And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838(E) dated 5th December, 2008 and subsequently amended vide G.S.R. 950(E) dated 3rd December, 2010, G.S.R. 15(E) dated 12th January, 2011, G.S.R. 756(E) dated 12th October, 2011, G.S.R. 778(E) dated 16th December, 2013, G.S.R. 26(E) dated 16th January, 2014, G.S.R. 831(E) dated 21st November, 2014, G.S.R. 02(E) dated 29th December, 2014, G.S.R. 220(E) dated 23rd March, 2015, G.S.R. 585(E) dated 8th June, 2016, G.S.R. 1114(E) dated 2nd December, 2016 and G.S.R. 248(E) dated 14th March, 2017 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement with M/s Essel Walajahpet Poonamallee Toll Roads Private Limited, having its registered office at Essel House, B-10, Lawrence Road, Industrial Area, New Delhi - 110035 (hereinafter referred to as the “Concessionaire”) the successful bidder for bids submitted on 27.04.2012 for the development to Six lane of the Walajahpet – Poonamalle section from km 106.800 to km 13.800 on National Highway Number 4 (hereinafter referred to as the “said section”).
And whereas, in exercise of the powers conferred by Section 8A of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India vide S.O. No. 376 (E) dated 14.02.2013 authorized the Concessionaire M/s Essel Walajahpet Poonamallee Toll Roads Private Limited, New Delhi, for levying and collecting fee on mechanical vehicles for the use of Walajahpet – Poonamalle section from km 106.800 to km 13.800 on National Highway Number 4 in the State of Tamil Nadu on BOT basis on and from the Date of Commercial Operation declared ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 by the Authority and till the termination date as specified in the Agreement. BOT Concessionaire started user fee collection from COD on 01.06.2013.
And whereas, the user fee collection has been taken over by NHAI from BOT Concessionaire w.e.f. 29.07.2016 (00:00 Hrs.). Due to failure of Concessionaire in progressing the work, NHAI has terminated the subject project Concession Agreement 22.07.2016 and project assets including toll plazas have been taken over by NHAI. NHAI is continuing the user fee collection as per provisions in Fee Notification dated 14.02.2013. However, after date of publication of this fee notification, NHAI shall collect user fee as per provisions under this fee notification.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), and in supersession of the notification number S.O. 376 (E) dated 14.02.2013, except as respects things done or omitted to be done before such supersession, the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length of
93.000 km [including 394.44m (239.44m + 155m) of structure on road (having length more than 60m) with equivalent length of 3.940 km (2.390 km + 1.550 km)] for use of the four and more lane sections (hereinafter referred to as “base rate”) on the Type of Vehicles specified in column (1) of the Table 1 below for the use of Walajahpet – Poonamalle section from km 106.800 to km 13.800 on National Highway Number 4 in the State of Tamil Nadu and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- TABLE 1 Type of vehicle Base rate of fee per km. for the base year 2007-08 (in Rupees)

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 235.00 (Rupees Two Hundred Thirty Five only) for the year 2016-17, and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.
6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules.
8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.
9. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
10. The rate of fee for use of a section of a national highway consisting of bypass or tunnel constructed on or after 11th September, 1956 but before 5th December, 2008, through public funded project or build, operate and transfer (annuity) project, shall be the same, as provided in sub-rule (2) for the Section of a national highway, and, shall be revised in accordance with the provisions of rule 5;
Provided that notwithstanding whether the Section of the national highway or the bridge has been taken for further lane upgradation or not, the increase in the rate of fee for use of a Section of such national highway, permanent bridge, bypass or tunnel, constructed through any public funded project or any build, operate and transfer (annuity) project constructed before the commencement of the said rules, shall not be increased after the commencement of the National Highways Fee (Determination of Rates and Collection) second Amendment, Rule, 2011 by more than twenty five per cent of the rates of fee applicable immediately before such commencement and further annual increase shall in no case be more than twenty five per cent of the rate applicable in the immediately preceding year;
11. The present value of Capital Cost of the Project as on 31.03.2016 is Rs. 119.44 Crore (Rupee One Hundred Nineteen Crore Forty Four Lakh only) & Total capital cost as on 31.03.2013 is Rs. 226.69 Crore (Rupee Two Hundred Twenty Six Crore Sixty Nine Lakh only) for Nemili Sriperumpudur fee plaza and Rs. 36.82 Crore (Rupee Thirty Six Crore Eighty Two Lakh only) & Total capital cost as on 31.03.2013 is Rs. 135.30 Crore (Rupee One Hundred Thirty Five Crore Thirty Lakh only) for Chennasamudram fee plaza. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
