Section 446: Consequence of Appellate Court annulling a sentence and ordering retrial

(1) When an Appellate Court annuls a sentence and directs that the prisoner be retried, and a warrant for the prisoner's release on bail is not received, the prisoner shall be remanded to the under-trial yard (unless he be undergoing some other sentence), and the Superintendent shall apply to the committing court for warrant for his custody pending trial if such warrant is not at the same time furnished.
(2) Such warrant should set forth the Court by which the prisoner is to be tried and the date on which he is to be produced before the Court.
