2869 (अ), तारीख 19 अ᭍टूबर, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह उᲦ अिधसूचना अंतᳶवᭅ᳥ ह,ै उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;

और, उᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ ᳰक᭠हᱭ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई आᭃेप और सुᭃाव ᮧा᳙ नहᱭ ᱟए थ;े और, मूकांिबका व᭠यजीव अभयार᭛य का नाम कनाᭅटक रा᭔ य मᱶ उडुिप िजला के कंुडापुर तालुक मᱶ अवि᭭ थत व᭠ यजीव अभयार᭛य के म᭟ य भाग मᱶ अवि᭭ थत कोलरू मᱶ ᮧिस᳍ मूकांिबका मंᳰदर के अिध᭬ ठाता “मूकांिबका दवेी” के नाम पर रखा गया ह ैऔर 13o 42’ और 13 o 59’ उ᭜ तर अᭃांश और 74o 39’ से 74o 50’ पूवᭅ दशेांतर के म᭟ य ि᭭ थत ह ै तथा 394.65 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ ह ै और कनाᭅटक सरकार ᳇ारा अिधसचूना स᭎ं या एएफडी.48.एफड᭣ लूएल.74 तारीख 22 मई, 1978 को अिधसूिचत ᳰकया गया था । और, मूकांिबका व᭠ यजीव अभयार᭛य पि᭫ चमी घाट के पि᭫ चमी ढालᲂ तक फैला ᱟआ ह ै और भ-ूभाग साधारणत: पहाड़ी और लहरदार ह ै। व᭠ यजीव अभयार᭛य कᳱ ऊंचाई जनालेने आरएफ के पास इदरु मᱶ 50 मीटर औसत समुᮤ ᭭ तर से अिधक स े लेकर कु᲻ाचादरी मᱶ 1343 मीटर औसत समुᮤ ᭭ तर स े अिधक ह ै । मूकांिबका व᭠ यजीव अभयार᭛य मᱶ वषाᭅ का िवतरण असमान ह,ै परंतु यह दिᭃण पि᭫ चमी मानसून से भारी वषाᭅ ᮧा᭡ त करता ह ैऔर वाᳶषᭅक औसत वृि᭬ टपात 6000 िमलीमीटर के आसपास ह ै। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, मूकांिबका व᭠ यजीव अभयार᭛य का उपयुᭅ᭍ त भ-ूभाग, ऊंचाई और वषाᭅ िवतरण, वन के ᮧकार फुटिह᭨ स के िनचली ऊंचाई पर आᮤᭅ पतझड़ी वन से म᭟ य ऊंचाई पर पि᭫ चम तटीय अ᳍ᭅ सदाबाहरी वन और पि᭫ चम तटीय उ᭬ ण सदाबाहरी वन से शोला ᮕासलᱹड तक अिधक ऊंचाई पर ह ै। इस ᮧकार मूकांिबका व᭠ यजीव अभयार᭛य के ᮧमुख वन के ᮧकार पि᭫ चम तटीय ऊ᭬ ण सदाबाहरी वन (1ए/सी4), पि᭫ चम तटीय अ᳍ᭅ सदाबाहरी वन (2ए/सी2), दिᭃणी गौण आᮤᭅ िमि᮰त पतझड़ी वन (3बी/सी2/2एस1) और शु᭬ क घास भूिम (5डीएस4) ह ै। और, मूकांिबका व᭠ यजीव अभयार᭛य कᳱ मु᭎ य जीवजंतु ᮧजाितयां िचᱫीदार िहरण, सांभर िहरण, भारतीय गौर, मंुजक, िपसरूी, जंगली सूअर, भारतीय साही (शाकाहारी ᮧजाितयां) इ᭜ याᳰद ह ᱹ । मांसाहारी ᮧजाितयᲂ के अंतगᭅत बाघ, तᱶदआु, काला तᱶदआु, जंगली कु᭜ ता, धारीदार लकड़ब᭏ घा और िसयार ह ै। ᮧाइमे᭗स के अंतगᭅत सकंटाप᭠ न ᳲसंह पु᭒ छ लघु पु᭒ छ वानर, लघु पु᭒ छ वानर और सामा᭠य लगूंर इ᭜ याᳰद ह ᱹ । अ᭠ य जीवजंत ु संबंधी ᮧजाितयᲂ के अंतगᭅत रीछ, मालावार जांइट िगलहरी, उड़ने वाली िगलहरी, लᱹड मानीटर िछपकली, केन कछुआ (दलुᭅभ ᮧजाितयां, जो िवलु᭡ त होने के कगार पर ह ᱹ) । सुमे᭫ वर व᭠ यजीव अभयार᭛य के साथ-साथ मूकांिबका व᭠ यजीव अभयार᭛य मालाबार िसवैट कैट के िलए शेष बचे ᱟए वनᲂ और पयाᭅवास मᱶ से एक रहता ह,ै जो केरला और कनाᭅटक के कुछ ᭭ थानᲂ तक ᭭ थािनकत: ᮧितबंिधत समझा जाता ह ै और आईयूसीएन ᳇ारा गंभीर ᱨप स े संकटाप᭠ न ᮧजाितयां घोिषत कᳱ गई ह ᱹ। कुछ सरीसृपᲂ के अंतगᭅत ᳴कंगकोबरा, राक पायथन, इंिडयन कोबरा बᱹबू िपट वाइपर इ᭜ याᳰद ह ᱹ। पᭃी जीवजंत ुसंबंधी ᮧजाितयᲂ के अंतगᭅत ᮕेट हानᭅिबल, मालाबार ᮕे हानᭅिबल, मालाबार पाइड हानᭅिबल, मालाबार लाकᭅ , मालाबार ᮝोगोन इ᭜ याᳰद ह ᱹ। और, अंतराᭅ᳦ीय ᮧकृित और ᮧाकृितक संसाधनᲂ के संरᭃण के िलए अंतराᭅ᳦ीय संघ (आईयूसीएन) के अनुसार कुछ ᮧजाितयां जो गंभीर लु᳙ ᮧाय, कमजोर, खतरे के पास कᳱ ᮰ेणी मᱶ आती ह,ᱹ मूकंिबका व᭠यजीव अभयार᭛य मᱶ पाए जाते ह ᱹ᭭तनपायी जसैे पᱹथेरा टाइगᳯरस (बाघ), पᱹथेरा पाडᭅस (सामा᭠य तᱶदआु), ᮧो᭠युलुस ᱧिबइिनसस (र᭭टी िचᱫीदार िब᭨ली), वीवराᭅ िसवेᳯटना (मालाबार गंध िबलाव), मेलुरसस अरिसनस (रीछ), एलीफस मैि᭍समस (एिशयाई हाथी), बोस गौरास (गौर), सᳶवᭅस यनूीकलर (सांभर), पेᳯटनोमीज़ यूएसकोकैिपलस (लघु ᮢावणकोर उड़ान िगलहरी), रतफा इंिडका (इंिडयन िजयंट िगलहरी), मैनीस ᮓािसकाउडाटा (भारतीय साल), ᭡लैटᱹथोिमस लासीᱧस (मालाबार ि᭭पनी डोरमॉज़), लुᮝा लुᮝा (सामा᭠य ऊदिबलाव), एनो᭍सी सीनेᳯरया (पंजा रिहत ऊदिबलाव) पᭃी जैसे ए᭠ᮣेकोसोरोस कोरोनाटस (मालाबार िचतकबरी धनेश), बुसेरस िबकोᳶनᭅस (ᮕेट धनेश), इ᭏᭝योफोगा इिच᭝येटस (ᮕे मछली गᱨड़), अᳲनंगा मेलेनोगा᭭टर (बांकर), िसकोिनया एिप᭭कोपस (वूली ने᭍ड सारस), ᳰफसेडुला िनगरोᱧफा (᭣लैक एडं ऑरᱶज ᭢लाईकचर) इयूमेस एलिबकुडाटा (िनलिगरी ᭢लाई कैचर) सरीसपृ जसै े इंडोटे᭭टुडो वननेनी (कछुए), िजयोकेलोन एिलगᱶस (भारतीय ᭢लैप शेल कछुए), ᮓोकॉडायलस पलुसᮝीस (मगरम᭒छ), नाजा नाजा (᭭पे᭍सा᭨लेड कोबरा), ओᳰफओफैगस ह᳖ा (᳴कंग कोबरा) उभयचरᲂ जसै े ए᭠᭭सोिनया ओरनेट (मालाबार टॉरᱶट मᱶढक), बुफो बेडडोमी (बेडडोमी मᱶढक), रामानेला मो᭠टाना (जेरडन कᳱ संकᳱणᭅ-मᱶढक मᱶढक), इंᳰदराना लेइिथ (िलथ का छलांग वाला मᱶढक या माथेरान भारतीय मᱶढक), िल᳜ोने᭍᭗स िलमोचाइसᭅ (भारतीय ᳰᮓकेट मᱶढक), मैᳯरᳰकयलस सैि᭍सकॉलस ( मालाबार उ᭬णकᳯटबंधीय मᱶढक), िनकᳱबेᮝाचस डᲥेनᱶिसस (डᲥेन रात मᱶढक, डᲥेन झुरᱮदार मᱶढक), िन᭍टीबेᮝाचस मेजर (मालाबार रात का मᱶढक), िन᭍टीबाᮝाᮓस सटᱹी पलुि᭭ᮝस (कूगᭅ रात मᱶढक या पिवᮢ दलहन झुरᱮदार मᱶढक), राना औरंितयाका (िᮢवे᭠ᮤम मᱶढक, आम लकड़ी मᱶढक) , राना टे᭥पोरैिलस (ᮩो᭠᭸ड मᱶढक या गंुठर के ᭭वणᭅ-समᳶथᭅत मᱶढक), टॉपोटेमा ᱨफ᭭से᭠स (ᱨ᭢सᱶट बुरोइंग मᱶढक), िततली जसै ेआइिडया मलबᳯरका (मालाबार पेड़ अ᭡सरा) जसै े फूलᲂ कᳱ ᮧजाितया ं कैलोफᳱलुम एपेट᭨यूम (होली होन), िसनामोमम सु᭨फ़ुरटम (दालिचनी), डायोि᭭पअसᭅ कᱹडोलेना (करी मारा), होपेया कैरेनᱶिसस (मलाई हाइगा), ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 होपा परिव᭢लोरा (ᳰकरल बोगी), होिपया पᲂगा (डोडडलेे बोगी), वांडा ᭭पथुलता (ऑ᳸कᭅ ड), गाᳶसᭅिनया इंिडका (कोकुम), हाइडनोकापᭅस पᱶटᱶᮟा (कलमोगरा येन मोरा, िमरोलहाकाई, सुरती), नामे ए᭠Ჷूनेट (राᲦमारा) आᳰद ह ै। और, मूकांिबका व᭠ यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाए ं इस अिधसूचना के पैरा 1 मᱶ िविन᳸दᭅ᳥ ह,ᱹ पयाᭅवरण कᳱ दिृ᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करन े को ᮧितिष᳍ करना आव᭫यक ह ै;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करत े ᱟए, कनाᭅटक रा᭔ य मᱶ मूकांिबका व᭠ यजीव अभयार᭛य कᳱ सीमा से चारᲂ ओर के िव᭭ ताᳯरत ᭃेᮢ को मूकांिबका व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथाᭅत ्:--

(1) पाᳯरि᭭थितक सवंदेी जोन का िव᭭तार और उसकᳱ सीमाए-ं-(1) मूकांिबका व᭠ यजीव अभयार᭛य कनाᭅटक रा᭔ य मᱶ उडुिप िजले के कंुडापुर ता᭨ लुक मᱶ ि᭭ थत ह ै। पाᳯरि᭭थितक संवेदी जोन अभयार᭛य कᳱ सीमा 0 (शावᭅथी घाटी व᭠यजीव अभयार᭛य और सोमे᳡रा व᭠यजीव अभयार᭛य के उᱫरी भाग पर जुड़ती ह ैऔर मूकांिबका व᭠यजीव अभयार᭛य का दिᭃणी भाग पᳯरणाम᭭वᱨप, यह भाग पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧ᭭तािवत नहᱭ ह)ै स े

10.80 ᳰकलोमीटर के िव᭭ तार तक 319.86 वगᭅ ᳰकलोमीटर (संलᲨᲂ को छोड़कर) ᭃेᮢ पर फैला ᱟआ ह ै। ऐसे जोन कᳱ सीमा का वणᭅन उपाबधं I पर ह ै।

(2) पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले 41 ᮕामᲂ कᳱ सूची ᮧमुख िब᭠ दᲐु के िनदᱷशांकᲂ के साथ और आरिᭃत वनᲂ के िववरण उपाबधं II के ᱨप मᱶ उपाब᳍ ह ै।

(3) पाᳯरि᭭थितक संवेदी जोन के साथ अᭃांश और दशेा᭠तर मानिचᮢ उपाबधं III के ᱨप मᱶ उपाब᳍ ह ᱹ।

(4) पाᳯर᭭ थितक संवेदी जोन के साथ-साथ अभयार᭛य पर मु᭎ य ᭭ थल (जीपीएस ᳲबंद)ु उपाबधं IV क के ᱧप मᱶ उपाब᳍ ह ै।

2. पाᳯरि᭭थितक सवंदेी जोन के िलए आचंिलक महायोजना-

1. रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आचंिलक महायोजना तैयार करेगी । उᲦ योजना को रा᭔य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत ᳰकया जाएगा।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना रा᭔य सरकार ᳇ारा इस अिधसचूना मᱶ यथािविन᳸दᭅ᳥ रीित मᱶ और सुसंगत कᱶ ᮤीय और रा᭔य िविधयᲂ और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस᳒ातंᲂ, यᳰद कोई हᲂ, के सामंज᭭य स ेतैयार कᳱ जाएगी ।

3. पयाᭅवरणीय और पाᳯरि᭭ थितक बातᲂ को इसमᱶ समकिलत करने के िलए आचंिलक महायोजना सभी संबंिधत रा᭔ य िवभागᲂ के साथ परामशᭅ से तैयार ᳰक जाएगी, अथाᭅत् :-- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(i) पयाᭅवरण;

(ii) वन और व᭠यजीव;

(iii) कृिष;

(iv) राज᭭ व;

(v) शहरी िवकास;

(vi) पयᭅटन;

(vii) ᮕामीण िवकास;

(viii) ᳲसंचाई और बाढ़ िनयंᮢण;

(ix) नगरपािलका;

(x) पंचायती राज;

(xi) लोक िनमाᭅण िवभाग।

4. आचंिलक महायोजना अनुमोᳰदत िव᳒मान भ-ूउपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ, पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸दᭅ᳥ न ᳰकया जाए और उᲦ आंचिलक महायोजना सभी अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का सधुार करेगी ।

5. आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।

6. आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, जनजातीय ᭃेᮢ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैस ेउ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कᭅ डᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का मानिचᮢᲂ के साथ अ᭤यकंन करेगी । योजना को मानिचᮢᲂ मᱶ ᳰदए गए िव᳒मान तथा ᮧ᭭तािवत भूिम उपयोग सुिवधाᲐ के िववरण ᳇ारा समᳶथᭅत ᳰकया जाएगा।

7. आंचिलक महायोजना ᭭ थानीय पाᳯरि᭭ थतकᳱय जोन मᱶ िवकास को िविनियमत करेगी िजसस ेसमुदायᲂ कᳱ जीवकोपाजᭅन कᳱ सुरᭃा के िलए पाᳯरि᭭ थितकᳱ अनुकूल िवकास का सुिन ᭫ चय ᳰकया जा सके ।

8. आंचिलक महायोजना ᭃेᮢ ीय िवकास योजना के साथ सह-अंतक होगी ।

9. आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।

3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करन ेके िलए िन᳜िलिखत उपाय करेगी, अथाᭅत ्:--

(1) भ-ूउपयोग – (क) पाᳯरि᭭थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :

¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष और अ᭠य भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और ᭃेᮢीय नगर योजना अिधिनयम के तहत सᭃम ᮧािधकारी के पूवᭅ अनुमोदन के से और यथा लागू के᭠ᮤीय/रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करन े के िलए आव᭫यक ह,ᱹ अनु᭄ात ᳰकया जा सकेगा, जैस:े- i. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

ii. बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;

iii. ᮧदषूण उ᭜प᳖ न करन ेवाले लघु उ᳒ोग;

iv. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो ᮕह वास; और v. संवᳶधᭅत ᳰᮓयाकलाप और अनु᭒छेद 4 के अधीन ᳰदया गया ह:ै परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ तथा िविनयमᲂ के अधीन सᭃम अिधकारी के पूवᭅ अनुमोदन और संिवधान के अन᭒ु छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै के अनुपालन के िबना, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा:

परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भ-ूअिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय को सूचना दनेी होगी :

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा :

(ख) अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएगें।

(2) ᮧाकृितक जल-᮲ोत -- आंचिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके सरंᭃण और पुननᭅवीकरण के िलए योजना सि᭥ मिलत होगी ।

3. पयᭅटन/ पाᳯरि᭭थितक-पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना के अनुसार हᲂगे, जो आंचिलक महायोजना का भाग हᲂगे । (ख) पाᳯरि᭭थितक पयᭅटन महायोजना पयᭅटन िवभाग ᳇ारा रा᭔य सरकार के वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगी । (घ) पाᳯरि᭭थितक पयᭅटन सबंंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) होटलᲂ और ᳯरसᲃटᲂ का नया संिनमाᭅण व᭠यजीव अभयार᭛य कᳱ सीमा स े 1 ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट हो, अनु᭄ात नहᱭ ᳰकया जाएगा । तथािप, व᭠यजीव अभयार᭛य कᳱ सीमा स े1 ᳰकलोमीटर कᳱ दरूी स ेपरे, पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसᲃटᲂ कᳱ ᭭थापना पयᭅटन महायोजना के अनसुार पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए पूवᭅ सीमांᳰकत और पदािभिहत ᭃेᮢᲂ मᱶ ही अनु᭄ात कᳱ जाएगी । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा मागᭅदशᭅक िस᳍ांतᲂ के तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितकᳱ पयᭅटन पर बल दतेे ᱟए होगा;

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸दᭅ᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया जाएगा ।

4. नसैᳶगᭅक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगᭅक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाए,ं जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए ऐसी योजना आंचिलक महायोजना का भाग होगी ।

5. मानव िनᳶमᭅत िवरासत ᭭ थल- पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और उनके संरᭃण कᳱ योजनाए ंतैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

6. ᭟ विन ᮧदषूण – पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसार मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।

7. वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण एवं िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंधᲂ के अनुसार वाय ु ᮧदषूण के िनयंᮢण के िलए मानक और िविनयम कायाᭅि᭠वत करेगा ।

8. बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के अ᭠तगᭅत आन ेवाल ेपयाᭅवरणीय ᮧदषूण के िन᭭सारण संबंधी साधारण मानकᲂ के उपबंधᲂ के अनुसार होगा तथा पयाᭅवरण कᳱ सरंᭃण के िलए मानक ओर अिधक कठोर बनाये जा सकते ह।ᱹ

9. ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा-- (क) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान और ᮧबंधन, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थ,े के अनुसार ᳰकया जाएगा ;

अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा;

(ख) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण और भूिम भराव के ᭭थापनᲂ को अनु᭄ात नहᱭ ᳰकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7

(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- जैव िचᳰक᭜ सीय अपिश᭬ ट ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासशंोिधत अिधसूचना सं.का.िन 343 (अ), तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई सामा᭠य उपचार सुिवधा या जलाया जाना अनु᭄ात नहᱭ ᳰकया जाएगा ।

11. ᭡लाि᭭टक अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनसुार ᳰकया जाएगा।

12. िनमाᭅण और िव᭟वसं अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

13. ई–अपिश᳥:- पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।

14. यानीय पᳯरवहन: - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएगें और आंचिलक महायोजना के तैयार होन ेऔर रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होन ेतक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

15. यानीय ᮧदषूण:- लागू िविधयᲂ के अनुसार वाहन ᮧदषूण कᳱ रोकथाम और िनयंᮢ ण का अनुपालन ᳰकया जाएगा। ᭭व᭒छक ᲊधन के उपयोग के िलए ᳰकए गए ᮧयास उदाहरण के िलए सीएनजी, एलपीजी, आᳰद ह ᱹ।

16. औ᳒ोिगक ईकाइया:ं - (i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के बाद या ᮧकाशन मᱶ, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी।

(ii) पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनुमित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दᭅ᳥ न हो । इसके अलावा, गैर-ᮧदिूषत कुटीर उ᳒ोगᲂ को ᮧितिष᳍ ᳰकया जाएगा।

17. पहाड़ी ढलानᲂ को सरंᭃण: - पहाड़ी ढलानᲂ के सरंᭃण के अंतगᭅत:

(क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहां ᳰकसी भी संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी । (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी ।

18. अगर यह आव᭫यक समझता ह,ै इस अिधसूचना के ᮧावधानᲂ को ᮧभावी करने मᱶ के᭠ᮤ सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िन᳸दᭅ᳥ करेगा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

4. पाᳯरि᭭थितक सवंदेी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰकए जान ेवाल ेᳰᮓयाकलापᲂ कᳱ सचूी - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तटीय िविनयमन जोन (सीआरजेड), 2011 और पयाᭅवरणीय ᮧभाव आकलन (ईआईए ) अिधसूचना, 2006 और वन (संरᭃण) अिधिनयम, 1980 (1980 के 69), भारतीय वन अिधिनयम, 1927 (1927 के 16), व᭠यजीव (संरᭃण) अिधिनयम, 1972 (1972 के 53) संशोधनᲂ सिहत ᳇ारा शािसत हᲂगे और नीच ेदी गई तािलका मᱶ िविन᳸दᭅ᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप टीका-ᳯट᭡पणी

(1) (2) (3) क. ᮧितिष᳍ ᳰᮓयाकलाप

(1) वािणि᭔यक खनन । (क) सभी ᮧकार के नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या ᲊटᲂ का िनमाᭅण करना भी सि᭥मिलत ह,ै के िसवाय नहᱭ हᲂगी ;

(ख) खनन संᳰᮓयाए,ं माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडशेन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।

(2) जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । कोई नई या पाᳯरि᭭थितक सवेंदी जोन मᱶ ᮧदषूण फैलाने वाल े उ᳒ोगᲂ के िव᭭तार कᳱ अनुमित दी जाएगी। पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनुमित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दᭅ᳥ न हो ।

(3) बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापन । लागू िविधयᲂ के अनसुार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

(4) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनसुार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

(5) ᮧाकृितक जल िनकायᲂ या भूिम ᭃेᮢ मᱶ अनुपचाᳯरत ᮧवाह के िनवᭅहन । लागू िविधयᲂ के अनसुार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

(6) ठोस अपिश᳥ िनपटान ᭭थल कᳱ पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान कᳱ कोई ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 ᭭थापना और सामा᭠य जलाए जान े कᳱ सुिवधा के िलए ठोस और जैव िचᳰक᭜सा अपिश᳥। नई ठोस अपिश᳥ िनपटान ᭭थल और अपिश᳥ उपचाᳯरत/ᮧसं᭭करण सुिवधा कᳱ अनुमित नहᱭ ह ै। औ᳒ोिगक ᮧᳰᮓया और ᭭वा᭭᭝य ᮧित᳧ान/अ᭭पतालᲂ आᳰद से उ᭜प᳖ ᳰकसी भी ठोस अपिश᳥ के उपचाᳯरत के िलए सामा᭠य या ᳞िᲦगत जलावतरण कᳱ सुिवधा का अिधकतर ᮧितिष᳍ ह ै।

(7) फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़ े पैमाने पर वािणि᭔यक पशुधन संपदा और कु᭍कुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।

(8) नई आरा िमलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।

(9) ᲊट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

(10) जलावन लकिड़यᲂ का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनसुार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।

(11) पवन िमलᲂ का िनमाᭅण । लागू िविधयᲂ के अनसुार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । ख. िविनयिमत ᳰᮓयाकलाप

(12) होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलापᲂ संबंधी पयᭅटकᲂ कᳱ लघु संरचनाᲐ के िलए संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात हᲂगे, अ᭠यथा नहᱭ । परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा ह ै वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और यथा लागू मागᭅदशᱮ िस᳍ांतᲂ के अनुᱧप होगा।

(13) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो, कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा:

परंतु ᭭ थानीय लोगᲂ को पैरा 6 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करन े कᳱ अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।

(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमाᭅण;

(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;

(iii) कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण;

(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो ᮕह वास;

और

(v) इस अिधसूचना मᱶ संवᳶधᭅत ᳰᮓयाकलापᲂ कᳱ सचूी :

पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदषूण उ᭜ प᭠ न नहᱭ करते ह,ᱹ से संबंिधत सिंनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएगें और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित स ेही ᭠ यनूतम पर रखे जाएगें । (ख) एक ᳰकलोमीटर स े आगे आंचिलक महायोजना कᳱ अनुसार िविनयिमत हᲂगे ।

(14) ᮧदषूण उ᭜प᳖ न करन े वाले लघ ु उ᳒ोग । पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनुमित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दᭅ᳥ न हो । इसके अलावा, गैर-ᮧदिूषत कुटीर उ᳒ोगᲂ को ᮧितिष᳍ ᳰकया जाएगा।

(15) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कंही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶ ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनसुार िविनयिमत होगी ।

(16) वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(17) िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पᳯरिनमाᭅण और केबल िबछाना और अ᭠य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल को बढ़ावा ᳰदया जाएगा।

(18) नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।

(19) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढृ करना । लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।

(20) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैस े लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11 गमᭅ वायु गु᭣बारᱶ, हलेीका᭡टर, ᮟोन, माइᮓोलाइटस और अ᭠य पयᭅटन ᳰᮓयाकलाप आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना।

(21) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(22) रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।

(23) ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(24) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करन े और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन ᳰकया जाएगा । अ᭠यथा लागू िविधयᲂ के अधीन उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण/ᮧवाह के िनवᭅहन को िविनयिमत ᳰकया जाएगा।

(25) सतह और भूजल के वािणि᭔यक िन᭬कषᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(26) खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ स᭎ती स ेमानीटरी कᳱ जाएगी।

(27) ठोस अपिश᭬ ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(28) िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(29) पाᳯरि᭭थितक पयᭅटन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(30) पोिलथीन बैगᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(31) वािणि᭔ यक साइनबोडᭅ और होᳺडᲈग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. सवंᳶधᭅत ᳰᮓयाकलाप

(32) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(33) जैिवक खेती। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(34) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(35) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर भी ह ᱹ। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(36) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । बायोगैस, सौर ᮧकाश इ᭜ याᳰद को बढ़ावा ᳰदया जाना ह ै।

(37) कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(38) पाᳯरि᭭थितक अनकूुल पᳯरवहन का उपयोग । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

(39) कौशल िवकास । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।

5. मानीटरी सिमित-

(1) कᱶ ᮤीय सरकार, पयाᭅवरण (सरंᭃण) अिधिनयम,1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) इस ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी तीन वषᭅ कᳱ अविध के िलए एक मानीटरी सिमित गᳯठत करती ह ैजो िन᳜िलिखत स ेिमलकर बनेगी, अथाᭅत ्:- i. ᭃेᮢीय आयु᭍ त, मैसरू - अ᭟यᭃ ;

ii. कनाᭅटक सरकार के पयाᭅवरण िवभाग का ᮧितिनिध - सद᭭ य ;

iii. कनाᭅटक सरकार के शहरी िवकास िवभाग का ᮧितिनिध - सद᭭ य ;

iv. कनाᭅटक रा᭔ य ᮧदषूण िनयंᮢण बोडᭅ का ᮧितिनिध - सद᭭ य ;

v. पयाᭅवरण (िजसके अंतगᭅत िवरासत संरᭃण भी ह)ै के ᭃेᮢ मᱶ कायᭅ करन ेवाले गैर सरकारी संगठनᲂ का कनाᭅटक रा᭔य सरकार ᳇ारा ᮧ᭜ येक मामले मᱶ तीन वषᭅ के िल ए नामिन᳸दᭅ᳥ एक ᮧितिनिध - सद᭭ य ;

vi. पयाᭅवरण के ᭃेᮢ मᱶ एक िवशेष᭄ िजसे कनाᭅटक रा᭔ य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ तीन वषᭅ के िलए नामिन᳸दᭅ᭬ ट ᳰकया जाएगा - सद᭭ य ;

vii. उपायु᭍ त या उसका ᮧितिनिध, िशमोगा – सद᭭ य ;

viii. उपायु᭍ त या उसका ᮧितिनिध, उडुपी – सद᭭ य ;

ix. सागर िनवाᭅचन ᭃेᮢ से िवधान सभा सद᭭ य - सद᭭ य ;

x. िथरथाहाली िनवाᭅचन ᭃेᮢ से िवधान सभा सद᭭ य - सद᭭ य ;

xi. िब᭠ दरू िनवाᭅचन ᭃेᮢ से िवधान सभा सद᭭ य - सद᭭ य ;

xii. कु᭠ डापुर िनवाᭅचन ᭃेᮢ से िवधान सभा सद᭭ य - सद᭭ य ;

xiii. रा᭔य जैव िविवधता बोडᭅ का सद᭭य - सद᭭ य ;

xiv. उप वन संरᭃक, कुदरीमुख व᭠ यजीव ᮧभाग करकाला - सद᭭ य-सिचव । ᳯट᭡पण: (कनाᭅटक रा᭔ य सरकार ᳇ारा, अ᭠ य बातᲂ के साथ, सुसंगत अनुमोदन अिभᮧा᭡ त करते ᱟए, िजसके अंतगᭅत अ᭟ यᭃ, िवधान सभा, कनाᭅटक से अनु᭄ा ह,ै यᳰद अपेिᭃत हो, के अ᭟ यधीन)

6. िनदᱷश िनबधंन

(1) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं.

का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसचूी के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ िविन᳸दᭅ᭬ ट ᮧितिष᳍ गितिविधयᲂ के िसवाय आन ेवाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13 वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸दᭅ᳥ कᳱ जाएगी ।

(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸दᭅ᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया ह,ै परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸दᭅ᳥ ᳰकया जाएगा ।

(4) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संबंिधत उ᳒ान उप वन संरᭃक ऐस े᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करन ेके िलए सᭃम होगा ।

(5) मानीटरी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहत ेᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

(6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक रा᭔ य के मु᭎ य व᭠ यजीव वाडᭅन को अपनी वाᳶषᭅक कारᭅवाई ᳯरपोटᭅ उपाबधं V मᱶ उपबंिधत ᱨप मᱶ उ᭍ त वषᭅ के 30 जनू तक ᮧ᭭तुत करेगी ।

(7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदᱷश द ेसकेगा, जो वह ठीक समझे ।

7. इस अिधसूचना के उपबंधᲂ को ᮧभावी बनान ेके िलए कᱶ ᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸दᭅ᭬ ट कर सकᱶ गी ।

8. इस अिधसूचना के उपबंध, भारत के माननीय उᲬतम ᭠यायालय या उᲬ ᭠यायालय या रा᭬ ᮝीय हᳯरत ᮧािधकरण ᳇ारा पाᳯरत कोई आदशे या पाᳯरत होने वाले ᳰकसी आदशे, यᳰद कोई हᲂ, के अधीन हᲂगे । [फा. सं. 25/142/2015-ईएसजेड-आरई] व᭠ यजीव अभयार᭛य से संबंिधत ह,ै सीमा रेखा मूकांिबका व᭠ यजीव अभयार᭛य स े गुजरती ह ै और इस ᮧकार पाᳯर᭭ थितक संवेदी जोन के िलए 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अितᳯर᭍ त ᭃेᮢ पर िवचार नहᱭ ᳰकया गया ह ैइस ᮧकार पाᳯर᭭ थितक संवेदी जोन सीमा रेखा करनी आर एफ कᳱ सीमारेखा को उ᭜ तर मᱶ काटती ᱟई गुजरती ह ैतथा कनगोड के पास ᭭ थानीय ᭃेᮢ मᱶ पᱟचंती ह ै। इसस ेआगे सीमारेखा उ᭜ तरपूवᭅ कᳱ ओर काटते ᱟए गुजरती ह ैऔर बरलाहोल पᱟचंती ह ै। त᭜ प᭫ चात ्रेखा नागोडी होल के साथ-साथ पि᭫ चम कᳱ ओर ितरछी गुजरती ह ै। ᱟलगरगुडा के समीप ᱟनारम᭠ य आर एफ कᳱ आर एफ सीमा के ᭭ थानीय ᭃेᮢ मᱶ पᱟचंती ह ै । इससे आगे रेखा ᱟनारम᭠ य आर एफ कᳱ आंतᳯरक सीमा के साथ-साथ पूवᭅ कᳱ ओर ितरछी गुजरती ह ै और केनाम᭍ कᳱगुडडा के समीप ᭭ थानीय ᭃेᮢ मᱶ पᱟचंती ह ै। पूवᭅ : रेखा दिᭃण कᳱ ओर ितरछी गुजरती ह ैऔर मरकटीके होल पᱟचंती ह ै। इससे आगे रेखा नदी के साथ-साथ ितरछी गुजरती ह ै । त᭜ प᭫ चात् रेखा पूवᭅ कᳱ ओर ितरछी गुजरती ह ैऔर कटीनाहोल नामक ᭭ थानीय ᭃेᮢ मᱶ पᱟचंती ह ै। इससे आगे रेखा पूवᭅ कᳱ ओर नाला के साथ ितरछी गुजरती ह ै और मटठीकाए आर एफ सीमा पᱟचंती ह ै। बाद मᱶ, रेखा मटठीकाए आर एफ के साथ पूवᭅ कᳱ ओर ितरछी गुजरती ह ैऔर तब रेखा दिᭃण पूवᭅ कᳱ ओर गुजरत ेᱟए आर एफ सीमा के साथ-साथ कि᭣ बनहोल को पार करती ह ैऔर कंुडगल के समीप स् थानीय ᭃेᮢ मᱶ पᱟचंती ह ै। इससे आगे रेखा दिᭃण पूवᭅ कᳱ ओर ितरछी गुजरती ह ैऔर िबस ᭭ टेट कᳱ ओर रा᭔ यवन सीमा पᱟचंती ह ैऔर िबस ᭭ टेट कᳱ ओर रा᭔ यवन सीमा के साथ ितरछी गुजरती ᱟई करीमने के समीप नाला पᱟचंती ह ै । इससे आगे रेखा दिᭃण कᳱ ओर नाला के साथ ितरछी गुजरती ह ैऔर संपीगोडी गांव सड़क पᱟचंती ह ै। इसस ेआगे रेखा नाला के साथ दिᭃण पूवᭅ कᳱ ओर ितरछी गुजरती ह ैऔर ᳰकलगारो के समीप ᭭ थानीय ᭃेᮢ पᱟचंती ह ै। इससे आगे रेखा दिᭃण पि᭫ चम कᳱ ओर ितरछी गुजरती ᱟई म᭭ तीकटे सड़क पᱟचंती ह ै। इसस ेआगे रेखा दिᭃण पूवᭅ कᳱ ओर ितरछी गुजरती ᱟई मनीबेल रा᭔ यवन सीमा को ᭭ पशᭅ करती ह ै। उसके बाद रेखा ᮝाई जं᭍ शन ᳲबंद ुपर पᱟचंती ह ैऔर उससे आगे रेखा दिᭃण पि᭫ चम कᳱ ओर ितरछी गुजरते ᱟए कंचीक᭨ लाबी ᮧतापᲂ के करीब ᭭ पशᭅ करती ह ै। दिᭃण : इससे आगे रेखा वराही आर एफ सीमा के साथ पि᭫ चम कᳱ ओर ितरछी गुजरती ह ैऔर मथकलगुड े आर एफ पᱟचंती ह ै। इसस ेआगे रेखा दिᭃण पि᭫ चम कᳱ ओर मथकलगुड ेआर एफ के साथ ितरछी गुजरती ह ैऔर वराही नदी पᱟचंती ह ै । चूंᳰक िनकटवतᱮ ᭃेᮢ सोमे᭫ वर व᭠ यजीव अभयार᭛य स े संबंिधत ह ैऔर इस ᮧकार पाᳯरि᭭ थितक संवेदी जोन के अितᳯर᭍ त ᭃेᮢ पर िवचार नहᱭ ᳰकया गया ह ै। इससे आगे रेखा वराही नदी के साथ दिᭃण कᳱ ओर ितरछी गुजरती ह ैऔर हरकेबल के समीप संपूणᭅ ᭭ थान पᱟचंती ह ै। इससे आगे रेखा उ᭜ तर पि᭫ चम कᳱ ओर ितरछी गुजरती ह ैऔर सूरालडवी आर एफ कᳱ सीमा पᱟचंती ह ै 8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th April, 2017 S.O. 1176(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 2869 (E), dated the 19th October, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, no objections and suggestions received from persons and stakeholders in response to the draft notification;

AND WHEREAS, the Mookambika Wildlife Sanctuary has been named after goddess “Mookambika” the presiding deity of the famous Mookambika temple at Kollur located in the heart of the Wildlife Sanctuary and situated in Kundapur Taluk of Udupi district in the State of Karnataka and lies between 130 42’ and 130 59’ North Latitude and 740 39’ to 740 50’ East Longitude and spread over an area of 394.65 sq. km. and notified vide Government of Karnataka Notification number AFD.48.FWL.74 dated the 22nd May, 1978;

AND WHEREAS, the Mookambika Wildlife Sanctuary spreads across the Western slopes of Western Ghats and the rain is generally hilly and undulating and the altitude of the Wildlife Sanctuary varies from 50 meters above Mean Sea Level at Idur near Jannalane Reserved Forest to 1343 meters above Mean Sea Level at Kodachadri and the distribution of rainfall at Mookambika Wildlife Sanctuary is very uneven, but it receives torrential downpour from the South-West monsoon and the annual average precipitation is close to 6000 millimetre;

AND WHEREAS, with the above mentioned terrain, elevation and rainfall distribution, the forest types of Mookambika Wildlife Sanctuary varies from Moist Deciduous Forest at the lower altitude of foot hills to West Coast Semi-Evergreen forest and West Coast Tropical Evergreen Forest at mid-altitude to Shola Grass land at higher altitude and thus the major forest types of the Mookambika Wildlife Sanctuary is West Coast Tropical Evergreen Forest (1A/C4), West Coast Semi-Evergreen forest (2A/C2), Southern Secondary Moist Mixed Deciduous Forest (3B/C2/2S1) and Dry Grass lands(5 DS 4);

AND WHEREAS, major faunal species of the Mookambika Wildlife Sanctuary is Spotted Deer, Sambar Deer, Indian Guar, Barking Deer, Mouse Deer, Wild Pig, Indian Porcupine (herbivore species) etc. Carnivore includes Tiger, Leopard, Black Panther, Wild Dog, Striped, Hyena and Jackal. Primates include endangered Lion-Tail Macaque, Bonnet Macaque and Common Langur etc. Other faunal species includes Sloth Bear, Malabar Giant Squirrel, Flying Squirrel, Land Monitor Lizard, Cane Turtle (rare species, on the verge of extinction). Along with Someshwara Wildlife Sanctuary, Mookambika Wildlife Sanctuary also remains one of the last remaining forest or habitat for Malabar Civet Cat, which is considered as endemic restricted to few places of Kerala and Karnataka and declared as Critically Endangered species by International Union for Conservation of Nature and Natural Resources. Some of the reptiles include King Cobra, Rock Python, Indian Cobra, Bamboo Pit Viper etc. Avifaunal species includes Great Hornbill, Malabar Grey Hornbill, Malabar Pied Hornbill, Malabar Lark, Malabar Trogon etc;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of the Mookambika Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.

NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of the Mookambika Wildlife Sanctuary in the State of Karnataka as the Mookambika Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and Boundaries of Eco-sensitive Zone.—

(1) Mookambika Wildlife Sanctuary is situated at Kundapur Taluk of Udupi district in the State of Karnataka and the Eco-sensitive Zone is spread over an area of 319.86 square kilometers (excluding revenue enclosures) with an extent varying from zero (Sharavathi Valley Wildlife Sanctuary and Someshwara Wildlife Sanctuary adjoin on northern side and southern side of the Mookambika Wildlife Sanctuary consequently, no Eco-sensitive Zone has been proposed on these sides) to 10.80 kilometres from the boundary of sanctuary and the boundary description of such Zone is given in Annexure-I.

(2) The list of 41 villages falling within the Eco-sensitive Zone along with co-ordinates of prominent points and the details of the Reserve Forests are appended as Annexure-II.

(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure- III.

(4) The Geo Coordinates of major points on the Eco-sensitive Zone boundary as well as on the sanctuary boundary are appended as Annexure-IV .

2. Zonal Master Plan for the Eco-sensitive Zone.-

(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

1. Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:

Provided that the conversion of agricultural and other lands, for the purpose other within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as.-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities and given under para 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

(3) Tourism/Eco-tourism.-

(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The activities of Eco-tourism shall be regulated as under, namely:-

(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Kurdapur Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km.

from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.

(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016;

the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.

(b)No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.- Bio medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.

(b)No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.

(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016,.

(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27 Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016,.

(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.

(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and the efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.

(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:-

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description A. Prohibited Activities

1. Commercial Mining

(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).

No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.

Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances.

Prohibited (except as otherwise provided) as per applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws.

6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.

No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco-sensitive Zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is prohibited.

7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.

Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.

8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.

10. Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws.

11. Erection of wind mills. Prohibited (except as otherwise provided) as per applicable laws.

B. Regulated Activities

12. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of the Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:-

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution termed as per classification done by the Central Pollution Control Board in the year 2016;

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and

(v) Promoted activities listed in this Notification:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

14. Small scale non polluting industries.

Non polluting industries as per classification of industries issued by the Central Pollution Control Board in the year 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

15. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the relevant Central or State Act and the rules made thereunder.

16. Collection of Forest produce or Non-Timber Forest Produce (NTFP).

Regulated under applicable laws.

17. Erection of electrical and communication towers and laying of cables and other infrastructures.

Regulated under applicable law. Underground cabling may be promoted.

18. Infrastructure including civic amenities.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

19. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

20. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

Regulated under applicable law.

21. Protection of Hill Slopes and river banks.

Regulated under applicable laws.

22. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

23. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted under applicable laws for use of locals.

24. Discharge of treated waste water/effluents in natural water bodies or land area.

The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.

25. Commercial extraction of surface and ground water.

Regulated under applicable law.

26. Open Well, Bore Well etc. for agriculture or other usage.

Regulated and the activity should be strictly monitored by the appropriate authority.

27. Solid Waste Management. Regulated under applicable laws.

28. Introduction of Exotic species. Regulated under applicable laws.

29. Eco-tourism. Regulated under applicable laws.

30. Use of polythene bags. Regulated under applicable laws

31. Commercial Sign boards and hoardings.

Regulated under applicable laws.

5. Monitoring Committee.- (1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-

(i) Regional Commissioner, Mysore – Chairman;

(ii) Representative of the Department of Environment, Government of Karnataka -Member;

(iii) Representative of the Department of Urban Development, Government of Karnataka - Member;

(iv) Representative of Karnataka State Pollution Control Board - Member;

(v) A representative of NGO working in the field of environment to be nominated by the Government of Karnataka for a term of three years in each case -Member;

(vi) An expert in the area of ecology and environment to be nominated by the Government of Karnataka for a term of three years in each case - Member;

(vii) Deputy Commissioner or his representative, Shivamogga – Member;

(viii) Deputy Commissioner or his representative, Udupi –Member;

(ix) Member from Legislative assembly from Sagara constituency – Member;

(x) Member from Legislative assembly from Thirthahalli constituency – Member;

(xi) Member from Legislative assembly from Byndoor constituency – Member;

(xii) Member from Legislative assembly from Kundapur constituency – Member;

(xiii) Member, State Biodiversity Board -Member

(xiv) The Deputy Conservator of Forests, Kudremukh Wildlife Division, Karkala - Member Secretary.

Note: Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required.

6. Terms of Reference.-

(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

C. Promoted Activities

32. Rain water harvesting. Shall be actively promoted.

33. Organic farming. Shall be actively promoted.

34. Adoption of green technology for all activities.

Shall be actively promoted.

35. Cottage industries including village artisans, etc.

Shall be actively promoted.

36. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.

37. Agro-Forestry. Shall be actively promoted.

38. Use of eco-friendly transport. Shall be actively promoted.

39. Skill Development. Shall be actively promoted.

40. Restoration of Degraded Land/ Forests/ Habitat.

Shall be actively promoted.

41. Environmental Awareness. Shall be actively promoted.

(4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.

(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

[F. No. 25/142/2015-ESZ-RE] LALIT KAPUR, Scientist ’G’ ANNEXURE-I Boundary description of the Eco-sensitive Zone around Mookambika Wildlife Sanctuary.

North : The Eco-Sensitive Zone boundary starts from the Edamale gudda runs along the Hulmurdibare Reserved Forest boundary line towards South-East till Modalabare gudda and touches to Meginivalley Reserved Forest boundary. The line then runs along the boundary of Meginivalley Reserved Forest towards Eastern direction The line then moves North along Karni Reserved Forest boundary to meet 1Km parallel line to Meginivalley Reserved Forest in the village Kadanavalli. From this point Eco-sensitive Zone line follows 1km parallel line to Meginivalley Reserved Forest boundary towards East and reaches Marati village boundary. Then it runs along 1km parallel line with the Kodachadri Reserved Forest boundary and reaches Honnarmagne Reserved Forest boundary line near the locality Ikkibil, SS Bhoga village. Then the Eco-Sensitive Zone boundary line runs towards East along with Honnarmagne Reserved Forest boundary, and touches to Mavinagudda, Nittur village. Then the Eco-sensitive Zone boundary line runs South-East along 1km parallel line to Kodachadri Reserved Forest and passes through Adugodu, Nittur village. Then the line runs South-West and reaches Marakatak hole at Kenemakki gudda, Manjagalale village. Further the line runs South-East along 1km parallel to the Chakra Reserved Forest boundary in Kattinahole Village. Then the line traverses East along 1Km parallel line to Kilandoor Reserved Forest boundary and reaches Mattikai Reserved Forest boundary.

Then the line traverses along the Mattikai Reserved Forest boundary and touches Baise State Forest boundary near Samgodu, Bhramhanavada village.

East : Then the Eco-sensitive Zone boundary line runs along the Baise State Forest boundary then Ecosensitive Zone line follows 1Km parallel line to the Kilandur Reserved Forest boundary in the village Malali. Then it runs North passing through Nilsakal, Karimane village. Further the line traverses South- East along 1Km parallel line to the Kilandaur Reserved Forest by passing through Karimane village, and reaches to Nagar-Mastikatte roadat Mastikatte. Then the line traverses South-West along 1Km parallel line to Hulikal State Forest and reaches Hulikal hole. Then the line runs South-East along the Manibyl Dam road and reaches Varahi State Forest boundary. And the line continues along the Varahi State Forest boundary till joins to the Eco-sensitive Zone boundary line of Someshwara Wildlife Sanctuary.

South : The Eco-sensitive Zone line merges with the Tambottu Reserved Forest boundary of Someshwara wildlife sanctuary till it touches Western Eco-sensitive Zone line of Someshwara wildlife sanctuary.

Then the Eo-sensitive Zone boundary line follows west along 1km parallel line to the Metkal gudde Reserved Forest boundary and touches to Suraladavi Reserved Forest boundary in Ulluru 74 village.

And runs along the Suraladavi Reserved Forest boundary. Then the line continues along 1km parallel line to the Metkalgudde Reserved Forest boundary North-East direction by passing through Siddapura village and touches the Dottinaberu Reserved Forest boundary. And runs along with Dottinaberu Reserved Forest boundary and reaches Hennabyl, Siddapur village. Then it runs along 1km. parallel line to the Metkal gudde Reserved Forest boundary North-East and reaches to Kerekatte, hosangadi village.

Then again the line traverses towards North-East and touches Doddinamane Reserved Forest boundary.

Then the line continues west along 1km parallel line to Baregundi Reserved Forest boundary in Ajri village. And passes through Kodladi village. Then the line runs along 1 km. parallel line to Harmanupare Reserved Forest boundary and touches Kamradi Hole Reserved Forest boundary, at locality of Hemmakki hara. Then Eco-Sensitive Zone boundary line runs along the Kamradihole Reserved Forest boundary and Hemmakki-Neralekatte road then touches the Mavinaguli Reserved Forest boundary in Karkunje village. Further the line runs along the Mavinaguli Reserved Forest boundary in Neralakatte village and touches Kundapura- Kollur road near Nempu Vandse village.

West : Then Eco-sensitive Zone boundary line runs North-West and touches the Kasanakatte Reserved Forest boundary line near Adikekodlu in Vandse village and continues to runs along the Reserved Forest boundary. Further the line runs towards west along 1km parallel line to the Abbigudde Reserved Forest boundary and touches Mudarigudde Reserved Forest boundary near Panjurligudi and runs along the mud arigudda Reserved Forest boundary. Further the line traverses along 1km parallel line to the Abbigudde Reserved Forest boundary towards North and touches Harkur Reserved Forest near Kodagi.

Then the line runs along the Harkur Reserved Forest boundary and touches Aloor, Aloor village. Further the line traverses towards North-East along 1Km parallel line to the Abbigudde Reserved Forest boundary and touches Heroor Reserved Forest boundary by crossing the Kolluru river near the locality Mavinaguli. Then line continues to run along the Herur Reserved Forest boundary in Herur village and run towards North and touches Hulimisepare Reserved Forest boundary near Hitlamane. Further the Eco-sensitive Zone boundary line runs along the Hulimisepare Reserved Forest boundary by passing Kalthodu village and touches to the Kollur Baindoor road at Areshirur, Golihole village. Then the line runs North-West along 1Km parallal line to the Kortikalbare boundary in Golihole and Yelajith village and meets Guruvankote Reserved Forest boundary near Kambali locality. The line then runs along the Guruvankote Reserved Forest boundary line then it meets along 1 km. parallel to the Korathikal bare Reserved Forest and Hulilmurdibare Reserved Forest boundary by passing through Theggarse village, Baindoor village and yedthere village. The line then touches Kadike Reserved Forest boundary line near Kadike Yedthare village. And then runs along the boundary line of Kadike Reserved Forest in the village Yedthare and touches Savantgudde Reserved Forest boundary at Hadiginagadde locality and run continues to along the boundary of Savantagudde Reserved Forest boundary. Then touches the Nuz Reserved Forest boundary by crossing the Sankadagundi river and runs along its boundary. Then the Line touches the Starting Point.
