PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1041] ubZ fnYyh] c`gLifrokj] vizSy 13] 2017@pS=k 23] 1939 No. 1041] NEW DELHI, THURSDAY, APRIL 13, 2017/CHAITRA 23, 1939 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 12 अᮧैल, 2017 का.आ. 1173(अ).—भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 2052, (अ), तारीख 22 िसत᭥बर, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह उᲦ अिधसूचना अंतᳶवᭅ᳥ ह,ै जनता को उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, उᲦ राजपᮢ, िजसमᱶ उᲦ अिधसूचना अंतᳶवᭅ᳥ है, कᳱ ᮧितया ंजनता को तारीख 22 िसत᭥बर, 2015, को उपल᭣ध करा दी गई थी;
और, सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेप और सुᭃाव अिधसूचना के ᮧ᭜युतर मᱶ कᱶ ᮤीय सरकार ᳇ारा स᭥यक ᱧप से िवचार ᳰकया गया;
और, टोडगढ़ रावली व᭠ यजीव अभयार᭛य, पूवᭅ दशेांतर 7302’ से 73030’ उᱫर अᭃांश 25000’ से 25040’ के बीच अरावली मᱶ ि᭭थत
475.235 वगᭅ ᳰकलोमीटर मᱶ फैला ह,ै राज᭭थान का एक सबसे बड़ा अभयार᭛य है और तीन राजपᮢ िजलᱶ अथाᭅत ्अजमेर, पाली और राजसम᭠द के भीतर आता है और राज᭭थान व᭠यजीव संरᭃण अिधिनयम, 1972 कᳱ धारा 18 (1) के उपबंधᲂ के अधीन राज᭭थान सरकार अिधसूचना सं. एफ II (56) रेव ᮕुप- 8/82, तारीख 28 िसत᭥बर, 1983 ᳇ारा अिधसूिचत ह;ै और, उᲦ अभयार᭛य के वन चᱹिपयन एवं सेठी वगᱮकरण के अनसुार शु᭬क उ᭬णकᳯटबंधीय वनᲂ के अंतगᭅत आते ह।ै िविवध उप ᮧकार तथा उनके सहायक इडाᳰफक और ᮓिमक ᮧकार उ᭬णकᳯटबंधीय शु᭬क पणᭅपाती वन, उᱫरी उ᭬णकᳯटबंधीय शु᭬क पणᭅपाती वन, उ᭬णकᳯटबंधीय शु᭬क िमि᮰त पणᭅपाती वन के ᱨप से जाने जात े ह।ै मुय वृᭃ ᮧजाितयᲂ एनोिगयािसस पे᭠डूला, बोसिविलया सेराटा, बूᳯटया, मोनो᭭पृमा, िजजयाफूस मरूीिवयाना, और अकाᳰकया केᳯटचू इ᭜याᳰद ह;ᱹ और, टोडगढ़ रावली व᭠ यजीव अभयार᭛य मᱶ िविवध ᮧकार के वन᭭पित एवं जीवज᭠तु और िविवध आ᮰य᭭थल ह।ै रीछ, तᱶदआु, लकड़बघा, जंगल िब᭨ली, भेिड़या, अजगर, ᳲचंकारा, ᮕे जंगल मुगᱮ इ᭜याᳰद ᮧमुख जीव-ज᭠तु ᮧजाितयां पाई जाती है;
और, अ᭜यिधक चराई, पᱶड कᳱ कमी से भूिम अपरदन से पयाᭅवरण मᱶ अ᭜यिधक िगरावट के कारण पयाᭅवरण पर ᮧितकूल ᮧभाव पड़ा ह ैऔर इस िलए अभयार᭛य मᱶ ᮧाकृितक संसाधनᲂ तथा वन᭭पितयᲂ एवं जीव-जंतु संकटाप्᳖ ि᭭थत मᱶ आ गये ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, टोडगढ़ रावली व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸दᭅ᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक ह;ै अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, राज᭭थान रा᭔य मᱶ टोडगढ़ रावली व᭠ यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 1 ᳰकलोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को टोडगढ़ रावली व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानसुार है, अथाᭅत ्:--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन दिᭃण ᳰदशा को छोड़कर टोडगढ़ रावली व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰकलोमीटर तक है और इसका िव᭭तार 202.68 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ ह,ै दिᭃणी ओर कᳱ तरफ जहां व᭠ यजीव अभयार᭛य एक अ᭠य संरिᭃत ᭃेᮢ, फुलवारी कᳱ नाल के साथ अपनी सीमा को साझा करता है, जो बदले मᱶ कंुभलगढ़ अभयार᭛य से जुड़ा ᱟआ ह।ै पाᳯरि᭭थितक संवेदी जोन का सीमा िववरण उपाबंध I पर ᳰदया गया है ।
(2) पाᳯरि᭭थितक संवेदी जोन का मानिच ᮢ इसके अᭃांश और दशेा᭠तर और जीपीएस िनदᱷशांकᲂ के साथ उपाबधं II पर उपाब ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन राज᭭थान के अजमेर, पाली और राजसम᭠द िजलᲂ मᱶ 217 ᮕामᲂ तक फैला ᱟआ ह ै|
(4) टोडगढ़ रावली व᭠यजीव अभयार᭛य कᳱ सीमा के साथ सीमा के जीपीएस िनदᱷशांक िववरण और इसके पाᳯरि᭭थितक संवेदी जोन उपाबंध III पर उपाब ह ै।
(5) पाᳯरि᭭थितक संवेदी जोन मᱶ आने वाले ᮕामᲂ कᳱ सूची उपाबधं IV पर उपाब ह ै।
2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से और रा᭔य मᱶ सᭃम ᮧािधकारी के अनुमोदन से और रा᭔य सरकार मᱶ सᭃम ᮧािधकारी के अनुमोदन से आंचिलक महायोजना तैयार करेगी ।
(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸दᭅ᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष ;
(iv) राज᭭ व;
(v) शहरी िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसंचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िन माᭅण िव भाग।
(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दᭅ᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢ ᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग का िववरण ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(7) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(8) आंचिलक महायोजना इस अिधसूचना ᳇ारा उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत्:--
(1) भ-ूउपयोग – (क) पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा। मानिचᮢ के साथ आंचिलक महायोजना मᱶ ᭭प᳥ ᱨप से ᭃेᮢᲂ को िनधाᭅᳯरत ᳰकया गया ह:ै परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन िनगरानी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭃेᮢीय नगर योजना अिधिनयम के तहत सᭃम ᮧािधकारी के पूवᭅ अनुमोदन के साथ और के᭠ᮤीय/रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ के ᱨप मᱶ लागू हᲂगे, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए ह,ै जैसे:-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर हᱹ; सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत ᮕह वास; और
(v) संवᳶधᭅत ᳰᮓयाकलाप और अनु᭒छेद 7 के अंतगᭅत ᳰदया गया ह:ै परंतु यह और भी ᳰक ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ और िविनयमᲂ के अंतगᭅत रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, िनगरानी सिमित के िवचार ᮧा᳙ करने के प᳟ात ् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । (ख)परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ जाना जायेगा । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। तथािप, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ैवहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना के अनुसार होगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸दᭅ᳥ संवीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगᭅक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगᭅक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा और उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमᭅत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, 2000 अंतगᭅत तैयार करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343 (अ), तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(12) िनमाᭅण और िव᭟वसं अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(13) यानीय पᳯरवहन: - पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होने तक, िनगरानी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(14) औ᳒ोिगक इकाईया ं- (i) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के प᳟ात या ᮧकाशन मᱶ, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण बोडᭅ के वगᱮकरण के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा दी जाएगी। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(15) पहाड़ी ढलानᲂ को संरᭃण: - पहाड़ी ढलानᲂ के संरᭃण के अंतगᭅत:
(क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहां ᳰकसी भी संिनमाᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी । (ख)कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी ।
(16) यᳰद यह आव᭫यक समझता ह,ै इस अिधसूचना के उपाबंधᲂ को ᮧवृत करने मᱶ कᱶ ᮤीय सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िन᳸दᭅ᳥ करेगा।
4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰकए जान ेवाल े ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸दᭅ᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप ᳯट᭡पिणया ं
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ दशेी आव᭫यकताᲐ के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनुसार अनु᭄ात हᲂगे । (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।
4. नए बृहत जल िव᳒ुत पᳯरयोजना और ᳲसंचाई पᳯरयोजना कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
5. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
6. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
7. नए का᭬ ठ आधाᳯरत उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी:
परंतु िव᳒मान का᭬ ठ आधाᳯरत उ᳒ोग िविध के अनुसार बना रहगेा :
परंतु यह और ᳰक िव᳒मान आरा िमलᲂ कᳱ अनु᭄ि᭡ तयᲂ का नवीकरण उनकᳱ पयᭅवसान अविध पर नहᱭ ᳰकया जाएगा ।
8. म᭜᭭य पालन । ओरयी और टोड़गढ रावली बांध सिहत जल नकायᲂ मᱶ मछली पकडना पर पूणᭅ रोक रहगेी।
9. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
10. ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत ᳰᮓयाकलाप
11. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी पयᭅटकᲂ कᳱ लघु संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂगे, अ᭠यथा नहᱭ । परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा है वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा लागू मागᭅदशᱮ िसांतᲂ के अनुᱧप होगा।
12. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ एक ᳰकलोमीटर कᳱ सीमा के भीतर ᳰकसी भी ᮧकार के नए वािणि᭔ यक संिनमाᭅण को अन᭄ुात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को पैरा 6 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनु᭄ा दी जाएगी । (ख) ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे ।
13. भू-जल का िन᭬ कषᭅण । लागू िविधयᲂ के अधीन ᭭थानीय लोगᲂ के पीने का पानी या कृिष कᳱ आव᭫यकता को पूरा करने के िलए िविनयिमत हᲂगे।
14. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳰक᭠ही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
15. िव᳒ुत और दरूसंचार टावरᲂ और िबछाई गई केबलᲂ और अ᭠य बुिनयादी ढाँचᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे और भूिमगत केबलᲂ को ᮧो᭜सािहत ᳰकया जा सकेगा ।
16. नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
17. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना । लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
18. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
19. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
20. पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
22. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
23. वािणि᭔ यक साइनबोडᭅ और होᳺडᲈग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
24. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग कृिष, पु᭬ प कृिष, उ᳒ान कृिष, या कृिष आधाᳯरत उ᳒ोग दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई ᮧितकूल ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात हᲂगे ।
25. वन उ᭜पादᲂ और गैर-का᳧ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. वायु ᮧदषूण। पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
27. ᭟विन ᮧदषूण। पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
28. खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती से िनगरानी कᳱ जाएगी।
29. ठोस अपिश᳥ ᮧबंधन । ठोस अपिश᳥ ᮧबंधन िनयम, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के अधीन ठोस अपिश᳥ ᮧबंधन िनयम 2016 के उपाबंधᲂ के अनुसार होगा।
30. पाᳯरि᭭थितक-पयᭅटन ᳰᮓयाकलाप । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
31. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधᭅत ᳰᮓयाकलाप
32. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और म᭜᭭य पालन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
33. जैिवक खेती। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
34. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
35. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
36. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
37. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
38. कृिष वािनकᳱ। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
39. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
40. कौशल िवकास। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
41. िनि᳜कृत भूिम या जंगलᲂ या वास कᳱ बहाली। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
5. पाᳯरि᭭थितक सवंेदी जोन िनगरानी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी िनगरानी के िलए एक िनगरानी सिमित का गठन करेगी जो िन᳜िलिखत स ेिमलकर बनेगी, अथाᭅत ्
(i) िजला कलेटर, राजसम᭠द और पाली -अ᭟यᭃ;
(ii) िन᳜िलिखत िवभागᲂ के िजला ᭭तरीय अिधकारी: लोक िनमाᭅण िवभाग, खनन, ᳲसंचाई, पयᭅटन, पुिलस, नगर पᳯरषद, उ᳒ोग, यूनी ᮝ᭭ट आफ इंिडया -सद᭭य;
(iii) ᮧादिेशक अिधकारी, रा᭔य ᮧदषूण िनयंᮢण बोडᭅ, -सद᭭य;
(iv) माननीय व᭠यजीव वाडᭅन, राजसम᭠द -सद᭭य;
(v) पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय, भारत सरकार का ᮧितिनिध -सद᭭य;
(vi) पᳯरि᭭थित िव᭄ान और पयाᭅवरण के ᭃेᮢ मᱶ राज᭭थान सरकार ᳇ारा ᮧ᭜येक मामले मᱶ तीन वषᭅ के िलए नािमत एक िवशेष᭄ - सद᭭य;
(vii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठन का राज᭭थान सरकार ᳇ारा ᮧ᭜येक मामले मᱶ तीन वषᭅ के िलए नािमत एक ᮧितिनिध -सद᭭य;
(viii) उपख᭛ड अिधकारी, राजसम᭠द/पाली -सद᭭य;
(ix) खंड िवकास अिधकारी, राजसम᭠द/पाली -सद᭭य;
(x) उप वन संरᭃक, पाली/राजसम᭠द/अजमेर -सद᭭य;

6. िनदᱷश िनबधंन (1) सिमित का कायᭅकाल तीन वषᭅ कᳱ अविध के िलए ᳰकया जाएगा।
(2) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष गितिविधयᲂ के िसवाय आन ेवाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸दᭅ᳥ कᳱ जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸दᭅ᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸दᭅ᳥ ᳰकया जाएगा ।
(5) िनगरानी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(6) िनगरानी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) िनगरानी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषᭅक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबंध V मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय िनगरानी सिमित को अपन ेकृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदशे द ेसकेगा, जो वह ठीक समझे ।
7. इस अिधसूचना के उपबंधᲂ को ᮧवृत दनेे के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸दᭅ᭬ ट कर सकᱶ गे ।

7. पयाᭅवरण ( संरᭃण ) अिधिनयम, 1986 कᳱ धारा 19 के अधीन दजᭅ कᳱ गई िशकायतᲂ का सारांश ।
8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 12th April, 2017 S.O.1173(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
2052, dated September 22, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And Whereas, the copies of the Gazette containing the said notification were made available to the public dated September 22, 2015;
And Whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
And Whereas, the Todgarh Raoli Wildlife Sanctuary lying between 7302’ to 73030’ East Longitude and 25000’ to 25040’ North Latitudes and situated in the Aravallis is one of the largest Sanctuaries of Rajasthan having an area of
475.235 Sq kms and falls within three revenue districts viz. Ajmer, Pali and Rajasamand and notified vide Government of Rajasthan Notification No.F II (56) Rev-Group-8/82, dated 28th September, 1983 under the provisions of section18
(1) of the Rajasthan Wildlife Protection Act 1972.
And Whereas, the forest area of the said Sanctuary falls under the Dry Tropical Forests as per Champion and Seth’s classification. The various sub types along with their subsidiary edaphic and serial types recognised are Tropical Dry Deciduous Forest, Northern Tropical Dry Deciduous Forest, Northern Tropical Dry Mixed Deciduous Forest. The major tree species are Anogeissus pendula, Boswellia serrata, Butea, monosperma, Zizyphus mauritiana, and Acacia catechu etc.
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 And Whereas, the Todgarh Raoli Wildlife Sanctuary has a varied habitat and diversified fauna and flora. The Sloth Bear, Leopard, Hyena, Jungle Cat, Wolf, Python, Chinkara, Grey Jungle Fowl etc. are important faunal species present in this Sanctuary.
And Whereas, considerable adverse environment impact has been caused due to excessive degradation of the environment with excessive grazing, loss of tree cover soil erosion etc. and thereby endangering the natural resources of the said Sanctuary, and it’s flora and fauna.
And Whereas, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Todgarh Raoli Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
Now Therefore , in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area up to an extent of 1 kilometers from the boundary of Todgarh Raoli Wildlife Sanctuary in the State of Rajasthan as the Todgarh Raoli Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone. - (1) The Eco-Sensitive Zone is spread over an area of 202.68 square kilometers with an extent of upto 1 kilometer from the boundary of Todgarh Raoli Wildlife Sanctuary, except on the southern side side where the WLS shares its boundary with another Protected Area, Phulwari Ki Naal which in turn is connected to Kumbhalgarh sanctuary. The boundary description of said Zone is given in Annexure-I.
(2) The map of the Eco-sensitive Zone along with latitudes and longitudes and GPS coordinates is appended as Annexure II.
(3) The Eco-sensitive Zone is spread across 217 villages falling in Ajmer, Pali and Rajasamand Districts of Rajasthan.
(4) The details of GPS coordinates of the points along the boundary of the Todgarh Raoli Wildlife Sanctuary and its Ecosensitive Zone are appended as Annexure-III.
(5) The list of villages falling within Eco-sensitive Zone is appended as Annexure-IV.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the Competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
i. Environment;
ii. Forest and Wildlife;
iii. Agriculture;
iv. Revenue;
v. Urban Development;
vi. Tourism;
vii. Rural Development;
viii. Irrigation and Flood Control;
ix. Municipal ;

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring vide the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities.
Such areas shall be clearly defined in the Zonal Master Plan along with maps.
Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable, to meet the residential needs of the local residents such as:
i. Widening and strengthening of existing roads and construction of new roads;
ii. Construction and renovation of infrastructure and civic amenities;
iii. Small scale industries not causing pollution;
iv. Cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and v. Promoted activities and given under para 7:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b)Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment area plan shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up as part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. -
(9) Solid wastes. - Disposal of solid wastes shall be as under:- 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Plastic Waste Management:- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management:- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
(14) Industrial Units- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed be established within ESZ vide Central Pollution Board’s categorization.
(15) Protection of Hill Slopes.- The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(16) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. Prohibited, Regulated and Promoted Activities All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 Table S.No. Activity Remarks

UOI in W.P.(C) No.202 of 1995 and dated 21st April, 2014, in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
4. Establishment of new major hydroelectric projects and irrigation projects.
Prohibited (except as otherwise provided) as per applicable laws.
5. Use, production or processing of any hazardous substances.

6. Discharge of untreated effluents and solid waste in natural water bodies or land area.

8. Fishing. There shall be complete ban on fishing in all the water bodies including Orai & Todgarh Raoli dam.
9. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
10. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
11. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Ecotourism activities.
Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] applicable.
12. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws.
(b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
13. Extraction of ground water Regulated under applicable laws to meet the drinking water or agricultural requirement of locals.
14. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
15. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law. Underground cabling may be promoted.
16. Infrastructure including civic amenities Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
19. Introduction of exotic species. Regulated under applicable laws.
20. Uses of Plastic carry bags. Regulated under applicable laws.
21. Protection of hill slopes and river banks. Regulated under applicable laws.
22. Discharge of treated effluents in natural water bodies or land area.
The discharge of treated effluent shall be regulated as per applicable laws. Efforts shall be made to recycle/reuse the treated effluent.
23. Commercial Sign boards and hoardings. Regulated under applicable laws.
24. Small scale industries not causing pollution.
Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
25. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
26. Air and Vehicular Pollution Regulations for the control of air pollution in the Ecosensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.

5. Monitoring Committee:- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(i) District Collector, Rajsmund and Pali -Chairman
(ii) District level officers of the following departments:
Public Work Department, Mining, Irrigation, Tourism, Police, Municipal Council, Industry, Uni Trust of India -Members
(iii) Regional Officer (RO) of the State Pollution Control Board -Member
(iv) Hon.Wildlife Warden Rajasamand -Member
(v) Representative of the Ministry of Environment, Forest and Climate Change, Government of India -Member
(vi) An expert in the area of ecology and environment from a reputed institution or university to be nominated by the Government of Rajasthan for a period of three year. -Member
(vii) A representative of Non-Government organisation working in the field of
27. Noise pollution Control of noise pollution in the Eco-sensitive Zone shall be in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986

6. Terms of Reference: (1) The tenure of monitoring committee shall be for three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India, Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India, Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Ecosensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
