DRAFT RECIPROCAL TRANSPORT AGREEMENT BETWEEN JHARKHAND AND WEST BENGAL.
Notification 24 January, 2003 In the terms of provisions under sub-section (5) of section 88 of the Motor Vehicle Act, 1988 (Act 59 of 1988), the Governor is hereby pleased to publish the draft Reciprocal Transport Agreement which the State of West Bengal and Jharkhand propose to enter into, for information, of all likely to be effected thereby.
Draft Reciprocal Transport Agreement between the State of West Bengal and Jharkhand, 2002 Whereas with a view to encouraging the movement of Transport Vehicles on inter-state routes between West Bengal and Jharkhand, regulating and controlling their operation, providing facilities to travelling public and infrastructural support for the growth of industry and trade and also creating scope of employment, it is necessary to enter into Reciprocal Transport Agreement.
Now, therefore, the Govt. of West Bengal and Govt. of Jharkhand hereby enter into a draft Reciprocal Transport Agreement on the terms and conditions as set out herein below.
For the purpose of ready reference the name of routes, number of permits on each route agreed upon have been shown in Annexures. Annexure A is in respect of the existing routes which were included in the agreement of 1988 between Bihar and West Bengal. However the number of permits stand modified as agreed upon. The new routes are shown in Annexure 'B'. The list of the routes lying between West Bengal and Bihar and passing through Jharkhand is shown under annexure 'C'. The extended agreed routes including quota of permit are shown under Annexure 'D'.
This Reciprocal Transport Agreement shall be valid till it is replaced by another agreement by mutual consent for reasons to be given in writing by either of the State Governments. This Agreement shall be subject to revision periodically at the instance of either state by way of supplementary agreements.
It is now agreed by and between the above parties as follows:-- That this Reciprocal Transport Agreement shall be enforced from the date of notification in the official gazette of the respective state and shall be valid till such time as a new agreement between the two states is arrived at.
1. TAXATION(A) :
(i) Permits issued under the provisions of this Agreement shall be subject to the provisions of the Act, Rules and Regulations providing for taxes/fees as may be in force from time to time in the reciprocating state.
(ii) There shall be double point motor vehicles tax in respect of all categories of transport vehicles covered by the arrangement of Inter-state reciprocal Transport Agreement between the State of West Bengal and Jharkhand. This double point taxation will be applicable even during pendency of renewal, if substantive permit under section 87 of the M. V. Act, 1988 is issued under the agreed route and countersigned by the other state.
(iii) The Transport Authority of Home State granting permit of stage carriages, contract carriages and goods carriages shall assist the recovery of taxes and arrears of reciprocating state in all possible ways.
(iv) At the time of renewal, replacement of the vehicle or surrender of Inter-state permits, the receipt of payment of taxes of the reciprocating state shall be verified by the permit granting state so that either of the state may not lose tax revenue.
(v) Taxes payable in respect of temporary permits or special permits shall be collected at the entry point of the reciprocating state or at the point where the reciprocating state may decide.
TAXATION(B) :
The 'double point taxation basis' in respect of a motor vehicle means the liability of payment of all taxes applicable in the reciprocating state.
2. SATAGE CARRIAGE :- a) As agreed upon, in the Reciprocal Transport Agreement in regard to the Inter-state stage carriage permit on the inter-state routes and number of permits allocated to each state against the routes have been fixed as far as practicable on the basis of length of the alignment of the routes falling in each state.
b) That the routes mentioned in the Annexures indicate, the routes alongwith total number of permits allocated to each state as agreed upon under the agreement.
c) That any discrepancy discovered latter in the distance shown in the said Annexure(s) shall be promptly corrected through correspondence between the two State Transport Authorities and shall not be treated as modification of the agreement. The change of alignment of route(s) not exceeding 24 Km., in either of the reciprocating states shall be similarly dealt with.
d) That the temporary stage carriage permits issued u/s 87(i) (c) of the M. V. Act, 1988, pursuant to this draft Reciprocal Transport Agreement, prior to the final publication of this Draft Agreement u/s 88(6) of the M.V. Act, 1988 shall be countersigned by the states in accordance with the provision of law.
e) The time-table of every service shall be fixed by the permit issuing State, avoiding clash of timings of other operators, subject to the approval of the reciprocating state.
f) The initial time-table shall be fixed by permit issuing State on a purely provisional basis to be valid for 2 (two) or 3 (three) months and which is to be countersigned by the reciprocating State. The provisional time-table will be final after the expiry of provisional period or meeting the objection(s) if filed any.
g) It is agreed upon between the two states that a Single permit with 4 (four) trips per day (2 ups x 2 downs) may be granted where length of the route is upto 100 kms. and single permit with 2 (two) trips per day (1 up x 1 down) may be granted where the length of the route is more than 100 kms. but not more than 200 kms. If the length of the route is more than 200 kms. one single permit with one trip may be granted.
h) Any extension/curtailment of a portion of an inter-state route may be granted only by the permit issuing state authority subject to the consent of the reciprocating state if the portion under consideration lies in that state. But that extension or curtailment should be within the limit of 24 kms.
i) At the time of renewal of the permit, replacement of vehicle or cancellation of permits, the permit granting authority shall examine if permit has been countersigned by the reciprocating state and if the taxes of the rexiprocating state have been cleared.
j) The maximum fare and freight chargeable shall be as fixed by the State Government of the permit issuing STA in respect of operation of bus service. The form of tickets issued in one state shall be valid in other state.
k) Suspension or cancellation of the countersignature of permit(s), should be done under intimation to the authority which issued the permit(s) so as to enable the latter to make arrangements of operating the substantive service.
l) All the bus services operating on the route which are more than 100 kms. shall operate as express bus service and those on the routes which are upto 100 kms. shall operate either as express or ordinary bus service in accordance with the direction of the permit issuing State Transport Authority.
3. SPECIAL PERMITS :- a) Special permits may be granted u/s 88(8) of the M.V. Act, 1988 by the Transport Authority of either state in the respect of Tourism, Marriage, Jatra Parties, Medical treatment for sick persons, Pilgrimage etc. For the period nor exceeding 30 days to perform one up & one down trip.
b) Such permits shall contain lists of passengers approved and authenticated under proper seal and signature by the permit issuing authority along with approved detailed programmed of tour shown in the order and places to be visited by the party.
Such lists must be in duplicate, one for the upward journey and the other for the return journey which shall be suitably attached to the pernit while the short description such as number of travellers, place(s) of visit and the programme etc. must be indicated on the permit. Any permit without such particulars shall be treated as no permit. The manner and mode of remittance of fees/taxes etc. together with the details of the payee must be indicated on the permit.
4. CONTRACT CARRAIGE : (Temporary Permits):- a) Temporary permit for contract carriage may be issued u/s 87(1) (a) & (c) of the M.V.
Act, 1988 for maximum period of 2 (two) weeks according to the need without prior concurrence of the reciprocating state to perform one up and down trip with the following conditions:-
(i) The vehicle shall be hired by single party and shall be used for only one outward and one return journey.
(ii) The temporary permit shall clearly specify the date of outward and return journey.
(iii) The vehicle shall not do any intra-state business in the reciprocating state i.e they shall not take any passenger for any two points lying wholly within the territory of the reciprocating state.
(iv) If due to unavoidable circumstance, the validity of the temporary permit expires in the reciprocating state, a fresh temporary permit shall be obtained from the reciprocating state with due compliance with the provision of law.
(v) Passenger in excess of the seating capacity specified in the certificate of registration shall not be carried and no standing passenger shall be allowed.
5. GOODS CARRIAGE (Permanent Permits):- a) The public carriers permits for 1000 vehicles shall be countersigned by the State Transport Authority of either of the State. The countersignature shall be valid for the National and State Highways with a deviation not exceeding 50 kms. from these roads to reach manufacturing concerns or industrial centres.
b) Public carriers of each state shall continue to be countersigned by State Transport Authority or the concerned Regional Transport Authority of the reciprocating state for one adjoining district only without any restriction as to their number, subject to compliance with the requirement of Law/Rules of the reciprocating state.
c) The permits for petrol tankers owned by oil companies or their authorised agents or contractors and exclusively used for transport of petrol and petroleum products is to be countersigned as and when recommended by the State Transport Authority of either State for operation in the whole of the reciprocating State without any restriction on their number subject to compliance of the requirement of Laws/Rules of the reciprocating State.
d) Public carriers or Petrol tankers operating on inter-state routes on countersignature shall not be used as intra-state transport within the territory of the countersigning State.
6. PRIVATE CARRIAGE(Permanent Permits):- a) Private Carriage permits recommended for countersignature by the State Transport Authority of either state is to be countersigned by the State Transport Authority of the reciprocating state without any restriction on their number subject to the condition that goods of the specified nature shall only be carried and subject to the provision of Laws and Rules in this behalf of the reciprocating State.
b) Recommendation for countersignature in the respect of private carrier shall be made after a a through scrutiny of the bonafide of the business of the applicants in the other state.
c) Such vehicle shall not be used as intra-state transport within the jurisdiction of the countersigning state.
7. GOODS CARRIAGE(Temporary Permit):- The temporary permits may be issued for a maximum period of one month by the State Trans port Authority of the either state u/s 87 of the M. V. Act, 1988 for plying on the Inter-State routes between the two states without prior concurrence of the reciprocating state to perform one up and one down trip service, subject to the following conditions:-- a) No goods shall be picked up or set down in between any two points lying wholly within the areas of the reciprocating state i.e. such vehicles shall not be used as intra-state transport within the jurisdiction of the reciprocating state.
b) Such temporary permit shall be issued for direct and shortest route connecting the two termini and shall be subject to such other conditions as may be imposed by the transport authority of the reciprocating state.
8. RULES :- The vehicle of one reciprocating state plying in the order reciprocating state shall abide by the M.V. Act & M.V. Rules of the other reciprocating state.
9. GENERAL :- A. The reciprocating state shall accord recognition to Tax Token, Registration Certificate, Conductors'/Drivers' Licence, Authorisation to drive Public Service vehicles, Certificate of Fitness etc. issued under the relevant rules of each of the two states in respect of their vehicles plying in accordance with agreement.
B. Any restriction imposed by the signatory state in its territory under provision of the M.V.
Act, 1988 shall equally be applicable to the vehicles of the both states.
C. The restriction on laden weight of the vehicle or restriction of wheel base, seating capacity and such other matter as may be enforced by the respective state shall not be exceeded by the transport vehicles plying under this agreement and such vehicles shall also abide by any other restriction(s) as existing in the reciprocating state and as may be enforced by the reciprocating state from time to time.
D. West Bengal Stage carriage plying between Orissa and West Bengal but using corridor facilities of Baharagoda in Jharkhand, which is more than 22 kms. Shall get their permit countersigned on payment of Motor Vehicle Tax to Jharkhand State.
E. If in the public interest it is necessary to open any new inter-state route beyond the quota fixed in the Reciprocal Agreement, the procedure of prior concurrence as envisaged u/s 88 (7) of the M. V. Act, 1988 shall be followed by both the States.
F. All transport vehicles not covered by any agreement while operating in the other State shall be liable to pay all the taxes/fees liveable in the other State.
G. Any change or correction in any clause of the agreement or any addition or deletion of route(s) or any correction/change in the alignment of route(s) shown in the Draft Reciprocal Transport Agreement may be done by the mutual consent after discussion and that change or correction is to be reflected in the Final Reciprocal Transport Agreement between the State of West Bengal & Jharkhand.
