I-F-I-22-2015-XVIII-3.-In exercise of the powers conferred by Section 37 and 73 read with Section 433 of the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956) and Section 70 and 110 read with Section 355 and 356 of the Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961), the State Government hereby, makes the following further amendments in the Madhya Pradesh Municipalities (the Conduct of Business of the Mayor-in-CouncillPresident- in-council and the powers and functions of the Authorities) Rules, 1998, ' namely:- AMENDMENTS
1. In the said rules, rule 2, for sub-rule (7), the following sub-rule shall be substituted, namely:- "(7) "Department" means-
(a) in case of Municipal Corporation-
(i) General Administration Department;
(ii) Water Works and Sewerage Department;
(iii) Public Works and Garden Department;
(iv) Revenue Department
(v) Finance and Account Department;
(vi) Electrical and Mechanical Department;
(vii) Sanitation and Solid Waste Managemnet Department;
(viii) Traffic and Transport Department;
(ix) Planning and Information Technology Department;
(x) Urban Poverty Alleviation Department;
(b) in case of Municipal Council-
(i) General Administration Department;
(ii) Water Works and Sewerage Department;
(iii) Public Works and Garden, Electrical and Mechanical Department;
(iv) Revenue, Finance and Account Department
(v) Sanitation and Solid Waste Managment Department;
(vi) Planning, Traffic, Transport and Information Technology Department;
(vii) Urban Poverty Alleviation Department;
(c) In case of Nagar Parishad
(i) General Administration, Revenue, Finance and Account Department
(ii) Water Works Sewerage, Sanitation and Solid Waste Managment Department;

2. In the rule-5,-
(i) for sub-rule (1) the following sub-rule shall be substituted, namely:- "(1) the financial powers shall be vested in the various authorities as under:- 12 (4) l=f~ ~, ~ 4 ~ 2016

Provided that in case of Externally Aided Projects, Centrally Sponsored Schemes, Deposit Works or specific State Government Projects, the State Government may, by order, authorise the Commissioner or the Mayor-in Council of Municipal Corporation and Chief Municipal Officer or the president-in-Council of Municipal Council/ Nagar praishad to exercise such enhandced finacial powers, as it may deem Fit.".
(ii) In the sub rule (5),-
(a) in clause (vii), for the words "twenty five thousand", the words "one lac" shall be substituted. li~~, fc:::ricI;" 4 ~ 2016 12 (5)
(b) In clause (x), for the table, following table shall be subsitituted, namely:- "S. No.
(1) Category of the Body
(2) Expenditure
(3) 1 In case of Municipal Corporation having more than five lacs population. Rs. Five crores 2 In case of Municipal Corporation having less than five lacs population. Rs. Two crores 3 Municipal Council Rs. Twenty five lacs 4 Nagar Parishad Rs. Ten lacs.".
(c) in clause (xi), for the words "twenty five thousand", the words "one lac" shall be substituted.
(d) in clause (xi), for sub clause (e), the following sub clause shall be substituted, namely:- "(e) For every. procurement to purchase goods,material and services of more than two lacs, the tender information would be required to be uploaded in website of the State Government and the Local Bodies and tenders shall be invited only through E-tendering.".
3. In rule 6, for sub rule (1), the following sub rule shall be substituted namely:- "(1) In case of Municipal Council and Nagar Parishad the tender committee shall be as under:-
(a) Evaluation Committee for Technical bid-
(i) Divisional Executive Engineer, Urban Administration and Development Chairman
(ii) Chief Municipal Officer Member Secretary
(iii) Executive Engineer, if available, Otherwise Assistant Engineer and if the Assistant Engineer is also not available then Sub-Engineer. Member
(iv) The Head of Department of such Department to which the work relates Member
(b) Evaluation Committee for Financial bid-
(i) Chief Municipal Officer Chairman
(ii) Executive Engineer, if available Otherwise Assistant Engineer and if the Assistant Engineer is also not available then Sub-Engineer. Member Secretary
