PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1043] ubZ fnYyh] c`gLifrokj] vizSy 13] 2017@pS=k 23] 1939 No. 1043] NEW DELHI, THURSDAY, APRIL 13, 2017/CHAITRA 23, 1939 पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 12 अᮧैल, 2017 का.आ. 1175 (अ). – भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. 3224 (अ), तारीख 23 नव᭥बर, 2015 ᳇ारा भारत के राजपᮢ, असाधारण मᱶ, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ है, जनता को उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करते ᱟए एक ᮧाᱨप अिधसूचना ᮧकािशत कᳱ गई थी;
और उᲦ राजपᮢ, िजसमᱶ उ त अिधसूचना अंतᳶव᭬ ट है, कᳱ ᮧितयां जनता को 23 नव᭥बर, 2015, को उपल᭣ध करा दी गई थᱭ ;
और, उᲦ ᮧाᱨप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा स᭥यक् ᱨप से िवचार ᳰकया गया;
और, भामरागढ़ व᭠ यजीव अभयार᭛ य महारा᳦ के गडिचरोली िजले मᱶ ि᭭थत ह ैऔर 104.38 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह;ै और, यह अभयार᭛ य जैव िविवधता से समृ ह ैऔर कᳱटᲂ और रीढधारी कᳱ लगभग सभी ᮰ेिणयᲂ कᳱ ᳞ापक रᱶज के अलावा 245 पादप ᮧजाितयᲂ, पिᭃयᲂ कᳱ 193 ᮧजाितयᲂ का आ᮰य ᭭थल ह;ै और, इस ᭃेᮢ से जड़ी-बूᳯटयᲂ कᳱ 73 ᮧजाितयᲂ, झािडयᲂ कᳱ 15 ᮧजाितयᲂ, घास कᳱ 47 ᮧजाितयᲂ और वृᭃᲂ कᳱ 69 ᮧजाितयᲂ का ᮧलेखन ᳰकया गया ह ैिजनमᱶ से 151 ᮧजाितयᲂ औषधीय पादपᲂ कᳱ ह;ै और, भामरागढ़ व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ ह,ᱹ पाᳯरि᭭थितक और पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक है;
अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] शिᲦयᲂ का ᮧयोग करते ᱟए, महारा᳦ रा᭔ य मᱶ भामरागढ़ व᭠ यजीव अभयार᭛य कᳱ सीमा से 3 से 6 ᳰकलोमीटर तक के िव᭭ तार तक के ᭃेᮢ को भामरागढ़ व᭠ यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत् :--
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) पाᳯरि᭭थितक संवेदी जोन, महारा᳦ रा᭔य मᱶ भामरागढ़ व᭠ यजीव अभयार᭛य के चारᲂ ओर कᳱ सीमा 85.75 वगᭅ ᳰकलोमीटर 3 से 6 ᳰकलोमीटर कᳱ िभ᳖-िभ᳖ सीमा तक के िव᭭तार तक फैला ᱟआ ह।ै पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन उपाबधं-I मᱶ ᳰदया गया ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन महारा᭬ ᮝ के गडिचरोली िजले के अंतगᭅत आन ेवाले 7 ᮕामᲂ मᱶ फैला ᱟआ ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले ᮕामᲂ कᳱ सूची ᮧमुख िब᭠दᲐु के िनदᱷशांकᲂ के साथ उपाबधं-II के ᱨप मᱶ उपाब ह ै।
(4) अᭃांश और दशेा᭠तर के साथ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबधं-III के ᱨप मᱶ इस अिधसूचना से उपाब ह ै।
2. पाᳯरि᭭थितक संवदेी जोन के िलए आचंिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2) उᲦ महायोजना रा᭔ य सरकार के सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ यथा िविन᳸द᭬ ट रीित मᱶ तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य सभी और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार कᳱ जाएगी ।
(4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार कᳱ जाएगी, अथाᭅत्:--
(i) पयाᭅवरण;
(ii) वन;
(iii) नगर िवकास;
(iv) पयᭅटन;
(v) नगरपािलका;
(vi) राज᭭ व;
(vii) कृिष ;
(viii) महारा᳦ रा᭔य ᮧदषूण िनयंᮢण बोडᭅ;
(ix) ᳲसचाई; और
(x) लोक िन माᭅण िव भाग।
(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
(8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास के पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ आजीिवका को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकारᱶ इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :--
(1) भ-ूउपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा:
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 10,17, 23, 30 और 33 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद;
(ii) िव᳒मान सड़कᲂ को चौड़ा और सुदढ़ृ बनाना;
(iii) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोग ;
(iv) वषाᭅ जल संचयन; और
(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭ थानीय सुख-सुिवधाएं ह ᱹ:
परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना दनेी होगी । परंतु यह भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पाᳯरि᭭थितक/पयᭅटन – (i) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी ।
(ii) पाᳯरि᭭थितक/पयᭅटन महायोजना पयᭅटन िवभाग, महारा᳦ ᮧदशे सरकार ᳇ारा महारा᳦ सरकार के राज᭭व िवभाग और वन िवभाग, के परामशᭅ से तैयार कᳱ जाएगी ।
(iii) पाᳯरि᭭थितक/पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत्:- (क) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पाᳯरि᭭थितक/पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत और यथा लागू) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय भामरागढ़ व᭠ यजीव अभयार᭛ य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा । तथािप संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दरूी से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक नए होटल और ᳯरसोटᭅ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया जाएगा । (ग) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाए,ं ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाए ं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदषूण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986, ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयमᲂ 2000 के अनुसार अंतगᭅत कायाᭅि᭠वत करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िसांतᲂ और िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए पयाᭅवरणीय ᮧदिूषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे, के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाए ंतैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना स.का.िन 343 (अ), तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) यानीय यातायात- पᳯरवहन कᳱ यानीय गितिविधया ंआवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होन ेऔर रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाईया ं- (क) ᮧ᭭ तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᭬ ठ उ᳒ोगᲂ कᳱ ᭭ थापना िविध के अनुसार ᭭ थािपत िव᳒मान का᭬ ठ आधाᳯरत उ᳒ोगᲂ के िलए अनु᭄ात कᳱ जाएगी अ᭠ यथा नहᱭ । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (ख) ᮧ᭭ तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु, मृदा, ᭟ विन ᮧदषूण उ᭜ प᭠ न करने वाले ᳰकसी नए उ᳒ोग कᳱ ᭭ थापना नहᱭ कᳱ जाएगी ।
4. पाᳯरि᭭थितक संवदेी जोन मᱶ ᮧितिष और िविनयिमत ᳰकए जाने वाल े ᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीच ेदी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी
(1) (2) (3) ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइया ं। (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़न ेकᳱ इकाइयां ᮧितिष हᲂगी । तथािप, वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए देशी टाइ᭨स या टᲂ का िनमाᭅण करना िव᳒मान िविनयमᲂ के अनुसार अनु᭄ात हᲂगे । (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (िसिवल) सं.
2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅथा हᲂगे ।
2. आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदषूण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा ।
4. नए बृहत जल िव᳒ुत पᳯरयोजना और ᳲसचाई पᳯरयोजना कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
5. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
6. ᮧाकृितक जल िनकायᲂ या भूिम ᭃेᮢ मᱶ अनुपचाᳯरत ᮧवाह के िनवᭅहन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
7. नए का᳧ आधाᳯरत उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन कᳱ सीमाᲐ के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰकया जाएगा :
तथािप िव᳒मान का᳧ आधाᳯरत उ᳒ोग लागू िविध के अनुसार िनरंतर बने रहᱶगे ;
8. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़ े पैमान े पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे। तथािप ᭭थानीय ᳰकसानᲂ ᳇ारा छोटे ᭭तर पर कᳱ गई पहले अनु᭄ात हᲂगी। िविनयिमत ᳰᮓयाकलाप
9. जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार िविनयिमत (अ᭠ यथा उपबंिधत के िसवाय) होगᱶ ।
10. होटल और ᳯरसोटᭅ का वािणि᭔यक ᭭थापन । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट है, नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। तथािप, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा है वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िव᭭तार पयᭅटन महायोजना और रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण के अनुसार होगा। रा᭔य सरकार के ᭭थानीय/ ᭃेᮢीय/ शहर िनयोजन ᮧािधकरणᲂ ᳇ारा तय ᳰकए गए सभी योजना और िनयम उपयुᭅᲦ िनयमᲂ पर लागू हᲂगे।
11. संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭थानीय ᳞िᲦयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत आंचिलक महायोजना के अनुसार पैरा 6 के उपपैरा
(1) मᱶ सूचीब ᳰᮓयाकलाप भी हᱹ, को करने के िलए अनु᭄ात ᳰकया जाएगा । (ख) पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜पन नहᱭ करते ह,ᱹ से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ग) पाᳯरि᭭थितक संवेदी जोन मᱶ िनमाᭅण ᳰᮓयाकलापᲂ आंचिलक महायोजना कᳱ अनुसार िविनयिमत हᲂगे । रा᭔य सरकार के ᭭थानीय / ᭃेᮢीय / शहर िनयोजन ᮧािधकरणᲂ ᳇ारा तय ᳰकए गए सभी योजना और िनयम उपयुᭅᲦ िनयमᲂ पर लागू हᲂगे।
12. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अनुसार िविनयिमत (अ᭠ यथा उपबंिधत के िसवाय) होगᱶ।
13. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी । (ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा कायᭅयोजना मᱶ ᳰदए गए िववरण का अनुसरण ᳰकया जाएगा ।
14. वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू- जल संचयन भी है । (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण सतही और भूिमगत जल अनु᭄ात होगा । (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी ह ै। (ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा । (घ) जल के संदषूण या ᮧदषूण, िजसके अंतगᭅत कृिष भी है, को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
15. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण ।
(i) िबजली के केबलᲂ का िनमाᭅण केवल उन ᮕामᲂ के िलए ᳰकया जाएगा ह ै जहां िबजली नहᱭ ह।ै
(ii) िबजली और दरूसंचार केबल बनाने कᳱ उ᳖यन/नवीनीकरण कᳱ अनुमित दी जाएगी ।
(ii) भूिमगत केबलᲂ को बढ़ावा ᳰदया जाएगा।
16. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
17. िव᳒मान सड़कᲂ को चौड़ा और मजबूत करना। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
18. रािᮢ मᱶ यािनक पᳯरवहन का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
19. ᮧवासी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
20. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
21. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
22. साइनबोडᭅ और होᳺडग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ दशेीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएंगे ।
24. वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. वायु और यािनक ᮧदषूण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. ठोस अपिश᳥ ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. दकुानदारᲂ ᳇ारा पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । संवᳶधत ᳰᮓयाकलाप
29. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । तथािप, इनमᱶ से कुछ ᳰᮓयाकलापᲂ का अ᭜यिधक िव᭭तार, महायोजना के अनुसार िविनयिमत होगा।
30. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाए ।
31. जैिवक खेती। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाए ।
32. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाए ।
33. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह।ᱹ सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाए ।
34. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । सᳰᮓय ᱨप से बायो गैस, सौर ᮧकाश आᳰद को बढ़ावा ᳰदया जाएगा ।
35. कौशल िवकास। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाए ।
36. कृिष वािनकᳱ। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाए ।
37. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाए ।
5. पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का तीन वषᭅ के िलए गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत्
(i) गडिचरोली िजले का कले टर, -अ᭟ यᭃ;
(ii) उप वन संरᭃक(व᭠यजीव), अ᭨लाप᭨ली -सद᭭ य;
(iii) महरा᳦ सरकार के ᮧ᭜येक िवभाग अथाᭅत् राज᭭व, पुिलस, लोक िनमाᭅण िवभाग ,उ᳒ोग, जल संसाधन, शहरी िवकास, ᮕामीण िवकास का ᮧितिनिध -सद᭭य;
(iv) गैर सरकारी संगठन का ᮧितिनिध जो पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ कर रहा ह,ै जो महारा᳦ रा᭔य सरकार नामिन᳸द᳥ ᳰकया जाएगा -सद᭭य;
(v) पाᳯर ि᭭ थ ित क और पयाᭅवरण के ᭃेᮢ मᱶ महारा᭬ ᮝ रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक िवशेष᭄ सद᭭य;
(vi) ᭃेᮢीय अिधकारी, महारा᳦ रा᭔य ᮧदषूण िनयंᮢण बोडᭅ सद᭭य;
(vii) सद᭭य-सिचव/सद᭭य, रा᭔य जैव-िविवधता बोडᭅ सद᭭य;
(viii) ᭔ये᳧ नगर योजनाकार, बु᭨धाना सद᭭य;
(ix) उप वन संरᭃक(टी), भामरागढ़ सद᭭य-सिचव। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िनदᱷश िनबंधन : (1) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸द᭬ ट ᮧितिष गितिविधयᲂ के िसवाय आन े वाले ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै और जो पाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(4) मानीटरी सिमित का सद᭭य-सिचव या संब कलटर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा।
(5) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠य जीव वाडᭅन को उपाबधं IV मᱶ उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए ऐसे िनदेश द ेसकेगा, जो वह ठीक समझे ।
6. इस अिधसूचना के उपबंधᲂ को ᮧभाव दनेे के िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶगे ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, 12th April, 2017 S.O.1175(E).- WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
3224 (E), dated the 23rd November 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And Whereas, copies of the Gazette containing the said notification were made available to the dated the 23rd November 2015, And Whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
And Whereas, the Bhamragarh Wildlife Sanctuary is situated in Gadchiroli District of Maharashtra and is spread over an area of 104.38 square kilometres;
And Whereas, the Sanctuary is rich in biodiversity and harbours 245 plants species, 193 species of birds, in addition to a wide spectrum of insects and almost all classes of vertebrates;
And Whereas, 73 species of herbs, 15 species of shrubs, 47 species of grasses and 69 species of trees have been documented from the area, of which 151 species are medicinal plants;
And Whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Bhamragarh Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
Now Therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government here by notifies an area with an extent of three to six kilometres all around the boundary of Bhamragarh Wildlife Sanctuary in the State of Maharashtra as the Bhamragarh Wildlife Sanctuary Eco sensitive Zone (herewith after called as Eco-sensitive Zone) details of which are as under, namely:- ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 85.75 square kilometres with an extent of up to three to six kilometres all around the boundary of Bhamragarh Wildlife Sanctuary in the State of Maharashtra. The boundary description of the Eco-sensitive Zone is given in Annexure I.
(2) The Eco-sensitive Zone is spread across 7 villages in Gadchiroli District of Maharashtra.
(3) The list of the villages falling within Eco-sensitive Zone along with coordinates of prominent points is appended as Annexure II.
(4) The map of the eco-sensitive zone along with latitude and longitude is appended to this notification as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Maharashtra State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed at item numbers 10,17, 23, 30 and 33 in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for eco-friendly tourism activities;
(ii) Widening and strengthening of existing roads;
(iii) Small scale industries not causing pollution;

(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Eco-Tourism.- (i) The activity relating to eco-tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(ii) The Eco-Tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.
(iii) The activities of eco-tourism shall be regulated as under, namely:-
(a) all new eco-tourism activities or expansion of existing eco-tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as applicable and as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(b) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the Bhamragarh Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities. However, beyond the distance of one kilometre from the boundary of the Protected Areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;
(c) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs and other natural heritage shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. -
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder;
(12) Industrial Units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.
(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

(b) The mining operations shall strictly be in accordance with the interim order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.

4. Establishment of new major hydroelectric projects and irrigation projects.
Prohibited (except as otherwise provided) as per laws.
5. Use or production of any hazardous substances.

Prohibited (except as otherwise provided) as per laws.
7. New wood based industry. Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone:
Provided the existing wood-based industry may continue as per law.
8. Establishment of large-scale commercial livestock and poultry farms by firms, corporates, companies.
Prohibited (except as otherwise provided) as per applicable laws. However, initiatives on a small-scale by the local farmers are permitted.
Regulated Activities
9. Commercial use of firewood. Regulated (except as otherwise provided) as per laws.
10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one Kilometre of the boundary of the Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities. However, beyond one kilometre and upto the extent of the Eco-sensitive Zone all new tourism activities or expansions of existing activities would in conformity and Tourism Master Plan and guidelines of National Tiger Conservation Authority.
All planning and regulations decided by local / regional / town planning authorities of State Government will prevail on above regulations.
11. Construction activities. (a) No new commercial construction of any kind shall be allowed within one kilometre from the boundary of the Protected Area:
Provided that, local people shall be allowed to undertake construction in their land for their residential use including the activities listed at item 3(1), the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any.
(b) Further, beyond one kilometre upto the extent of Ecosensitive Zone construction for bona fide local needs shall be allowed and other commercial construction activities shall be regulated as per Zonal Master Plan.
(c) construction activity in the Eco-sensitive Zone shall be as per Zonal Master Plan.
All planning and regulations decided by local / regional / town planning authorities of State Government will prevail on above regulations.
12. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons.
Regulated (except as otherwise provided) as per laws.
13. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.
(c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
14. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be allowed only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
5. Monitoring Committee:- (1) The Central Government hereby constitutes a Monitoring Committee for a period of three years, for the effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- I. The Collector of Gadchiroli District Chairman;
II. The Deputy Conservator of Forests (Wildlife), Allapalli Member;
III. A representative each of Department of Revenue, police, Public Works Department, Industries, Water Resources, Urban Development, Rural Development of Government of Maharashtra Members;
shall require prior written permission from the concerned regulatory authority;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
15. Erection of electrical cables and telecommunication towers.
(iii) Erection of electric cables to be permitted only for villages where there is no electricity
(iv) Augmentation/ Renovation of electric and telecommunication cabling are permitted.
(ii) Promote underground cabling
16. Fencing of existing premises of hotels and lodges.
Regulated under as per laws.
17. Widening and strengthening of existing roads.
Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
18. Movement of vehicular traffic at night. Regulated for commercial purpose, under as per laws.
19. Introduction of exotic species. Regulated under as per laws.
20. Protection of hill slopes and river banks. Regulated under as per laws.
21. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
22. Commercial sign boards and hoardings. Regulated under as per laws.
23. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment.
24. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under as per laws.
25. Air and vehicular pollution. Regulated under as per laws.
26. Solid waste management. Regulated under as per laws.
27. Use of polythene bags by shopkeepers. Regulated under as per laws.
28. Drastic change of agriculture systems. Regulated under as per laws.
Promoted Activities
29. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, and fisheries.
However, excessive expansion of some of these activities should be regulated as per, master plan.
30. Rain water harvesting. Shall be actively promoted.
31. Organic farming. Shall be actively promoted.
32. Adoption of green technology for all activities.
Shall be actively promoted.
33. Cottage industries including village artisans, etc.
Shall be actively promoted.
34. Use of renewable energy sources. Bio gas, solar light etc to be promoted.
35. Skill development. Shall be actively promoted.
36. Agro-forestry. Shall be actively promoted.
37. Environmental awareness. Shall be actively promoted.

V. one expert in the area of ecology and environment to be nominated by the Government of Maharashtra Member;
VI. The Regional Officer, Maharashtra State Pollution Control Board, Member;
VII. Member-Secretary/Member, State Biodiversity Board Member;
VIII. The Senior Town Planner, Buldhana Member; and IX. The Deputy Conservator of Forest (T) - Bhamragarh Member-Secretary.
Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
[F.No. 25/12/2015-ESZ-RE] LALIT KAPUR, Scientist ‘G’ Annexure I Description of Boundaries of proposed Eco-sensitive Zone The entire area of Bhamragarh Wildlife Sanctuary and the proposed Eco-sensitive Zone is remote and traversed by perennial rivers namely Parlakota, Pamulgautam and Nibra. On its Northern side, which is bordering with Chattisgarh ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 State in par, the Eco-sensitive Zone has common boundary with forests of Bhamragarh Range of Bhamragarh Forest Division of Maharashtra Forest Department. The village Hicker of Gatta Range and compartment nos. 410, 421 and 425 of Gatta Range are also located on the Northern border of this Eco-sensitive Zone.
Western side is bordered with villages Padhur, Dobhur, Krusnar, Kothi and Compartment no. 501, 509, 487 and 488 and river Parlakota is the range boundary between Gatta and Bhamragarh.
On southern side of the Eco-sensitive Zone are villages Tadpar, Hitapadi and Hidur and compartment nos. 695, 781, 787, 795 and 843.
Eastern side of the Eco-sensitive Zone are villages Kuwakodi and compartments 745, 716,717, 749, 750 and 751 of the Bhamragarh Range.
