(1) When the Flag Officer Commanding-in-chief proceeds with trial of the accused officer, he shall red out the charge against the accused officer and ask him whether he plead
(2) If the accused officer pleads guilty, the plea of guilty shall be so recorded and if there no further charge to be read, the accused may be permitted to make a statement in mitigation of punishment. If the accused officer makes an oral statement, its gist or the statement, if in writing shall be attached to the proceedings.
(3) The Flag Officer Commanding-in-chief shall then consider the whole case and award such punishment as he consider just and proper.
(4) Where an accused officer pleads not guilty to the charges, the Flag Officer Commanding-in-chief shall proceed further with the trial.
(5) After the statements of witnesses received along with the report have been made part of the proceedings the Flag Officer Commanding-in-chief shall inform the accused officer that he is not obliged to make any statement, but if he wishes to make a statement orally or in writing, he may do so. The statement of the accused officer may deal with the facts of the case, with his character and with matters in mitigation of punishment. If the accused officer makes an oral statement its gist or the statement, if in writing, shall from part of the proceedings.
(6) In the course of a trial wherever it appears desirable, the Flag Officer Commanding-in-Chief, he may call and examine any witness whom be considers essential for proper proposal of the case. The witness so call may be crossexamined by the accused officer and if necessary by the presenting officer.
(7) The evidence of such a witness shall be recorded in brief in narrative form on a separate sheet and attached to proceedings.
(8) If on consideration of the whole case, the finding of the Flag Officer Commanding-in-chief finds the accused officer guilty and acquits the officer
(10) If after considering the whole case, the Flag Officer Commanding-in-chief finds the accused officer guilty on any or all of the charges, he may award proper punishment empowered under section 94.
