झारखÖड गजट असाधारण अंक झारखÖड सरकार Ʈारा Ĥकािशत 9 वैशाख, 1938 (श०) संÉ या 292 राँची, शुĐवार, 29 अĤैल, 2016 (ई०) पय[टन, कला संèकृित, खेलकूद एव ंयवुा काय[ ǒवभाग (पय[टन Ĥभाग) ---------- अिधसूचना 27 अĤैल, 2016 संÉया - पय[॰/यो॰-23/2015 – 05-- झारखÖड राÏय मɅ Ǒकसी èथल को पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ घोǒषत/िचǔÛहत करने हेतु झारखÖड पय[टन èथल (संर¢ण एवं रख-रखाव) अिधिनयम, 2015 के धारा-3 के अÛतग[त Ǒकए गए Ĥावधान के आलोक मɅ सàयक ǒवचारोपराÛत राÏय सरकार Ʈारा झारखÖड राÏय मɅ Ǒकसी èथल को पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ घोǒषत/िचÛहȣत करने हेतु एक िनयमावली (अंĒेजी एवं ǑहÛदȣ) तैयार Ǒकया गया है, जो पǐरिशƴ के Ǿप मɅ संलÊन है ।
2. झारखÖड राÏय मɅ Ǒकसी èथल को पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ घोǒषत/िचÛहȣत करने हेतु उƠ िनयमावली (अंĒेजी एवं ǑहÛदȣ) को अिधसूिचत Ǒकया जाता है ।
3. इस पर ǒवभागीय मंğी का अनुमोदन ĤाƯ है ।
4. यह अिधसूचना झारखÖड गजट मɅ Ĥकाशन कȧ ितिथ से लागू होगा । झारखÖड राÏयपाल के आदेश से, अǒवनाश कुमार, सरकार के सिचव । 2 झारखÖड गजट (असाधारण) शĐुवार, 29 अĤैल, 2016 पय[टन, कला, संèकृित, खेलकूद एवं युवा काय[ ǒवभाग झारखÖड राÏय मɅ Ǒकसी èथल को पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ िचǔÛहत करने हेतु िनयमावली झारखÖड राÏय मɅ Ĥचुर माğा मɅ आकष[क एंव मनोरम पय[टन èथल है ǔजस कारण काफȧ संÉया मɅ पय[टक इन èथलɉ पर ħमण को आते हɇ। इन èथलɉ को ‘पय[टक èथल या Ĥ¢ेğ’ के Ǿप मɅ घोǒषत करने हेतु समय-समय पर ǒविभÛन İोतɉ से बहुत सारे अिधयाचनाएँ ǒवभाग को ĤाƯ होते रहते हɇ, परÛतु राÏय मɅ Ǒकसी èथल को ‘पय[टक èथल या Ĥ¢ेğ’ के Ǿप मɅ घोǒषत करने हेतु पूव[ मɅ कोई िनयमावली नहȣं होने के कारण अब तक Ǒकसी भी èथल को ‘पय[टक èथल या Ĥ¢ेğ’ के Ǿप मɅ घोǒषत नहȣं Ǒकया जा सका है। Ǒकसी èथल या Ĥ¢ेğ को पय[टक èथल के Ǿप मɅ घोǒषत करने कȧ आवæयकता एवं पय[टन कȧ संभावनाओं को देखते हुए तथा झारखÖड पय[टन èथल (संर¢ण एवं रख-रखाव) अिधिनयम, 2015 के धारा- 3 के अÛतग[त Ǒकए गए Ĥावधान के आलोक मɅ यह िनयमावली तैयार Ǒकया गया है, जो िनàनवत ्है:-
1. संǔ¢Ư नाम, ǒवèतार एवं Ĥारàभ:-
(1) यह िनयमावली झारखÖड राÏय मɅ Ǒकसी èथल को परय्टक èथल या Ĥ¢ेğ के Ǿप मɅ िचǔÛहत करने हेतु िनयमावली कहȣ जाएगी।
(2) इसका ǒवèतार सàपूण[ झारखÖड राÏय मɅ होगा।
(3) यह उस तारȣख से Ĥवƣृ होगा जो राÏय सरकार राजपğ मɅ अिधसूचना Ʈारा इस िनिमƣ अिधिनयिमत करɅ।
2. पǐरभाषाएँ :- जबतक Ǒक ǒवषय या संदभ[ मɅ कोई ǒवǾƨ बात न हो इस िनयमावली मɅ- (क) ‘‘ Ĥधान सिचव/सिचव’’ से अिभĤेत है राÏय सरकार Ʈारा सàयक Ǿप से िनयुƠ Ǒकसी ǒवभाग का Ĥधान सिचव/सिचव ;
(ख) ‘‘उपायुƠ” से अिभĤेत है राÏय सरकार Ʈारा सàयक Ǿप से िनयुƠ ǔजला दंडािधकारȣ-सह-उपायुƠ;
3 झारखÖड गजट (असाधारण) शुĐवार, 29 अĤैल, 2016 (ग) ‘‘ǔजला पय[टन Ĥो×साहन पǐरषɮ” से अिभĤेत है ǒवभाग Ʈारा पय[टन के ǒवकास से संबंिधत कायɟ को करने हेतु ǔजला èतर पर अिधसूिचत पǐरषद ;
(घ) ‘‘राÏय पय[टन Ĥो×साहन पǐरषɮ” से अिभĤेत है ǒवभाग Ʈारा पय[टन के ǒवकास से संबंिधत कायɟ को करने हेतु राÏय èतर पर अिधसूिचत पǐरषद;
(ड.) ‘‘ǒवभाग” से अिभĤेत है पय[टन, कला संèकृित, खेलकूद एवं युवा काय[ ǒवभाग, झारखÖड, राँची ;
(च) ‘‘पय[टक” से अिभĤेत है झारखÖड राÏय मɅ ħमण को आनेवाले तीथ[ याǒğयɉ, लोग या लोगो को समूह ;
3. पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ घोǒषत करने कȧ ĤǑĐया:- I. पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ घोǒषत करने हेतु Ǒकसी भी माÚयम यथा जन आवेदन, संचार माÚयम या अÛय माÚयम इ×याǑद से ǒवभाग को ĤाƯ होने वाला कोई भी Ĥèताव संबंिधत ǔजले के उपायुƠ को अĒसाǐरत कर Ǒदया जाएगा। Ǒकसी èथल या Ĥ¢ेğ से संबंिधत वैसे Ĥèताव जो इस िनयमावली के अधीन उपयुƠ समझा जाय को उपायुƠ èवःĤेरणा लेते हुए अवलोकनोपरांत सारȣ औपचाǐरकताओं को पूरा करते हुए Ĥèताव ǒवभाग को अĒसाǐरत कर सकते हɇ। II. Ǒकसी èथल या Ĥ¢ेğ के पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ पहचान या िचǔÛहत करने कȧ सàभावना पर ǒवचार ǒवमश[ करने हेतु ĤाƯ सभी Ĥèतावɉ को ǔजला पय[टन Ĥो×साहन पǐरषद (DTPC) के सम¢ रखा जायेगा।
4. èथल या Ĥ¢ेğ के िचǔÛहतीकरण हेतु सामाÛय मापदÖड:- Ǒकसी भी èथल या Ĥ¢ेğ का पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ िचǔÛहतीकरण हेतु सामाÛय मापदÖड िनàनवत हɉगे - I. èथल या Ĥ¢ेğ के पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ महƣा (पƵृभूिम एवं महƣा का कारण)। 4 झारखÖड गजट (असाधारण) शĐुवार, 29 अĤैल, 2016 II. ǒपछले तीन (03) वषɟ मɅ उƠ èथल पर राÏय, राÏय के बाहर तथा ǒवदेश से ħमण करने आने वाले सैलािनयɉ कȧ संÉया। III. उƠ èथल का पूव[वतȸ, ऐितहािसक/धािम[क एंव सांèकृितक मह×व से संबंिधत सभी सूचना। IV. िनकटतम रेल, रोड एवं जल माग[ से उƠ èथल का जुड़ाव। V. पय[टक èथल या Ĥ¢ेğ के Ǿप मɅ ǒवकिसत या घोǒषत होने के उपराÛत पय[टकɉ कȧ संÉया मɅ वǒृƨ कȧ संभावनाएँ (पय[टकɉ के आने कȧ Ĥ¢ेपण)। VI. वत[मान मɅ उƠ èथल मɅ उपलÞध संरचनाएँ - होटल, धम[शालाएँ, िनǐर¢ण भवन, गेèट हाऊस, Revenue Rest Shed आǑद से िनकटता। VII. उƠ संभाǒवत èथल के ǒवकास हेतु समèया मुƠ/अितĐमण मुƠ एवं आसानी से िमलने वाले सरकारȣ भूिम कȧ उपलÞधता तथा इसका भǒवçय। VIII. ǔजला Ĥशासन Ʈारा उƠ èथल के ǒवकास के िलए पूव[ से उपलÞध कराए जाने वाले िनिधयɉ का (Dovetailing) तथा अÛय İोतɉ से जैसे CSR, Donation इ×याǑद से िनिधयɉ कȧ ĤािƯ कȧ संभावनाएँ। IX. भǒवçय मɅ कȧ जाने वाली सुǒवधाओं के रख-रखाव/र¢ा इ×याǑद हेतु Ěèट/बोड[/सिमित कȧ मौजूदगी। X. संभाǒवत ¢ेğ जहाँ से पय[टकɉ के आने कȧ संभावना है।
5. उƠ èथल के संबंध मɅ ǔजला पय[टन Ĥो×साहन पǐरषɮ (DTPC) कȧ अनुशंसा ĤाƯ होने के बाद संबंिधत ǔजले के उपायुƠ उसे मंतåय के साथ राÏय पय[टन Ĥो×साहन पǐरषɮ (STPC) के सम¢ ǒवचार हेतु अĒसाǐरत करɅगे। 5 झारखÖड गजट (असाधारण) शुĐवार, 29 अĤैल, 2016
6. ǔजला पय[टन Ĥो×साहन पǐरषɮ (DTPC) Ʈारा उƠ èथल के संबंध मɅ Ǒकये गये अनुसंशा के समी¢ोपरानत् राÏय पय[टन Ĥो×साहन पǐरषɮ (STPC) अपने मंतåय सǑहत Ĥèताव को सिचव, पय[टन, कला संèकृित, खेलकूद एवं युवा काय[ ǒवभाग, झारखÖड को अĒसाǐरत करेगा।
7. राÏय पय[टन Ĥो×साहन पǐरषɮ (STPC) Ʈारा Ǒदये गये अनुशंसा के आधार पर सिचव, पय[टन, कला संèकृित, खेलकूद एवं युवा काय[ ǒवभाग, झारखÖड Ʈारा िनण[य िलया जायेगा एवं उƠ िनण[य अंितम होगा।
8. सिचव, पय[टन, कला संèकृित, खेलकूद एवं युवा काय[ ǒवभाग, झारखÖड Ʈारा िलये गये िनण[य के आलोक मɅ Ǒकसी भी èथल को पय[टक èथल या Ĥ¢ेğ घोǒषत/अिधसूिचत Ǒकया जायेगा । झारखÖड राÏयपाल के आदेश से, अǒवनाश कुमार, सरकार के सिचव । उपरोƠ अिधसूचना का अंĒेजी मɅ िनàनिलǔखत अनुवाद झारखÖड राÏयपाल के Ĥािधकार से इसके Ʈारा Ĥकािशत Ǒकया जाता है जो भारतीय संǒवधान के अनुÍछेद 348 के खÖड (3) के अधीन अंĒेजी भाषा मɅ उसका Ĥािधकृत पाठ समझा जायगा । 6 झारखÖड गजट (असाधारण) शĐुवार, 29 अĤैल, 2016 DEPARTMENT OF TOURISM,ART CULTURE, SPORTS AND YOUTH AFFAIRS RULES FOR IDENTIFICATION OF TOURIST PLACE OR ZONE IN JHARKHAND Rules for Identification of Tourist Place or Zone in Jharkhand There are so many places in our state which are much attractive and a lot of peoples come to visit these spots or sights. The Department has got so many demands to declare such places or zones as "Tourist Places or zones". But till now this could not be done as there is no rule to declare any place or zone as Tourist place or zone. So there is need to prepare a rule for the same. Seeing the tourism potentiality and necessity to declare a place as tourist place or zone and in exercise of the powers conferred upon by the Section 3 of The Jharkhand Tourist Places (Protection and Maintenance) Act, 2015 an elaborative rule is prepared which is as follows:-
1. Short title, extent and commencement – i. This Rule shall be called the Rules for Identification of Tourist Place or Zone in Jharkhand State.
ii. It shall extend to the whole of the State of Jharkhand.
iii. It shall come into force on such date as the State Government may, by notification in the official gazette, declare.
2. Definition - In this Rule unless contrary intention appears from the context :- a) Principal Secretary/Secretary means Principal Secretary/ Secretary of a Department of the State Government, duly appointed/specified by Government of the State.
b) Deputy Commissioner means District Magistrate-cum-Deputy Commissioner of the District, duly appointed/specified by Government of the State.
c) District Tourism Promotion Council means a council notified by the department at district level for doing Tourism related work/ activity.
d) State Tourism Promotion Council means a council notified by the department at state level for doing Tourism related work / activity.
7 झारखÖड गजट (असाधारण) शुĐवार, 29 अĤैल, 2016 e) Department means Department of Tourism, Art Culture, Sports and Youth Affairs, Government of Jharkhand.
f) Tourist means a person or group of persons, including pilgrims visiting the State of Jharkhand, for the purpose of Tourism.
3. Process to declare Tourist Place or Zone - i. Any proposal for identification of any place or zone as Tourist Place or Zone received by the department by any means like public petition, through media etc., shall be forwarded to the concerning Deputy Commissioner of the district. The Deputy Commissioner may also suo moto process such proposals as he thinks fit under this Rule.
ii. All such proposals shall be placed before District Tourism Promotion Council (so called thereafter DTPC) to consider the potential of the place for its identification as a Tourist Place or Zone.
4. General Criteria for identification / notification of tourist place :- General Criteria for identification of tourist place or zone will be as follows ;
i) Importance of the site from Tourists/Visitors viewpoint (the main USP of the place) ii) Flow of Visitors – Flow of Tourists/Visitors to that particular place or zone within Jharkhand or from outside Jharkhand and foreign countries in the last three years.
iii) For all historical / pilgrimage centers, the antecedents of the site. (How old is the site and its Cultural significance) iv) Connectivity available like nearest Rail head, Road & water route (distances).
v) Possibility to increase the number of visitors if the place is identified and developed (Projection of tourist footfall).
vi) Present infrastructure available – proximity to Tourist centre such as units like Hotels, Dharamasalas, Inspection Bhawan, Guest House, Revenue Rest Shed.
vii) Availability of problem-free / encroachment-free admissible Government Land, for proposed site & its future development.
viii) Dovetailing of funds already initiated by District administration for the development of the site and possibility of other sources of funding like CSR, Donation etc.
8 झारखÖड गजट (असाधारण) शĐुवार, 29 अĤैल, 2016 ix) Existence of a Trust / Board / Committee for development of future upkeep of facilities.
x) Prospective Areas from where Tourists can be expected to come.
5. The recommendation of the DTPC shall be forwarded to State Tourism Promotion Council (so called thereafter STPC) by the Deputy Commissioner of the concerning district with his comments.
6. The STPC after reviewing on the recommendation of DTPC shall forward the matter with its recommendation to the Secretary, Tourism, Art Culture, Sports and Youth Affairs, Jharkhand.
7. The Secretary, Tourism, Art Culture, Sports and Youth Affairs, Jharkhand shall take decision on the recommendation of STPC and that decision shall be final.
8. On the decision of the Secretary, Tourism, Art Culture, Sports and Youth Affairs, Jharkhand a place shall be notified as a Tourist Place or Zone.
