And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838 (E) dated the 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time ( hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length 60.47 Km (hereinafter referred to as “base rate”) for use of the two lane with paved shoulders sections or more on the Type of Vehicles specified in column (1) of Table 1 below, for the use of the section from kilometre

3.45 Oversized Vehicles (seven or more axles) 4.20 1 As per Rule 4(3), the rate of fee for use of a section of NH having 2-lanes shall be 60%.
2 The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza:
Location of Toll Plaza (chainage) Length (in km) for which Fee is payable Km 23.500 (near Balgudar village in Lakhisarai district) 60.47 3 In addition to above, the fee shall also be due and payable for one no. of bypass (Barahiya Bypass ) costing Rs 10 crore or more at the following Toll Plaza at one and half times of the base rate for the length of bypass specified for such Toll Plaza as under after completion of the said bypass.
Location of Toll Plaza (chainage) Length of bypasses (in km) for which additional fee is payable Km 23.500 (near Balgudar village in Lakhisarai district) 8.10 Km (Barahiya Bypass) 4 The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
5 For multiple journey on the highway section, passes shall be issued at the following rates, namely:
Amount Payable Maximum number of one way journeys allowed Period of validity One and half times of the fee for one way journey Two Twenty four hours from the time of payment Two-third of amount of the fee payable for fifty single journeys Fifty or more One month from date of payment 6 Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7 Mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 8 All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.
9 The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
10 Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
11 The estimated capital cost of the project is Rupees 351.54 crores. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
