पिााथ व्यसिूयों ाो सभंािूे ाे लिए नलभवव्यास प्रलशक्षण ाे साा मा्यथाप्रातथ बोडथ या ससं्ााू से 10+2परीक्षा उत्थ णथ ाी हो, ाो थ ू माह ाे भ थर स्ााू य थौर पर ाे्र पर उपिब्ि ारवाूा होगा।
(v) िो सरुक्षा ाालमथा- एा-एा, दिू-राथ िगाथार।
(vi) िो सफाई ामथचारी।
(vii) थाज ेपौम्ष्टा भोजू ाे लिए िूयलमथ व्यवस्ाा पर िो रसोइये-एव-ंसहाया।
(viii) प यर एजुाेटर (वाैम्ल्पा)
(2) परामशथ ाे्र ाे लिएः
(i) एा पररयोजूा िूिेशा/प्रोग्रामर नधिाारी-एा।
(ii) कास मा्यथाप्रातथ ससं्ाा से िूराव्यसू उपचार में प्रलशक्षण ाी नधिमाूथा ाे साा मूोववज्ञाू, समाजशास्त्र या सामाम्जा ाायथ में एम.ए. ाी मनिभनथ नहथथा ाे साा िो सामाम्जा ाायथाथाथ/परामशथिाथा।

(v) लिाेंज कक्रयाािापों और दपाथाािीू धचकात्स य िेख-रेख ाे प्रयोजूााथ मरीजों ाे लिए पयाथतथ पररवहू सवुविाएं। (ङ) नलभिेख रखूा, प्रसारः
(i) समस्थ ाे्रों ाे लिए समस्थ मरीजों ाे व्यम्तथगथ और उपचार नलभिखे रखूा दज्ञापा होगा ।
(ii) यह नलभिेख गोपू य होंग े और िूवेिू काय े जाूे पर, ाे्र ाे प्रभारी नधिाारी ाे वववेााूसुार ाेवि नधिाृथ व्यम्तथयों ाो ही उपिब्ि होंग।े

1. Short title and Commencement.- (1) These rules may be called the Rajasthan De-addiction Centres Rules, 2020.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Definitions.- (1) In these rules unless the context otherwise requires,-
(i) "Act" means the Narcotic Drugs and Psychotropic Substances Act, 1985 (Central Act No. 61 of 1985);
(ii) "Appellate Authority" means the Chairperson of the State Level Committee;
(iii) "Centre means drugs de-addiction and rehabilitation centre established under sub-section (1) of section 71 of the Act;
(iv) "District Level Committee" means the Committee constituted under subrule (1) of rule 9;
(v) "Form" means form appended to these rules;
(vi) "Government" means the Government of Rajasthan;
(vii) "License" means the License-cum-Registration Certificate issued under rule 7;
(viii) "Licensing Authority" means the Licensing-cum-Registering Authority constituted under sub-rule (1) of rule 7;

(ix) "Organisation" means a society registered under the Societies Registration Act, 1860 (Central Act No. 21 of 1860), Rajasthan Societies Registration Act, 1958, registered charitable Trust, a company incorporate under the Companies Act, 1956/2013, institution fully funded and managed by the Central or State Government; and
(x) "State Level Committee" means the State Level Committee constituted under sub-rule (1) of rule 3.
(2) Words and expressions used in these rules but not defined shall have the same meaning respectively assigned to them in the Act.
3. Constitution of State Level Committee.- (1) There shall be a State Level Committee, comprising of the following officials and non-official members, namely:-
(i) Secretary to the Government in-charge of Social Justice and Empowerment Department Chairperson
(ii) Representative of the Medical and Health Department, not below the rank of Deputy Secretary Member
(iii) Representative of the Technical Education Department, not below the rank of Deputy Secretary Member
(iv) Representative of the Higher Education Department, not below the rank of Deputy Secretary Member
(v) Representative of the School Education Department, not below the rank of Deputy Secretary Member
(vi) Representative of the Child Rights Department, not below the rank of Deputy Secretary
(vii) Commissioner/ Director, Social Justice and Empowerment Department
(viii) Representative of the Department of Food and Civil Supply, not below the rank of Deputy Secretary
(ix) Head of Department, Psychiatry Department, SMS Medical College, Jaipur

(xv) The Committee may invite any person who has special knowledge and experience in the field of De-addiction for giving his expert opinion to the Committee.

(2) The State Level Committee shall,-
(i) act as supervisory, policy making and facilitatory body with regard to treatment of addicts and their rehabilitation;
(ii) frame guidelines for the licensing authority to grant licences for operation of centres;
(iii) ensure effective implementation of minimum standards of care in centres as laid down by the Government of India or any statutory Body or this Committee;
(iv) help and guide to establish a collaborative treatment network amongst the centres and Government Health Care Facilities;
(v) conduct training programme for personnel deployed in centres; and
(vi) undertake any other activity for the promotion of welfare and rehabilitation of addicts.
4. Disqualifications.- A person shall be disqualified, for being appointed as or for being a member of the State Level Committee, if he,
(i) has been convicted and sentenced to imprisonment for an offence which in the opinion of the Government involves moral turpitude; or
(ii) is an un-discharged insolvent; or
(iii) is of unsound mind and stands so declared by a competent court; or
(iv) has been removed or dismissed from the service of the Central or State Government or any body corporate owned or controlled by the Government.
5. Term of office of non-official members.- (1) Every non-official member shall hold office for a period of three years from the date of his nomination and shall be eligible for re-nomination.
(2) A non-official member may at any time resign from membership of the State Level Committee by forwarding letter of resignation to the Chairperson and such resignation shall take effect from the date on which it is accepted.

(3) Where a vacancy occurs by resignation or otherwise of a non-official member, the State Government shall fill the vacancy by nominating from amongst the same category and the person so nominated, shall hold office for the remainder of the term of office of the member in whose place he has been so nominated.
(4) Where the term of office of any non-official member is about to expire, the Government may nominate a successor three month before the expiry of the terms of such member but the successor shall assume office only after expiry of the term of the member.
6. Requirement of Licence.- No centre in the State of Rajasthan shall be allowed to operate, unless it has obtained license from the Licensing Authority:
Provided that the centre, which is operating in the State before the commencement of these rules, shall have to obtain a license under these rules within a period of three months from the date of commencement of these rules, failing which, it shall not be allowed to operate.
7. Licensing Authority.- (1) There shall be a Licensing-cum-Registration Authority consisting of the following members, namely:-

(2) The functions of the Licensing Authority shall be as under:-
(i) to issue licence and renew the licence for operation of centres;
(ii) to investigate complaints received against centres as also against suspected /alleged unlicensed centres;
(iii) to monitor, supervise and evaluate functioning of centres;
(iv) to ensure minimum standards of care in the centres as per guidelines issued by the Government of India, any statutory body or the State Level Committee, from time to time;
(v) to implement the guidelines issued by the State Level Committee for setting up and functioning of the centres;
(vi) to carry out periodic inspections of the centres and in case of any violation of these rules, any other law or direction issued by the any competent authority, to initiate punitive proceedings against them including suspension or cancellation of the licence;
(vii) to devise its own procedure for discharging its duties and to achieve the objectives and implementing these rules and the provisions of the Act; and
(viii) to maintain record in the Form specified by the State Level Committee, from time to time.
(3) The Licensing Authority shall follow the following procedure, namely:- 1215 jktLFkku jkt&i=] fnlEcj 18] 2020 Hkkx 4 ¼x½
(i) an application shall be submitted to the Licensing Authority by the organisation intending to obtain a license for establishment of a centre in Form-I along with proof of payment of fee of rupees ten thousand. Fee may be paid in shape of Demand Draft or any other mode approved by the Licensing Authority. On receipt of an application in Form-I, the Licensing Authority may cause such enquires as it deems fit to ensure that the organisation is capable of adhering to the minimum standards prescribed under these rules for running a centre;
(ii) after enquiry and after satisfying itself about the capability of an organisation for setting up a centre in accordance with the minimum standards prescribed in these rules, the Licensing Authority may issue a licence in Form-II;
(iii) a licence shall be valid for a period of three years from the date of issue unless suspended, revoked or cancelled earlier by the Licensing Authority for non compliance of any of the conditions of licence and non adherence of the minimum standards prescribed under these rules;
(iv) the licensee may apply for renewal of licence in Form-III along with proof of payment of fee of rupees five thousand. Fee may be paid in shape of Demand Draft or any other mode approved by the Licensing Authority.
The Licensing Authority after such enquiry as it deems fit and after satisfying itself about the maintenance of minimum standards prescribed in these rules, the Licensing Authority may renew the licence;
(v) the centres established by the Central or State Government shall be exempted from the payment of license fee;
(vi) Psychiatric Nursing Homes/Hospitals which are holding licence under the Mental Healthcare Act, 2017 (Central Act No. 10 of 2017 or Act repealed by the said Act of 2017 and rules made theirunder and are providing treatment and care to addicts shall be exempted from obtaining licence.
However, they shall submit data of de-addiction cases in the prescribed Performa i.e. Drug Abuse Monitoring System (DAMS) to the Licensing Authority for the purpose of consolidation of data on de-addiction in the State; and
(vii) on the receipt of application for licence in Form-I the Licensing Authority may issue the same within thirty days of the receipt of reports regarding compliance of the minimum standards and maintenance of centre.
8. Appeal.- Any organisation aggrieved from the order of the Licensing Authority may prefer an appeal in From-IV before the Chair-person of the State Level Committee along with the poof of payment of fee as may be determined by the State Level Committee.
9. District Level Committee.- (1) There shall be a District Level Committee, comprising of the following members, namely:-
(i) District Collector Chairperson
(ii) Superintendent of Police
(iii)PMO/Superintendant (Hospital/ Medical Collage) Member Member
(iv) Assistant Director, Integrated Child Protection unit Member Hkkx 4 ¼x½ jktLFkku jkt&i=] fnlEcj 18] 2020 1216
(v) Deputy Director/ District Education Officer
(vi) DeputyDirector/Assistant Director, Social justice and Empowerment Department Member Member Secretary
(2) The functions of the District Level Committee shall be as under:-
(i) to periodically monitor, supervise and evaluate the functioning of the centres in the district in accordance with the conditions of the licence and guidelines issued by the State Level Committee or Licensing Authority, from time to time.
(ii) to ensure that no centre is functioning without valid licence;
(iii) to maintain the record in the Form prescribed by the State Level Committee, from time to time.
10. Minimum Standards.- (1) The centre shall maintain the following minimum standards; namely:- A. Physical Standards:
(i) The centre after obtaining licence shall start operations within thirty days from the date of issue of license and inform the Licensing Authority about the commencement of its operation.
(ii) The Licensing Authority shall cause an inspection of such new centre to be conducted by the District level Committee.
(iii) The Centre shall have requisite number of beds (one for each patient), adequate accommodation and proper spacing between the beds shall be provided.
(iv) The centre shall have sufficient ventilation and be free from any pollution which may be detrimental to the health of admitted patients.
(v) The centre shall have potable/ drinking water and running water for washing, bathing and cleaning purposes.
(vi) The centre shall have proper sanitation facilities in terms of cleanness and shall have adequate number of bathrooms, toilets and sinks.
(vii) The centre shall provide clean bed linen, utensils and articles for personal hygiene of the patients.
(viii) The centre shall provide fresh, nutritious and adequate meals to the admitted patients.
(ix) The centre shall have adequate recreational facilities for the patients.
(x) Reception enquiry/registration counter/waiting space with seating arrangements for a minimum of five persons.
(xi) Cubicle/room for providing individual counselling, group therapy and family counselling.
(xii) Space to store records of patients to ensure confidentiality and a system of easy retrieval.
(xiii) related educational material such as posters to be prominently displayed at strategic points in the centre.
(xiv) Pamphlets, hand bills and other educational materials in vernacular shall be made freely available for the public.

(xvi) Facility for Bio-metric Attendance of staff and admitted patient B. Medical Standards:
(i) No patient shall be coerced to undergo detoxification treatment without explaining the range of treatment options available to him including substitution/maintenance therapy and Psychosocial interventions and his consent for undergoing treatment for de-addiction.
(ii) Treatment protocol of centre shall follow established and evidence based medical practice and guidelines published by the World Health Organization (WHO), Government of India, and Indian Psychiatric Society (IPS), including the harm minimization practices advocated, from time to time.
(iii) Nursing and other staff employed in the centre shall be duly qualified as per their job requirement, be competent to handle the work assigned to them. The core staff (doctors and nurses) shall have received training in de-addiction treatment from a recognized institution.
(iv) Officer in-charge of a centre shall be duly qualified psychiatrist or doctor (M.B.B.S) with at least three months training in de-addiction treatment.
(v) When an M.B.B.S doctor manages a centre, it shall have a psychiatrist on its roll for visiting the centre at least once in a week.
(vi) Each centre shall display the arrangement on the notice board for providing support and emergency services to the in-patients, if needed.
(vii) Adequate transport/ambulance for patients shall be ensured by the centre.
(viii) Round the clock medical nursing care to the patients/addicts shall be ensured by the centre.
(ix) There shall be adequate and readily available stock of medicines required and related physical and psychiatric co-morbidities.
C. Staff Requirement:
(1) for de-addiction center:
(i) One part-time (4 hours a day) doctor who is MD preferably in Psychiatry, or M.B.B.S with at least three months training in deaddiction treatment from a recognized institution. (Doctor-Patient Ratio 1:20)
(ii) Two Social Workers/Counsellors who are M.Phil./M.A. in psychology, Sociology or social work (preferable with training in de-addiction treatment) from a recognized institution (Social Workers/counsellor- Patient Ratio 1:10)
(iii) Four staff nurses for round the clock services, who are B.Sc . Nursing or Diploma in Nursing with training in de-addiction treatment from a recognized institution (Nurse-Patient Ratio 1:20)
(iv) Three ward attendants who have passed 10+2 examination. from a recognized board or institution with orientation training to handle drug addicts to be provided at the centre locally within three months.
(v) Two security personnel-one each, round the clock.
(vi) Two Safai Karamcharies.
(vii) Two Cook cum Helper on regular arrangement for fresh nutritious food.
(viii) Peer Educators (Optional)
(2) For counseling Centre:
(i) One Project Director/Programmer Officer-one.

(ii) Two Social Workers/ Counsellors with basic qualification of M.A.
in Psychology, Sociology or Social work preferable with training in de-addiction treatment from a recognized institution.
(iii) Three ward Attendants who have passed 10+2, examination from a recognized board or institution with orientation training to handle druge addiction to be provided at the Centre locally within three months.
(iv) Two security guards/Chowkidars.
(v) Two safai Karamcharies.
(vi) Peer Educators (Optional).
(vii) One Cook cum Helper on regular arrangement for fresh nutritious food.
D. Support Services: Each centre shall provide the following support servicees:-
(i) Emergency medical care.
(ii) Recreation/rehabilitation facility and outdoor activities.
(iii) Regular daily outpatient's services.
(iv) Referral linkage for specialist medical services, laboratory services.
HIV/AIDS centres, RNTCP centres.
(v) Adequate transport facilities for patients for the purpose of linkage activities and emergency medical care.
E. Record Maintenance Dissemination:
(i) It shall be mandatory for all the centres to maintain personal and treatment record of all the patients.
(ii) These records shall be confidential and available only to the authorized persons on request with the discretion of officer incharge of the centre.
(iii) All the data on activities of the centre shall be sent on Drug Abuse Monitoring System (DAMS) in performa developed by the Union Ministry of Health and Family Welfare, to the Director Public Health Medical and Health Department, Rajasthan and to the Director, Health and Family Welfare, Ministry of Health and Family Welfare, Government of India on the quarterly basis for the purpose of information and compilation of State and National data.
11. Admission to centre.- (1) Admission to the centre shall be made only with consent of the patient, after discussing risks, benefits and alternatives to treatment to be recorded in writing. Copy of the consent Form shall be provided to the patient. The patinet shall have the right to refuse and discontinue treatment at any time.
(2) The State Level Committee or the Licensing Authority, as the case may be, may frame guidelines or impose such conditions as it deems proper.
(3) Each centre shall give an undertaking to the effect that it shall protect the human rights of the admitted patients as per the universal Human Rights and it will not engage in the following activities with the patients i.e. solitary confinement, forced labour, punishment, beating, psychological torture, chaining or locking up. The patient's liberty shall be protected at all times. it shall allow private interaction with family and provide communication to the patient under supervision of the authorized person of Centre. It will ensure confidentiality of medical and counselling records of the patients except caregivers and under judicial orders.
