(1) पद की प्रकृित सेवा में शािमल िकए जाने वाले पद अनुसूची के स्तंभ 2 में िनर्िदष्ट अनुसार होंगे।

(2) पदों की संख्या ऐसी होगी, जो आयोग द्वारा िनर्धािरत की जाए। सरकार समय-समय पर;

बशर्ते िक सरकार- (क) समय-समय पर आवश्यकतानुसार कोई भी स्थायी या अस्थायी पद सृिजत करना, तथा (ख) िकसी भी स्थायी या अस्थायी पद को समय-समय पर खाली छोड़ना, स्थिगत रखना या समाप्त करना, िजससे िकसी व्यक्ित को कोई मुआवजा पाने का अिधकार न िमले या िकसी पद पर भर्ती करने के िलए कोई बाध्यता न पैदा हो।
