PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् अजधसचूना नई दिल् ली, 7 िनवरी, 2026 का.आ. 109(अ).— भारत के राजपत्र, असाधारण भाग II, खंड 3, उपखंड (ii) में भारत सरकार के पर्ाावरण, वन और जलवारु् पररवतान मंत्रालर् की अधधसूचना संख्र्ा का.आ. 1933 (अ), तारीख 29 अप्रैल 2025 के माध्र्म से एक प्रारुप अधधसूचना प्रकाशित की गई थी, जजसमें उक्त अधधसूचना की प्रततर्ा ंजनता को उपलब्ध कराए जाने की तारीख स ेसाठ दिनों की अवधध के भीतर इससे प्रभाववत होने वाले सभी व्र्जक्तर्ों से आक्षेप और सुझाव आमतं्रत्रत ककए गए थे;
और, उक्त प्रारुप अधधसूचना को अंतववाष्ट करने वाली राजपत्र की प्रततर्ां जनता को तारीख तारीख 29 अप्रैल 2025 को उपलब्ध करा िी गई थी;
और, उक्त प्रारुप अधधसूचना की प्रततकिर्ा में व्र्जक्तर्ों और पणधाररर्ों से प्राप्त आक्षेप और सुझावों पर कें द्रीर् सरकार द्वारा ववचार ककर्ा गर्ा है;
और, राजौली (नवािा) वन्र्जीव अभर्ारण्र् त्रिहार राज्र् के नवािा जजल ेके राजौली ब्लॉक में जथथत है और इसका क्षेत्रफल 27.37 वगा ककलोमीटर है। र्ह अभर्ारण्र् तीन ब्लॉकों में ववभाजजत है: दििाउर भाग-1 (12.76 वगा ककलोमीटर), चटकारी (6.25 वगा ककलोमीटर) और दििाउर भाग-2 (8.36 वगा ककलोमीटर)। राष्रीर् राजमागा-31 इस अभर्ारण्र् को दििाउर 1 और दििाउर 2 में ववभाजजत करता है। स.ं 99] नई दिल्ली, बुधवार, िनवरी 7, 2026/पौष 17, 1947 No. 99] NEW DELHI, WEDNESDAY, JANUARY 7, 2026/PAUSHA 17, 1947 सी.जी.-डी.एल.-अ.-08012026-269196 CG-DL-E-08012026-269196 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, त्रिहार सरकार द्वारा वन्र्जीव संरक्षण अधधतनर्म, 1972 की धारा 18 के अधीन राजौली (नवािा) वन्र्जीव अभर्ारण्र् को अधधसूचना संख्र्ा: वन्र् प्राणी – 07/19/527 (अ), तारीख 10 मई 2019 द्वारा अधधसूधचत ककर्ा गर्ा था। और, चैंवपर्न एवं सेठ वन वगीकरण के अनुसार, र्ह अभर्ारण्र् उष्णकदटिंधीर् िुष्क पणापाती वन का घर है और छोटा नागपुर पठार जैव-भौगोशलक क्षेत्र के िक्कन पठार पर जथथत है। और जिकक, राजाउली (नवािा) वन्र्जीव अभर्ारण्र् में िेि का सिस ेसमदृ्ध अभ्रक भंडार है और संरक्षक्षत वन में खनन पर प्रततिंध लगाने से पहल ेसरकार द्वारा पट्टे पर दिए गए क्षते्र में कई अभ्रक खिानें संचाशलत थीं। और, संरक्षक्षत क्षते्र में मौजूि पुष्प प्रजाततर्ााँ- अरार (अकेशसर्ा पेनाटा), अकवन (कैलोरोवपस धगगेंटेन), आंवला (एज्ब्लका ऑकफशसनैशलस), ििूल (केशसर्ा अरेत्रिका), िंटुलसी (पेररल्ला ओसीमोइड्स), िीजासाल (पेटोकापास मारुसुवपर्म), िररर्ार (शसडा कॉर्ड ाफोशलर्ा), िहारा (टशमानशलर्ा िेलेररका , चामरोर (एहे्रदटर्ा लीववस), चोरैंथ (हेटरोपोगन कॉन्टोटास), ढेला (एलैंधगर्म साजल्वफोशलर्ाम), धावई (वुडफोर्ड ार्ा फु्रदटकोसा), ग्हार (गमेशलना आिोररर्ा), हरे (टशमानशलर्ा चेिुला), काज (त्रिडेशलर्ा रेटुसा), कुसुम (श्लेइचेरा ओलेओसा), कें झी (थटरकुशलर्ा रू्रेन्स), कोकुर-खस (वेदटवरेरर्ा ज़ि़िातनर्ोइड्स), केकर (गरुगा वपनाटा), महुआ (मधुका इंर्डका), वपर्ार (िुचनातनर्ा लाऩिान), पटधामन (ग्रेववर्ा इलाजथटक), सतवार (एथपेरेगस ररसेमोसस), सेमल (सलमाशलर्ा माल्िररका), सलाई (िोसवेशलर्ा सेराटा), शसधा (लेगरथरोशमर्ा परववफ्लोर), सागवान (टेक्टोना ग्रैंर्डस), उिल (थटरकुशलर्ा ववलोसा) )वगैरह हैं;
और, इस क्षेत्र में पाई जाने वाली िलुाभ, ववलुप्तप्रार्: और संकटग्रथत पुष्प प्रजाततर्ां भेलाओ (सेशमकोरपस एनाकार्ड ार्म), टी. िेडेम (टशमानशलर्ा कैटाप्पा ), हल्ि ू (एर्डना कार्ड ार्डफोशलर्ा), वनप्र्ाज (उजजातनर्ा इंर्डका), धचरार्ते (थवदटार्ा धचरार्ता), रोजवुड (डोलिधगार्ा लैदटफोशलर्ा), महुआ (मधुका लॉजन्गफेशलर्ा), काइंड (डार्ोथपार्रोस मेलानोजक्सलीन), जंगली िेल (एगल मामेलोस) हैं;
और, वन्र्जीव अभर्ारण्र् में पाई जाने वाली िलुाभ ववलुप्तप्रार् और संकटग्रथत जीव-जंतु प्रजाततर्ााँ हैं- जंगल त्रिल्ली (फेशलस चाउस) , साही (दहजथरक्स इंर्डका), हॉग दहरण (एजक्सस पोशसानस), जंगली सूअर (सस थिोफा), िाककिं ग दहरण (मंदटर्ाकस मंुटजकै), थलॉथ भालू (मेलसास रू्ररशसनस), नेवला (हपेथटेस उवाा), पोंगेशलन, शसवेट (वववेररराकुला इंर्डका). अन्र् ररकॉडार जीव प्रजाततर्ों में धचत्तल (एजक्सस एजक्सस), सांभर (सवास रू्तनकोलर), खरगोि (लेपस नाइग्रीकोशलस), हाइना (हाइना हाइना), नीलगार् (िोसेलाफस रैगोकैमेलस), शसर्ार (कोतनस ऑररर्स), भारतीर् लोमडी (वुल्प्स िेंगालेंशसस);
और, वन्र्जीव अभर्ारण्र् से प्राप्त प्रमुख पक्षी प्रजाततर्ााँ चील (शमल्वस माइग्रन्स), धनेि (ओसीसेनोस त्रिरोजथरस), ब्लैक थटॉका (शससोतनर्ा नाइग्रा), जंगल वप्रतनर्ा (वप्रतनर्ा शसल्वेदटका), कोर्ल (कुकुलस फुगैक्स), ब्लैक हेडेड मुतनर्ा (मलक्का आदटाकैवपला), कॉमन िेन (ग्रस ग्रस), इंर्डर्न कौरसर (कसोररर्स कोरोमन डेशलकस), उल्लू (ओटस लेदटर्ा), घुघु (िुिो िेंगालेंशसस) हैं;
और, राजौली (नवािा) वन्र्जीव अभर्ारण्र् से लगे इस अधधसूचना के पैरा 1 में तनदिाष्ट सीमा और ववथतार को पाररजथथततकी और पर्ाावरणीर् दृजष्टकोण से पाररजथथततकी संवेिी जोन के रूप में संरक्षक्षत और सुरक्षक्षत रखना आवश्र्क है और उक्त पाररजथथततकी संवेिी जोन में उद्र्ोगों र्ा उद्र्ोगों के वगा तथा उनके प्रचालन और प्रकिर्ाएं प्रततविद्ध करना आवश्र्क है;
अर्ः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) तनर्म, 1986 के तनर्म 5 के उपतनर्म (3) के साथ पदठत, पर्ाावरण (संरक्षण) अधधतनर्म 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उपधारा (2) के खंड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजक्तर्ों का प्रर्ोग करत ेहुएत्रिहार राज्र् में राजौली (नवािा) वन्र्जीव अभर्ारण्र् की सीमा से 0 ककमी से 4.965 ककमी की सीमा तक के क्षेत्र को राजौली (नवािा) वन्र्जीव अभर्ारण्र् पाररजथथततकी संवेिी जोन (जजसे इसके पश्चात ्पाररजथथततकी संवेिी जोन कहा जाएगा) के रूप में अधधसूधचत करती है, जजसके ब्र्ौरे तन्नानुसार हैं, अथाात:- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 -सयरणी-
1. पयररस्थितर्की संवेदी जोन कय ववथर्यर और सीमयए.ँ- (1) पाररजथथततकी संवेिी जोन राजौली (नवािा) वन्र्जीव अभर्ारण्र् की सीमा के आसपास 0.00 ककमी से 4.965 ककमी तक फैला हुआ है और पाररजथथततकी संवेिी जोन का क्षेत्रफल लगभग 100.15 वगा ककलोमीटर है। ववशभन्न दििाओं में पाररजथथततकी संवेिी जोन की ववशिष्ट सीमा नीचे सारणी में िी गई है:

4.060 ककलोमीटर उत्तर-पजश्चम िभनी पी.एफ. 3.351 ककलोमीटर दटप्पण: राष्रीर् राजमागा संख्र्ा 31 अभर्ारण्र् के दििौर-1 और दििौर-2 खंडों को िो भागों में ववभाजजत करता है, जो त्रिहार, झारखडं, पजश्चम िंगाल और आस-पास के राज्र्ों के िीच एक महत्वपूणा संर्ोजक के रूप में कार्ा करता है। उल्लेखनीर् है कक इस राजमागा का तनमााण 1972 में वन्र्जीव संरक्षण अधधतनर्म के लागू होने से पहल ेककर्ा गर्ा था और अभर्ारण्र् की झारखंड राज्र् सीमा से तनकटता को िेखते हुए, 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] झारखंड राज्र् सीमा के साथ दििा में पाररजथथततकी संवेिी जोन को िून्र् के रूप में नामतनदिाष्ट ककर्ा गर्ा है।
(2) राजौली वन्र्जीव अभर्ारण्र् के आसपास के पाररजथथततकी सवंेिी जोन का सीमा वववरण उपयबंध-I के रूप में संलग्न है ।
(3) पाररजथथततकी संवेिी जोन के मानधचत्र अक्षांि और िेिांतर सदहत उपयबंध II क, II ख और II ग के रूप में संलग्न हैं।
(4) राजौली वन्र्जीव अभर्ारण्र् और उसके पाररजथथततकी संवेिी जोन की सीमा के भू-तनिेिाकंों की सूची उपयबंध -III की सयरणी क और सयरणी ख में िी गई है।
(5) पाररजथथततकी संवेिी जोन में आने वाले गांवों की सूची उपयबंध IV में संलग्न है।
2. पयररस्थितर्की संवेदी जोन के ललए आंचललक महयर्ोजनय. - (1) राज्र् सरकार, पाररजथथततकी संवेिी जोन के प्रभावी प्रिंधन के प्रर्ोजनों के शलए, अधधसूचना के प्रकािन की तारीख से िो विा की अवधध के भीतर एक आंचशलक महार्ोजना तैर्ार करेगी। थथानीर् लोगों के परामिा से तथा इस अधधसूचना में दिए गए उपिंधों का पालन करत े हुए राज्र् सरकार में सक्षम प्राधधकारी के अनुमोिन हेतु आधधकाररक राजपत्र में अंततम अधधसूचना जारी की जाएगी ।
(2) पाररजथथततकी संवेिी जोन के शलए आंचशलक महार्ोजना राज्र् सरकार द्वारा इस अधधसूचना में ववतनदिाष्ट तरीके से और प्रासंधगक कें द्रीर् और राज्र् कानूनों और कें द्रीर् सरकार द्वारा जारी मागाििाक शसद्धांतों, र्दि कोई हो, के अनुरूप तैर्ार ककर्ा जाएगा।
(3) उक्त आंचशलक महार्ोजना को राज्र् सरकार के तन्नशलखखत ववभागों के परामिा से तैर्ार ककर्ा जाएगा, ताकक उक्त र्ोजना में पाररजथथततकी और पर्ाावरणीर् पहलुओं को एकीकृत ककर्ा जा सके ;
i. पर्ाावरण;
ii. वन एवं वन्र्जीव;
iii. कृवि;
iv. राजथव;
v. िहरी ववकास;
vi. पर्ाटन;
vii. ग्रामीण ववकास;
viii. शसचंाई और िाढ़ तनरं्त्रण;
ix. नगरपाशलका;
x. पंचार्ती राज;
xi. लोक तनमााण ववभाग;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 xii. राजमागा; और xiii. राज्र् प्रििूण तनरं्त्रण िोडा।
(4) आंचशलक महार्ोजना र्ह भी सुतनजश्चत करेगा कक अनुमोदित मौजूिा भूशम उपर्ोग, िुतनर्ािी ढाचंे और किर्ाकलापों पर कोई प्रततिधं न लगार्ा जाए, जि तक कक इस अधधसूचना में ऐसा ववतनदिाष्ट न ककर्ा गर्ा हो और आंचशलक महार्ोजना में सभी अवसंरचनाएाँ और कार्ाकलापों को और अधधक कुिल और पर्ाावरण अनुकूल िनाने के शलए सुधार को सज्मशलत ककर्ा जाएगा।
(5) आंचशलक महार्ोजना में जल-ववहीन क्षते्रों के पुनरुद्धार, ववद्र्मान जल तनकार्ों के संरक्षण, जलग्रहण क्षेत्रों के प्रिंधन, जलग्रहण प्रिंधन, भूजल प्रिंधन, मिृा और नमी संरक्षण, थथानीर् समुिार् की आवश्र्कताओं तथा पाररजथथततकी और पर्ाावरण के ऐसे अन्र् पहलुओं, जजन पर ध्र्ान िेने की आवश्र्कता है, के शलए उपािंध ककर्ा जाएगा।
(6) आंचशलक महार्ोजना में सभी मौजूिा पूजा थथलों, गांवों और िहरी िजथतर्ों, वनों के प्रकार और ककथमों, कृवि क्षते्रों, उपजाऊ भूशम, हररत क्षेत्र, जैस ेपाका और इसी तरह के थथान, िागवानी क्षेत्र, िाग-िगीचे, झीलें और अन्र् जल तनकार्ों को मौजूिा और प्रथताववत भूशम उपर्ोग वविेिताओं का ब्र्ौरा िेने वाले मानधचत्रों के साथ धचजननत ककर्ा जाएगा।
(7) आंचशलक महार्ोजना पाररजथथततकी संवेिी जोन में ववकास को ववतनर्शमत करेगा तथा इस अधधसूचना के पैरा 4 में ताशलका में सूचीिद्ध प्रततविद्ध, ववतनर्शमत और संवधधात किर्ाकलापों का अनुपालन करेगा तथा थथानीर् समुिार्ों की आजीववका की सुरक्षा के शलए पाररजथथततकी अनुकूल ववकास सुतनजश्चत करेगा।
(8) आंचशलक महार्ोजना, क्षेत्रीर् ववकास र्ोजना के साथ सह-काशलक होगी।
(9) इस प्रकार अनुमोदित आंचशलक महार्ोजना, इस अधधसूचना के उपिंधों के अनुसार तनगरानी सशमतत के शलए उसके कार्ों के कार्ाान्वर्न हेतु संिभा िथतावेज होगा।
(10) पाररजथथततकी-संवेिी जोन के शलए आंचशलक महार्ोजना की तैर्ारी और अनुमोिन तक, कोई भी नई ववकासात्मक कार्ाकलाप उप-पैरा (1) और (2) के पैराग्राफ 6 में ववतनदिाष्ट उपिंधों द्वारा िाशसत होंगे।
3. रयज्र् सरकयर द्वयरय ककए जयने वयले उपयर्.- राज्र् सरकारें इस अधधसूचना के उपिंधों को प्रभावी करने के शलए तन्नशलखखत उपार् करेंगी, अथाात:- (क) 1. भूलम उपर्ोग: पाररजथथततकी संवेिी जोन में मनोरंजन के प्रर्ोजनों के शलए धचजन्हत वन, िागवानी क्षेत्र, कृवि क्षते्र तथा पाका और खुले थथान का उपर्ोग वाखणजज्र्क, आवासीर् र्ा औद्र्ोधगक कार्ाकलापों के शलए नहीं ककर्ा जाएगा र्ा उन्हें पररवततात नहीं ककर्ा जाएगा। परंतु पाररजथथततकी संवेिी जोन के भीतर, ऊपर खंड (क) में ववतनदिाष्ट उद्िेश्र् के अलावा ककसी अन्र् उद्िेश्र् के शलए कृवि और अन्र् भूशम के पररवतान की अनुमतत तनगरानी सशमतत की शसफाररि पर और र्थाप्रर्ोज्र् क्षते्रीर् नगर तनर्ोजन अधधतनर्म और कें द्र सरकार र्ा राज्र् सरकार के अन्र् तनर्मों और ववतनर्मों के अधीन सक्षम प्राधधकारी के पूवा अनुमोिन से और इस अधधसूचना के उपिंधों के अनुसार थथानीर् तनवाशसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के शलए िी जा सकती है, रे् तन्नानुसार हैं: - i. ववद्र्मान सडकों का चौडीकरण एवं सुदृढ़ीकरण तथा नई सडकों का तनमााण;
ii. अवसंरचना और नागररक सुववधाओं का तनमााण और नवीनीकरण;

iv. कुटीर उद्र्ोग जजनमें ग्रामोद्र्ोग भी िाशमल है; सुववधाजनक थटोर और गहृ वास सदहत पररजथथततकी पर्ाटन को समथान िेने वाली थथानीर् सुववधाएं; तथा v. अनुच्छेि 4 के सारणी में दिए गए प्रवधधात कार्ाकलाप;
परंतु र्ह भी कक, राज्र् सरकार के पूवा अनुमोिन के त्रिना तथा भारत के संववधान के अनुच्छेि 244 र्ा अनुसूधचत जनजातत और अन्र् परंपरागत वन तनवासी (वन अधधकारों की मान्र्ता) अधधतनर्म, 2006 (2007 का 2) सदहत वतामान में प्रर्ोज्र् कानून के उपिंधों के अनुपालन के त्रिना जनजातीर् भूशम के उपर्ोग को वाखणजज्र्क और औद्र्ोधगक ववकास किर्ाकलापों के शलए अनुज्ञा नहीं िी जाएगी;
परंतु र्ह भी कक पाररजथथततकी संवेिी जोन के भीतर भूशम अशभलखेों में दिखाई िेने वाली ककसी भी त्रुदट को संिंधधत राज्र् सरकार द्वारा प्रत्रे्क मामल ेमें एक िार तनगरानी सशमतत के ववचार प्राप्त करने के िाि ठीक ककर्ा जाएगा और उक्त त्रदुट के सुधार की सूचना पर्ाावरण, वन और जलवारु् पररवतान मंत्रालर् में कें द्रीर् सरकार को िी जाएगी;
परंतु र्ह भी उपरोक्त त्रुदट सुधार में इस उप-पैराग्राफ के अधीन दिए गए उपिंध को छोडकर ककसी भी मामल ेमें भूशम उपर्ोग में पररवतान सज्मशलत नहीं होगा;
परंतु र्ह भी कक त्रुदट के िुद्धीकरण केवल उप-पैरा के तहत दिरे् गए मामलों के अलावा भूशम- उपर्ोग का अपवतान सज्मशलत नहीं ककर्ा जाएगा (ख) वनीकरण और पर्ाावास पुनिाहाली के साथ उपर्ोग न की गई र्ा अनुवार कृवि भूशम पर पुनवातनकरण के प्रर्ास ककए जाएंगे।
(2) प्रयकृतर्क जल तनकयर् एवं झरने- सभी प्राकृततक झरनों के जलग्रहण क्षेत्रों को अशभज्ञात ककर्ा जाएगा और उनके संरक्षण और पुनरुद्धार के शलए र्ोजनाए ंआंचशलक महार्ोजना में सज्मशलत की जाएंगी और राज्र् सरकार द्वारा मागाििाक शसद्धांत इस प्रकार तरै्ार ककए जाएंगे कक इन क्षते्रों में र्ा इनके तनकट ऐसी ववकास किर्ाकलापों पर रोक लगाई जा सके जो इन क्षेत्रों के शलए हातनकारक हैं।
(3) पर्ाटन र्य पयररस्थितर्की पर्ाटन - (क) पाररजथथततकी संवेिी जोन के भीतर सभी नए पाररजथथततकी पर्ाटन, पर्ाटन गततववधधर्ा ंर्ा मौजिूा पर्ाटन किर्ाकलापों का ववथतार पाररजथथततकी संवेिी जोन के शलए पर्ाटन महार्ोजना के अनुसार होगा। (ख) पारर-पर्ाटन महार्ोजना राज्र् सरकार के पर्ाावरण एवं वन ववभाग के परामिा से पर्ाटन ववभाग द्वारा तैर्ार ककर्ा जाएगा। (ग) पर्ाटन महार्ोजना, आंचशलक महार्ोजना का एक घटक होगा। (घ) र्ह पारर-पर्ाटन महार्ोजना पाररजथथततकी संवेिी जोन की वहन क्षमता अध्र्र्न पर आधाररत होगा। (ङ) पाररजथथततकी पर्ाटन की किर्ाकलाप को तन्नानुसार ववतनर्शमत ककर्ा जाएगा, अथाात:्- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 i. एक ककलोमीटर के भीतर र्ा पाररजथथततकी संवेिी जोन की सीमा तक, जो भी तनकटतम हो, होटलों और ररसॉट्ास के ककसी भी नए संतनमााण की अनुज्ञा नहीं िी जाएगी। परंतु संरक्षक्षत क्षते्र की सीमा से एक ककलोमीटर की िरूी से परे पाररजथथततकी संवेिी जोन की सीमा तक, नए होटलों और ररसॉट्ास की थथापना केवल पर्ाटन महार्ोजना के अनुसार पाररजथथततक पर्ाटन सुववधाओं के शलए पूवा-तनधााररत और ववतनदिाष्ट क्षते्रों में ही अनुमतत िी जाएगी;
ii. पाररजथथततकी संवेिी जोन के भीतर सभी नई पर्ाटन किर्ाकलापों र्ा मौजिूा पर्ाटन किर्ाकलापों का ववथतार पर्ाावरण, वन और जलवारु् पररवतान मंत्रालर् द्वारा 2018 में जारी ककए गए पाररजथथततक-पर्ाटन मागाििाक शसद्धांतों और राष्रीर् िाघ संरक्षण प्राधधकरण द्वारा जारी पाररजथथततक-पर्ाटन मागाििाक शसद्धांतों के अनुसार होगा, जजसमें पाररजथथततक-पर्ाटन, पाररजथथततक-शिक्षा और पाररजथथततक-ववकास पर जोर दिर्ा जाएगा;
iii. जि तक आंचशलक महार्ोजना तैर्ार और अनुमोदित नहीं हो जाता, पर्ाटन के शलए ववकास और मौजूिा पर्ाटन किर्ाकलापों के ववथतार की अनुमतत संिंधधत तनर्ामक प्राधधकरणों द्वारा वाथतववक थथल-ववशिष्ट संवीक्षा और तनगरानी सशमतत की शसफाररि के आधार पर िी जाएगी।
(4) प्रयकृतर्क ववरयसर्- पाररजथथततकी संवेिी जोन में मूल्र्वान प्राकृततक ववरासत के सभी थथल, जैस ेजीन पूल आरक्षक्षत क्षते्र, चट्टान संरचनाएं, झरने, झरने, घादटर्ााँ, उपवन, गुफाएं, त्रििं,ु पैिल मागा, सैरगाह, चट्टानें आदि की पहचान की जाएगी और क्षेत्रीर् माथटर प्लान के एक भाग के रूप में उनके संरक्षण और संवधान के शलए एक ववरासत संरक्षण र्ोजना तैर्ार की जाएगी।
(5) मयनव तनलमार् ववरयसर् थिल - ऐततहाशसक, थथापत्र्, सौंिर्ा और सांथकृततक महत्व की इमारतों, संरचनाओं, कलाकृततर्ों, क्षते्रों और पररसरों की पाररजथथततकी संवेिी जोन में पहचान की जाएगी और आंचशलक महार्ोजना के दहथस ेके रूप में उनके संरक्षण की र्ोजना तैर्ार की जाएगी।
(6) ध्वतन प्रदषूण - राज्र् सरकार का पर्ाावरण ववभाग पर्ाावरण अधधतनर्म और उसके अधीन ववतनर्शमत तनर्मों के उपािंधों के अधीन ध्वतन प्रििूण (तनर्मन एवं तनरं्त्रण) तनर्म, 2000 के उपािंधों के अनुसार पाररजथथततकी संवेिी जोन में ध्वतन प्रििूण तनरं्त्रण के शलए मागाििाक शसद्धांत और तनर्म के अनुसार ककर्ा जाएगा।
(7) वयरु् प्रदषूण -राज्र् सरकार का पर्ाावरण ववभाग वारु् (प्रििूण तनवारण एवं तनरं्त्रण) अधधतनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण) अधधतनर्म, 1986 तथा इन अधधतनर्मों के अधीन तनशमात तनर्मों के उपािंधों के अनुसार पाररजथथततक संवेिी जोन में वारु् प्रििूण तनरं्त्रण के शलए मागाििाक शसद्धांत और ववतनर्म तैर्ार करेगा।
(8) अपलिष्टों कय ववसजान - पाररजथथततकी संवेिी जोन में उपचाररत अपशिष्ट जल का तनवाहन जल (प्रििूण तनवारण एवं तनरं्त्रण) अधधतनर्म, 1974 (1974 का अधधतनर्म 6) और पर्ाावरण (संरक्षण) अधधतनर्म, 1986 तथा इन अधधतनर्मों के अधीन िनाए गए तनर्मों के उपािंधों के अनुसार होगा।
(9) ठोस अपलिष्ट - ठोस अपशिष्ट का तनपटान और प्रिंधन तन्नानुसार होगा: - 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) पाररजथथततकी संवेिी जोन में ठोस अपशिष्ट तनपटान भारत सरकार के पर्ाावरण, वन और जलवारु् पररवतान मंत्रालर् की अधधसूचना सं. का.आ. 1357 (अ), तारीख 8 अप्रैल, 2016, द्वारा प्रकाशित ठोस अपशिष्ट (प्रिंधन) तनर्म, 2016 के अनुसार ककर्ा जाएगा।
(ii) थथानीर् प्राधधकरण ठोस अपशिष्ट के जैव-अविमणीर् और जैव-अनविमणीर् घटकों में पथृक्करण के शलए र्ोजना तैर्ार करेंग।े
(iii) जैव-अविमणीर् सामग्री को अधधमानतः खाि र्ा वमीकल्चर र्ा िार्ोगैस संरं्त्रों के माध्र्म स े पुनचाकित ककर्ा जाएगा।
(iv) अकािातनक सामग्री का तनपटान पाररजथथततकी संवेिी जोन के िाहर अशभज्ञात ककए गए थथल पर पर्ाावरण की दृजष्ट से थवीकार्ा तरीके स ेककर्ा जाएगा और पाररजथथततकी-संवेिनिील क्षते्र में ठोस अपशिष्टों को जलाने र्ा भथम करने की अनुमतत नहीं िी जाएगी।
(10) जैव-चचककत्सय अपलिष्ट - जैव-धचककत्सा अपशिष्ट प्रिंधन तन्नानुसार होगा:
(क) पाररजथथततकी संवेिी जोन में जैव-धचककत्सा अपशिष्ट का तनपटान पर्ाावरण और वन मंत्रालर्, भारत सरकार की अधधसूचना सं. सा.का.तन. 343(अ), तारीख 28 माचा, 2016 के द्वारा प्रकाशित जैव-धचककत्सा अपशिष्ट प्रिंधन तनर्म, 2016, के अनुसार ककर्ा जाएगा। (ख) पाररजथथततकी संवेिी जोन के भीतर पहचानी गई प्रौद्र्ोधगककर्ों का उपर्ोग करते हुए ववद्र्मान तनर्मों और ववतनर्मों के अनुरूप जैव-धचककत्सा अपशिष्टों के सुरक्षक्षत और पर्ाावरण की दृजष्ट से उधचत प्रिंधन ककर्ा जाएगा।
(11) प्लयस्थटक अपलिष्ट प्रबंधन - पाररजथथततकी सवंेिी जोन में प्लाजथटक अपशिष्ट प्रिंधन, प्लाजथटक अपशिष्ट प्रिंधन तनर्म, 2016 के उपिंधों और समर्-समर् पर र्थासंिोधधत उपिंधों के अनुसार ककर्ा जाएगा।
(12) तनमयाण एवं ववध्वंस अपलिष्ट प्रबंधन - पाररजथथततकी संवेिी जोन में तनमााण एवं ववध्वंस अपशिष्ट प्रिंधन, तनमााण एवं ववध्वंस अपशिष्ट प्रिंधन तनर्म, 2016 के उपिंधों के अनुसार तथा उपिंधों के अनुसार ककर्ा जाएगा। पाररजथथततकी संवेिी जोन में तनमााण एवं ववध्वंस अपशिष्ट प्रिंधन, भारत सरकार के पर्ाावरण, वन एवं जलवारु् पररवतान मंत्रालर् द्वारा अधधसूचना संख्र्ा जी.एस.आर. 317(अ), तारीख 29 माचा, 2016 के द्वारा प्रकाशित तनमााण एवं ववध्वंस अपशिष्ट प्रिंधन तनर्म, 2016 के उपािंधों के अनुसार ककर्ा जाएगा।
(13) ई-अपलिष्ट - पाररजथथततकी संवेिी जोन में ई-अपशिष्ट प्रिंधन, पर्ाावरण, वन और जलवारु् पररवतान मंत्रालर्, भारत सरकार द्वारा प्रकाशित ई-अपशिष्ट प्रिंधन तनर्म, 2016 के उपिंधों के अनुसार ककर्ा जाएगा।
(14) वयहन र्यर्यर्यर् - वाहनों के आवागमन को पर्ाावास अनुकूल तरीके से ववतनर्शमत ककर्ा जाएगा और इस संिंध में ववशिष्ट उपािंध आंचशलक महार्ोजना में सज्मशलत ककए जाएंगे और जि तक आंचशलक महार्ोजना तैर्ार नहीं हो जाता और राज्र् सरकार में सक्षम प्राधधकारी द्वारा अनुमोदित नहीं हो जाता, ति [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 तक तनगरानी सशमतत संिंधधत अधधतनर्मों और उनके अधीन िनाए गए तनर्मों और ववतनर्मों के अधीन वाहनों के आवागमन के अनुपालन की तनगरानी करेगी।
(15) वयहन प्रदषूण - वाहन प्रििूण की रोकथाम और तनरं्त्रण लागू ववधधर्ों के अधीन ककर्ा जाएगा। सीएनजी, एलपीजी आदि जसै ेथवच्छ ईंधन के उपर्ोग के शलए प्रर्ास ककए जाएगंे।
(16) औद्र्ोचगक इकयइर्यँ – (क) इस अधधसूचना के सरकारी राजपत्र में प्रकािन के समर् र्ा उसके पश्चात ्पाररजथथततकी संवेिी जोन में कोई भी नर्ा प्रििूणकारी उद्र्ोग थथावपत करने की अनुमतत नही ंिी जाएगी;
(ख) फरवरी 2016 में कें द्रीर् प्रििूण तनरं्त्रण िोडा द्वारा जारी मागाििाक शसद्धांतों में उद्र्ोगों के वगीकरण के अनुसार पाररजथथततकी सवंेिी जोन के भीतर केवल गैर-प्रििूणकारी उद्र्ोगों को ही अनुज्ञा िी जाएगी, जि तक कक इस अधधसूचना में ऐसा ववतनदिाष्ट न ककर्ा गर्ा हो और इसके अलावा गैर-प्रििूणकारी कुटीर उद्र्ोगों का संवधान जाएगा।
(17) पहयडी ढलयनों कय संरक्षण - पहाडी ढलानों का सरंक्षण तन्नानुसार होगा:
(क) क्षेत्रीर् माथटर प्लान में पहाडी ढलानों पर जथथत उन क्षेत्रों को ििाार्ा जाएगा जहा ं तनमााण की अनुज्ञा नहीं होगी। (ख) मौजूिा खडी पहाडी ढलानों र्ा अत्र्धधक कटाव वाली ढलानों पर तनमााण की अनुज्ञा नही ंिी जाएगी।
4. पाररजथथततकी संवेिी जोन के भीतर तनविद्ध र्ा ववतनर्शमत की जाने वाली गततववधधर्ों की सूची.- पाररजथथततकी-संवेिी जोन में सभी कार्ाकलाप पर्ाावरण अधधतनर्म (संरक्षण) अधधतनर्म, 1986 (1986 का 29) और उसके अधीन तनशमात तनर्मों तथा पर्ाावरण, वन और वन्र्जीव से संिंधधत भारत सरकार की अन्र् अधधसूचनाओं, ववधधर्ों और अधधतनर्मों के उपािंधों द्वारा िाशसत होंगी, जो पूवावती पर्ाावरण एवं वन मंत्रालर् द्वारा तारीख 14 शसतंिर, 2006 को िमाकं 1533(अ) के अधीन जारी की गई थीं, तथा उस समर् लागू ववधधर्ों का पालन नीचे िी गई सारणी में ववतनदिाष्ट रीतत स ेककर्ा जाएगा:

(ख) खनन कार्ा टीएन गोिावमान धथरुमुलपाि िनाम भारतीर् संघ के मामल ेमें ररट र्ाधचका (सी) संख्र्ा 202/1995 और गोवा फाउंडेिन िनाम रू्ओआई के मामले में ररट र्ाधचका (सी) संख्र्ा 435/2012 और आईए संख्र्ा 1000/2003 के तनणार् तारीख 3 जून, 2022 और उसके िाि आईए संख्र्ा 131377/2022 के तनणार् तारीख 26 अप्रैल, 2023 और 28 अप्रैल, 2023 के मामल ेमें माननीर् उच्चतम न्र्ार्ालर् के आिेि (आिेिों) के अधीन ककर्ा जाएगा।
2. प्रििूण उत्पन्न करने वाले उद्र्ोगों की थथापना (जल, वारु्, मिृा, ध्वतन, आदि)। पाररजथथततकी संवेिी जोन में नए उद्र्ोगों और मौजूिा प्रििूणकारी उद्र्ोगों के ववथतार की अनुमतत नहीं िी जाएगी:
परंतु कक गैर-प्रििूणकारी उद्र्ोगों को केन्द्रीर् प्रििूण तनरं्त्रण िोडा द्वारा फरवरी, 2016 में जारी मागाििाक शसद्धांतों में उद्र्ोगों के वगीकरण के अनुसार पाररजथथततकी संवेिी जोन के भीतर अनुमतत िी जाएगी, जि तक कक इस अधधसूचना में ऐसा ववतनदिाष्ट न ककर्ा जाए और इसके अलावा गरै-प्रििूणकारी कुटीर उद्र्ोगों का संवधान ककर्ा जाएगा।
3. प्रमुख जलववद्रु्त पररर्ोजना की थथापना। प्रततविद्ध।
4. ककसी भी खतरनाक पिाथा का उपर्ोग, उत्पािन र्ा प्रसंथकरण। प्रततविद्ध।
5. प्राकृततक जल तनकार्ों र्ा भूशम क्षेत्र में अिोधधत अपशिष्टों का ववसजान। प्रततविद्ध।
6. नई आरा शमलों की थथापना। पाररजथथततकी संवेिी जोन के भीतर नई आरा शमलों र्ा मौजूिा आरा शमलों के ववथतार की अनुमतत नहीं िी जाएगी।
7. ईंट भट्टों की थथापना। प्रततविद्ध। ख. ववतनर्लमर् कक्रर्यकलयप
8. होटलों और ररसॉटों की व्र्ावसातर्क थथापना। संरक्षक्षत क्षते्र की सीमा के एक ककलोमीटर के भीतर र्ा पाररजथथततकी संवेिी जोन की सीमा तक, जो भी तनकटतम हो, पाररजथथततकी-पर्ाटन किर्ाकलापों के शलए [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 छोटे अथथार्ी ढांचों के अलावा ककसी भी नए वाखणजज्र्क होटल और ररसॉटा की अनुमतत नहीं िी जाएगी:
परंतु कक संरक्षक्षत क्षते्र की सीमा से एक ककलोमीटर से आगे र्ा पाररजथथततकी संवेिी जोन की सीमा तक, जो भी तनकटतम हो, सभी नई पर्ाटन किर्ाकलापों र्ा मौजूिा किर्ाकलापों का ववथतार, पर्ाटन महार्ोजना और लागू मागाििाक शसद्धांतों के अनुरूप होगा।
9. तनमााण कार्ाकलाप। (क) संरक्षक्षत क्षेत्र की सीमा से एक ककलोमीटर के भीतर र्ा पाररजथथततकी संवेिी जोन की सीमा तक, जो भी तनकट हो, ककसी भी प्रकार के नए वाखणजज्र्क तनमााण की अनुमतत नहीं िी जाएगी:
परंतु तनवाशसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के शलए भवन उप-तनर्मों के अनुसार पैराग्राफ 3 के उप-पैरा (1) में उजल्लखखत किर्ाकलापों सदहत उनके उपर्ोग के शलए उनकी भूशम पर तनमााण कार्ा करने की अनुमतत होगी। आगे र्ह भी उपािंध है कक प्रििूण न फैलाने वाले लघु उद्र्ोगों से संिंधधत तनमााण किर्ाकलापों को लागू तनर्मों और ववतनर्मों, र्दि कोई हो, के अनुसार सक्षम प्राधधकारी से पूवा अनुमतत लेकर ववतनर्शमत ककर्ा जाएगा और न्रू्नतम रखा जाएगा। (ख) एक ककलोमीटर से आगे इस ेक्षेत्रीर् माथटर प्लान के अनुसार ववतनर्शमत ककर्ा जाएगा।
10. लघु एवं गैर प्रििूणकारी उद्र्ोग। फरवरी 2016 में कें द्रीर् प्रििूण तनरं्त्रण िोडा द्वारा जारी उद्र्ोगों के वगीकरण के अनुसार केवल गैर- प्रििूणकारी उद्र्ोग और गरै-खतरनाक, लघु और सेवा उद्र्ोग, कृवि, पुष्प-कृवि, िागवानी र्ा पाररजथथततकी संवेिी जोन से थविेिी सामधग्रर्ों से उत्पाि िनाने वाले कृवि-आधाररत उद्र्ोग को लागू तनर्मों और ववतनर्मों के अनुसार सक्षम प्राधधकारी से पूवा अनुमतत के साथ अनुमतत िी जाएगी।
11. पेडों की कटाई। (क) राज्र् सरकार में सक्षम प्राधधकारी की पूवा अनुमतत के त्रिना वन र्ा सरकारी र्ा राजथव र्ा तनजी भूशम में पेडों की कटाई नहीं की जाएगी। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) वकृ्षों की कटाई को संिंधधत केन्द्रीर् र्ा राज्र् अधधतनर्म तथा उसके अधीन िनाए गए तनर्मों के उपिंधों के अनुसार ववतनर्शमत ककर्ा जाएगा।
12. वन उपज र्ा गैर-काष्ठ वन उपज का संग्रहण। लागू ववधधर्ों के अनुसार ववतनर्शमत।
13. ववद्रु्त एवं संचार टावरों का तनमााण तथा केिल त्रिछाना एवं अन्र् अवसंरचनाएं। लागू ववधधर्ों के अधीन ववतनर्शमत (भूशमगत केिशलगं का संवधान ककर्ा जा सकता है)।
14. नागररक सुववधाओं सदहत अवसंरचना। लागू ववधधर्ों, तनर्मों और ववतनर्मन तथा उपलब्ध मागाििाक शसद्धांतों के अधीन िमन उपार्ों के साथ ककर्ा जाएगा।
15. सडकों का चौडीकरण एवं सुदृढ़ीकरण तथा नव तनमााण। लागू ववधधर्ों, तनर्मों और ववतनर्मन तथा उपलब्ध मागाििाक शसद्धांतों के अधीन िमन उपार्ों के साथ ककर्ा जाएगा।
16. पर्ाटन से संिंधधत अन्र् किर्ाकलाप जैस ेपाररजथथततकी संवेिी जोन के ऊपर हॉट एर्र िैलून, हेलीकॉप्टर, ड्रोन, माइिोलाइट्स आदि से उडान भरना। लागू ववधधर्ों के अनुसार ववतनर्शमत।
17. पहाडी ढलानों और निी तटों का संरक्षण। लागू ववधधर्ों के अनुसार ववतनर्शमत।
18. रात्रत्र में वाहनों का आवागमन। लागू ववधधर्ों के अधीन वाखणजज्र्क उद्िेश्र् के शलए ववतनर्शमत।
19. थथानीर् समुिार्ों द्वारा डेर्री, डेर्री फाशमिंग, जलीर् कृवि और मत्थर् पालन के साथ-साथ संचाशलत कृवि और िागवानी के कार्ा। थथानीर् लोगों के उपर्ोग के शलए लागू ववधधर्ों के अनुसार अनुमतत िी गई है।
20. फमो, कॉपोरेट और कंपतनर्ों द्वारा िडे पैमाने पर वाखणजज्र्क पिुधन और कुक्कुट फामों की थथापना। थथानीर् आवश्र्कताओं को पूरा करने के अलावा लागू ववधधर्ों के अनुसार ववतनर्शमत (अन्र् प्रावधान को छोडकर)।
21. प्राकृततक जल तनकार्ों र्ा भूशम क्षेत्र में िोधधत अपशिष्ट जल र्ा िदहःस्राव का ववसजान। िोधधत अपशिष्ट जल र्ा िदहःस्राव को जल तनकार्ों में जाने से रोका जाएगा तथा िोधधत अपशिष्ट जल के पुनचािण और पुनः उपर्ोग के शलए प्रर्ास ककए जाएंगे। अन्र्था िोधधत अपशिष्ट जल र्ा िदहःस्राव के ववसजान को लागू ववधधर्ों के अधीन ववतनर्शमत ककर्ा जाएगा। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13

12. प्रभागीर् वन अधधकारी (संरक्षक्षत क्षेत्र के प्रभारी) सिथर्-सधचव पिेन 6 तनगरयनी सलमतर् के कयर्ा :- (1) तनगरानी सशमतत, वाथतववक थथल-ववशिष्ट जथथततर्ों के आधार पर, का.आ. 1553 (अ), तारीख 14 शसत्िर, 2006 द्वारा भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अधधसूचना की अनुसूची में सज्मशलत तथा पाररजथथततक रूप से पाररजथथततकी संवेिी जोन में आने वाले किर्ाकलापों, जजसमें पैरा 4 के अधीन सारणी में ववतनदिाष्ट प्रततविद्ध किर्ाकलापों को सज्मशलत नहीं ककर्ा जाएगा, तथा जो उक्त अधधसूचना के उपिंधों के अधीन पूवा पर्ाावरणीर् मंजूरी के शलए, र्था जथथतत, केन्द्रीर् सरकार के पर्ाावरण, वन और जलवारु् पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण समर् तनधाारण प्राधधकरण को संिशभात की गई हों, की संवीक्षा करेगी।
(2) ऐसे किर्ाकलापों की, जो भारत सरकार के तत्कालीन पर्ाावरण और वन मतं्रालर् की अधधसूचना सं. का.आ. 1533 (अ), तारीख 14 शसत्िर, 2006 की अनुसूची में नहीं आते हैं, और जो पाररजथथततकी संवेिी जोन के अंतगात आते हैं, ऐसे प्रततविद्ध किर्ाकलापों के शसवार्, जो उस अधधसूचना के पैरा 4 के अधीन सारणी में ववतनदिाष्ट हैं, वाथतववक थथलीर् -ववतनदिाष्ट ििाओं के आधार पर मानीटरी सशमतत द्वारा संवीक्षा की जाएगी और उन्हे संिद्ध ववतनर्ामक प्राधधकरणों को तनदिाष्ट ककर्ा जाएगा।

(6) केन्द्रीर् सरकार, तनगरानी सशमतत को उसके कार्ों के प्रभावी तनवाहन के शलए शलखखत रूप में ऐसे तनिेि िे सकेगी, जो वह उधचत समझे।

S.O. 109(E).—WHEREAS a draft notification was published in the Gazette of India, Extraordinary Part II, Section 3, Sub-section (ii), vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 1933 (E), dated the 29th April 2025, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS copies of the Gazette containing the said draft notification were made available to the public on 30th April, 2025;
AND WHEREAS no objections, comments and suggestions were received from persons and stakeholders in respect of the said draft notification;
WHEREAS, the Rajauli (Nawada) Wildlife Sanctuary is located in the Rajauli Block of the Nawada District in the state of Bihar and has an area of 27.37 square kilometre and three blocks make up the Wildlife Sanctuary: Dibaur Part-1 (12.76 square kilometre), Chatkari (6.25 square kilometre), and Dibaur Part-2 (8.36 square kilometre). The National Highway-31 bisects the Wildlife Sanctuary into Dibaur 1 and Dibaur 2.

AND WHEREAS, according to the champion and seth classification of forests, the Sanctuary is home to tropical dry deciduous forest and is situated on the Deccan Plateau of the Chota Nagpur Plateau biogeographic zone.
AND WHEREAS, the Rajauli (Nawada) Wildlife Sanctuary has the richest deposit of mica in the country and numbers of mica mines were operating in the area under lease by the Government prior to imposition of ban on mining in the protected forest.
AND WHEREAS, the floral species present in the protected area are Arar (Acacia pennata), Akwan (Calotropis gigantean), Amla (Emblica officinalis), Babul (Acacia arabica), Bantulsi (Perilla ocimoides), Bijasal (Ptetocarpus marusupiam), Bariar (Sida cordifolia), Bahara (Terminalia belerica), Chamror (Ehretia leavis), Choranth (Heteropogan contortus), Dhela (Alangium salvifoliam), Dhawai (Woodfordia fruticosa), Gamhar (Gmelina arborea), Harre (Terminalia chebula), Kajh (Bridelia retusa), Kusum (Schleichera oleosa), Kenjhi (Sterculia urens), Kokur-Khus (Vetiveria zizanioides), Kekar (Garuga pinnata), Mahua (Madhuca indica), Piar (Buchanania lanzan), Patdhaman (Grewia elastic), Satwar (Asparagus recemosus), Semal (Salmalia malbarica), Salai (Boswellia serrata), Sidha (Lagerstroemia parviflora), Sagawan (Tectona grandis), Udal (Sterculia villosa) etc.;
AND WHEREAS the rare, endangered and threatened floral species found in the area are Bhelao (Semicorpus anacardium ), T. Bedem (Terminalia catappa) , Haldu (Adina cardidifolia), Vanpyaj (Urginea indica), Chiraite (Swertia chirayita), Rose wood (Dolbergia latifolia) , Mahua (Madhuca longifalia), Kaind (Diospyros melanoxylon), Jungali Bel (Aegle marmelos );
AND WHEREAS, the rare endangered and threatened faunal species found in the Wildlife Sanctuary are Jungle Cat (Felis chaus) , Porcupine (Hystrix Indica), Hog deer (Axis porcinus), Wild boar (Sus scrofa ), Barking deer (Muntiacus muntjak) , Sloth Bear (Melursus urisinus), Mongoose (Herpestes urva ), Pongelin, Civet (Viverrricula indica). Other recorder faunal species includes Chittal (Axis axis), Sambar (Cervus unicolor), Hare (Lepus nigricollis), Hyena (Hyaena hyaena), Nilgai (Boselaphus tragocamelus), Jackal (Conis aureus), Indian fox (Vulpes bengalensis);
AND WHEREAS, the major avifaunal species recoded from the Wildlife Sanctuary are Cheel (Milvus migrans), Dhanesh (Ocycenos birostris), Black stork (Ciconia nigra), Jungle Prinia (Prinia sylvatica), Cuckoo (Cuculus fugax), Black headed munia (Malacca articapilla), Common Crane (Grus grus), Indian Courser (Cursorius coroman delicus), Owl (Otus lettia), Ghughu (Bubo bengalensis);
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Rajauli (Nawada) Wildlife Sanctuary which is specified in paragraph 1 as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent of 0.0 kilometre to 4.965 kilometre from the boundary of Rajauli (Nawada) Wildlife Sanctuary in the State of Bihar as the Rajauli (Nawada) Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The extent of the Eco-sensitive Zone varies from 0.0 km to 4.965 km around the boundary of Rajauli (Nawada) Wildlife Sanctuary and the area of the Eco-sensitive Zone is approximately 100.15 square kilometres. The specific extent of the Eco-sensitive Zone in different directions is provided in table below:

4.060 kilometres North-West Babhani P.F. 3.351 kilometres Note: The National Highway Number. 31 bisects the Dibaur-1 and Dibaur-2 sections of the Sanctuary, serving as a crucial connector between Bihar, Jharkhand, West Bengal and adjacent states. Notably, this highway was constructed prior to the enactment of the Wildlife (Protection) Act, 1972 and given the sanctuary’s proximity to Jharkhand state border, the Eco-sensitive Zone on the side bordering Jharkhand State is designated as Zero.
(2) The boundary description of the Eco-Sensitive Zone around Rajauli Wildlife Sanctuary is appended as Annexure-I.
(3) The maps of the Eco-sensitive Zone along with latitude and longitude are appended as Annexure II A, II B and II C.
(4) List of geo co-ordinates of the boundary of the Rajauli Wildlife Sanctuary and its Eco-sensitive Zone are given in Table A and Table B of Annexure-III.
(5) The list of the villages falling within Eco-sensitive Zone is annexed as Annexure IV.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purposes of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union territory laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union territory Government, for integrating the ecological and environmental considerations into the said plan;
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipality;
(x) Panchayati Raj;
(xi) Public Works Department;
(xii) Highways; and
(xiii) Bihar State Pollution Control Board.
(4) The Zonal Master Plan shall also ensure that no restrictions are imposed on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to Prohibited;
Regulated and Promoted activities listed in the Table in paragraph 4 of this notification and shall ensure ecofriendly development for security of local communities livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
(10) Pending the preparation of the Zonal Master Plan for Eco-sensitive Zone and approval thereof, any new developmental activities shall be governed by provisions specified at paragraph 6 of sub-para (1) and (2).
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(a) (1) Land use:- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as,-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under table at paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies and springs:- The catchment areas of all natural springs and all natural bodies shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas and discharge of any pollutants in such a manner as which are detrimental to such areas.
(3) Tourism or Eco-tourism:- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and ecodevelopment;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage:- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites:- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution:- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise pollution (Regulation and Control Rules,2000 under the provision of Environment Act) and the rules made thereunder.
(7) Air pollution:- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (protection) Act, 1986 the rules made thereunder there Acts.
(8) Discharge of effluents:- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and Environment (protection) Act, 1986 the rules made thereunder there Acts.
(9) Solid wastes: - Disposal of solid wastes shall be as under: -
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture or biogas plants;
(iv) the inorganic material shall be disposed of in an environmentally acceptable manner at a site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste:- Bio-medical waste Management shall be as under:- (a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest vide notification number. G.S.R. 343(E), dated the 28th March, 2016.
(b) Safe and environmentally sound management of Bio- medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic Waste management: - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.
(12) Construction and demolition waste management: - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March,
2016.
(13) E-waste:- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change.

(14) Vehicular traffic:- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Ministry of Environment, Forests and Climate Change, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and rules made thereunder.
(15) Vehicular pollution: - Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units, – a) no new polluting industries shall be allowed to be set up within the Eco-Sensitive Zone on or after the publication of this notification in the Official Gazette;
b) only non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes - The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made under there and other notifications, laws and Acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006, and laws for the time being in force in the manner and specified in the Table below:

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
New industries and expansion of existing polluting industries in the Eco-Sensitive Zone shall not be permitted:

B. Regulated Activities
8. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer:
Provided that local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph
(1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

10. Small scale non polluting industries. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
12. Collection of Forest produce or Non- Timber Forest produce.

8. The Regional Officer, Bihar State Pollution Control Board, Patna Member- ex officio;
9. Representative of District Nawada Agriculture Department, Government of Bihar Member- ex officio;
10. Representative of District Nawada Urban Development and Housing Department, Government of Bihar Member- ex officio;
11. District Collector of Nawada Member- ex officio;
12. Divisional Forest Officer (In-charge of Protected Area) Member-Secretary ex officio
6. Functions of the Monitoring Committee: (1) The Monitoring Committee shall, based on the actual sitespecific conditions scrutinize, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.
(2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma appended at Annexure V.

(6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional Measures- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
