(xiv) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment and Forests number S.O. 1265(E), dated the 1st June, 2011, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; tf6V&l//3~-3 18 THE GAZETTE OF INDIA : EXTRAORDINARY [P\RI U- -Sir. 3(ii)] And whereas, copies of the Gazette containing the said notification were made available' to the public on the 1 ̂ June, 2011; And whereas, all objections and suggestions received in response to the .:'.raft , notification have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by? sub-section (l)read with clause
(v) and clause (xiv) of sub - section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules. 1086. the Central Government hereby notifies the area upto 2.5 kilometer from'the boundar)' of the protected area of Narayan Sarovar Wildlife Sanctuary, enclosed within the boundary described below in the State of Gujarat as the Eco-sensitiv,e Zone (herein after called as the Narayan Sarovar Eco-sensitive Zone):-
1. Boundaries of Narayan Sarovar Eco-sensitive Zone. -
(a) Narayan Sarovar Wildlife Sanctuary is located in the Western most part of the country, lies between Latitudes 23°27' N to 23°42' N and Longitudes 68°30' H to 68°57' E; administratively, the sanctuary is located within the Lakhpat Taluka of Kachchh district of Gujarat State; the Kori-creek surrounds the sanctuary on the North West and mangrove forests on the West and no prominent land features are observed on Eastern, Northern and Southern sides.
(b) Eco-sensitive Zone covers a peripheral area of about 22588.00 hectare which includes 28 villages of Lakhapat Taluka, District Kutch and one village of Nakhatrana Taluka, District Kutch and two villages of Abdasa Taluka, District Kutch. Out of the 22588 hectare area, an area of 8531.00 hectare is forest land and 14057.00 hectare is nonforest land.
(c) The range of radius of the Eco-sensitive zone is 0-2.5 kilometers on all sides and mean distance is 1.5 kilometers surrounding the Protected Area.
(d) The Eco-Sensitive Zone is divided in two sub-zones within the buffer zone of 2.5 kilometers from the outer boundary of the sanctuary as follows: Sub-Zone-A: The area within the buffer zone of 2.5 kilometer, where the drainage lines towards the sanctuary area and the rock is relatively pervious; thus, on the one hand, this sub-zone will be a part of the catchments' area for various water courses or water bodies in the sanctuary and, on the other hand due to the relatively pervious nature of rock, water borne pollutants will have more effect on the ground water. Sub-Zone-B: The area where the drainage lines travel outwardly away from the sanctuary area, moreover, the rocks in this area are relatively impervious.
(e) The map and boundary Global Positioning System points of Narayan Sarovar Wildlife Sanctuary and Narayan Sarovar Eco-sensitive Zone is appended with this notification as Annexure I and the list of the villages falling within Narayan Sarovar Eco-sensitive /'one is appended as Annexure II.
2. Zonal Master Plan for the Narayan Sarovar Eco-sensitive Zone. -
1. A Zonal Master Plan for the Narayan Sarovar Eco-sensitive Zone shall be prepared by the State Government in such manner as are specified under .he Wild :,ife (Protection) Act, 1972 (53 of 1972), the law relating to town and country planum*. for [wi ii—Tans' 3(ii)] *TRCT ^JI TJWH : 3renvrnn 19
(2) Quarrying and Mining: No mining and crushing shall be allowed within the radius of 3 kilometers from the outer boundary of the Narayan Sarovar Wildlife Sanctuary, as per the directions of Hon'ble Supreme Court order dated 7th May 2010 in SLP 13658/1996.
(3) Trees: Felling of trees on forest should be as per the Working Plan or Management Plan approved by the Competent Authority and the felling of trees on private or revenue lands may be allowed in accordance with the State regulations.
(4) Tourism: Tourism activities shall be as per the Tourism Master Plan which shall emphasize on ecotourism, eco-education and eco-development and be prepared by the Department of Tourism in consultation with the Department of Environment and Forest and shall be a component of the Zonal Master Plan.
(5) Ground Water: Extraction of ground water for bona-fide agricultural and domestic consumption of the occupier of land shall be allowed.
(b) Extraction of ground water for industrial, commercial use shall require prior written permission, including the amount that can be extracted, from the State Ground Water Board.
(c) Appropriate steps shall be taken to prevent contamination or pollution of water, including from agriculture activities.
(6) Use of Plastics: No person shall use plastic carry bags within the Eco-sensitive zone area and the disposal of plastic articles shall be strictly regulated.
(7) Noise pollution: The Environment Department or the State Forest Department, Gujarat shall be the authority to draw up guidelines and regulations for the control of noise in the Eco-sensitive Zone.
(8) Discharge of effluents: No untreated or industrial effluent shall be permitted to be discharged into any water body or on land within the Eco-sensitive Zone and the treated effluent shall meet the provisions of the Water (Prevention and Control of Pollution) Act,
1974.
(9) Solid Wastes: (a) The solid waste disposal shall be carried out in accordance with the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 notified by the Central Government vide notification number S.O. 908 (E), dated the 25l September 2000, as amended from.time to time.
(b) (i) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(ii) the biodegradable material may be recycled preferably through composting or vermi culture;
(iii) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone; and
(iv) no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Natural Springs: The catchment areas of all springs shall be identified and plans for their conservation and rejuvenation of those that have run dry, in their natural setting shall be incorporated in the Zonal Master Plan and the strict guidelines shall be drawn up by the State Government to ban development activities at or near these areas. 20 THE GAZETTE OF INDIA: EXTRAORDINARY [PART II—SEC. 3(H)] the time being in force in the State, the divisional working plans and the guidelines issued by Central Government, within a period of two years from the date of this notification and approved by the Central Government in the Ministry of Environment and Forests.
2. The Zonal Master Plan shall be prepared with due involvement of all concerned State Departments of Environment, Forest, Urban Development, Tourism, Municipal, Revenue and the Gujarat State Pollution Control Board for integrating environmental and ecological considerations into it.
3. The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
4. The Zonal Master Plan shall demarcate all the existing worshipping places, village settlements, types and kinds of forests, agricultural areas, fertile lands, green areas, horticultural areas, orchards, lakes and other water bodies.
5. No change of land use from green uses such as tea. gardens, horticulture areas, agriculture, parks and others like places to non green uses shall be permitted in the Zonal Master Plan. However, to meet the residential needs of the local residents due to the natural growth of existing local population, strictly limited conversion of agricultural lands may be permitted, with the prior approval of the State Government.
6. All the human habitation areas with populations of 5000 and above shall have Area Development Plan and be prepared under the guidance of local self Government.
7. Pending the preparation of the Zonal Master Plan for Eco-sensiti\e Zone and approval thereof by the Ministry of Environment and Forests all new constructions and other developmental activities shall be referred to the Ministry.of Environment and Forests by the Monitoring Committee as per sub-para (4) of paragraph 4 of the notification.
8. There shall be no consequential reduction in Green area such as forest area, agricultural area, etc. and the .unused or unproductive agricultural areas may be re forested.
9. The Zonal Master Plan shall be a reference document for the Monitoring Committee for any decision to be taken by them.
10. The Central Government and the State Government may specify other measures, if it considers necessary, in giving effect to the provisions of mis notification.
3. Prohibited, regulated and permitted activities in Eco-sensitive Zone - All activities in the Narayan Sarovar Eco-sensitive Zone shall be governed by the provisions of the Wildlife (Protection) Act, 1972 (53 of 1972) the Forest (Conservation) Act, 1980 (69 of 1980) and the Environment (Protection) Act, 1986 (29 of 1986). Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in accordance with Annexure III to this notification.
(1) Industrial Units: (a) On or after the publication of this notification in the official ga/ette, no new industrial development within 500 meter of the periphery of the Sanctuary shall be allowed;
(b) no polluting industries shall be allowed within the eco-sensitive zone, only non-polluting industries beyond the 500 meters periphery in the eco-fragile area shall be considered with the provision of a minimum of 50 meters wide green belt;
(c) where the eco-fragile zone is limited to less than 2.5 kilometer^ the industry, if permitted, must ensure safe guards including 50 meters wide monitoring strip and 200 meters wide greenbelt and 250 meters wide no activity zone shall be maintained in the 500 meters ecofragile zone. (11) Awareness: The state Environment and Forests Department shall regularly carry out nature education and environmental awareness campaigns in each village falling in Kcosensitive Zone, highlighting the importance and usefulness of the Wildlife Sanctuary.
4. Monitoring Committee. -
(1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a committee to be called the Narayan Sarovar Eco-sensitive Zone Monitoring Committee to monitor the compliance of this notification.
(2) The Monitoring Committee referred to in sub-paragraph (1), shall consist of not more than ten members who shall represent the following, namely:-
(a) Collector, Kutch - Chairman;
(b) a representative of the Ministry of Environment and Forests, Government of India - Member;
(c) one representative of Non-governmental Organizations working in the field of environment to be nominated by the Government of India - Member;
(d) Regional Officer, Gujarat State Pollution Control Board, Kutch - Member;
(e) Senior Town Planner of the area - Member;
(f) a representative of the Department of Forests and Environment, Government of Gujarat - Member;
(g) one expert in the area of ecology and environment to be nominated by the Ministry of Environment and Forests, Government of India - Member;
(h) Deputy Conservator of Forests (In Charge of the Sanctuary), Kutch - Member Secretary.
(3) The powers and functions of the Monitoring Committee shall be restricted to the compliance of the provisions of this notification.
(4) In case of activities requiring prior permissibn, under the provisions of the notification of the Government of India in the Ministry of Environment and Forests number S.O. ] 533 (E), dated the 14th September, 2006 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), the Monitoring Committee shall refer all such mailers to the Central Government in the Ministry of Environment and Forests for prior clearances under the provisions of the said notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments or Associations to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Chairman or the Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act. 19S;> tor non compliance of the provisions of this notification.
(7) The Monitoring Committee shall submit its annual action taken report of its acti\ iiic; by the 31st March of every year to the Central Government in Ministry of Fnvironmem and Forests.
(8) The Central Government in Ministry of Environment and Forests shall give direct; ins, from time to time, to the Monitoring Committee for effective discharge of the functions of the Monitoring Committee.
