और जबᳰक, इस सबंंध मᱶ कोई आपिᱫ या सझुावᮧा᳙ नहᱭ ᱟए ह।ᱹ अब इसिलए भारतीय सूचना ᮧौ᳒ोिगकᳱ सं᭭थान अिधिनयम, 2014 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए के᭠ᮤ सरकार एत᳏ारा िन᳜िलिखत िनयम बनाती ह,ै नामतः

1. लघ ुशीषᭅक और ᮧारंभ.—(1) इन िनयमᲂ को भारतीय सूचना ᮧौ᳒ोिगकᳱ सं᭭थान (पᳯरषद) िनयमावली, 2016 कहा जाएगा।

(2) वे शासकᳱय राजपᮢ मᱶ उनके ᮧकाशन कᳱ तारीख से लागू हᲂगे। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

2. पᳯरभाषाएं.—(1) इन िनयमᲂ मᱶ, जब तक ᳰक संदभᭅ अपिेᭃत न हो। (क) “अिधिनयम” भारतीय सूचना ᮧौ᳒ोिगकᳱ अिधिनयम (2014 का 30) से अिभᮧते ह;ै (ख) “पᳯरषद”् स ेआशय, अिधिनयम के अधीन ᭭थािपत पᳯरषद;

(ग) “सिचव” से आशय, पᳯरषद ्के सिचव स ेह।ै

(2) इन िनयमᲂ मᱶ ᮧयुᲦ ᳴कत ुअिधिनयम मᱶ पᳯरभािषत नहᱭ तथा पᳯरभािषत, श᭣दᲂ और अिभ᳞िᲦयᲂ का वही अथᭅ होगा जो अिधिनयम मᱶ ᮓमानसुार उ᭠हᱶ ᳰदया गया ह।ै

3. बठैक और कायᭅ कᳱ रीित.—(1) पᳯरषद कᳱ एक कैलᱶडर वषᭅ मᱶ कम-स-ेकम एक बार बैठक होगी।

(2) पᳯरषद कᳱ बैठकᱶ , पᳯरषद के अ᭟यᭃ ᳇ारा ᭭वᮧᳯेरत अथवा सिचव के अनुरोध पर अथवा पᳯरषद के सद᭭यᲂ, जो सात स ेकम नहᱭ हᲂगे, ᳇ारा ह᭭ताᭃᳯरत मांग पर बुलाई जाएगंी।

(3) पᳯरषद कᳱ बैठक का कोरम पᳯरषद के आध ेसद᭭यᲂ से पूरा होगा।

(4) सिचव ᳇ारा बैठक कᳱ तारीख से कम-से-कम दस ᳰदन पूवᭅ ᮧ᭜यके सद᭭य को बैठक का िलिखत नोᳯटस भेजा जाएगा िजसमᱶ बैठक का ᭭थान, तारीख और समय का उ᭨लेख ᳰकया होः बशतᱷ, अ᭟यᭃ मह᭜वपूणᭅ मु᳎ᲂ पर िवचार करने के िलए अ᭨प सचूना पर िवशेष बैठक बुलाए।

(5) बैठक कᳱ सचूना पᳯरषद कायाᭅलय के ᳯरकॅाडᭅ मᱶ दजᭅ ᮧ᭜यके सद᭭य के पत ेपर या द᭭ती ᳇ारा अथवा ᭭पीड पो᭭ट या ई-मेल ᳇ारा भजेा जा सकता ह ैऔर यᳰद इस ᮧकार भेजा जाता ह ैतो इस ेउस समय िविधवत् ᱨप स ेभेजा मान िलया जाएगा, िजस तारीख को इस ेसाधारण डाक के मा᭟यम से भेजा जाता;

बशतᱷ, सूचना ᮧितिलिप अथवा लघ ुसदंशे सेवा के मा᭟यम से भी भेजी जाए।

(6) सिचव ᳇ारा बैठक से कम-स-ेकम सात ᳰदन पहले सद᭭यᲂ मᱶ बैठक कᳱ कायᭅसूची पᳯरचािलत कᳱ जाएगी।

(7) कायᭅसूची मᱶ ᳰकसी मद को शािमल करने के ᮧ᭭ताव कᳱ सचूना बैठक स ेकम-स-ेकम सात ᳰदन पूवᭅ सिचव को दी जाएगी। बशतᱷ, पᳯरषद का अ᭟यᭃ ऐसी ᳰकसी मद, िजसकᳱ यता समय सूचना ᮧा᳙ नहᱭ ᱟई हो, को शािमल करने कᳱ अनमुित द ेसकता ह।ै

(8) ᮧᳰᮓया-िविध के सभी िवषयᲂ के संबंध पᳯरषद के अ᭟यᭃ का िनणᭅय अंितम होगा।

(9) पᳯरषद कᳱ बैठक कᳱ कायᭅवाही के कायᭅवृᱫ सिचव ᳇ारा तैयार ᳰकए जाएगें और पᳯरषद के सभी सद᭭ यᲂ को पᳯरचािलत ᳰकए जाएंगे।

(10) ᳰकसी संशोधन हते ु ᳰदए गए सझुावᲂ के साथ कायᭅवृᱫ आगामी बैठक मᱶ पᳯरषद के अनमुोदन के िलए रखा जाएगा।

(11) कायᭅवृᱫ के अनमुोदन के प᳟ात और पᳯरषद के अ᭟यᭃ के ह᭭ताᭃर के प᳟ात कायᭅवृᱫ कायᭅवृᱫ-पुि᭭तका मᱶ दजᭅ हᲂगे िजस ेकायाᭅलय-समय मᱶ पᳯरषद के सद᭭यᲂ के िनरीᭃण के िलए हर समय खुला रखा जाएगा।

(12) पᳯरषद कᳱ बैठक मᱶ िवचार ᳰकए गए सभी मामलᲂ का िनणᭅय पᳯरषद के अ᭟यᭃ सिहत उपि᭭थत सद᭭यᲂ के मतᲂ के बᱟमत स ेᳰकया जाएगा। बशतᱷ मत बराबरी से िवभािजत हᲂ, तो पᳯरषद के अ᭟यᭃ दोबारा मतदान कराएंगे। ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3

4. पᳯरषद कᳱ कायाᭅ᭠वयन िविध.—पᳯरषद िनयत कायᲄ का िन᳜ िविध स ेकायाᭅ᭠वयन करेगी अथाᭅतः— (क) पᳯरषद अिधिनयम ᳇ारा उस ेसᲅपी गई ऐसी शिᲦयᲂ का ᮧयोग और कतᭅ᳞ᲂ का िनवᭅहन करेगी;

(ख) जहां बैठक बुलाना उपयᲦु न हो, सिचव पᳯरषद के अ᭟यᭃ के अनमुोदन से उस मद या उन मदᲂ, जो आव᭫यक हो, को सद᭭यᲂ कᳱ ᳯट᭡पिणयां ᮧा᳙ करने के िलए पᳯरचािलत कर सकता ह ैताᳰक अ᭟यᭃ उन पर िनणᭅय ल ेसके और ऐसे मामलᲂ को पᳯरषद कᳱ अगली बैठक मᱶ ᮧ᭭तुत ᳰकया जा सके;

(ग) पᳯरषद िविश᳥ मामलᲂ अथाᭅत अंतराᭅ᳦ीय सहयोग को बेहतर बनान,े िशᭃण कᳱ गणुवᱫा मᱶ सधुार करन,े ᭭टाफ संबंिध मामलᲂ आᳰद के िलए आव᭫यक समझे जान ेवाल ेिनधाᭅᳯरत िवचाराथᭅ-िवषयᲂ के साथ एक सिमित का गठन कर सकती ह ैऔर उस सिमित कᳱ ᳯरपोटᭅ या ᳯरपोटᲄ को पᳯरषद कᳱ बैठक मᱶ िवचाराथᭅ और िनणᭅय लनेे हते ुᮧ᭭ततु ᳰकया जाएगा; और (घ) यᳰद, अ᭟यᭃ कᳱ राय मᱶ कोई संकट कᳱ ि᭭थित उ᭜प᳖ होती ह,ै िजस पर त᭜काल कारᭅवाई ᳰकया जाना आव᭫यक ह,ै तो अ᭟यᭃ जैसा आव᭫यक समझे वैसी कारᭅवाई कर सकता ह ैऔर इसके बारे मᱶ पᳯरषद को उसकᳱ अगली बैठक मᱶ सिूचत करेगा।

5. याᮢा एवं अ᭠य भᱫ.े—(1) अिधिनयम कᳱ धारा 40 कᳱ उप-धारा (2) के खंड (viii) और (iv) मᱶ िन᳸द᳥ पᳯरषद के सद᭭यᲂ के याᮢा भᱫ ेके᭠ᮤ सरकार के समकᭃ ᮕेड के समूह ‘क’ अिधकाᳯरयᲂ पर लागू िनयमᲂ के अनसुार िविनयिमत हᲂगे।

(2) अिधिनयम कᳱ धारा 40 कᳱ उप-धारा (2) के खंड (ii) मᱶ िन᳸द᳥ पᳯरषद के सद᭭य भारत सरकार ᳇ारा गᳯठत सिमितयᲂ और आयोगᲂ मᱶ िनयुᲦ सांसदᲂ के ᱨप मᱶ उ᭠हᱶ ᭭वीकायᭅ याᮢा और दैिनक भᱫᲂ के हकदार हᲂगे।

(3) अिधिनयम कᳱ धारा 40 कᳱ उप-धारा (2) के खंड (i), (iii), (v), (vi), (vii), (ix), (x) और (xi) मᱶ िन᳸द᳥ पᳯरषद के सद᭭य अपने िनयोᲦा िनकायᲂ के िनयमᲂ के अंतगᭅत ᭭वीकायᭅ याᮢा और दैिनक भᱫᲂ के हकदार हᲂगे।

(4) सद᭭य अपने याᮢा और दिैनक भᱫᲂ के दावे अपने संबंिधत संगठनᲂ से करᱶगे, िजनसे वे संबंध रखते ह ᱹया के᭠ᮤ सरकार स े या जसैी ि᭭थित हो, पᳯरषद सिचवालय से करᱶगे। [फा. सं. 79-4/2015-टीएस.I] राकेश रंजन, संयुᲦ सिचव एवं सिचव, आईआईआईटी पᳯरषद MINISTRY OF HUMAN RESOURCE DEVELOPMENT (Department of Higher Education) NOTIFICATION New Delhi, the 5th September, 2016 G.S.R. 856(E).—Whereas, a draft notification of the Indian Institutes of Information Technology (Council) Rules, 2016 was published as required by sub-section (1) of section 43 of the Indian Institutes of Information Technology Act, 2014 (30 of 2014) in the Gazette of India Extraordinary Part II section 3, subsection (i) vide Notification No.G.S.R. 586(E), dated the 9th June, 2016 inviting objections or suggestions from the public likely to be affected thereby within a specified period of thirty days from the date on which the copies of the Gazette of India containing the draft notification were made available to the public;

And whereas, copies of said notification were made available to the public on 9th June, 2016;

And whereas, no objection or suggestion has been received in this regard.

Now, therefore, in exercise of the powers conferred by section 43 of the Indian Institutes of Information Technology Act, 2014, the Central Government hereby makes the following rules, namely :-

1. Short title and commencement.– (1) These rules may be called the Indian Institutes of Information Technology (Council) Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions .– (1) In these rules, unless the context otherwise requires -

(a) “Act” means the Indian Institutes of Information Technology Act, 2014 (30 of 2014);

(b) “Council” means the Council established under the Act;

(c) “Secretary” means the Secretary of the Council.

(2) Words and expressions used in these rules but not defined and defined in the Act shall have the same meanings respectively assigned to them in the Act.

3. Meeting and the manner of conducting business – (1) The Council shall meet at least once during a calendar year.

(2) The meetings of the Council shall be convened by the Chairperson of the Council suo-moto or at the request of the Secretary or on a requisition signed by not less than seven members of the Council.

(3) Half of the members of the Council shall form a quorum for a meeting of the Council.

(4) A written notice of every meeting shall be sent by the Secretary to every member at least ten days before the date of the meeting, mentioning therein the place, date and time of the meeting:

Provided that the Chairperson may call a special meeting of the Council at short notice to consider urgent issues.

(5) The notice of a meeting may be delivered either by hand or sent by registered post or speed post or by email at the address of each member as recorded in the office of the Council and if so sent shall be deemed to be duly delivered at the time at which notice would be delivered in the ordinary course of post:

Provided that the notice may also be sent through facsimile or short message service.

(6) The agenda of a meeting shall be circulated by the Secretary to the members at least seven days before a meeting.

(7) Notices of motions for inclusion of any item in the agenda shall reach the Secretary at least seven days before the meeting:

Provided that the Chairperson of the Council may permit inclusion of any item for which due notice has not been received.

(8) The decision of the Chairperson of the Council in regard to all questions of procedure shall be final.

(9) The minutes of the proceedings of a meeting of the Council shall be drawn up by the Secretary and circulated to the members of the Council.

(10) The minutes together with any amendment suggested shall be placed for confirmation of the Council at its next meeting.

(11) After the minutes are confirmed and signed by the Chairperson of the Council, they shall be recorded in a minute book which shall be kept open for inspection of the members of the Council at all times during office hours.

(12) All questions considered at the meeting of the Council shall be decided by a majority of the votes of the members present including the Chairperson of the Council:

Provided that if the votes are equally divided, the Chairperson of the Council shall have a second or casting vote.

4. Functions of the Council.– The Council shall perform the functions assigned to it in the following manner namely : –

(a) the Council shall exercise such powers and perform such duties as are assigned to it by the Act;

(b) where it is not expedient to convene a meeting, the Secretary may with the approval of the Chairperson of the Council circulate such item or items as are considered necessary among the ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 members so as to obtain their comments to enable the Chairperson of the Council to take decisions thereon and such matters shall be reported to the Council at its next meeting;

(c) if, in the opinion of the Chairperson, any emergency has arisen which requires immediate action, the Chairperson may take such actions which are deemed necessary and shall report the same to the Council at its next meeting.

5. Travelling and other allowances.– (1) The travelling allowances of the members of the Council referred to in clauses (viii) and (iv) of sub-section (2) of section 40 of the Act shall be regulated as per the rules applicable to Group ‘A’ Officers of the equivalent Grade in the Central Government.

(2) The members of the Council referred to in clause (ii) of sub-section (2) of section 40 of the Act shall be entitled to such traveling and daily allowances as are admissible to them as Members of Parliament appointed in Committees and Commissions set up by the Government of India.

(3) The members of the Council referred to in clauses (i), (iii), (v), (vi), (vii), (ix), (x) and (xi) of subsection (2) of section 40 of the Act shall be entitled to such traveling and daily allowances as are admissible to them under the rules of their employing bodies.

(4) The members shall claim their traveling and daily allowances from their respective organisations to which they belong or the Central Government or as the case may be, the Council Secretariat.
