1. Short title—This Act may be called the Rajasthan Lepis lative Assembly (Officers and Members Emoluments) Act, 1956.
2‘. Interpretation.—(1) In this Act, unless the subject or context otherwise requires—
(a) “appointed day” means the first day of November, 1950,
(b) “member” means a member of the Legislative Assembly of the State other than an officer thercof or a Minister;
(C) “Minister” means a Minister of the State of Rajasthan and includes the Chief Minister as well as a Deputy Minister;
(d) “officer” wused with 1ecference to the Lepislative Assembly for the State, means the Speaker as well ag the Deputy Speaker of such Assembly; and
(e) “State” means the State of Rajasthan as formed by ;g]cgiforig})%)c‘)f the States Reorganisation Act, 1956 (Central Act Voo . (2) The provisions of the Rajasthan General Clauses Act, 1955 (Rajasthdn Act 8 of 1955) in force in the pre-reorganisation State of Rajasthan shall, as far as may ba, apply mutatis mutandis to this Act.
3. Salaries of Officers.—(1) Therc shall be paid—
(a) « salary of one thousand rupces per mensera to the Speaker, and
(b) a salary of eight hundred rupces per mensem to the Deputy Stcaker, of the Legislative Assembly of the State.
(2), The salary fixed by sub-section (1) shall be payable to the Speaker or Deputy Speaker, as the case may be, with effect {from the appointed day or with effect fron: the date on which he is chosen as such Speaker or Deputy Speaker under article 178 of the Constitution, whichever may be later, and until he vacates or resigns or is removed from his office as such Speaker or Deputy Speakcr in accordance with law.
4. Salaries of Members—~Every member of the Legislative Assembly of the State shall be entitled to receive a salarv‘qf two hundred rupees per mensem with effect from the date on which he makes and subscribes the oath or affirmation of his office under article 5 188 of the Constitution until he ceases to be such member:

8. Allowances of members.— (1) Subject to such conditions a.nd restrictions as may he prescribed, every member of the Legislative. A::f:':mh_ly shall be entitled 1o rceeive, for his attendance required in conncction with his duties ag such member,— ‘| (a) travelling (mileage) allowance at the rates admissible’ for the time being to Government servants of the first class in accofid;\nce with rules made in that behalf, and ’ \ (b) dally allowance at the rate of twelve rupees and eight" annas per diem:
Provided that no surn on account of any such allowance shall be paid toa member before he has made and subscribed the oath or aflirmation of his office prescribed by article 188 of the Constitution.
. (2) Notwithstanding anything contained in the proviso to sub- section (1) every member of the provisional Legislative Assembly of the State formed by virtue of section 28 of the States Reorganisation
9. Amenities.—Evcry member of the Legislative Assembly shall he entitled to such medical, housing, telephone and postal facilities * as may be prescribed. i
10. Officers not to practise profession ete.—An oflicer for the time being of the Legislative Assembly shall not, during the tenure of his office, practise any profession or engage in any trade or under- 3 take for remuneration any employment other than his duties as such - officer. .
11. Rules.— (1) The Sthte Government shall, by notification in the Official Gazetle, make rules for carrying out the purposes of this Act.
(2) In particular and without prejudice to the gencrality of the foregoing power, such rules shall— ' ;
(a) prescribe the conditions and restrictions subject to A which daily allowance may be drawn;
(b) prescribe the conditions under which and the journeys for which travelling allowances may be claimed; Ly ti

(e) prescribe the medical, housing, telephone and postal {acilities LO which members shall be enlitled;
(0 specify the circumslances in which and the extent to which the salary of a member may be deducted;
(g) lay down such other malters as may be or are required to be bruscribul by this Act.
12. Savings.—Nothing in this Act or in the rules made thereunder shall prevent uny olticer or member of 1vlu~ Lepislative Assembl or any Minister from receiving or baing entitled to receive in uddltion to the salaries and allowances to which he is entitled in accordance with Jaw, any pension, allowance or sulary lawfully permissible to him as a retired Government gervant or otherwise.
13. Repeal and Savings.—(1) The Rajasthan Legislative Assembly (Officers and Members moluments) Ordinance, 1956 (Rajasthan Ordinance IX of 1956), is hereby repealed.
(@ The said repeal shall not affect the rules made under' the Rajasthan Legislative Assembly (Officers and Members Emoluments) Act, 1952 (Rajasthan Act XV of 1952), in force in the pre-reorganisation State of Rajasthan and such rules as in force immediately before . the appointed day shall continue to be in force and shall be deemed, 3::iiétnew rules are made under this Act, to have been made there- PRABHU DAYAL\LOIWAL, ot Sectetary to the Government.
