3. नोडल अिभकरण नोडल अिभकरणनोडल अिभकरण नोडल अिभकरण— —— —इन िनयम% के योजन% के िलए भारतीय मानक G यूरो नोडल अिभकरण होगा और वह इन िनयम% को काया�िT वत करेगा ।

(i) िनयम 2 म� यथािविनOदP ट उ< पाद म� सीसा क9 माFा से सबंंिधत अनबुंध इन िनयम% के वृ< त होने क9 तारीख से ही िविन\मत प�ट% को लाग ूह%गे ;
(ii) उ< पाद के < येक िविनमा�ता या आयातकता� के पास भारत म� उ< पाद के िविनमा�ण या भारत म� उ< पाद के आयात �कए जाने के िलए नोडल अिभकरण के अनुमोदन का िविधमाT य माणपF होगा ;
(iii) < येक िविनमा�ता या आयातकता� िनयम 2 के उपबधं% क9 अनु(पता के स< यापन हतेु अपने उ< पाद% का योग कराने के िलए < येक वष� 31 माच� तक नोडल अिभकरण ;ारा नमूने लेने के िलए एक समय-सूची @ततु करेगा ;
(iv) उ< पाद का < येक िविनमा�ता या आयातकता� अपने उ< पाद पर यह कथन करते ?ए एक लेबल लगाएगा �क सीसा क9 माFा 90 पीपीएम से अिधक नह] ह ैतथा ऐसा लबेल @ थायी और सहजदIृ य होगा ;
(v) लेबल पर िविनमा�ता या आयातकता� का नाम और पता अंत\वP ट होगा ।

5. अनपुालन और परी�ण �*+या अनपुालन और परी�ण �*+याअनपुालन और परी�ण �*+या अनपुालन और परी�ण �*+या— —— —नोडल अिभकरण उ<पाद% के अपने अनुवत�न और परी,ण के िलए इन िनयम% के अधीन अनुसरण क9 जान ेवाली �_या को िविनOदP ट करेगा । [फा. सं. 7-21/2010-एचएसएमडी] िबI वनाथ िसT हा, सयंु� त सिचव ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 8th April, 2016 The following draft of certain rules to regulate the manufacture, trade, use, import and export of lead contents in household and decorative paints which the Central Government proposes to make in exercise of its powers under subsection (1) of section 3 and clause (d) of sub-section (2) of section 6 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (2) of rule 13 of the Environment (Protection) Rules, 1986, is hereby published for information of all persons including organisations likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration by the Central Government after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person or organization desirous of making any suggestion or objection in respect of the proposed draft rules may forward the same in writing by mail or fax for consideration of the Central Government within the period so specified to Shri W. Bharat Singh, Joint Director, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jor Bagh Road, New Delhi-110 003; email: w.bharat@nic.in; Fax: 011-24695387; DRAFT RULES G.S.R. 409(E).—In exercise of the powers conferred under sub- section (1) of section 3 and clause (d) of subsection (2) of the section 6 of the Environment (Protection) Act, 1986 (29 of 1986), read with rule 13 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following rules, namely:-
1. Short title and commencement. - (1) These rules may be called the Regulation on Lead contents in Household and Decorative Paints Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Prohibition of use of metallic lead in certain cases. – Any manufacture, trade, import and export of household and decorative paints hereinafter referred to as product containing metallic lead exceeding 90 parts per million is hereby prohibited.
3. Nodal agency. – The Bureau of Indian Standards shall be the nodal agency for the purposes of these rules, and shall implement the provisions of these rules.
4. General Conditions. – The following conditions shall be applicable, namely;-
(i) the stipulations relating to contents of lead in the product as specified in rule 2 shall apply to paints manufactured on and from the date of coming into force of these rules;
(ii) every manufacturer or importer of product shall have a valid certificate of approval of the nodal agency for the manufacture of the product in India or for being imported into India;
(iii) every manufacturer or importer shall submit a schedule for drawing samples by the nodal agency by 31 st March every year for subjecting its products for verification for conformity with the provisions of rule 2;
(iv) the manufacturer or importer of the product shall label its product stating that the lead contents does not exceed 90 ppm and such labeling shall be durable and legible;
(v) the label shall contain the name and address of the manufacturer or importer.
5. Compliance and testing procedure.- The nodal agency shall specify the procedure to be followed under these rules for its compliance and for testing of products. [F.
