1. सकं्षिप्न न तां और प्रारं .- (1) इं अधिननयाम का नाम राजस् थान तकनीकी विश् िवि्याायया की विधियााश (ंशो िन) अधिननयाम, 2018 ह ।
(2) याह तरुन् त ्रवितत्त ह गा। अध् याय 2 बीकाने तर नकन तीकव वि िवि्यायय अिधनन तयं , 2017 ं प सशंोधन त
2. 2017 के राजस् थान त अिधनन तयं स.ं 29 कव धारा 11 का सशंोधन त.- बीकानेर तकनीकी विश् िवि्याायया अधिननयाम, 2017 (2017 का अधिननयाम ंश. 29) की िारा 11 में,-
(i) वि्यामान उप-िारा (2) के स् थान पर, ननम् नलयखित ्रवनतस् थावपत यकयाा जायेागा, अथाषत - ''(2) क ई भी व् याक्तत कुयपनत के ूपप में ननयातु त यकयाे जाने के लयए पात्र नह श ह गा जब तक यक िह यकंी विश् िवि्याायया याा महावि्याायया में तकनीकी लोक्षा के क्षते्र में आचायाष के ूपप में न् यानूतम ं िर्ष का अनभुि रिने िाया याा यकंी भी ्रवनतक्ठित ो ि और/याा ो क्षखणक 2 ्रवोांननक ंशगिन में यकंी ंमकक्ष प पर ं िर्ष का अनभुि रिने िाया क ई ्रवख् याात लोक्षावि् नह श ह ।''
(ii) उप-िारा ( ) में, वि्यामान अलभव् याक्तत '' ेो'' के पश् चात और वि्यामान अलभव् याक्तत ''में उ् चतर'' के पिूष वि्यामान अलभव् याक्तत ''और वि ेो'' हाायाी जायेागी
(iii) उप-िारा (10) में, वि्यामान अलभव् याक्तत ''प के कत ् या के'' के पश् चात और वि्यामान अलभव् याक्तत ''ननिषहन के लयए'' के पिूष, अलभव् याक्तत '', राज् या-विश् िवि्याायया के यकंी भी अन् या कुयपनत ्िारा,'' अशत स् थावपत की जायेागी और
(iv) वि्यामान उप-िारा (1 ) के पश् चात , ननम् नलयखित नयाी उप-िारा ज डी जायेागी, अथाषत - ''(17) उप-िारा (3) में अशतविषठ ा यकंी बात के ह त े हुए भी, विश् िवि्याायया का ्रवथम कुयपनत, कुयाधिपनत ्िारा, राज् या ंरकार ंे परामोष के पश् चात , तीन िर्ष ंे अनधिक की कायािधि के लयए, ऐंे ननबशिन और ोतों पर, ज कुयाधिपनत अििाररत करे, ननयातु त यकयाा जायेागा।''। अध् याय 3 राजस् थान त नकन तीकव वि िवि्यायय अिधनन तयं , 2006 ं प सशंोधन त
3. 2006 के राजस् थान त अिधनन तयं स.ं 8 कव धारा 11 का सशंोधन त.- राजस् थान तकनीकी विश् िवि्याायया अधिननयाम, 200 (200 का अधिननयाम ंश. 8) की वि्यामान िारा 11 के स् थान पर ननम् नलयखित ्रवनतस् थावपत यकयाा जायेागा, अथाषत - ''11. कः यरनन.- (1) कुयपनत विश् िवि्याायया का पणूषकालयक ि तननक अधिकार ह गा। 3
(2) क ई भी व् याक्तत कुयपनत के ूपप में ननयातु त यकयेा जाने के लयए पात्र नह श ह गा जब तक यक िह यकंी विश् िवि्याायया याा महावि्याायया में तकनीकी लोक्षा के क्षते्र में आचायाष के ूपप में न् यानूतम ं िर्ष का अनभुि रिने िाया याा यकंी भी ्रवनतक्ठित ो ि और/याा ो क्षखणक ्रवोांननक ंशगिन में यकंी ंमकक्ष प पर ं िर्ष का अनभुि रिने िाया क ई ्रवख् याात लोक्षावि् नह श ह ।
(3) कुयपनत, ननम्नलयखित ं स्या ंे लमयकर बनी ि जबीन ंलमनत ्िारा लंफाररो यकयेा गयेा प नय में ंक्म्मलयत व् याक्ततया में ं,े राज्या ंरकार के परामोष ं,े कुयाधिपनत ्िारा ननयातुत यकयाा जायेागा- (क) ब डष ्िारा नामनन ेलोत एक व्याक्तत;
(ि) विश् िवि्याायया अन ुान आया ग के अ् याक्ष ्िारा नामनन ेलोत एक व् याक्तत;
(ग) कुयाधिपनत ्िारा नामनन ेलोत एक व् याक्तत; और (घ) राज् या ंरकार ्िारा नामनन ेलोत एक व्याक्तत, और कुयाधिपनत, इनमें ंे यकंी एक व्याक्तत क ंलमनत का अ्याक्ष ननयातुत करेगा।
(4) विश् िवि्याायया और उंके महावि्याायया ंे अंशब्ि उ् चतर लोक्षा क्षेत्र का क ई विख् याात व् याक्तत ह ि जबीन ंलमनत के ं स् या के ूपप में नामनन ेलोत यकयेा जाने के लयए पात्र ह गा।
(5) ि जबीन ंलमनत कुयपनत के ूपप में ननयातु त यकयेा जाने के लयए कम ंे कम तीन व् याक्ततया का और अधिकतम पाशच व् याक्ततया का एक प नय त याार करेगी और लंफाररो करेगी। ( ) कुयपनत के चयान के ्रवया जन के लयए, ि जबीन ंलमनत यकंी य क ंचूना के मा् याम ंे पात्र व् याक्ततया ंे आि ेन आमशत्रत्रत करेगी और कुयपनत के ूपप में ननयातु त यकयाे जाने िाये व् याक्ततया के 4 नाम पर विचार करत ेंमया, ि जबीन ंलमनत, ो क्षखणक उ् कत ठ ाता, ेो में उ् चतर लोक्षा ्रवणाय में ्रव ोषन और ो क्षखणक तथा ्रवोांननक ोांन में पयााषप् त अनभुि क , उधचत मह् ि ेगी और इंके ननठ कर्ों क येिब्ि करेगी और उन् हें कुयाधिपनत क ्रवस् ततु यकयेा जाने िाये प नय के ंाथ रिेगी।
(7) कुयपनत की प ािधि उं तार ि ंे, क्जंक िह अपना प ग्रहण करता ह , तीन िर्ष याा ंत्तर िर्ष की आया ु ्रवाप्त कर येने तक, इनमें ंे ज भी पहय ेह , ह गी परन्त ु िह व्याक्तत ूं र अिधि के लयए पनुननषयाकु्तत का पात्र ह गा।
(8) कुयपनत, ऐंा िेतन और भते्त ्रवाप्त करेगा ज राज्या ंरकार ्िारा अििाररत यकयेा जायाें। इंके अनतररतत, िह विश् िवि्याायया ्िारा ंशिाररत नन ोलु्क ंुं क्ज्जत ननिां और ऐंी अन्या पररयक्धिया का हक ार ह गा ज विहहत की जायाें।
(9) जब कुयपनत के प की क ई स्थायाी ररक्तत उंकी मत्या,ु ्याागपत्र, हाायाे जाने याा उंकी प ािधि ंमाप्त ह जाने के कारण ह जायेा त िह ररक्तत कुयाधिपनत ्िारा, उप-िारा (3) के अनुं ार भर जायेागी और जब तक िह इं ्रवकार नह श भर जाती ह तब तक उंके ्िारा, उप-िारा (10) के अिीन और अनुं ार कामचयाऊ व्यािस्था की जायेागी।
(10) जब कुयपनत के प की क ई अस्थायाी ररक्तत छुट्ा , ननयशबन के कारण याा अन्याथा ह जायेा, याा जब उप-िारा (9) के अिीन क ई कामचयाऊ व्यािस्था आिश्याक ह तब कुय-ंधचि मामय ेकी ररप ाष तरुशत कुयाधिपनत क करेगा, ज राज्या ंरकार की ंयाह ंे, कुयपनत के प के कत ्या के, राज् या-विश् िवि्याायया के यकंी भी अन् या कुयपनत ्िारा, ननिषहन के लयए इशतजाम करेगा। 5
(11) कुयपनत यकंी भी ंमया प का ्यााग, अपना ्याागपत्र ऐंी तार ि ंे, क्जंक िह प भार ंे मतुत ह ने का इ्छुक ह , कम ंे कम ंाि ह िं पिूष कुयाधिपनत क ्रवस्ततु करके, कर ंकेगा।
(12) ऐंा ्याागपत्र ऐंी तार ि ंे ्रवभािी ह गा ज कुयाधिपनत ्िारा अििाररत की जायेा और क्जंकी ंचूना कुयपनत क जायेा।
(13) जहाश, कुयपनत के ूपप में ननयातु त क ई व् याक्त त, ऐंी ननयाकु्त त के पिूष यकंी भी अन् या महावि्याायया, ंशस् था याा विश् िवि्याायया में ननया क्जत था, िहाश िह उं भविठ या ननधि में अशो ान करना जार रि ंकेगा क्जंका िह ऐंे ननया जन में ं स् या था और विश् िवि्याायया उं भविठ या ननधि में ऐंे व् याक्तत के येिे में अशो ान करेगा।
(14) जहाश कुयपनत, उंके पिूषिती ननया जन में, यकंी बीमा याा पेंोन स् कीम का ं स् या रहा ह , िहाश विश् िवि्याायया, ऐंी स् कीम में आिश् याक अशो ान करेगा।
(15) कुयपनत, ऐंी र पर ज ब डष ्िारा ननयात की जायाें, याात्रा और ननक भते्त का हक ार ह गा। (1 ) कुयपनत, ननम् नानुं ार छुट्ा का हक ार ह गा - (क) ्रव् येाक याारह ह िं की िास् तविक ंेिा के लयए एक ह िं की र ंे पणूषि तननक छुट्ा और (ि) ंेिा के ्रव् येाक पणूष िर्ष के लयए बीं ह िं की र ंे अिषि तननक छुट्ा परन् त ु धचयक् ं ा ्रवमाणपत्र ्रवस् ततु करने पर अिषि तननक छुट्ा क पणूषि तननक छुट्ा में ूपपान् तररत यकयाा जा ंकेगा।''। 6 उ्देय और कारण का कथन त राज् या ंरकार ने विश् िवि्याायया अन ुान आया ग विननयाम, 2010 के उपबशि क अशगीकार करने के लयए मशजूर ्रव ान की थी। त् पश् चात इन विननयाम में िर्ष 2013 में ंशो िन यकयेा गयेा। कुयपनत के अनभुि और चयान ्रवयियाा के ंशबशि में विश् िवि्याायया अन ुान आया ग (विश् िवि्याायया एिश महावि्याायया में अ् याापक एिश अन् या अका लमक स् ााफ की ननयाकु्तत हेत ु न् यानूतम या याता एिश उ् च लोक्षा के मानक के अनरुक्षण के उपाया) (्वितीया ंशो िन) विननयाम, 2013 के िण् ड 7.3.0 क ्रवभािी करने के लयए बीकानेर तकनीकी विश् िवि्याायया अधिननयाम, 2017 की िारा 11 और राजस् थान तकनीकी विश् िवि्याायया अधिननयाम, 200 की िारा 11 क ंशो धित यकयाा जाना ्रवस् तावित ह । याह वििेयाक पिूोत त उ् ेश् या की ्रवाक्प्त के लयए ईक्प्ंत ह । अत वििेयाक ्रवस् ततु ह । यकरण माहेश् िर प्र ारी ं तं्री। 7 बीकाने तर नकन तीकव वि िवि्यायय अिधनन तयं , 2017 (2017 का अिधनन तयं स.ं 29) से लयये )ये उ्धरण XX XX XX XX XX

(10) जब कुयपनत के प की क ई अस्थायाी ररक्तत छुट्ा , ननयशबन के कारण याा अन्याथा ह जायेा, याा जब उप-िारा (9) के अिीन क ई कामचयाऊ व्यािस्था आिश्याक ह , तब कुय-ंधचि मामय ेकी ररप ाष तरुशत कुयाधिपनत क करेगा/करेगी ज , राज्या ंरकार की ंयाह ंे, कुयपनत के प के कत ्या के ननिषहन के लयए इशतजाम करेगा/करेगी।

(2) कुयपनत की प ािधि उं तार ि ंे, क्जंक िह अपना प ग्रहण करता/करती ह , तीन िर्ष याा ंत्तर िर्ष की आया ु ्रवाप्त कर येने तक, इनमें ंे ज भी पहय ेह , ह गी परन्त ु िह व्याक्तत ूं र अिधि के लयए पनुननषयाकु्तत का पात्र ह गा/ह गी ।
(3) कुयपनत, ऐंा िेतन और भते्त ्रवाप्त करेगा/करेगी ज राज्या ंरकार ्िारा अििाररत यकया े जायाें। इंके अनतररतत, िह 10 विश् िवि्याायया ्िारा ंशिाररत नन ोलु्क ंुं क्ज्जत ननिां और ऐंी अन्या पररयक्धिया का/की हक ार ह गा/ह गी ज विहहत की जायाें।
(4) जब कुयपनत के प की क ई स्थायाी ररक्तत उंकी मत्या,ु ्याागपत्र, हाायाे जाने याा उंकी प ािधि ंमाप्त ह जाने के कारण ह जायेा त िह कुयाधिपनत ्िारा, उप-िारा (1) के अनुं ार भर जायेागी और जब तक िह इं ्रवकार नह श भर जाती ह तब तक उंके ्िारा, उप-िारा (5) के अिीन और अनुं ार कामचयाऊ व्यािस्था की जायेागी।
(5) जब कुयपनत के प की क ई अस्थायाी ररक्तत उंकी छुट्ा , ननयशबन के कारण याा अन्याथा ह जायेा, याा जब उप-िारा (4) के अिीन क ई कामचयाऊ व्यािस्था आिश्याक ह तब कुय-ंधचि मामय ेकी ररप ाष तरुशत कुयाधिपनत क करेगा ज , राज्या ंरकार की ंयाह ंे, कुयपनत के प के कत ्या के ननिषहन के लयए व्यािस्था करेगा। ( ) कुयपनत अपने प का ्यााग, यकंी भी ंमया अपना ्याागपत्र ऐंी तार ि ंे, क्जंक िह प भार ंे मतुत ह ने का/की इ्छुक ह , कम ंे कम ंाि ह िं पिूष कुयाधिपनत क ्रवस्ततु करके, कर ंकेगा/ंकेगी।
(7) ऐंा ्याागपत्र ऐंी तार ि ंे ्रवभािी ह गा ज कुयाधिपनत ्िारा अििाररत की जायेा और क्जंकी ंचूना कुयपनत क जायेा।
(8) जहाश, कुयपनत के ूपप में ननयातु त क ई व् याक्त त, ऐंी ननयाकु्त त के पिूष यकंी भी अन् या महावि्याायया, ंशस् था याा विश् िवि्याायया में ननया क्जत था/थी, िहाश िह उं भविठ या ननधि में अशो ान करना जार रि ंकेगा/ंकेगी क्जंमें िह ऐंे ननया जन में 11 ं स् या था/थी और विश् िवि्याायया उं भविठ या ननधि में ऐंे व् याक्त त के येिे में अशो ान करेगा।
(9) जहाश कुयपनत, उंके पिूषिती ननया जन में, यकंी बीमा याा पेंोन स् कीम का ं स् या रहा ह /रह ह , िहाश विश् िवि्याायया, ऐंी स् कीम में आिश् याक अशो ान करेगा।
(10) कुयपनत, ऐंी र पर ज ंीयक ब डष ्िारा ननयात की जायाें, याात्रा और ननक भते्त का हक ार ह गा।
(11) कुयपनत, ननम् नानुं ार छुट्हाया का हक ार ह गा - (क) ्रव् येाक याारह ह िं की िास् तविक ंेिा के लयए एक ह िं की र ंे पणूष िेतन पर छुट्ा और (ि) ंेिा के ्रव् येाक पणूष िर्ष के लयए बीं ह िं की र ंे अिषि तननक छुट्ा परन् त ु धचयक् ं ा ्रवमाणपत्र ्रवस् ततु करने पर अिषि तननक छुट्ा क पणूष ि तननक छुट्ा में ूपपान् तररत यकयाा जा ंकेगा। XX XX XX XX XX 12 (Authorised English Translation) Bill No. 9 of 2018 THE RAJASTHAN TECHNICAL UNIVERSITIES' LAWS (AMENDMENT) BILL, 2018 (To be introduced in the Rajasthan Legislative Assembly) A Bill to amend the Bikaner Technical University Act, 2017 and the Rajasthan Technical University Act, 2006.
Be it enacted by the Rajasthan State Legislature in the Sixty-ninth Year of the Republic of India, as follows:-
CHAPTER-I Preliminary
1. Short title and commencement.- (1) This Act may be called the Rajasthan Technical Universities' Laws (Amendment) Act, 2018.
(2) It shall come into force at once.
CHAPTER-II Amendment in the Bikaner Technical University Act, 2017
2. Amendment of section 11, Rajasthan Act No. 29 of
2017.- In section 11 of the Bikaner Technical University Act, 2017 (Act No. 29 of 2017),-
(i) for the existing sub-section (2), the following shall be substituted, namely:- “(2) No person shall be eligible to be appointed as Vice-Chancellor unless he is a distinguished academician in the field of technical education having a minimum of ten years experience as Professor in a University or college or ten years experience in an equivalent position in a reputed research and/or academic administrative organization.”;
(ii) in sub-section (6), after the existing expression “in the country” and before the existing expression “, and” the existing expression “and abroad” shall be deleted;

(iii) in sub-section (10), after the existing expression “of the Vice-Chancellor” and before the existing punctuation mark “.”, the expression “by any other Vice-Chancellor of a State University” shall be inserted; and
(iv) after the existing sub-section (16), the following new sub-section shall be added, namely:- “(17) Notwithstanding anything contained in sub-section (3), the first Vice-Chancellor of the University shall be appointed by the Chancellor after consultation with the State Government for a period not exceeding three years on such terms and conditions as the Chancellor may determine.”.
CHAPTER-III Amendment in the Rajasthan Technical University Act, 2006
3. Amendment of section 11, Rajasthan Act No. 8 of
2006.-For the existing section 11 of the Rajasthan Technical University Act, 2017 (Act No. 8 of 2006), the following shall be substituted, namely:- “11. Vice-Chancellor.- (1) The Vice-Chancellor shall be a whole time paid officer of the University.
(2) No person shall be eligible to be appointed as Vice- Chancellor unless he is a distinguished academician in the field of technical education having a minimum of ten years experience as Professor in a University or college or ten years experience in an equivalent position in a reputed research and/or academic administrative organization.
(3) The Vice-Chancellor shall be appointed by the Chancellor in consultation with the State Government from amongst the persons included in the panel recommended by the Search Committee consisting of –
(a) one person nominated by the Board;
(b) one person nominated by the Chairman, University Grants Commission;
(c) one person nominated by the Chancellor; and
(d) one person nominated by the State Government, and the Chancellor shall appoint one of these persons to be the Chairman of the Committee.

(4) An eminent person in the sphere of higher education not connected with the University and its colleges shall only be eligible to be nominated as the member of the Search Committee.
(5) The Search Committee shall prepare and recommend a panel of not less than three persons and not more than five persons to be appointed as Vice-Chancellor.
(6) For the purpose of selection of the Vice-Chancellor, the Search Committee shall invite applications from eligible persons through a public notice and while considering the names of persons to be appointed as Vice-Chancellor, the Search Committee shall give proper weightage to academic excellence, exposure to the higher education system in the country, and adequate experience in academic and administrative governance and record its findings in writing and enclose the same with the panel to be submitted to the Chancellor.
(7) The term of the office of the Vice-Chancellor shall be three years from the date on which he enters upon his office or until he attains the age of seventy years, whichever is earlier:
Provided that the same person shall be eligible for reappointment for a second term.
(8) The Vice-Chancellor shall receive such pay and allowances as may be determined by the State Government. In addition to it, he shall be entitled to free furnished residence maintained by the University and such other perquisites as may be prescribed.
(9) When a permanent vacancy in the office of the Vice- Chancellor occurs by reason of his death, resignation, removal or the expiry of his term of office, it shall be filled by the Chancellor in accordance with sub-section (3), and for so long as it is not so filled, stop-gap arrangement shall be made by him under and in accordance with sub-section (10).
(10) When a temporary vacancy in the office of the Vice- Chancellor occurs by reason of leave, suspension or otherwise or when a stop-gap arrangement is necessary under sub-section (9), the Registrar shall forthwith report the matter to the Chancellor who shall make, on the advice of the State Government, arrangement for the carrying on of the function of the office of the Vice-Chancellor by any other Vice-Chancellor of a State University.

(11) The Vice-Chancellor may at any time relinquish office by submitting, not less than sixty days in advance of the date on which he wishes to be relieved, his resignation to the Chancellor.
(12) Such resignation shall take effect from the date determined by the Chancellor and conveyed to the Vice- Chancellor.
(13) Where a person appointed as the Vice-Chancellor was in employment before such appointment in any other college, institution or University, he may continue to contribute to the provident fund of which he was a member in such employment and the University shall contribute to the account of such person in that provident fund.
(14) Where the Vice-Chancellor had been in his previous employment, a member of any insurance or pension scheme, the University shall make a necessary contribution to such scheme.
(15) The Vice-Chancellor shall be entitled to travelling and daily allowance at such rates as may be fixed by the Board.
(16) The Vice-Chancellor shall be entitled to leave as under:-
(a) leave on full pay at the rate of one day for every eleven days of active service; and
(b) leave on half pay at the rate of twenty days for each completed year of service:
Provided that leave on half pay may be commuted as leave on full pay on production of medical certificate.”.
16 STATEMENT OF OBJECTS AND REASONS The State Government had given sanction for adoption of the provisions of University Grants Commission Regulation, 2010.
Later amendments were made in these Regulations in the Year
2013.
In order to give effect to clause 7.3.0 of the University Grants Commission (Minimum Qualifications for Appointment of Teachers and other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standards in Higher Education) (2nd Amendment) Regulations, 2013 regarding experience and selection procedure of Vice-Chancellor, section 11 of the Bikaner Technical University Act, 2017 and section 11 of the Rajasthan Technical University Act, 2006 are proposed to be amended.
The Bill seeks to achieve the aforesaid objectives.

11. The Vice-Chancellor.- (1) xx xx xx xx xx
(2) No person shall be eligible to be appointed as Vice- Chancellor unless he or she is a distinguished academician having a minimum of ten years experience as Professor in a University or ten years experience in an equivalent position in a reputed research and/or academic administrative organization.

(6) For the purpose of selection of the Vice-Chancellor, the Search Committee shall invite applications from eligible persons through a public notice and while considering the names of persons to be appointed as Vice-Chancellor, the Search Committee shall give proper weightage to academic excellence, exposure to the higher education system in the country and abroad, and adequate experience in academic and administrative governance and record its findings in writing and enclose the same with the panel to be submitted to the Chancellor.

(9) When a permanent vacancy in the office of the Vice- Chancellor occurs by reason of his death, resignation, removal or the expiry of his term of office, it shall be filled by the Chancellor in accordance with sub-section (3), and for so long as it is not so filled, stop-gap arrangement shall be made by him under and in accordance with sub-section (10).

11. Vice-Chancellor.- (1) The Vice-Chancellor shall be a whole- time paid officer of the University and shall be appointed by the Chancellor in consultation with the State Government upon recommendation of a Selection Committee consisting of -
(a) one person nominated by the Board not connected with the University or any college thereof;
(b) one person nominated by the Chairman, University Grants Commission;
(c) one person nominated by the Chancellor; and
(d) one person nominated by the State Government, and the Chancellor shall appoint one of these persons to be the Chairman of the Committee.
(2) The term of the office of the Vice-Chancellor shall be three years from the date on which he or she enters upon his or her office or until he or she attains the age of seventy years, whichever is earlier:
Provided that the same person shall be eligible for reappointment for a second term.
(3) The Vice-Chancellor shall receive such pay and allowances as may be determined by the State Government. In addition to it, he or she shall be entitled to free furnished residence maintained by the University and such other perquisites as may be prescribed by the statutes.
