And Whereas, the Kite-Flying thread means any thread/string/cord/filament used for flying kites and use of Kite-Flying thread made of nylon, plastic, or other synthetic materials, including any thread coated with glass, metal, or other sharp/abrasive substances (commonly known as Chinese Thread / Chinese Manja or any other names), poses a serious threat to human life, animals and birds, frequently causing grievous injuries and fatalities;
And Whereas, such threads are non-biodegradable and cause environmental pollution besides may create hazards to electricity transmission lines, resulting in power disruptions, accidents, and damage to public infrastructure;
And Whereas, bird activity is generally at its peak during morning hours between 6:00 AM to 8:00 AM and evening hours between 5:00 PM to 7:00 PM, during which the risk of fatal injuries to birds from sharp Kite-Flying threads is significantly high;
And Whereas, the Hon’ble National Green Tribunal, Principal Bench, New Delhi, vide its order dated 11.07.2017 passed in Original Application Nos. 384 of 2016 and 442 of 2016, has issued directions prohibiting the manufacture, sale, storage, purchase and use of Kite-Flying threads made of nylon, synthetic material or coated with synthetic substances, being non-biodegradable in nature, in order to safeguard the environment, wildlife and public safety;
And Whereas, the Ministry of Environment and Forests, Central Government has, vide its notification number S.O. 152(E) dated 10th February, 1988, delegated the powers vested in it under section 5 of the Environment (Protection) Act, 1986 (Central Act No. 29 of 1986) to the State Government of Rajasthan;
And Whereas, the State Government is of opinion that in view of likelihood of a grave injury to the environment, it is expedient to issue directions under sub-rule (5) of rule 4 of the Environment (Protection) Rules, 1986 for the said purposes without providing an opportunity to file objections against the directions;
13 राजè थान राज-पğ, अĤेल 22, 2026 भाग 4(ग) Now, therefore, in exercise of the powers conferred by section 5 of the Environment (Protection) Act, 1986, read with sub-rule (5) of rule 4 of the Environment (Protection) Rules, 1986, and in suppression of all orders and notification issued in this regard and in compliance with the aforesaid directions of the Hon’ble National Green Tribunal, the State Government hereby directs that,-
1. There shall be a complete ban on the manufacture, sale, storage, supply, import, transportation, and use of Kite-Flying thread made from nylon, plastic, or any other synthetic material, including thread popularly known as Chinese Thread / Chinese Manja/ any other names, and any cotton thread that is made sharp by coating or lacing with glass, metal, or any other sharp or abrasive substances, within the State of Rajasthan.
2. The prohibition shall not be applicable on plain cotton thread which is free from glass, metal, sharp/abrasive substances, adhesives, or any other thread-strengthening or abrasive materials.
3. The following officers shall implement and enforce the provisions of this notification within their respective jurisdictions:-
(i) All Executive Magistrates in the State of Rajasthan, not below the rank of Naib Tehsildar;
(ii) All Forest Officers, not below the rank of Forest Ranger Officer;
(iii) All Police Officers, not below the rank of Sub-Inspector;
(iv) All Officers, not below the rank of Chief Municipal Officers in Municipality;
(v) All Officers, not below the rank of Assistant Environment Engineers in the Rajasthan State Pollution Control Board.
4. The Chairman and Member Secretary, Rajasthan State Pollution Control Board shall periodically review enforcement reports of above directions.
5. District Collectors and Sub-Divisional Magistrates shall ensure effective implementation and initiate necessary action based on inputs received from officers of Revenue, Forest, Police and Municipality.
6. Any violation of said directions shall be punishable under section 15 of the Environment (Protection) Act, 1986.
