आ. 2871 (अ) तारीख 19 अᲦूबर, 2015, ᳇ारा भारत के राजपᮢ, असाधारण मᱶ राज᭭थान मᱶ सीमामाता व᭠यजीव अभयार᭛य के चारᲂ ओर पाᳯरि᭭थितक संवेदी जोन को घोिषत करते ᱟए एक ᮧकािशत कᳱ गई थी िजसमᱶ उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ उᲦ अिधसूचना अंतᳶवᭅ᳥ है जनता को उपल᭣ध करा दी गई थᱭ, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत ᳰकए गए थे;
और, उᲦ राजपᮢ, िजसमᱶ उᲦ अिधसूचना अंतᳶवᭅ᳥ है, कᳱ ᮧितयां जनता को 19 अᲦूबर, 2015 को उपल᭣ध करा दी गई थी;
और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा स᭥यक् ᱧप से िवचार ᳰकया गया है;
और, सीतामाता व᭠यजीव अभयार᭛य जो अरावली पवᭅतीय ᮰ेणी, िव᭠᭟या पवᭅतीय ᮰ेणी और मालवा पठार के िमलन ᭭थान पर और राज᭭थान रा᭔य के िजला िचᱫौड़गढ और ᮧतापगढ़ के दिᭃणी – पूवᱮ ᭃेᮢ पर अवि᭭थत ह ैऔर 740 23’ पू– 74040’ पू दशेांतर और 240 04’ उ से 24023’ उ अᭃांश के बीच ह ैऔर 422.94 वगᭅ ᳰकलोमीटर के ᭃेᮢ पर फैला ᱟआ है िजसे राज᭭थान सरकार ᳇ारा अिधसूचना संया एफ 11(9) राज᭭व/समूह-8/78, जयपुर, तारीख 2 जनवरी, 1979 ᳇ारा वषᭅ 1979 मᱶ अभयार᭛य के ᱨप मᱶ अिधसूिचत ᳰकया गया था;
और, सीतामाता व᭠यजीव अभयार᭛य कᳱ उᱫर-पि᳟म सीमा सागौन बांस िमि᮰त वन के िलए और इसके साथ जुडे ᮧजाितयᲂ, वन᭭पितयᲂ और जीव के सबसे ᮧचुर अभयार᭛य मᱶ से एक ह ै। यहां करीब सरीसृप के लगभग 50 ᮧजाितया,ं उभयचर के 9 ᮧजाितया,ं पिᭃयᲂ कᳱ 275 ᮧजाितयां और मछिलयᲂ कᳱ 30 ᮧजाितया ंअभयार᭛य कᳱ सूची मᱶ सूचीब ह।ै सीतामाता अभयार᭛य मᱶ पौधᲂ कᳱ 800 ᮧजाितयां ह ैिजसमᱶ से 108 औषधीय पौधᲂ कᳱ ᮧजाितयां पहले स ेही पहचानी जा चुकᳱ ह,ै रा᳦ीय औषधीय पादप बोडᭅ, नई ᳰद᭨ली ᳇ारा जारी संकटाप᳖ औषधीय पौधᲂ कᳱ 13 ᮧजाितया ंह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, जहां इस संरिᭃत ᭃेᮢ कᳱ सतह अपेᭃाकृत कम लहरदार है और तीन बारहमासी नᳰदया ं(जाखम, सीतामाता और करमोई) उ᭬णकᳯटबंधीय नम पणᭅपाती वृᭃ ᮧजापितयᲂ को वास ᮧदान करती है जो ᳰक अरावली रेड ᭭पूर मुगᱮ, ᮕे जंगल मुगᱮ, सूरजभगत और तमाम अ᭠य जीव-ज᭠तु एवं वन᭭पित ᮧजाित के िलए सू᭯म वास बनाती है और यह तमाम ᮧजाितयᲂ के िलए, िजनमᱶ पि᳟मी घाट के त᭜वᲂ के अलावा िहमालय, इंडो-मलायन और अᮨᳱकᳱ ᭃेᮢᲂ स ेतमाम बाहर जाने वाली ᮧजाितयᲂ के िलए िविवरणा᭜मक सीमा बनाती है जो ᳰक अि᳇तीय ह;ै और पयाᭅवरण दिृ᳥कोण से सीतामाता व᭠यजीव अभयार᭛य और उसके आस पास के ᭃेᮢ को पाᳯरि᭭थितक संवेदी जोन घोिषत करते ᱟए िजसमᱶ वन᭭पित और जीव के संरᭃण के िलए नुकसान पᱟचंाने वाले कितपय ᳰᮓयाकलापᲂ को िनयंिᮢत करना आव᭫यक ह;ै अतः अब के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, राज᭭थान रा᭔य मᱶ सीतामाता व᭠यजीव अभयार᭛य कᳱ सीमा से 0.5 ᳰकलोमीटर से 3 ᳰकलोमीटर के िव᭭तार के ᭃेᮢ को सीतामाता व᭠यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᳟ात् पाᳯरि᭭थितक संवेदी जोन कहा गया ह)ै के ᱨप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार है, अथाᭅत ्:-
1. पाᳯरि᭭थितक संवदेी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन सीतामाता व᭠यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 172.45 वगᭅ ᳰकलोमीटर तक के ᭃेᮢ तक फैला ᱟआ ह ैऔर इस जोन का सीमा का वणᭅन उपाबंध I मᱶ ᳰदया गया ह ै।
(2) पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबधं II के ᱨप मᱶ उपाब ह ै।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ सीतामाता व᭠यजीव अभयार᭛य के साथ जीपीएस िनदᱷशांक के मुय िब᭠दᲐु उपाबधं III के ᱨप मᱶ उपाब ह ै।
(4) पाᳯरि᭭थितक संवेदी जोन मᱶ राज᭭थान िजले िचᱫौडगढ़, ᮧतापगढ़ और उदयपुर के अंतगᭅत आने वाले 58 ᮕामᲂ मᱶ फैला ᱟआ ह।ै
(5) पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाले ᮕामᲂ कᳱ सूची उपाबंध IV के ᱨप मᱶ उपाब ह ै।
2. पाᳯरि᭭थितक सवंेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ के सामंज᭭ य से और रा᭔य सरकार मᱶ सᭃम ᮧािधकारी के अनुमोदन से आंचिलक महायोजना तैयार करेगी ।
(2) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस रीित मᱶ, इस अिधसूचना मᱶ िविन᳸दᭅ᭬ ट ᱨप तथा सुसंगत कᱶ ᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶ ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(3) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण;
(ii) वन और व᭠यजीव;
(iii) कृिष ;
(iv) राज᭭ व;
(v) नगर िवकास;
(vi) पयᭅटन;
(vii) ᮕामीण िवकास;
(viii) ᳲसंचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज;

(xi) लोक िन माᭅण िव भाग।
(4) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दᭅ᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢ ᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण स ेसंबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान दनेा आव᭫यक ह,ै के िलए उपबंध हᲂगे ।
(6) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी और इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧ᭭तािवत भूिम के उपयोग का िववरण ᳰकया जाएगा ।
(7) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(8) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के सबंंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जान ेवाल ेउपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत्:--
(1) भ-ूउपयोग – (क) पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा। मानिचᮢ के साथ आंचिलक महायोजना मᱶ ᭭प᳥ ᱨप से ᭃेᮢᲂ को िनधाᭅᳯरत ᳰकया गया ह:ै परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन स,े रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ के ᱨप मᱶ लागू हᲂगे, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए ह,ै जैसे:-
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना तथा नई सड़कᲂ का संिनमाᭅण;
(ii) बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण;
(iii) ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग;
(iv) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर हᱹ; सुिवधाजनक भ᭛डार और ᭭थानीय सुिवधाᲐ सहायक पाᳯरि᭭थितक पयᭅटन मᱶ सि᭥मिलत ᮕह वास; और
(v) संवᳶधᭅत ᳰᮓयाकलाप पैरा 4 के अधीन :
परंतु यह और भी ᳰक ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ और िविनयमᲂ के अंतगᭅत रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा:
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात ्रा᭔य सरकार ᳇ारा ᮧ᭜यके मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को दनेी होगी । परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा । परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।
(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी । (ख) पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा पयाᭅवरण और वन िवभाग के परामशᭅ से तैयार होगी । (ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ जाना जायेगा । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) व᭠यजीव अभयारण कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट ह,ै नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा है वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना के अनुसार होगा;
(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार केि᭠ᮤय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व दतेे ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जान ेतक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸दᭅ᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।
(4) नसैᳶगᭅक िवरासत -पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगᭅक िवरासत के सभी ᭭थलᲂ जैसे जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।
(5) मानव िनᳶमᭅत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख स ेछह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदषूण – पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसरण मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वाय ुᮧदषूण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण एवं िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के ᮧावधानᲂ के अनुसार वायु ᮧदषूण के िनयंᮢण के िलए मागᭅदशᭅक िसांत और िविनयम लागू हᲂगे ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जब ᮧदषूण िनवारण तथा िनयंᮢण अिधिनयम, 1974 (1974 का 6)उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा--
(i) पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ.
1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे, के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;

(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जवै िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343 (अ), तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(11) ᭡लाि᭭टक अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा।
(12) िनमाᭅण और िव᭟वसं अपिश᳥ ᮧबधंन: - पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(13) यानीय पᳯरवहन: - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(14) औ᳒ोिगक इकाईया ं- (i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के बाद या ᮧकाशन मᱶ, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण बोडᭅ के वगᱮकरण के भीतर िसफᭅ गैर- ᮧदिूषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनुमित दी जाएगी।
(15) पहाड़ी ढलानᲂ को संरᭃण: - पहाड़ी ढलानᲂ के संरᭃण के अंतगᭅत:
(क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहां ᳰकसी भी संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी । (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनमुित नहᱭ दी जाएगी ।
4. पाᳯरि᭭थितक सवंेदी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और इसके अ᭟यधीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸दᭅ᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत ्:-- सारणी ᮓम स.ं ᳰᮓयाकलाप ᳯट᭡पिणया ँ 1 2 3 ᮧितिष ᳰᮓयाकलाप
1. वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ िजसमᱶ िनजी उपयोग के िलए के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइ᭨स या टᲂ का िनमाᭅण करना भी सि᭥मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदशे के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
2. आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
3. जल या वायु या मृदा या ᭟ विन ᮧदषूण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन मᱶ नए और िव᳒मान ᮧदषूण काᳯरत करने वाले उ᳒ोगो का िव᭭ तार अनु᭄ात नहᱭ होगा ।
4. नए बृहत जल िव᳒ुत पᳯरयोजना और ᳲसंचाई पᳯरयोजना कᳱ ᭭ थापना । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
5. ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग ᮧसं᭭करण उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
6. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे ।
7. नए का᭬ ठ आधाᳯरत उ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी:
परंतु िव᳒मान का᭬ ठ आधाᳯरत उ᳒ोग िविध के अनुसार बना रहगेा :
8. म᭜᭭य ᮕहण। जखम और नागिलया बांध और सीतामाता और जखम नᳰदयᲂ सिहत सभी जल िनकायᲂ मᱶ म᭜᭭य ᮕहण पूणᭅतया वᳶजᭅत होगा।
9. फमᲄ, कंपिनयᲂ आᳰद ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुधन संपदा और कुकुट फामᲄ कᳱ ᭭थापना । ᭭थानीय जᱨरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे।
10. तᱶद ुपᱫा कᳱ खरीद । अभयार᭛य कᳱ सीमा से 100 मीटर के भीतर ठेकेदारᲂ ᳇ारा तᱶद ुपᱫा कᳱ खरीद पर ᮧितिष हᲂगे और वन िवभाग ᳇ारा तᱶद ुपᱫा इकाईयᲂ कᳱ नीलामी के समय कोई ᮓय ᭭थान (फैड) िनधाᭅᳯरत नहᱭ कᳱ जाएगी।
11. ट भᲵᲂ कᳱ ᭭थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । िविनयिमत ᳰᮓयाकलाप
12. होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :
पर᭠तु आरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर से परे या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट तक हो सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना और यथा लागू भागदशᭅन िसांत के अनुᱧप होगा ।
13. संिनमाᭅण ᳰᮓयाकलाप । संरिᭃत ᭃेᮢᲂ कᳱ सीमा से एक ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकटतम हो ᳰकसी नए वािण᭔यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय ᭪ यि तयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब ᳰᮓयाकलाप भी ह,ᱹ को करने के िलए अनु᭄ात ᳰकया जाएगा । (ख) ᮧदषूण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबिधत संिनमाणᭅ ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7 ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लाग िनयमᲂ और िविनयमᲂ यᳰद कोई हᲂ के अनुसार सᭃम ᮧािधकारी के पूवᭅ अनु᭄ा से ऐसे ᮧदषूण को कम ᳰकया जाएगा।
14. भू-जल का िन᭬ कषᭅण । लागू िविधयᲂ के अधीन ᭭थानीय लोगᲂ के पीने का पानी या कृिष कᳱ आव᭫यकता को पूरा करने के िलए िविनयिमत हᲂगे।
15. वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳰक᭠ही वृᭃᲂ कᳱ कटाई नहᱭ होगी;
(ख) वृᭃᲂ कᳱ कटाई संबंिधत के᭠ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत हᲂगे।
16. िव᳒ुत और दरूसंचार टावरᲂ और िबछाई गई केबलᲂ और अ᭠य बुिनयादी ढाँचᲂ का पᳯरिनमाᭅण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (भूिमगत केबलᲂ को ᮧो᭜सािहत ᳰकया जा सकेगा)।
17. अवसंरचना िजसके अंतगᭅत भी ह।ै लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
18. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदढ़ृ करना तथा नई सड़कᲂ का संिनमाᭅण। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
19. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
20. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. ᭡ लाि᭭ टक थैलᲂ का उपयोग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
22. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण लागू िविधयᲂ के अनुसार िविनयिमत हᲂगे और उपचाᳯरत बिह᮲ाᭅव के उपयोग पुनचᭅᮓण करने का ᮧयास ᳰकया जाएगा।
24. वािणि᭔ यक साइनबोडᭅ और होᳺडᲈग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. ᮧदषूण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ दशेीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदषूण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत दशेीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते ह,ᱹ अनु᭄ात ᳰकए जाएंगे ।
26. वन उ᭜पादᲂ और गैर-का᳧ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. वायु और यािनक ᮧदषूण। पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग वायु (ᮧदषूण िनवारण एवं िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के ᮧावधानᲂ के अनुसार वायु ᮧदषूण के िनयंᮢण के िलए मागᭅदशᭅक िसातं और िविनयम लागू हᲂगे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. ᭟विन ᮧदषूण। पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसरण मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदषूण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
29. खुले कुआं, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और संब ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ सती से मानीटरी कᳱ जाएगी।
30. ठोस अपिश᳥ ᮧबंध। ठोस अपिश᳥ ᮧबंधन िनयम, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के तहत ठोस अपिश᳥ ᮧबंधन िनयम 2016 के ᮧावधानᲂ के अनुसार होगा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
31. पाᳯरि᭭थितक पयᭅटन । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
32. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । सवंᳶधᭅत ᳰᮓयाᳰकलाप
33. डेयरी, डेयरी उ᳒ोग और म᭜ ᭭ य उ᳒ोग के साथ ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी गितिविधया ं। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
34. जैिवक खेती । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
35. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
36. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी ह ᱹ। सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
37. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
38. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
39. कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
40. पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
41. कौशल िवकास । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
42. िन᳜ीकृत भूिम वन या आवास कᳱ बहाली । सᳰᮓ य ᱨप से बढ़ावा ᳰदया जाएगा ।
5. पाᳯरि᭭थितक संवदेी जोन मानीटरी सिमित- (1) कᱶ ᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत स ेिमलकर बनेगी, अथाᭅत ्
(i) िजला कलेटर, ᮧतापगढ़ – अ᭟यᭃ;
(ii) लोक िनमाᭅण िवभाग का िजला ᭭तरीय अिधकारी - सद᭭य;
(iii) नगर योजना िवभाग का िजला ᭭तरीय अिधकारी - सद᭭य;
(iv) उ᳒ोग िवभाग का िजला ᭭तरीय अिधकारी - सद᭭य;
(v) ᭃेᮢीय अिधकारी, राज᭭थान रा᭔य ᮧदषूण िनयंᮢण बोडᭅ – सद᭭य;
(vi) पाᳯरि᭭थितक और पयाᭅवरण के ᭃेᮢ मᱶ एक िवशेष᭄ िजसे राज᭭थान सरकार ᳇ारा ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए नाम िन᳸दᭅ᳥ ᳰकया जाएगा - सद᭭य ;
(vii) गैर सरकारी संगठन का एक ᮧितिनिध जो पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ कर रहा ह,ै िजसे राज᭭थान सरकार ᳇ारा ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए नाम िन᳸दᭅ᳥ ᳰकया जाएगा – सद᭭य;
(viii) रा᭔य जैव-िविवधता बोडᭅ का सद᭭य - सद᭭य;
(ix) माननीय व᭠यजीव वाडᭅन - सद᭭य;
(x) उप वन संरᭃक, सीतामाता व᭠यजीव अभयार᭛य – सद᭭य-सिचव।
6. िनदᱷश िनबधंन :
(1) सिमित का कायᭅकाल तीन वषᭅ कᳱ अविध के िलए ᳰकया जाएगा।
(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸दᭅ᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आत ेह,ᱹ ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸दᭅ᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संबंिधत कलटर या संबंिधत उ᳒ान के उप-वन संरᭃक, कोई ᳞िᲦ जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता ह,ै उसके िवᱧ पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(6) मानीटरी सिमित मुᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिध ᮧित मुे कᳱ अपेᭃाᲐ के अनुसार िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषᭅक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय व᭠यजीव वाडᭅन को उपाबधं V पर उपाब ᮧाᱨप पर उᲦ वषᭅ ᳰक 30 जून तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपन ेकृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदशे द ेसकेगा, जो वह ठीक समझे ।

8. कोई अ᭠ य मह᭜ वपूणᭅ िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 17th April, 2017 S.O.1191(E).—WHEREAS, a draft notification, declaring Eco-sensitive Zone around Sitamata Wildlife Sanctuary in Rajasthan, was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2871 (E), dated the 19th October 2015, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on the 19th October 2015;
AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
AND WHEREAS, the Sitamata Wildlife Sanctuary situated in the South-East region of the State of Rajasthan in Chittorgarh and Pratapgarh districts at the junction of the Aravalli hill range, Vindhyan hill range and the Malwa Plateau and lying between 740 23’ E– 74040’ E longitude and 240 04’ N to 24023’ N latitude and spread over an area of 422.94 sq.kms was notified as a sanctuary in the year 1979 vide Government of Rajasthan notification No. F 11 (9) Revenue/ Group-8/78 Jaipur, dated the 2nd January, 1979;
AND WHERAS, Sitamata Wildlife Sanctuary forms the north -west limit for the teak-bamboo mixed forest and the species associated with it is one of the richest Sanctuary of flora and fauna; nearly 50 species of reptiles, 9 species of Amphibians, 275 species of birds and 30 species of fishes listed so far from the said Sanctuary; Sitamata Wildlife Sanctuary is a habitat of 800 species of plants out of which 108 species of medicinal plants are already identified including 13 species of the endangered medicinal plants issued by the National Medicinal Plant Board, New-Delhi;
AND WHEREAS this protected area, with its comparatively less undulating terrain and three perennial (Jakham, Sitamata and Karmoi) rivers provide habitat for the tropical moist deciduous plant species, which form micro habitat for the Aravalli Red Spur Fowl, Grey Jungle Fowl, Flying Squirrel and several other species of flora and fauna and is unique as it forms the distribution limit for many of species that have moved from Himalayas, Indo-Malayan and African regions, in addition to the elements from Western Ghats;
AND WHEREAS, it is necessary to regulate certain activities detrimental to the conservation of flora and fauna in the Sitamata Wildlife Sanctuary from environmental point of view, by declaring the Eco-sensitive Zone around it.
NOW THEREFORE, in exercise of powers conferred in sub-section (1) read with clause (V) and clause (xiv) of subsection (2) and sub-section (3) of section 3 of Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extant of 0.5 to 3 ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15 kilometers around the boundary of the Sitamata Wildlife Sanctuary as Sitamata Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area 172.45 square kilometers around the boundary of Sitamata Wildlife Sanctuary and the boundary description of the said Zone is given in Annexure-I.
(2) The map of the Eco-sensitive Zone is appended as Annexure-II.
(3) The details of Geographical Positioning System coordinates of the points along the boundary of the Sitamata Wilidlife Sanctuary and its Eco-sensitive Zone are appended as Annexure-III.
(4) The Eco-sensitive Zone is spread across 58 villages falling in Chittorgarh, Pratapgarh and Udaipur districts of Rajasthan.
(5) The list of villages falling within Eco-sensitive Zone is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the Competent authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan, namely:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and Eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring under the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.-
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Ecosensitive Zone shall not be used or converted into areas for commercial or industrial activities:

Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents, and for the activities such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidlines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometers from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometers from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism, Eco-education and Eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for protection and conservation, within six months from the date of publication of this notification in the official Gazette and such plan shall for part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 made under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic . - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
(14) Industrial units.- (i) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries may be allowed be established within Eco-sensitive Zone in accordance with the Central Pollution Control Board’s categorisation.
(15) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction may be permitted.
(b) No construction on steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. Prohibited, Regulated and Promoted Activities.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:- TABLE S.No. Activity Remarks

3. Setting up of industries causing water or air or soil or noise pollution.
No new or expansion of polluting industries in the Ecosensitive Zone shall be permitted.
4. Establishment of new major hydroelectric projects and irrigation projects.

5. Use, production or processing of any hazardous substances.

6. Discharge of untreated effluents and solid waste in natural water bodies or land area.

8. Fishing. There shall be complete ban on fishing in all the water bodies including Jakham and Nagliya Dam and Sitamata and Jakham rivers.
9. Establishment of large-scale commercial livestock and poultry farms by firms, companies etc.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
10. Purchase of Tendu Patta. Purchase of Tendu Patta by contractors within 100 meters from the boundary of the Sanctuary shall be prohibited and no purchasing places (Fads) shall be earmarked at the time of auction of Tendu Patta units by the Forest Department.
11. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
Regulated Activities
12. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Ecotourism activities:
Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
13. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometers from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws.
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 regulations, if any.
14. Extraction of ground water Regulated under applicable laws to meet the drinking water or agricultural requirement of locals.
15. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
16. Erection of electrical and communication towers and laying of cables and other infrastructures Regulated under applicable law (underground cabling may be promoted).
17. Infrastructure including civic amenities Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
20. Introduction of exotic species. Regulated under applicable laws.

22. Protection of hill slopes and river banks. Regulated under applicable laws.
23. Discharge of treated effluents in natural water bodies or land area.
The discharge of treated effluent shall be regulated as per applicable laws and efforts shall be made to recycle/re-use the treated effluent.
24. Commercial Sign boards and hoardings. Regulated under applicable laws.
25. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment may be permitted.
26. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
27. Air and Vehicular Pollution Guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with.
28. Noise pollution Control of noise pollution in the Eco-sensitive Zone shall be in accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 made under the Environment (Protection) Act, 1986.
29. Open Well, Bore Well etc. for agriculture or other usage Regulated and the activity shall be strictly monitored by the concerned authority.
30. Solid Waste Management. Management of solid waste shall be as per the provisions of the Solid Waste Management Rules, 2016 made under Environment (Protection) Act, 1986.
31. Eco-tourism. Regulated under applicable laws.
32. Undertaking activities related to eco-tourism like over-flying the protected area by aircraft, hot-air balloons.
Regulated under applicable laws.
Promoted Activities
33. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) District Collector, Pratapgarh - Chairman;
(ii) District level officer of Public Works Department - Member;
(iii) District level officer of Town Planning Department - Member;
(iv) District level officer of Industries Department - Member;
(v) Regional officer, Rajasthan State Pollution Control Board - Member;
(vi) An expert in the area of ecology and environment to be nominated by the Government of Rajasthan for a period of three year. - Member;
(vii) A representative of Non-Governmental Organisation working in the field of environment to be nominated by the Government of Rajasthan for a period of one year - Member;
(viii) Member of State Biodiversity Board- - Member;
(ix) Honorary wild life warden - Member;
(x) Deputy Conservator of Forests, Sitamata Wildlife Sanctuary - Member-Secretary
6. Terms of reference.- (1) The tenure of the Monitoring Committee shall be for three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are

37. Rain water harvesting. Shall be actively promoted.
38. Use of renewable energy sources. Shall be actively promoted.
39. Agro forestry. Shall be actively promoted.
40. Environmental awareness. Shall be actively promoted.
41. Skill development. Shall be actively promoted.
42. Restoration of degraded land/ forests/ habitat. Shall be actively promoted.
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collectors or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
