Part I Scope of orders These orders shall come into force in accordance with Section 7 of the Industrial Employment (Standing Orders) Act, 1946 and shall apply to all workmen as defined in section 2(i) of the said Act and employed in or in connection with Dairy Plants, Chilling Centers, Feed Factories, Livestock and Agriculture Farms, Semen Banks and others ancilliary units (existing or to be created in future) by Rajasthan Co-operative Dairy Federation Limited.
Part II Definitions :
(a) Federation : Federation means, the Rajasthan Co-operative Dairy Federation Limited registered under the provisions of the Rajasthan Co-operative Societies Act, 1965.
(b) Managing Directors : means the Managing Director of the Rajasthan Co-operative Dairy Federative Limited.
(c) Manager : means head of the Unit viz. Manager, General Manager and Dy. Manager and includes the acting Manager for the time being.
(d) Head of the Section : means the officers-in-Charge of the Section of a unit.
(e) Section : means any part of the unit or establishment.
(f) Employer : means the authority appointed by the Rajasthan Co-operative Dairy Federation Ltd. In this behalf and where no such authority is appointed, the head of the unit.
(g) Notice Board : means the displaying board or boards maintained for the purpose of displaying notices in the factory/establishment.
(h) ‘Workman means a workman as defined in Section 2(i) of the Industrial Employment (Standing Orders) Act, 1946.
(i) Words denoting the ‘Singular number’ shall include plural and words denoting masculine gender shall include the ‘Famine gender’.
Part III. Classification of Workmen :
(a) Permanent
(b) Probationer
(c) Temporary
(d) Badli or substitute
(e) Casual
(f) Apprentice or trainee.
(a) ‘Permanent’ workmen is a workmen who has been engaged on a permanent basic and includes any person who has satisfactorily completed the probationary period prescribed in clause (b) of this order.
(b) A Probationer’ is a workman who is provisionally employed to ascertain his suitability and fitness to fill a permanent vacancy and has not completed the probationary period prescribed by the Manager. Provided that the period of probation can be extended by the Manager for a further period of six months if the suitability and fitness requires the same.
(c) A ‘temporary’ workman is one who is engaged for work which is of a temporary nature and likely to be finished within six Months.
(d) A ‘Badli’ or ‘substitute’ is one who is appointed in the post of a permanent workmen or a probationer who is temporarily absent.
(e) A casual’ workman is a workman whose employment is of a casual nature.
(f) An ‘Apprentice’ or ‘ trainee’ is a learner who may or may not be paid an allowance during the period of his training, without any obligation on the part of the employer to provide him work after the training.
Part IV. Each / of the above category of workmen shall be further classified for the purpose of purpose of these orders as follows :-
(i) Monthly rated paid workmen i.e. workmen whose salaries or wages are calculated at a monthly rate and who are paid monthly.
(ii) Daily rated workmen i.e. workmen whose salaries or wages are calculated at daily rate and who are paid monthly.
(iii) Piece rate workers, i.e. those who are employed for work on piece rate basis for which payment is made to them on the basis of their output of work. The schedule of piece work and rates shall be notified on the notice board and payment shall be made to the workers monthly.
Part V. Recruitment & Promotion.
Recruitment & Promotion to the various categories of posts and grades therein shall be made in accordance with the Rules appended with these rules and made hereafter by the Federation from time to time.
Part VI. Identity Cards, Temporary permits, Entry, Exit and Search :
(a) Every workmen whether permanent , probationer, temporary , casual, apprentice or trainee or badli shall be issued an Identity card or temporary permit, provided that in the case of casual workmen who have to work for a very limited period a temporary permit may be issued, in the name of the Section officer concerned to cover a group of them. The identity card/ or temporary permit issued to an individual workman shall bear the workman name. designation, signature any identity marks and his photograph and shall be signed by the authority duly authorized by the manager in this behalf.
(b) The identity cards and temporary permits shall serve as individual Gate passes permitting the holders thereof to enter and remain within the premises of the works posted in connection with their work.
(c) The initial issue of identity cards/temporary permits shall be free of charge. If the identity card/temporary permit is lost or damaged by the workmen, he shall be liable to pay a sum of rupee one for the issue of a new identity card and a sum of 25 paise for the issue of a new permit.
(d) Identity cards/temporary permits are not transferable and shall be valid only in respect of the particular workman in whose favour it is issued.
(e) Every workman shall keep in his possession identity card/ temporary permit issued in his favour and he shall show it to any person authorized to inspect it, while the workman is entering or leaving, the establishment or the workshop at any gate put up for the purpose of checking or while in his workshop or the precincts thereof and shall subject himself to search as may be desired by Manager.
(f) The identity card / temporary permit issued to a workman shall remain the property of the Federation and every workman shall, on the termination of his services including retirement or on suspension from service, surrender it to Manager.
(g) If a workman, who surrenders his identity card / temporary permit as a result of suspension from service by the order of the employer is required to attend the establishment at his request or under instruction from him a temporary permit shall be issued in his favour.
(h) A workman who looses his identity card / temporary permit shall report the loss immediately to the Manager.
Part VII. Publication of working times :
The period and hours of work and intervals for rest for all classes of workman in each shift. Each section and weekly days of rest shall be exhibited in Hindi and English on the notice board.
Part VIII. Notice of instructions regarding attendance, departure’s etc :
All workman shall comply with instructions issued from time to time relating to the recording of time of arrival for work and departure from the place of work, notified on the notice board.
Part IX. Attendance and late coming :
(a) Every workman shall be present at his place of work at the commencement of his shift or hours of duty as may be notified.
(b) Those workmen who are required to sign in a register maintained for the purpose shall do so at the time of reporting for work and also at the time of leaving the establishment on cessation of his shift or hours of work.
(c) While reporting for work, the workmen shall be at the time office atleast before five minutes of the scheduled hour and be at his work till the schedule hour.
(d) Workman attending late by more than fifteen minutes shall be liable to be sent out and treated as absent.
(e) The wages of workmen coming late, or leaving early, with prior permission, will be liable to corresponding deduction, as provided for under the payment of Wages Act, 1936 as amended from time to time.
(f) Any workmen found absent from his place of work during his working hours without permission shall be liable to be treated as absent for the whole day and also liable for disciplinary action.
X. Shift Working :
(a) More than one shift may be worked in any plant or section of an establishment at the discretion of the Manager or General Manager. Notice showing the shifts worked in each plant or Section of an establishment shall be pasted on the notice board of the plant or section concerned .
(b) The Manager shall be entitled by notice to be pasted on the notice board of the plant or section of the establishment concerned to alter or vary the shifts and the hours of working of each shift, at its discretion and workman shall be liable to be transferred from one shift to another, at the discretion of the Manager.
(c) Workman shall not change their shifts without permission of the head of the section concerned.
(d) Shift working may be discontinued or the number of shifts reduced at any time, with notice of 21 days in accordance with Section 9A of the Industrial Disputes Act. If as result of discontinuance of shifts or reduction in the number of shifts, any number of workman whether permanent or temporary is likely to be discharged the Manager shall follow the principles of ‘last come first go” and apply this principle in accordance with the provisions of the Industrial Disputes Act, 1947 as amended from time to time.
(e) If shift working is re-started or the reduction in the number of shifts is restored, the Manager shall give a week’s notice thereof by posting such notice at the main entrance of the establishment and the Time Keeper’s office, if any.
Part XI Publication of Wage Rates :
Rates of wages payable to all classes or workmen in the various categories and grades shall be displayed on the notice board.
Part XII. Safety and Sanitary precautions :
Every workmen shall observe all safety and sanitary rules, regulations and orders as notified from time to time and use safety and sanitary equipment and device provided for the purpose.
Part 13. Periodical medical examination :
Every workmen shall submit himself for periodical medical examination as and when required by the Manager.
Part 14. Festival Holidays :
There shall be eight festival holidays with wages. Out of these eight days, the Republic Day.
Independence Day and Mahatma Gandhi’s Birthday shall be allowed without option and the rest of the days shall be fixed by consultation or local custom, which shall be notified in the month of January every year.
Part 15. Transfer Workman may by transferred due to exigencies of work form one Dairy, Department, Section or job to another belonging to the Federation provided that the pay, grade, continuity and conditions of service are not adversely affected by such transfers.
Part 16. Leave :
(i) Annual leave with wages will be allowed according to provisions in Chapter VIII of the factories Act, 1948.
(ii) A worker who desired to obtain leave of absence shall apply to the Manager in writing stating therein the purpose for which leave is requested. The period of leave and also the address where the leave is sought to be enjoyed shall be stated in the application.
(iii) Application for leave must in normal case be made a week before the date the leave is to commence and the applicant shall not enjoy such leave unless it is sanctioned in writing.
(iv) In case of refusal to grant the leave the authority refusing leave shall also state the reason for such refusal in the register to be maintained for the purpose. If the applicant so desires, a copy of the entry in the register shall be supplied to him.
(v) Application for leave in continuation or an extension of the leave already availed of must in all cirmumstances as far as possible be made well in advance to ensure reply before the original leave expires. Address shall be given when the reply is requested.
(vi) Absence beyond the period of the original leave or extension if not granted shall render the workman as absentee and he shall loose his lien in his appointment unless :-
(a) He returns within eight days of the expiry of the leave and
(b) Explains to the satisfaction of the Manager of his inability to return in time.
(vii) Leave account of the workers shall be maintained by the Manager.
17. Casual Leave :
A workman, who has completed 240 days in a calendar year shall be granted casual leave of absence not exceeding 10 days in the aggregate in the subsequent calendar year. Such leave shall not be for more than three days at a time except in case of stickness. Such leave in intended to meet special circumstances, which cannot be foreseen. Previous permission of the Departmental or sectional head of establishment shall be obtained before such leave in taken.
18. Maternity leave will be regulated by the Rajasthan Maternity Benefit Act, 1953.
19. Age of Supermauation :
The age of retirement on supermanuation of a workman shall be 58 years.
20. Retrial Benefits :
The retirement benefits will be paid in accordance with the Payment of Gratuity Act, 1972 and Employees Provident Fund Act, 1952.
21. Lay off and Retrenchment Lay off and retrenchment shall, where applicable, be governed by the provisions of the Industrial Disputes Act, 1947. As amended from time to time.
22. Termination of employment :
(1) For terminating employment of a permanent workman, one month’s notice in writing shall be given either by the employer or the workman or one month’s pay may be paid in lieu of notice, as the case may be.
(2) Workman employed on a special contract shall be governed by the terms of that contract.
(3) The services of a workman shall not be terminated as a punishment unless he has been given an opportunity of explaining the charges of misconduct alleged against him, in the manner prescribed in Rule No. 26.
(4) The services of the workman having continuous absence for more than 7 days without permission or without satisfactory cause shall automatically stand terminated and his lien to the service will stand broken.
(5) A probationer shall not be entitled to any notice or pay in lien thereof if his services are terminated.
23. Payment of wages :
(a) All workmen shall be paid wages before the expiry of the 7th or 10th day after the last day of the wage period in respect of which wages are payable according to the total number of workmen employed in the establishment in accordance with the provisions of the payment of Wage Act, 1936.
(b) Any wages due to a workman, but not paid on the usual pay day on account of their being unclaimed shall be paid on an unclaimed wages pay day in each week, which shall be notified on the notice board.
(c) If a workman so desired in writing his unpaid wages or other dues shall be remitted to his address by money order after deducting there from charges for money order commission.
(d) Where the employment of any workman is terminated by or on behalf of the Federation, the wages earned by him up to the date of such termination shall be paid to him before the expiry of the second working day from the day on which his employment is terminated.
24. Certificate on termination of Service :
Every permanent workman shall be entitled to a Service Certificate at the time of his dismissal, discharge or retirement from service.
25. Stoppage of work :
(1) The manager may, at any time in the event of fire, catastrophe, breakdown of machinery or stoppage of power supply, dislocation of procurement of milk, distribution of milk caused by failure of conveyance or accidents, epidemics, civil commotion or other cause beyond his control, stop any section or sections of the establishment, wholly or partially for any period or periods without notice.
(2) In case where workmen are laid off for short period on account of failure of plant or for temporary curtailment of production the period of unemployment shall be treated as compulsory leave admissible to the workman. When, however, workman have to be laid off for indefinitely long period, provisions of the Industrial Disputes Act relating to lay off or retrenchment, as the case may be, shall apply.
(3) The Manager may in the event of a strike affecting either wholly or partially any section or department of the establishment, close down either wholly or partially such section or department and any other section or department affected by such closing down. The fact of such closure shall be notified by notices put on the notice board in the section or department concerned and in the time-keepers office, if any, as soon as practicable. The workman concerned shall also be notified by a general notice, prior to resumption of work, as to when work will be resumed.
26. Disciplinary action for misconduct The following punishments may for good and sufficient reason, be imposed upon any workman serving in any unit of the Federation :
(a) Minor penalties :
(i) Censure.
(ii) Withholding of increments with or without cumulative effect.
(iii) Debarring from promotion
(iv) Recovery from pay of the whole or any part of pecuniary losses caused to the Federation by negligence or breach of Orders.
(b) Major Penalties :
(i) Reduction to a lower post or to a lower stage in the time scale.
(ii) Compulsory retirement.
(iii) Removal from service.
(iv) Dismissal from service.
Explanation : (i) Discharge.
(a) Of a person appointed on probation before the expiry at the end of the prescribed of extened period of probation or.
(b) Of a person engaged under contract, in accordance with the terms of his contract or
(c) Of a person appointed otherwise than under contract to hold temporary appointment on the expiration of the period of appointment, does not amount to removal or dismissal within the meaning of this regulations.
(ii) The removal of a person from the service of the Federation shall not disqualify him from future employment but dismissal shall disqualify him from future employment.
(1) The minor penalties as stated above can be imposed for any of the following acts or omissions thereof :
(i) Collection or canvassing for collection without the written permission of the management, of any money within the workspot or the precincts of the workspot, including collection of union subscription in the works premises.
(ii) Habitual late attendance.
(iii) Habitual absence without leave or without sufficient cause or continuous absence for more than ten days without leave or without satisfactory cause.
(iv) Absence from the place of work during working hours without permission or when permission is refused and loitering or talking in groups without attending to duty within the premises of the unit, Dairy workshop, factory or any other premises of the unit.
(v) Lending or borrowing money to or from another workman, or carrying on money lending or any other private business within the precincts of any of the workspots.
(vi) (a) Failure to observe safety and security instructions.
(b) Habitual breach of any law or rules or instructions for the maintenance and cleanliness of the establishment.
(c) Committing a nuisance while on duty at any place in the factory premises.
(vii) Attending or holding meetings within the boundaries of the establishment, or the dairies, or within the area required and owned by the Federation or at a place other than that specified for the purpose of union.
(viii) Gambling within any of the works site or in premises belonging to the Federation of Federation/unit.
(ix) Sleeping or dozing while on duty.
(x) Malingering
(xi) Unauthorized use of any property, machinery, tools, quarters or land belonging to the Federation/unit.
(xii) Acceptance of gifts from subordinates.
(xiii) Habitual indebtedness.
(xiv) Insolvency.
(xv) Writing of anonymous or pseudonymous letters criticizing superior in the service of the Federation.
(xvi) Spreading of false rumour or giving of false information which tends to bring into disrepute the Federation/Unit of its workmen or spreading panic among them.
(xvii) Abetment of or attempt at abetment of any of the above acts of misconduct.
(xviii) Not submitting to search by Manager or any persons authorised by him.
(2) A workman may be penalised by way or reduction to a lower rank or lower grade, compulsory retirement, removal or dismissal from service if he is found guilty of misconduct, The following acts and omissions shall be treated as misconduct.
(i) Wilful in subordination, disobedience or misbehaviour whether alone or in combination with any other person or persons, of any lawful and reasonable order of superior.
(ii) Striking work of inciting others to strike in contravention of the provisions of any law or rule having the force of law.
(iii) Theft, fraud, malpractice, dishonesty in connection with the Federation’s business or misappropriation of cash or property of the Federation/Unit.
(iv) Taking or giving of bribes or any illegal gratification whatsoever.
(v) Quarelling, abusing, teasing, threatening, wrongfully restraining, beating or assaulting a worker, officer or any body also in the service of the Federation or any act subversive of discipline.
(vi) Habitual negligence or neglect or work and habitual indispline.
(vii) Coming on duty in drunken state or drinking liquor or in intoxication while on duty or being found drunk during working hours.
(viii) Wilful disobedience of any order expressly given or any rule expressly framed for the purpose of securing safely, or unauthorised and wilful removal and damage to machines, facing or disregard or interference with, any safety guard, or other device provided for securing safety of lives and property.
(ix) Causing willful wastage or willful damage to work in process, or any property or asset of the Federation committing a congisable or non-congisable offence or involved in an offence of moral turpitude.
(x) Theft of property belonging to any other workmen, or from any of the workspots or any premises belonging to the Federation.
(xi) Carrying concealed weapons, or threating, intimidating or attempting bodily injury to any workmen of the Federation.
(xii) Disclosing to any unauthorised person/persons confidential information regarding the working of, or any process used in any of the manufactures or construction undertaken by the management, which comes into his possession during se of his work or otherwise.
(xiv) Wilful slowing down in performance of work.
(xv) All the acts and omissions for which minor penalties can be imposed under clause (I) above.
(27) Procedure for awarding minor penalties.
In case where it is proposed to impose any of the minor penalties on any workmen as provided in Rule 27(a) he shall be given a statement of Allegations and a reasonable opportunity of making any representation that he may desire to make and such representation if any shall be taken into consideration before the order imposing the penalty is passed.
28. Procedure for awarding major penalties :
(a) A person against whom action is proposed to be taken for a major penalty, shall be provided with a copy of the charge or charge as well as a statement of allegations that have been made against him and about which enquiry Qs proposed to be held. Such copy of charge sheet and allegations shall be delivered in person and if he refuses to accept the same, it shall be sent under postal certificate to the employee’s permanent address available and recorded with the Federation and such an issue of charge sheet under postal certificate shall be conclusive proof of service of the charge sheet and statement of allegations on him and no plea of non-receipt against this shall be admitted.
(b) The person charged shall be required within a period of 15 days of the receipt of the charge sheet by him to put in his written statement of the defence giving a complete list of documents and defence witnesses. If no such statement is furnished by the person charged with the prescribed time and unless extended, it shall be presumed that the person charge sheeted admits his guilt and the competent authority is within its right to pass final ex-parte orders against him in the enquiry.
(c) if after furnishing the writing statement the person charged desires to see the relevant documents such of the documents as are being taken into consideration or are to be replied upon for the purpose of supporting the charge/charges any at the discretion of the Enquiry Officer be shown to him.
(d) The person charged shall also produce all the relevant documents required by him in his defence together with a list of his defence witness if any alongwith his written statement so that the enquiry may not be delayed unnecessarily. However, the Enquiry Officer may admit evidence of relevant documents if any even at a later stage of the enquiry by either side before the final orders are passed by the officer provided he finds that such documents provide necessary evidence for arriving at a fair decision.
(e) Oral evidence may be recorded by the Enquiry Officer if he permits any witness to be produced by either side. After the person charged has presented his written statement as per clause (b), the evidence of the prosecution shall be recorded first and thereafter the defence evidence shall be recorded.
All such statements shall be read over to the witness and then signed by the witness. If the witness is illiterate then his thump impression shall be taken and the enquiry officer shall also sign the same in proof of the same being read over to him and admitted to be correct by the witness.
(f) Normally it shall be responsibility of the prosecution and defence to produce their witness by themselves unless the enquiry officer otherwise directs the summoning of the witnesses through its agency but unnecessary adjournments shall not be given for calling or appearances of witness which may prolong enquiry and defeat the justice.
(g) The expenses of witness, if any, called by the Federation to given evidence against the person charged shall be borne by the Federation and the expenses of witness called by, or at the instance of the person charged shall be borne by him.
(h) The competent authority, on the basis of its own findings or on those of the Enquiry Officer, shall pass such orders as he may deem fit provided that before the competent authority passes the final order imposing the penalty of dismissal or removal, the person concerned shall be supplied with a copy of the findings of the enquiry officer, as the case may be and give a 15 days notice to show cause why the penalty should not be imposed.
(i) Every order imposing a penalty on the Federation Employees shall be communicated to him in writing.
(3) The procedure laid down in sub-clause 2 need not be followed and all or any of its provisions may be waived in the following cases :
(i) When the person charged is a temporary employee;
(ii) When the person charged admits the charges;
(iii) When the order of punishment i.e. dismissal, removal or reduction is to be passed on facts which have led to the conviction of the person charged in a criminal court.
(iv) When the person charged has been absenting or when it is for other reasons impracticable to communicate with him.
29. Suspension :
(a) A workman may be placed under suspension when:
(i) An enquiry into grave charge of suspected disobedience malpractice or misappropriation is contemplated or is pending or during enquiry his continuance in service is considered to be determental to the interest of the Federation or;
(ii) A complaint against him on any criminal offence involving moral turpitude is under investigation or trial and if such suspension is necessary in the public interest.
(b) An order of suspension under clause (a) may be revoked at any time by the authority making the order or any authority to which it is subordinate.
(a) A workman who is placed under suspension under clause (a) Shall, during the period of such suspension be paid a subsistence allowance at the following rates, namely;-
(i) Where the enquiry contemplated or pending is departmental the subsistence allowance shall for the first ninety days from the date of suspension be equal to one half of the basic wages, dearness allowance and other compensatory allowance to which the workman would have been entitled if he was on leave with wages. If the departmental enquiry gats prolonged and the workman continues to be under suspension for a period exceeding ninety days, the subsistence allowance shall for such period be equal to three-fourths of such basic wages, dearness allowance and other compensatory allowance.
(ii) Provided that where such enquiry is prolonged beyond a period of ninety days for reasons directly attributable to the workman, the subsistence allowance shall, for the period exceeding ninety days, be reduced to one fourth of such basic wages, dearness allowance and other compensatory allowance.
(iii) Where the enquiry is by an outside agency or as the case may be, where criminal preceedings workman are under investigation or trial the subsistence allowance shall, for the first one hundred and eighty days from the date of suspension, be equal to one-half of his basic wages dearness allowance and other compensatory allowance to which the workman would have been entitled to which was on leave. If such enquiry of criminal proceedings gets prolonged and the workman continues to be under suspension for a period exceeding one hundred and eighty days, the subsistence allowance shall for such period be equal to three-fourth of such wages.
Provided that where such enquiry or criminal proceeding is prolonged beyond a period one hundred and eighty days for reasons directly attributable to the workman, the subsistence allowance shall for the period exceeding one hundred and eighty days, be reduced to one-fourth of such wages.
(d) if on tha conclusion of the enquiry the workman has been found guilty of the charges or any of the charge framed against him, he shall be deemed to have been absent from duty during the period of suspension and shall not be entitled to any remuneration for such period, and the subsistence allowance already paid to him shall not be recovered.
(e) If on the conclusion of the enquiry, the workman has been found to be not guilty of any of the charges framed against him, he shall be deemed to have been on duty during the period of suspension and shall be entitled to the same wages as he would have received if he had not been placed under suspension, after reducing the subsistence allowance already paid to him for such period.
(f) The payment of subsistence allowance under this standing order shall be subject to the production of a certificate by the workman concerned not taking any employment during the period of suspension.
(g) In awarding punishment under this order, the authority competent to inflict the punishment shall taken into account the gravity of misconduct, the previous record if any, of the workman, or any other extenuating or aggrating circumstances that may exist.
(h) A copy of the final order passed on the memorandum of charges served on the workman shall be delivered to him or dispatched to his last known address, by registered post.
28. Recovery of loss by the Federation :
Any losses suffered by the Federation, by the carelessness, negligence of any act of ommission by a workman may be recovered by the Federation from the workman, subject to the provision of the payment of wages Act, 1936.
29. Deduction :
Subject to the provisions of payment of wages Act, 1936 deduction from wages shall be made only for the following reasons :
1. Fines.
2. Absence from duty.
3. Damage to or loss of goods expressly entrusted to the workman for custody, or for loss of money for which he is required to account where such damage or loss is directly attributable to his neglect or default.
4. House accommodation supplied by the Federation.
5. Amenities and services supplied by the Federation or the prescribed authority & authorised under payment of Wages Act by general or special order.
6. Recovery of advance or adjustment of over payment of wages.
7. Income-tax payable by the workman.
8. Deductions required to be made by order of a Court or other authority competent to make such order.
9. Subsriptions to, and for repayment of advances from Provident Fund.
10. Payment due to approved Co-operative Societies.
11. Payment of Insurance Premium or deposits for cumulative Deposit Scheme, as authorised by the workman.
Note : Deduction for absence from duty may be made in accordance with the payment of Wages Act and the Rules there under for the time being in force.
30. Fines.
1. No fine will be imposed except in accordance with provision of the payment of Wages Act for the time being in force.
2. No fines shall be imposed unless workman concerned has been given an opportunity showing cause against the fine and unless the provisions of the Payment of Wages Act and the rule thereunder in relation to fines have been complied with.
31. Complaints :
All complaints arising out of employment including those relating to unfair treatment or wrongful execution on the part of the employer or his agent shall be submitted to the Manager or other person specified in this behalf with the right to appeal to the employer.
32. Power of different authorities :
All power conferred on any employee of the Federation under the Standing Orders, shall also be exercisable by any other authority or employee of the Federation superior to him.
33. Interpretation :
If there is any conflict between the Hindi version and English version, the English shall prevail.
34. Liability of the management :
The Manager or any other responsible officer nominated by the Federation shall be held responsible for the proper and faithful observance of these Standing Orders.
35. Exhibition of Standing Orders :
(a) A copy of these order in English and in Hindi will be pasted in the Managers office and on the notice board maintained at or near the establishment and shall be kept in a legible condition.
(b) A copy of the Standing Orders shall be supplied to each individual worker on demand at a cost of Rs. 1/-
36. Display of notices :
(i) Copies of all notices required by the Standing orders and instruction to be given by the Federation to its workman shall be pasted on the Notice Board and when so pasted shall be deemed to have been served on employee/employees for whom they are intended.
(ii) All notices required to be pasted under these Standing Orders shall be in Hindi an in English and shall be kept in a legible and clean condition.
37. Repeal :
(i) All rules/regulations corresponding to these rules and in force immediately before the commencement of these rules shall be repealed, and any action taken under those rules/regulations shall be deemed to have been taken under the corresponding provisions of these rules, If any questions arises relating to the interpretation of these rules, the matter shall be referred to the Managing Director whose decision thereon shall be final.
