Section 32: Points to be considered in assessing compensation

Each case shall be decided with due regard to the actual damage caused to the land of standing crops, the existing value of the land and the prevailing market rate of the crop damaged and the probable total loss to the claimant.

Damage to wells, walls, trees, houses and livestock, etc. shall also be assessed with due regard to the actual loss or inconvenience caused and shall not be less than the sum required to replace the property or to restore it to its original condition.
