In exercise of [he powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Rajasthan hereby makes the following rules further to amend the Rajasthan Medical & Health Service Kales. 1963, namtly:- ]. Short title ami commencement*- { I) These rules may he called the Rajasthan Medical & 1 leallh Service (. Amendment) Rules. 2012.

{2) They shall be deemed to have come into force with effect from I 1-07-201 I ,

2. Addition of new rule 24 It.- After the existing rule 24 A A o f the Rajasthan Medical & Health Service Rules, 1963* herein after referred to as the said rules, Ehe following new rule 24B shall be added, namelvt- “24H. Promotion under Dynamic Assured Career Progression (DACP) Scheme.- (1) .Notwithstanding anything contained in rule 25 and subject to the provisions of rule 24 R13. The Medical Officers having qualification o f the post o f Junior Specialist shall be promoted on the post o f Junior Specialist and others will be promoted on the posts indicated in item (a) of column 3.

(a) Senior Medical Officer including Dental / Deputy Chief Medical and Health Officer and equivalent post.

(b) Junior Special ist

(a) Deputy Director/ Chief Medical and Health Officer and equivalent post.

(b) Senior Specialist Six years service or more in the grade pay of Rs*6600/- or in the corresponding existing pay scale.

The Junior Specialist shall be promoted as Senior Specialist and others will be promoted on the posts indicated in item

(a) of column 3.

(2) The Senior Speciali.st shall be promoted on the post of Principal Specialist or Additional Director fUlcJ others will he promoted on the posts indicated in item (a) of column 3.

(3) The Principal Chief Medical Officer shall be posted in Districts/Zoiud Headquarters and on their posting in the Directorate they shall be designated as Additional Director.

(4) The Principal Specialist shall be posted in Hospitals and on their posting in the Directorate they shall be designated us Additional Director.

Exception: T Deputy Director/ Chief Medical and Health Officer and equivalent post holder/Senior Specialist who have completed total service of 18 years or more after regular appointment including two years service on the post o f Deputy Director/ Chief Medical and Health Officer and equivalent post/Senior Specialist in grade pay o f Rs.7600A as on 11.07.2011 shall be promoted on the post o f Principal Chief Medical Offlcer/PrincipaJ Specialist/Additional Director. Those who have not completed service o f two years on the post of Deputy Director/ Chief Medical and Health Officer and equivalent posi/Senior Specialist in grade pay of Rs.76G0/- as on

11.07,2011 shall be promoted on the post of Principal Chief Medical Officer/Principal Specialist/ Additional Director in grade pay o f Rs,8700/- as and when they completes service o f two years on the post of Deputy Director/ Chief Medical and Health Officer and equivalent posi/Senior Specialist.

2. The Medical Officer including Dental and who have completed service o f 12 years or more but Jess than 18 years as on 11.07.2011 after reguiar appointment as per the provisions o f the relevant recruitment rules and have been promoted under Finance Department Memorandum no. F.14 (9)FD/Rules/2011 dated 09.08.2011 on the post o f Senior Medical Officer including Dental/Deputy Chief Medical and Health Officer and equivalent post/Junior Specialist in grade pay of Rs. 6600A as on

The third DACP in grade pay of Rs.8700/- shall be admissible on completion o f service o f lour years instead o f 6 years in the grade pay o f Rs.7600/- subject to availability of vacant post as per prescribed ceiling of posts,

The Senior Medical Officer including Dcntal/Depufy Chief Medical and Health Officer and equivalent posi/Junior Specialist who have completed total service o f 18 years or more as on 11.07.20I I after regular appointment as per the provisions of the relevant recruitment rules and have also completed at least six years service in grade pay of Rs. 6600/- or in the corresponding existing pay scale as on 11.07.201!

and have been promoted tinder Finance Department Memorandum dated 09.08,2011 on the post of Deputy Direetor/Chict Medical and Health Officer and equivalent posts/Senior Specialist in grade pay of Rs.7600/- as on 11.07,2011 shall be eligible for promotion on the post o f Principal Chief Medical Officer/Addttional Director and equivalent posts/Prlncipal Specialist in (he grade pay of Rs.870f)/- after completion of service o f two years instead of six years in grade pay o f Rs. 7600/- subject to availability of vacant post as per prescribed ceiling o f posts.

(2) The Promotion under Dynamic Assured Career Progression (DACP) Scheme shall be made whether vacancy is available or not except In the grade pay of Rs, 8700/'.

(3) For the purpose o f this rule, regular service means and includes service by a government servant on the appointment after regular selection in accordance with the provisions contained in the relevant recruitment rules for that post. The period o f service rendered on ad-hoc basis/urgent temporary basis shall not be counted as the regular service. In other words, the period of service which is countable for seniority shall only be counted as regular service.

(4) After 11,07.2011 the members o f the service who are entitled for limit o f Dynamic Assured Career Progression (DACP) Scheme shall not be eligible to take benefit o f the rule 24 and 24A o f these rules."

3. Addition of new rule 24BB-- After rule 24B, so added, o f the said rules, the following new rule 24BB shall be added, namely:- ”24BB. Procedure fur granting Dynamic Assured Career Progression (DACP).- (1) The Secretary to Government in Medical and Health Department shall on 1st April o f every year prepare a list o f the members of the service, who are eligible for Dynamic Assured Career Progression (DACP) in the year.

(3) The Government may is s u e instructions fa r provisionally den liny, w i t h granting <ij' Dynamic Ass n u rd Career Progression (DACP) or o L h e r ancillary matters in an equitable Lind fair manner of persons who may he under suspension, or against w h o m depart menial proceeding is under progress, at the lime granting DACP are considered to a post to which they are eligible or w o u ld have been eligible but lor such suspensions or pendency o f such enquiry or proceedings,

(4) Notwithstanding anything contained in rule 6 and 9, if there is no vacancy for granting DACP available, the post held by the candidate shall be converted into the post on which The candidate is lo be promoted till he/she will hold lhat post.
