5.0. 376(E).—— Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing), number SO. 1097 (E) dated the 4th August, 2005, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer 0.000 to kilometer 107.200 (Chennai - Ranipet section) of National Highway No. 4 in the State of Tamil Nadu to the National Highways Authority of India (hereinafter referred to as the “Authority”);

And whereas, in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with National Highways (Fees for the Use of National Highways Section and Permanent Bridge - Public Funded Project) Rules, 1997, National Highways (Rate of Fee) Rules, 1997 and National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Govemment by notification of the Government of India authorized the Authority for levying and collecting fee on mechanical vehicles for the use of stretch as follows :

(i) Vide 8.0. No. 944 (E) dated 30th April, 2012 for the stretch from Km 60.100 to Km 13.800 Kancheepuram — Chennai section on National Highway No 4 in the State of Tamil Nadu.

(ii) Vide 5.0. No. 2841 (E) dated 6th“ December, 2012 for the stretch from Km 107.200 — Km

60.100 Walajahpet - Kanchipuram section on National HighWay No. 4‘in the State of Tamil Nadu.

And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with Ms Essel Walajahpet Poonamallee Toll Roads Private Limited having its registered office at Essel House, B—lO, Lawrence Road, Industrial area, New Delhi — 110035 w luau” mu m m w i‘hlilllll-“Tflliumrlw “WWW" In 1., «Ullwmmna' 1 1...”...wa ME." I, 1W!“ a.“ I...” w.” an [W'T II—E'UE 3(ii)] WWW : W 5 (hereinafter referred to as the “Concessionaire”), the successful bidder for bids submitted on 27/04/2012 for the development of the Walajahpet - Poonamallee section fiom Km 106.800~to Km

13.800 on National Highway No. 4 (hereinafter referred to as the “said section”) to Six lane operation and maintenance of the said'séction.

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafier referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table l for net road section length 93.000 km for use of the four and more lane (hereinafier referred to as “base rate”) on the Type of Vehicles specified in Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for the distance specified for such Toll P1aza(s):

The rate of monthly pass for a person who owns a mechanical vehicle registered for noncommercial purposes and resides within a distance of twenty kilometers from the toll plaza IS Rs. 200.00 (Rupees Two Hundred Only) for fire. year» 2012-13 which is subject to revasiomeveey year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

THE GAZETTE OF INDIA : EXTRAORDINARY [PART ll—SEC. 3(ii)] For multiple journey on the highway section, passes shall be issued at the following rates, namely.

One and half times of the fee for one Two Twenty four hours from way journey the time ofpayment Two—third of amount of the fee Fiftyormore One month from date'of payable for fifty or more single payment journeys Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in me Rules.

The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.

Based on the Base rate of fee per km for the base year 2007-08 as mentioned in TabIe-l, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
