Where the possession of a - requisitioned property is not hancied over, in compliance with an order issued under sub-section (1) of section 4 of the Act and the premises are found locked, the competent authority or any other person authorised by it in writing in this behalf may break open the fock in the presence of two witnesses and take possession of the property:
Provided that-
(i) before any such action is taken the competent authority shall satisfy itself that the order under sub-section (1) of section 4 has been duly served on the ·_ party concerned _ and that the party is evading compliance with the order; _ - -
(ii) the powers under this rule shall not be eiercised at any time after sunset or before sunrise; and -- _..

(iii) where possession is taken in pursuance of ·the powers conferred by · this rule, an inventory of the articles fpund in the premises shall be made in the presence of two witnesses· and such articles shall be -stored in safe custody.
