1. Short title and commencement.- (1) These rules may be called the Rajasthan Municipalities (Election) (Amendment) Rules, 2020.
(2) They shall be deemed to have come in to force with effect from 30-10-1999.
2. Amendment of rule 6.- In rule 6 of the Rajasthan Municipalities (Election) Rules, 1994,-
(i) the existing sub-rule (1) shall be substituted by the following, namely:- "(1) Subject to the provisions of sub-rule (4),(5) and (6) of this rule, the reservation to the office of Chairman, President and Mayor in the Municipalities of the State for Schedule Casts and Scheduled Tribes shall be done by drawing lottery by arranging the Municipalities in the descending order based on the percentage of population of Schedule Casts and Scheduled Tribes with reference to the total population of the concerned Municipality. After each census the exercise of reservation as per this subrule will be undertaken and in the next phase of the election before the new census, the Municipalities in which the reservation has been provided shall be excluded. After the new census, the reservation shall be applied afresh in the manner provided in this sub-rule and it will not be required to exclude the Municipality in which the reservation was provided after the previous census.";
(ii) the existing sub-rule (2), (3) and (4) shall be renumbered as sub-rule (4), (5) and (6), respectively;
(iii) after sub-rule (1), so substituted and before the sub-rule (4), so renumbered, the following new sub-rule (2) and (3) shall be inserted, namely:- 3414 राजस्थान रराज-पत्र,अक्टूबर13,2020 भाग6(क) "(2) Subject to the provisions of sub-rule (4), (5) & (6) of this rule the reservation to the office of Chairman, President and Mayor in the Municipalities of the each division of the State for Backward Classes shall be 21 percent subject to ceiling of 50 percent of the total reservation for Schedule Casts, Scheduled Tribes and Backward Classes.
Reservation for Backward Classes shall be done by drawing lottery amongst the Municipalities which remain in the Division after providing reservation for Schedule Casts and Scheduled Tribes. However, in the next phase of election before the next census, the Municipalities where the reservation for Backward Classes has been provided shall be excluded. After new census, the reservation shall be applied afresh in the manner provided in this sub-rule and it will not be required to exclude the Municipality in which the reservation was provided after the previous census.
(3) Subject to the provisions of sub-rule (4),(5) and (6) of this rule the reservation to the office of Chairman, President and Mayor in the Municipalities of the State shall be reserved for women by drawing lottery in the elections which are conducted after each census. However, in the next phase of election conducted before the next census, the Municipalities where the reservation has been provided shall be excluded. After new census, the reservation shall be applied afresh in the manner provided in this subrule and it will not be required to exclude the Municipality in which the reservation was provided after the previous census.
(iv) in sub-rule (4) so renumbered, for the existing expression "sub-rule (1), the expression " sub-rule (1) or sub-rule (2), as the case may be " shall be substituted;
(v) in sub-rule (5), so renumbered, for the existing expression "sub-rule (2), the expression "sub-rule (4)" shall be substituted; and
(vi) after the sub-rule (5) so amended the following explanation shall be added, namely:- "Explanation: For the purpose of this rule the term phase of election shall mean election of all the Municipalities in the State."
