1. Short title and commencement.-(1)These rules may be called the Rajasthan Honour of Dead Body Rules, 2025.
(2) They shall come into force on and from the date of their publication in the Official Gazette.
2. Definitions.- (1) In these rules, unless the context otherwise requires,-
(a) “Act” means the Rajasthan Honour of Dead Body Act, 2023 (Act No. 21 of 2023);
(b) "Executive Magistrate" means the Executive Magistrate appointed by the State Government under section 14 or section 15 of the Bharatiya Nagarik Suraksha Sanhita, 2023; and
(c) "Form" means form appended to these rules.
(2)Words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act.
3. Public Authority.-For the purpose of the Act, following shall be the public authorities, namely:-
(i) all Municipalities of the State;
(ii) all panchayats of the State; and
(iii) any other body specially authorized by the State Government, from time to time, to perform last rites of a dead body.
4. Notice to perform last rites.-The executive magistrate, on receipt of information under section 7 of the Act, shall serve notice to the family members of the deceased to perform the last rites. The notice shall be sent in the form appended to these rules, through special messenger, e-mail or any other electronic mode.

5. Storage of dead bodies in hospital.- (1) At the time of storage of dead bodies it shall be ensured that the dead bodies are segregated based on gender and are kept in dignified manner.
(2) Clothing of the deceased should be collected, examined as well as preserved and sealed by the doctor conducting the autopsy and should be sent for further examination at the concerned forensic science laboratory. Further, it should be covered in special Body Bags for proper transportation.
(3) The Hospital administration shall not retain any dead body on the ground of nonpayment of bills. The hospitals must hand over the body to the family of the deceased or to the public authority in a dignified manner.
(4) Regular mopping and cleaning of mortuary should be undertaken so that the dead bodies remains preserved in a proper and clean environment and dignity of dead bodies should be maintained.
(5) The Hospital administration should maintain confidentiality of clinical records and must have a mechanism for guarding information related to the deceased, especially for cases that are stigmatized or socially criticised.
(6) Post mortem room should not come under the direct line of sight of the general public/visitors. To ensure the same, provision of curtain, screen or buffer area may be made in a post mortem room.
(7) The mortuary administration may sensitize the staff, from time to time, to train them in handling of the dead body and deal with the attendants of the deceased with sensitivity.
6. Photography and Videography of the Post-mortem.- (1) Photography and videography shall be done so as to maintain a proper record of the unclaimed dead body, which may be used for identification of dead body:
Provided that photographs of the unclaimed dead body shall be used by the Data Bank as primary identification information while videos may be used for confirmatory purposes.
Provided further that for the use of finding missing persons,the Data Bank shall upload only photographs on web portal and videography may be shown only when a person claims and proves to be the family member of the unclaimed dead body.
(2) Videography and photography of the dead body shall be done by a professional photographer, who shall ensure that such videos shall not be used by him for any purpose other than the purpose specified in these rules and the Act.
7. Data Bank, Web portal and Digitalization.- (1) If dead body of a person remains unclaimed, such dead body shall be stored in the hospital as mentioned in section 9 of the Act and the experts from the post-mortem team shall collect DNA sample from the dead body and send for DNA analysis. On receipt of the DNA analysis report same shall be forwarded to the Data Bank along with the general identification information such as photograph, name etc and other biological samples, if any:
Provided that, the dead bodies stored in hospital may be disposed as per the provisions of section 15 of the Act:
(2) The Data Bank shall, after receipt of DNA analysis report, upload the general identification information on the web portal created under section 13 of the Act, so as to tally the above data with that of missing persons.
(3) Data Bank shall maintain a dataset of death cases for unidentified dead bodies on the web portal.
(4) Data Bank and Web portal shall be monitored and maintained by the State Forensic Science Laboratory, Jaipur.

(5) Whenever there is any calamity or disaster or major accident, etc., leading to deaths of persons being away from family, the Government should create a 24x7 Helpline facility on the web portal to help the families of deceased persons for collection of body or to report any grievance regarding any unethical behavior such as assault or any inhuman conduct with the body of the deceased.
FORM Notice to Family Members for performing last rites ( see rule 4) To Mr./Mrs./Miss __________________, _______________________________ _______________________________ _______________________________ Subject :For performing last rites of the dead body.
WHEREAS the Officer-in-charge of Police Station ...................., District................., Rajasthan has informed me that the dead body of _______________________(Name of the deceased) is being used or likely to be used for remonstration purpose by you or your family or someone else and you are not willing to perform the last rites of the deceased, which is against the provisions of the Rajasthan Honour of Dead Body Act, 2023 (Act No. 21 of 2023).
On being satisfied by the report of the Officer-in-charge of Police Station, you are requested to perform the last rites of the deceased person within twenty four hours, failing to do so within twenty four hours, the last rites will be performed by the Public Authority. If you have sufficient reason for not performing last rites of the deceased within twenty four hours, you shall convey the same to the undersigned before the aforesaid twenty four hours.

2. प2रभाषाए.ं-(1) इन ;नयम+ मN, जब तक /क संदभK से अ&यथा अपेPQत न हो,- (क) ''अ�ध5नयम'' से राज=थान मतृ शर.र का स� मान अ(ध;नयम, 2023 (2023 का अ(ध;नयम स.ं 21) अ5भ'ते है;
(ख) ''काय6पालक मिज� 9ेट'' से भारतीय ना ग*रक सरुQा स�ंहता, 2023 कE धारा 14 या 15 के अधीन रा# य सरकार ,वारा ;नयुG त कायKपालक मिज= Tेट अ5भ'ते है; और (ग) ''�;प'' से इन ;नयम+ से सलंVन ' प अ5भ'ते है।
(2) इन ;नयम+ मN 'युG त /कंतु प*रभा2षत नह.ं /कये गये शX द+ और अ5भY यिGतय+ के वह. अथK ह+गे जो अ(ध;नयम मN उ& हN समनु�दZट /कये गये ह[।
3. लोक �ा�धकार=.- अ(ध;नयम के 'योजन के 5लए, लोक 'ा(धकार. ;न� न5लIखत ह+गे, अथाKत ् :-
(i) रा# य कE सम= त नगरपा5लकाएं;
(ii) रा# य कE सम= त पंचायतN; और
(iii)/कसी मतृ शर.र का अं;तम सं= कार संपा�दत करने के 5लए रा# य सरकार ,वारा, समय- समय पर, 2वशषे प से 'ा(धकृत कोई अ& य ;नकाय।
4. अं5तम स�ं कार संपा�दत करने के �लए नो�टस.- अ(ध;नयम कE धारा 7 के अधीन सूचना कE 'ाि]त पर, कायKपालक मिज= Tेट अ;ंतम स=ं कार संपा�दत करने के 5लए मतृक के कुटु� ब सद= य+ को नो�टस तामील करायेगा। नो�टस 2वशषे सदेंशवाहक, ई-मेल या अ& य /कसी इलGै Tा;नक ढंग के मा_ यम से इन ;नयम+ से सलंV न ' प मN भेजा जायेगा।
5. अ�पताल म> मतृ शर=र? का भडंारण.- (1) मतृ शर.र+ के भंडारण के समय, यह स;ुनि`चत /कया जायेगा /क मतृ शर.र+ को 5लगं के आधार पर अलग-अलग /कया जाये और ग*रमापणूK र.;त से रखा जाये।
(2) मतृक के व= > शव-पर.Qा कर रहे (च/कF सक ,वारा सगंहृ.त, पर.PQत साथ ह. प*ररPQत और महुरबंद /कये जायNगे और अ;त*रG त पर.Qण के 5लए संबं(धत 2व(ध 2वaान 'योगशाला को 'े2षत /कये जाने चा�हए। इसके अ;त*रG त, समु(चत प*रवहन के 5लए इसे 2वशषे बॉडी बVैस मN ढका जाना चा�हए। 215 राज=थान राज-प>, �दस� बर 04, 2025 भाग 4 (ग)
(3) अ= पताल 'शासन cबल+ के असंदाय के आधार पर /कसी मतृ शर.र को कX ज ेमN नह.ं रखेगा। अ= पताल मतृक के कुटु�ब को या लोक 'ा(धकार. को ग*रमापणूK र.;त से मतृ शर.र सdप देगा।
(4) शवगहृ का ;नय5मत पोचा और सफाई कE जानी चा�हए ता/क मतृ शर.र समु(चत और = वf छ पयाKवरण मN प*ररPQत रह सकN और मतृ श र.र+ कE ग*रमा बनायी रखी जानी चा�हए।
(5) अ= पताल 'शासन को नैदा;नक अ5भलेख+ कE गोपनीयता बनाये रखनी चा�हए और मतृक से संब(ंधत सूचना, 2वशषेत: उन मामल+, जो कल/ंकत या सामािजक प से आलो(चत ह[, कE रQा के 5लए एक त>ं होना आव` यक है।
(6) मरणोFतर पर.Qा कQ समा& य जनता/प*रदशKक+ कE सीधी hिZट मN नह.ं आना चा�हए। इसे सु;नि`चत करने के 5लए, मरणोFतर पर.Qा कQ मN पदाK, =iEन या ';तरोधक Qे> का 'बंध /कया जा सकेगा।
(7) शवगहृ 'शासन कमKचा*रव&ृ द को समय-समय पर सवंेदनशील बना सकेगा, मतृ शर.र के रख-रखाव और संवेदनशीलता के साथ मतृक के प*रचर+ के साथ Y यवहार करने का उ& हN '5शQण दे सकेगा।
6. मरणोBतर पर=.ा कC फोटो�ाफC और वीEडयो�ाफC.- (1) अदावाकृत मतृ शर.र का सम(ुचत अ5भलेख संधा*रत करने के 5लए उसकE फोटो�ाफE और वीjडयो�ाफE कE जायेगी, जो मतृ शर.र कE पहचान के 5लए उपयोग मN ल. जा सकेगी:
परंतु अदावाकृत मतृ शर.र के फोटो�ाफ डाटा ब[क ,वारा 'ाथ5मक पहचान सचूना के प मN उपयोग मN 5लये जायNगे जब/क वीjडयो पिुZटकार. 'योजन+ के 5लए उपयोग मN 5लये जा सकN गे:
परंतु यह और /क लापता Y यिGतय+ का पता लगाने के उपयोग के 5लए, डाटा ब[क वेब-पाटKल पर केवल फोटो�ाफ ह. अपलोड करेगा और वीjडयो�ाफE केवल तभी �दखायी जा सकेगी जब कोई Y यिGत अदावाकृत मतृ शर.र के कुटु� ब का सद= य होने का दावा करता है और ऐसा साcबत करता है।
(2) मतृ शर.र कE वीjडयो�ाफE और फोटो�ाफE विृFतक फोटो�ाफर ,वारा कE जायेगी, जो यह स;ुनि`चत करेगा /क उसके ,वारा ऐसे वीjडयो अ(ध;नयम और इन ;नयम+ मN 2व;न�दKZ ट 'योजन के अलावा /कसी अ& य 'योजन के 5लए 'युG त नह.ं /कये जायNगे।
7. डाटा बFक, वेब-पोट6ल और Eडजीटलाइजेशन.- (1) य�द /कसी Y यिGत का मतृ शर.र अदावाकृत रहता है तो ऐसा मतृ शर.र, जसैा /क अ(ध;नयम कE धारा 9 मN उिlलIखत है, अ= पताल मN भडंा*रत /कया जायेगा और शव पर.Qण दल से 2वशषेa मतृ शर.र से डीएनए स[पल सगंहृ.त करNगे और डीएनए 2वश ् लेषण के 5लए 'े2षत करNगे। डीएनए 2व` लेषण *रपोटK कE 'ाि]त पर वह सामा& य पहचान सचूना जसेै /क फोटो�ाफ, नाम इF या�द और अ&य जैव नमनू+ य�द कोई ह+, के साथ डाटा ब[क को अ�े2षत कE जायेगी:
परंतु अ= पताल मN भडंा*रत मतृ शर.र+ का अ(ध;नयम कE धारा 15 के उपबधं+ के अनसुार ;नपटारा /कया जा सकेगा।
(2) डीएनए 2व` लेषण *रपोटK कE 'ाि]त के प` चात ्डाटा ब[क, अ(ध;नयम कE धारा 13 के अधीन सिृजत वेब-पोटKल पर सामा& य पहचान सचूना को अपलोड करेगा िजससे लापता YयिGतय+ के साथ उपयुKGत डाटा 5मलान /कया जा सके।
(3) डाटा ब[क, वेब-पोटKल पर cबना पहचाने गये मतृ शर.र+ के मFृ यु के मामल+ का डाटासेट सधंा*रत करेगा।
(4) डाटा ब[क और वेब-पोटKल, रा# य 2व(ध 2वaान 'योगशाला, जयपरु ,वारा मानीटर और सधंा*रत /कये जायNगे।
