PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1205] No. 1205] NEW DELHI, FRIDAY, APRIL 28, 2017/VAISAKHA 8, 1939 पययावरण, वन और जलवयय ुपररवतान मंत्रयलय ऄधधसचूनय नइ ददल्ली, 28 ऄपै्रल, 2017 कय.अ. 1365(ऄ).—प्रयरूप ऄधधसूचनय भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय स.ं कय.अ. 2991 तयरीख 2 नवम्बर, 2015 द्वयरय भयरत के रयजपत्र ऄसयधयरण में प्रकयधित की गइ थी धजसमें ईन सभी व्यधियों से, धजनको ईसस े प्रभयधवत होन े की संभयवनय थी, ईस तयरीख से, धजसको ईि ऄधधसूचनय की रयजपत्र की प्रधतययं जनतय को ईपलब्ध करय दी गइ थीं, सयठ ददन की ऄवधध के भीतर, अक्षेप और सुझयव अमंधत्रत दकए गए थ;े और, ईि प्रयरूप ऄधधसूचनय के प्रत्ययु्तरर में व्यधियों और पणधयररयों से कोइ ीीकय री्पधणययंआअक्षेप और सुक्षयव प्रयप्त नहीं हुए थ;े और, बरदय वन्यजीव ऄभययरण्य गुजरयत के पोरबन्दर, जयमनगर और दवेभूधम द्वयरकय धजलों में 21o40’ ई्तरर और 21o55’ ई्तरर के बीच ऄक्षयंि तथय 69o40’ पूवा और 69o55’ पूवा दिेयन्तर के बीच 192.31 वगा दकलोमीीर क्षेत्र में फैलय हुअ ह ै। और, बरदय वन्यजीव ऄभययरण्य जैव-धवधवधतय संपन्न और संघन क्षेत्र ह ैजो चयरों ओर से ऄच्छी गुणव्तरय वयले िुष्क पणापयती धवधवध जंगल, सूखी कयंीय जंगल, झयडी भूधम और अर्द्ाभूधम जंगल धजनके बीच में बयंस के झुण्ड पयए जयते हैं, स ेधघरय हुअ ह ैऔर यह ऄभययरण्य में संपन्न जैव धवधवधतय धजसमें की 430 जैनरय की 759 प्रजयधतयों के वृक्ष, जडी बूीी, झयडी और बेल, 22 स्तनपययी प्रजयधतययं, 26 सरीसृपों की प्रजयधतययं, 4 ईभयचर की प्रजयधतययं, 55 धततली की प्रजयधतययं और कीड ेकी 3000 से ज्ययदय प्रजयधतययाँ तथय पधक्षयों की 269 प्रजयधतयों से ऄधधक प्रजयधतययं पययी जयती हैं ;

और, बरदय वन्यजीव ऄभययरण्य के चयरों ओर के क्षेत्र को, धजसकय धवस्तयर और सीमयए ंआस ऄधधसूचनय के पैरय 1 में धवधनर्ददष्ट हैं, सरंधक्षत पययावरण की दधृष्ट से पयररधस्थधतक संवेदी जोन के रूप में तथय बरदय वन्यजीव ऄभययरण्य के अनुवयंधिक ससंयधनों को सुधयरन ेएवं ईनकय सरंक्षण करन ेके ईद्दशे्य स ेवयस प्रबंधन, प्रजनन कययाक्रम के मयध्यम स े स्थयनीय प्रजयधतयो को पुनस्थयधपत तथय पुनवयास, पययावरणीय धिक्षय तथय पयररधस्थधतक िोध के प्रोत्यसयहन के द्वयरय सरुधक्षत और संरधक्षत करनय तथय ईि पयररधस्थधतक संवेदी जोन में ईद्योगों यय ईद्योगों के वगों के संदक्रययओं तथय प्रसंस्करणों को प्रधतधिद्ध करनय अवश्यक ह;ै ऄतः, ऄब, केन्र्द्ीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) के सयथ परठत पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (1), ईपधयरय (2) के खंड (v) और खंड (xiv) और ईप धयरय (3) द्वयरय प्रद्तर िधियों कय प्रयोग करत ेहुए, गुजरयत रयज्य में बरदय वन्यजीव ऄभययरण्य की सीमय से 4.76 दकलोमीीर के चयरों ओर तक के धवस् तयररत क्षेत्र को बरदय वन्यजीव ऄभययरण्य पयररधस्थधतक संवेदी जोन (धजसे आसमें आसके पश् चयत् पयररधस् थधतक संवेदी जोन कहय गयय ह)ै के रूप में ऄधधसूधचत करती ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै ऄथयात् :--
1. पयररधस्थधतक सवंेदी जोन कय धवस्तयर और ईसकी सीमयए-ं(1) पयररधस्थधतक संवेदी जोन 65.58 वगा दकलोमीीर ईपयंत क्षेत्र में बरदय वन्यजीव ऄभययरण्य की सीमय के चयरों ओर 4.76 दकलोमीीर तक फैलय हुअ होगय ।
(2) पयररधस्थधतक संवेदी जोन सीमय कय वणान ईपयबंध I पर ईपयबद्ध ह ैऔर पयररधस्थधतक संवेदी जोन कय मयनधच त्र और आसकी सीमय कय वणान ऄक्षयंि और दिेयन्तर के सयथ ईपयबधं II के रूप में ईपयबद्ध ह ै।
(3) पयररधस्थधतक संवेदी जोन में भू-मंडलीय धस्थत प्रणयली के धनदिेयंक के सयथ धबन्दओुं की सीमय बरदय वन्यजीव ऄभययरण्य ईपयबधं III के रूप में ईपयबद्ध ह ै|
(5) पयररधस्थधतक संवेदी जोन में अने वयले 20 ग्रयमों की सूची ईपयबधं IV के रूप में ईपयबद्ध ह ै| II (ii) 3
2. पयररधस्थधतक सवंदेी जोन के धलए अचंधलक महययोजनय – (1) रयज्य सरकयर, पयररधस् थधतक संवेदी जोन के प्रयोजन के धलए रयजपत्र में आस ऄधधसूचनय के ऄंधतम प्रकयिन की तयरीख स ेदो विा की ऄवधध के भीतर, स्थयनीय व्यधियों के परयमिा से और आस ऄधधसूचनय में ददए गए ऄनुबंधों कय पयलन करके अंचधलक महययोजनय तैययर करेगी।
(2) अंचधलक महययोजनय रयज् य सरकयर में सक्षम प्रयधधकयरी द्वयरय ऄनुमोददत होगी ।
(3) पयररधस् थधतक संवेदी जोन के धलए अंचधलक महययोजनय, रयज् य सरकयर द्वयरय आस ऄधधसूचनय में धवधनर्ददष् ी रूप में ऐसी रीधत में तथय सुसंगत कें र्द्ीय और रयज् य धवधधयों के ऄनरुूप भी तथय कें र्द्ीय सरकयर द्वयरय जयरी मयगाधनदिे, यदद कोइ हों, द्वयरय तैययर होगी ।
(4) अचंधलक महययोजनय, ईि योजनय में पययावरणीय और पयररधस् थधतक बयतों को समयकधलत करन ेके धलए रयज् य के धनम्नधलधखत धवभयगों के परयमिा से तैययर होगी, ऄथयात्:--
(i) पययावरण;
(ii) वन और वन्यजीव;
(iii) कृधि ;
(iv) रयजस् व;
(v) नगर धवकयस;
(vi) पयाीन;
(vii) ग्रयमीण धवकयस;
(viii) ससचयइ और बयढ़ धनयंत्रण;
(ix) नगरपयधलकय;
(x) पंचययती रयज;
(xi) लोक धन मयाण धव भयग।
(5) संरधक्षत क्षेत्र को सरुधक्षत रखने की दधृष्ट से रयज्य सरकयर को संरधक्षत क्षेत्र के समीप खनकों स ेसमयपन योजनय प्रयप्त करने की अवश्यकतय ह ैऔर आसमें ऄन्तवाधलत व्यय कॉरपोरेी सयमयधजक ई्तररदयधयत्यव दक्रययकलयप के ऄधीन पूरय दकयय जयएगय । आसकी समयधप्त के पश्चयत् कोइ अगे खनन पट्टय और नवीकरण रयज्य सरकयर द्वयरय नहीं ददयय जयएगय । समयपन योजनय के अधयर पर खनन पटे्ट के समयपन के पश्चयत् क्षेत्र को जैव धवधवधतय पयकों में संपररवर्सतत दकयय जयएगय ।
(6) अंचधलक महययोजनय ऄनुमोददत धवद्यमयन भू-ईपयोग, ऄवसंरचनय और दक्रययकलयपों पर कोइ धनबंधन ऄधधरोधपत नहीं करेगी जब तक दक आस ऄधधसूचनय में धवधनर्ददष् ी न हो और अंचधलक महययोजनय में सभी ऄवसंरचनय और दक्रययकलयपों में दक्षतय तथय पयररधस्थधतक ऄनुकूलतय कय संवधान करेगी ।
(7) अंचधलक महययोजनय में ऄनयच्छयददत क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदय और नमी संरक्षण, स्थयनीय समुदययों की अवश्यकतयओं तथय पयररधस्थधतकी और पययावरण स ेसंबंधधत ऐसे ऄन्य पहलुओं, धजन पर ध्ययन दनेय अवश्यक ह,ै के धलए ईपबंध होंग े।
(8) अंचधलक महययोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमों और नगरीय बंदोबस्तों, वनों के प्रकयर और दकस् मों, कृधि क्षेत्रों, उपजयउ भूधम, हररत क्षेत्र जैस ेईद्ययन और ईसी प्रकयर के स् थयन, ईद्ययन कृधि क्षेत्र, फलोद्ययन, झीलों और ऄन्य जल धनकययों कय ऄभ्यकंन करेगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(9) अंचधलक महययोजनय पयररधस् थधतक संवेदी जोन में धवकयस को धवधनयधमत करेगी धजसके पयररधस् थधतक ऄनुकूल धवकयस और स् थयनीय समुदययों की अजीधवकय सरुक्षय को सुधनधश् चत दकयय जय सके ।
(10) अंचधलक महययोजनय आस ऄधधसूचनय में ददए गए ईपबंधों के ऄनुसयर में ऄपने कृत्ययों कय पयलन करन ेके धलए मयनीीरी सधमधत के धलए एक संदभा दस्तयवेज तैययर करेगी ।
3. रयज्य सरकयर द्वयरय दकए जयन ेवयल ेईपयय-- रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी करन ेके धलए धनम्नधलधखत ईपयय करेगी, ऄथयात:्--
(1) भ-ूईपयोग – (क) पयररधस्थधतक संवेदी जोन में अमोद-प्रमोद के धलए वनों, ईद्ययन कृधि क्षेत्रों, कृधि क्षते्रों, पयकों और मनोरंजनयत्यमक प्रयोजनों के धलए ऄधभधनधश्चत खुले स्थयनों को मुख्य वयधणधज्यक यय मुख्य अवयसीय पररसर यय औद्योधगक गधतधवधधयों के धलए ईपयोग नहीं दकयय जयएगय यय ईनके धनए क्षेत्रों में संपररवर्सतत नहीं दकयय जयएगय। परंत ुपयररधस्थधतक संवेदी जोन के भीतर भयग क में धवधनर्ददष्ट प्रयोजन से धभन्न, प्रयोजन के धलए कृधि और ऄन्य भूधम कय संपररवतान मयनीीरी सधमधत की धसफयररि पर और सुसंगत रयज्य धवधध के ऄधीन सक्षम प्रयधधकयरी के पूवा ऄनुमोदन स ेऄनुज्ञयत दकयय जय सकेगय और यथय लयग ूकेन्र्द्ीय सरकयरआरयज्य सरकयर के ऄन्य धनयम जैस ेधवधनयम तथय स्थयनीय अवश्यकतयओं को पूरय करन े के धलए आस ऄधधसूचनय के ईपबंधों के द्वयरय धनम्नधलधखत दकयय जय सकेगय जैस:े-
(i) धवद्यमयन सडकों को चौडय करनय और ईन्हें सुदढृ करनय तथय नइ सडकों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) प्रदिूण ईत्यपन्न न करन ेवयले लघु ईद्योग;
(iv) कुीीर ईद्योगों धजनके ऄंतगात ग्रयमीण कयरीगर भी हैं; सुधवधयजनक भण्डयर और स्थयनीय सुधवधयओं सहययक पयररधस्थधतक पयाीन में सधम्मधलत ग्रह वयस; और
(v) संवर्सधत दक्रययकलयप और पैरय 7 के ऄधीन ददयय गयय ह:ै परंतु यह और भी दक सुसंगत रयज्य धवधधयों और रयज्य सरकयर ऄन्य धनयमों और धवधनयमों के ऄंतगात रयज्य सरकयर के पूवा ऄनुमोदन तथय संधवधयन के ऄनुच्छेद 244 और तत्यसमय प्रवृ्तर धवधध के ईपबंधों के ऄनुपयलन के धबनय, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄन्य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मयन्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी ह,ै वयधणधज्यक यय ईद्योग धवकयस दक्रययकलयपों के धलए जनजयतीय भूधम कय ईपयोग ऄनुज्ञयत नहीं होगय:
परंतु यह और भी दक पयररधस् थधतक संवेदी जोन के भीतर भू-ऄधभलेखों में ईपसंजयत कोइ त्रुरी, मयनीीरी सधमधत के धवचयर प्रयप्त करन ेके पश्चयत् रयज्य सरकयर द्वयरय प्रत्ययेक मयमले में एक बयर संिोधधत होगी और ईि त्रुरी के संिोधन की सूचनय कें र्द्ीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को दनेी होगी । परंतु यह और भी दक ईपयुाि त्रुरी के संिोधन में आस ईप-पैरय के ऄधीन यथयईपबंधधत के धसवयय दकसी भी दिय में भू-ईपयोग कय पररवतान सधम्मधलत नहीं होगय । (ख) वनीकरण तथय वयस जीणोद्धयर दक्रययकलयपों सधहत ऄनप्रयु् त यय ऄनुत्य पयदक कृधि क्षेत्रों में पुन:
वनीकरण करने के प्रययस दकए जयएगें । II (ii) 5
(2) प्रयकृधतक जल स्रोत -- अचंधलक महययोजनय में सभी प्रयकृधतक जल स्रोतों की पहचयन की जयएगी और ईनके संरक्षण और पुनरुद्भूतकरण के धलए योजनय सधम् मधलत होगी रयज्य सरकयर द्वयरय आन क्षेत्रों में यय ईनके धनकी धवकयस दक्रययकलयपों जो औसे क्षेत्रों के धलए हयधनकयरक ह,ै को प्रधतधिद्ध करने के धलए ऐसी रीधत से मयगाधनदिे तैययर करेगय।
(3) पयाीनआपयररधस्थधतक पयाीन – (क) पयररधस्थधतक संवेदी जोन के भीतर सभी नए पयररधस्थधतक पयाीन दक्रययकलयप यय धवद्यमयन पयाीन दक्रययकलयपों कय धवस्तयर पयाीन महययोजनय के ऄनुसयर अंचधलक महययोजनय के धलए होगय । (ख) पयाीन महययोजनय पयाीन धवभयग, द्वयरय रयज्य पययावरण और वन धवभयग के परयमिा से तैययर होगी । (ग) पयाीन महययोजनय अंचधलक महययोजनय के एक घीक के रूप में होगी । (घ) पयररधस्थधतक पयाीन सबंंधी दक्रययकलयप धनम्नयनुसयर धवधनयधमत होंगे, ऄथयात् :-
(i) वन्यजीव ऄभययरण्य की सीमय स ेएक दकलोमीीर के भीतर यय पयररधस्थधतक संवेदी जोन के धवस्तयर तक, आनमें जो भी धनकी ह,ै नये वयधणधज्यक होील और ररसोीा ऄनुज्ञयत नहीं होंगे। और वन्यजीव ऄभययरण्य की सीमय से एक दकलोमीीर की दरूी स ेपरे पयररधस्थधतक संवेदी जोन के धवस्तयर तक होीलों और सैरगयहों कय स्थयपन केवल पूवा पररधनधश्चत क्षेत्रों में पयाीन महययोजनय के ऄनुसयर पयररधस्थधतक पयाीन सुधवधयओं के धलए ही ऄनुज्ञयत होगय;
(ii) पयररधस्थधतक संवेदी जोन के भीतर नए पयाीन दक्रययकलयपों यय धवद्यमयन पयाीन दक्रययकलयपों कय धवस्तयर कें र्द्ीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय के मयगादिाक धसद्धयंतों के द्वयरय तथय रयष् रीय ा ययघ्र स सरंक्षण प्रयधधकरण, द्वयरय जयरी पयररधस्थधतक पयाीन (समय-समय पर यथय संिोधधत) मयगादिाक धसद्धयंतों के ऄनुसयर, पयररधस्थधतक पयाीन, पयररधस्थधतक धिक्षय और पयररधस्थधतक धवकयस को महत्यव दतेे हुए पयररधस्थधतक संवेदी जोन की वहन क्षमतय के ऄध्ययन पर अधयररत होगय;
(iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयने तक, पयाीन के धलए धवकयस और धवद्यमयन पयाीन दक्रययकलयपों के धवस्तयर को वयस्तधवक स्थल धवधनर्ददष्ट संवीक्षय तथय मयनीीरी सधमधत की धसफयररि पर अधयररत संबंधधत धवधनययमक प्रयधधकरणों द्वयरय ऄनुज्ञयत दकयय होगय और पयररधस्थधतक संवेदी जोन में दकसी नए होीलआसरैगयह यय वयधणधज्यक स्थयपन के संधनमयाण को ऄनुज्ञयत नहीं दकयय जयएगय।
(4) नसैर्सगक धवरयसत -- पयररधस्थधतक संवेदी जोन में महत्यवपूणा नैसर्सगक धवरयसत के सभी स्थलों जैसे सभी जीन कोि अरधक्षत क्षेत्र, िैल धवरचनयए,ं जल प्रपयतों, झरनों, घयीी मयगों, ईपवनों, गुफयए,ं स्थलों, भ्रमण, ऄश्वरोहण, प्रपयतों अदद की पहचयन की जयएगी और धवरयसत सरंक्षण योजनय अंचधलक महययोजनय के भयग के रूप में ईनके परररक्षण तथय संरक्षण के धलए तैययर की जयएगी ।
(5) मयनव धनर्समत धवरयसत स् थल - पयररधस् थधतक संवेदी जोन में भवनों, संरचनयओं, धिल्प-तथ्य, ऐधतहयधसक, कलयत्यमक और सयंस्कृधतक महत्यव के क्षेत्रों की पहचयन भी होगी और ईनके संरक्षण के धलए धवरयसत संरक्षण योजनय अंचधलक महययोजनय के भयग के रूप में तैययर की जयएगी ।
(6) ध् वधन प्रदिूण -- पययावरण (संरक्षण) ऄधधधनयम 1986 के ऄधीन ध्वधन प्रदिूण (धवधनयमन और धनयंत्रण) धनयम, 2000 में धनयत ईपबंधों के ऄनुसयर में पयररधस्थधतक संवेदी जोन में ध्वधन प्रदिूण के धनयंत्रण के धलए धवधनयमों को कयययाधन्वत करेगय ।
(7) वयय ुप्रदिूण -- पयररधस्थधतक संवेदी जोन में, वययु प्रदिूण के धनवयरण और धनयंत्रण कय वयय ु(प्रदिूण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर ऄनुपयलन दकयय जयएगय । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(8) बधहस्रयव कय धनस्सयरण -- पयररधस्थधतक संवेदी जोन में ईपचयररत बधहस्रयव कय धनस्सयरण पययावरणीय (संरक्षण) ऄधधधनयम, 1986 और ईसके ऄधीन बनयए गए धनयमों के यय रयज्य सरकयर द्वयरय धनयत मयनकों के ऄन्तगात अने वयले पययावरणीय प्रदिूण तत्यवों के धनस्सयरण के धलए सयमयन्य मयनकों के ईपबंधों के ऄनुसयर होगय ।
(9) ठोस ऄपधिष्ट -- ठोस ऄपधिष्टों कय धनपीयन और प्रबंधन धनम्नधलधखत रूप में होगय--
(i) पयररधस्थधतक संवेदी जोन में ठोस ऄपधिष्ट धनपीयन तथय प्रबंधन ठोस ऄपधिष् ी प्रबंधन धनयम, 2016, जो भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं.
कय.अ. 1357(ऄ) तयरीख 8 ऄपै्रल, 2016 द्वयरय प्रकयधित दकए गए थे, के ईपबंधों के ऄनुसयर दकयय जयएगय ;
(ii) ऄकयबाधनक सयमग्री कय धनपीयन पयररधस्थधतक संवेदी जोन के बयहर पहचयन दकए गए स् थल पर दकसी पययावरणीय स्वीकृत रीधत में होगय;
(iii) पयररधस्थधतक संवेदी जोन में ठोस ऄपधिष् ीों को जलयनय यय भष् मीकरण और भूधम भरयव के स्थयपनों को ऄनुज्ञयत नहीं दकयय जयएगय ।
(10) जवै धचदकत्य सीय ऄपधिष् ी.- जैव धचदकत्य सीय ऄपधिष् ी प्रबंधन धनम्नधलधखत रूप में होगय— (क) पयररधस्थधतक संवेदी जोन में जैव धचदकत्यसीय ऄपधिष्टों कय धनपीयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं.सय.कय.धन. 343 (ऄ) तयरीख 28 मयचा, 2016 द्वयरय प्रकयधित जैव धचदकत्यसीय ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय । (ख) पयररधस्थधतक संवेदी जोन में कोइ सयमयन्य ईपचयर सुधवधय यय जलययय जयनय ऄनुज्ञयत नहीं दकयय जयएगय ।
(11) ययनीय पररवहन: - पररवहन की ययनीय गधतधवधधययं अवयस के ऄनुकूल रीधत धवधनयधमत होंगी और आस संबंध में अंचधलक महययोजनय में धवधनर्ददष्ट ईपबंध समयधवष्ट दकए जयएगें और अंचधलक महययोजनय के तैययर होन े और रयज्य सरकयर के सक्षम प्रयधधकयरी द्वयरय के ऄनुमोददत होन ेतक, मयनीीरी सधमधत प्रवृ्तर धनयमों और धवधनयमों के ऄनुसयर ययनीय गधतधवधधयों के ऄनुपयलन को मयनीीर करेगी ।
(12) ययनीय प्रदिूण:- लयगू धवधधयों के ऄनुसयर वयहन प्रदिूण की रोकथयम और धनयंत्रण कय ऄनुपयलन दकयय जयएगय और स्वच्छक ईंधन के ईपयोग के धलए दकए जयने वयले प्रययस ईदयहरण के धलए सीएनजी, एलपीजी, अदद हैं ।
(13) ्लयधस्ीक ऄपधिष्ट प्रबधंन: - पयररधस्थधतक संवदेी जोन में ्लयधस्ीक ऄपधिष्ट प्रबंध भयरत सरकयर के पययावरण, वन और जलवयय ुपररवतान मंत्रयलय की ऄधधसूचनय सं.सय.कय.धन. 340(ऄ), तयरीख 18 मयचा, 2016 द्वयरय प्रकयधित ्लयधस्ीक ऄपधिष्ट प्रबंध धनयम 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय।
(14) सधंनमयाण और धवध्वसं ऄपधिष्ट प्रबधंन: - पयररधस्थधतक संवेदी जोन में संधनमयाण और धवध्वंस ऄपधिष्ट प्रबंध भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय स.ंसय.कय.धन. 317(ऄ), तयरीख 29 मयचा, 2016 द्वयरय प्रकयधित संधनमयाण और धवध्वंस प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय।
(15) इ–ऄपधिष्ट:- पयररधस्थधतक संवेदी जोन में इ–ऄपधिष्ट प्रबंध भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय प्रकयधित इ–ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय। II (ii) 7
(16) औद्योधगक आकयआयय:ं - (i) रयजपत्र में आस ऄधधसूचनय के प्रकयिन के बयद यय प्रकयिन पर यय ईसके पश्चयत् पयररधस्थधतक संवेदी जोन के भीतर कोइ नए प्रदिूणकयरी ईद्योगों की स्थयपनय की ऄनमुधत नहीं दी जयएगी।
(ii) पयररधस्थधतक संवेदी जोन के भीतर कें र्द्ीय प्रदिूण धनयंत्रण बोडा द्वयरय जयरी ददियधनदिेों में फरवरी, 2016 में गैर- प्रदिूणकयरी ईद्योगों को ईद्योगों के वगीकरण के ऄनुसयर ऄनुमधत तब तक नहीं दी जयएगी, जब तक दक आस ऄधधसूचनय में ऐसी धवधनर्ददष्ट न दकयय जयए । आसके ऄलयवय, गैर- प्रदिूणकयरी कुीीर ईद्योगों को बढ़यवय ददयय जयएगय।
(17) पहयडी ढलयनों को सरंक्षण: - पहयडी ढलयनों कय सरंक्षण धनम्नयनसुयर होगय:
(क) अंचधलक महययोजनय पहयडी ढलयनों पर ईन क्षेत्रों को ईपदर्सित करेगी जहयं दकसी भी संधनमयाण को ऄनुमधत नहीं दी जयएगी । (ख) धवद्यमयन खडी पहयडी ढलयनों यय ढलयनों पर धजनमें कीयव के एक ईच्च धडग्री ह,ै के संधनमयाण की ऄनुमधत नहीं दी जयएगी ।
(18) केन्र्द्ीय सरकयर और रयज्य सरकयर, यदद वह अवश्यक समझती ह,ै आस ऄधधसूचनय के ईपयबंधों को प्रभयवी करने में ऄन्य ईपयय धवधनर्ददष्ट करेगी।
4. पयररधस्थधतक सवंदेी जोन में प्रधतधिद्ध और धवधनयधमत दकए जयन े वयल े दक्रययकलयपों की सचूी.— पयररधस्थधतक संवेदी जोन में सभी दक्रययकलयप पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) के ईपबंधों तथय तदयधीन बनयए गए धनयमों धजनमें तीीय धवधनयमन जोन (सीअरजेड), 2011 और पययावरणीय संघयत धनधयारण (इअइए) ऄधधसूचनय, 2006 भी हैं और ऄन्य लयगू धवधधयय ं धजनमें वन (संरक्षण) ऄधधधनयम, 1980 (1980 के 69), भयरतीय वन ऄधधधनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) ऄधधधनयम, 1972 (1972 के 53) तथय ईनमें दकए गए भी हैं संिोधनों द्वयरय ियधसत होंग े और नीच े दी गइ तयधलकय में धवधनर्ददष्ट रीधत में धवधनयधमत होंग,े ऄथयात ्:-- सयरणी क्रम स.ं दक्रययकलयप ीीकय-री्पणी
(1) (2) (3) क. प्रधतधिद्ध दक्रययकलयप
(1) वयधणधज्यक खनन । (क) सभी प्रकयर के नए और धवद्यमयन खनन (लघु और वृहत खधनज), पत्यथर की खयनें और ईनको तोडने की आकयआयय ं वयस्तधवक स्थयनीय धनवयधसयों की घरेलू अवश्यकतयओं धजसमें धनजी ईपयोग के धलए मकयनों के संधनमयाण यय मरम्मत के धलए धरती को खोदनय और मकयन बनयन े के धलए दिेी ीयआल्स यय ईंीों कय धनमयाण करनय भी सधम्मधलत ह,ै के धसवयय नहीं होंगी ;
(ख) खनन संदक्रययए,ं मयननीय ईच्चतम न्ययययलय की ररी ययधचकय (धसधवल) सं. 1995 कय 202 ीी.एन. गौडयबमान धथरुमूलपयद बनयम भयरत सरकयर के मयमल े में अदिे तयरीख 4 ऄगस्त, 2006 और ररी ययधचकय (सी) सं. 2012 कय 435 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] गोवय फयईंडिेन बनयम भयरत सरकयर के मयमल ेमें तयरीख 21 ऄपै्रल, 2014 के ऄंतररम अदिे के ऄनुसरण में सवादय प्रचयलन होगय ।
(2) जल, वययु, मृदय, ध्वधन प्रदिूण कयररत करने वयल े ईद्योगों की स्थयपनय । पयररधस्थधतक संवेदी जोन में दकसी नए यय प्रदिूण फैलयने वयल े ईद्योगों के धवस्तयर की ऄनुमधत दी जयएगी। पयररधस्थधतक संवेदी जोन के भीतर कें र्द्ीय प्रदिूण धनयंत्रण बोडा द्वयरय जयरी ददियधनदिेों में फरवरी 2016 धसफा गैर-प्रदिूणकयरी ईद्योगों को वगीकरण के ऄनसुयर ऄनुमधत दी जयएगी, जब तक दक आस ऄधधसूचनय में आस प्रकयर धवधनर्ददष्ट न दकयय गयय हो। आसके ऄधतररि, गैर-प्रदिूणकयरी कुीीर ईद्योगों को बढ़यवय ददयय जयएगय ।
(3) बृहत जल धवद्युत पररयोजनय पररयोजनय की स्थयपनय । लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
(4) दकसी पररसंकीमय पदयथों कय ईपयोग यय ईत्यपयदन यय प्रसंस्करण। लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
(5) प्रयकृधतक जल धनकययों यय क्षते्र सतही में ऄनुपचयररत बधहस्रयाव कय धनस्सयरण । लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ।
(6) ठोस ऄपधिष्ट धनपीयन स्थल की स्थयपनय और ठोस और जैव धचदकत्यसय ऄपधिष्ट के धलए सयमयन्य जलयए जयने की सुधवधय । पयररधस्थधतक संवेदी जोन में ठोस ऄपधिष्ट धनपीयन की कोइ नइ ठोस ऄपधिष्ट धनपीयन स्थल और ऄपधिष्ट ईपचयररतआप्रसंस्करण सुधवधय की ऄनुमधत नहीं ह ै । औद्योधगक प्रदक्रयय और स्वयस्थ्य स्थयपनोंआऄस्पतयलों अदद से ईत्यपन्न दकसी भी प्रकयर के ठोस ऄपधिष्ट के ईपचयर के धलए सयमयन्य यय व्यधिगत भस्मीकरण की सुधवधय कय ऄधतररि संस्थयपन प्रधतधिद्ध ह ै।
(7) फमों, कॉपोरेी, कंपधनयों द्वयरय बड े पैमयने पर वयधणधज्यक पिुधन संपदय और कु्कुी फयमों की स्थयपनय । स्थयनीय जरूरतों को पूरय करने के धलए लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे।
(8) नइ अरय धमलों की स्थयपनय। पयररधस्थधतक संवेदी जोन के भीतर नइ और धवद्यमयन अरय धमलों कय धवस् तयर ऄनुज्ञयत नहीं होगय ।
(9) ईंी भट्टों की स्थयपनय करनय। लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे । ख. धवधनयधमत दक्रययकलयप
(10) होीलों और ररसोीों की स्थयपनय । पयररधस्थधतक पयाीन दक्रययकलयपों संबंधी लघु ऄस्थययी संरचनयओं के धलए संरधक्षत क्षेत्र की सीमय से एक दकलोमीीर के भीतर यय पयररधस्थधतक संवेदी जोन के धवस्तयर तक, आनमें जो भी धनकी ह,ै नए वयधणधज्यक होील और धवश्रयम स्थलों को ऄनुज्ञयत दकयय जयएगय ऄन्यथय नहीं । परंतु, पयररधस्थधतक संवेदी जोन अगे यय ईसके धवस्तयर तक, जो भी धनकी हो के संरधक्षत क्षेत्र की सीमय से एक दकलोमीीर से सभी नए पयाीक दक्रययकलयप यय धवद्यमयन दक्रययकलयप कय II (ii) 9 धवस्तयर पयाीन महययोजनय और यथय लयगू मयगादिी धसद्धयंतों के ऄनुरूप होगय।
(11) संधनमयाण दक्रययकलयप । संरधक्षत क्षेत्र यय पयररधस्थधतक संवेदी जोन जो भी धनकी हो, की सीमय स े एक दकलोमीीर के भीतर दकसी भी प्रकयर कय वयधणधज्यक संधनमयाण ऄनुज्ञयत नहीं दकयय जयएगय:
परंतु स् थयनीय लोगों को पैरय 6 के ईप पैरय (1) में सचूीबद्ध दक्रययकलयपों सधहत ईनके ईपयोग के धलए ईनकी भधूम में संधनमयाण करने की ऄनुमधत ऐसे स्थयनीय धनवयधसयों को ईस रूप में अवयसीय अवश्यकतयओं के धलए धनमयाण ईपधवधधयों के ऄनुसयर दी जयएगी ।
(i) धवद्यमयन सडकों को चौडय करनय और ईन्हें सुदढृ करनय तथय नइ सडकों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) कुीीर ईद्योगों धजसके ऄंतगात ग्रयमीण ईद्योग हैं;
सुधवधयजनक भण्डयर और स्थयनीय सुख सुधवधयए ं जो पयररधस्थधतक पयाीन, धजस में गृह वयस भी ह ैमें सहययतय दतेी हो और
(iv) आस ऄधधसूचनय में सचूीबद्ध संवर्सधत दक्रययकलयप :
(12) प्रदिूण ईत्यपन्न न करन े वयल े लघु ईद्योग । फरवरी 2016 में, केन्र्द्ीय प्रदिूण धनयंत्रण बोडा द्वयरय जयरी ईद्योगों के वगीकरण के ऄनुसयर श्वते प्रवगा के रुप में मयने गए गैर प्रदिूणकयरी ईद्योग और ऄपररसंकी में, लघु और सेवय ईद्योग, कृधि ईद्ययन, कृधि यय कृधि अधयररत ईद्योग जो पयररधस्थधतक संवेदी जोन से दिेी सयमधग्रयों कय ईत्यपयदन करतय ह ैसक्षम प्रयधधकयरी द्वयरय ऄनुज्ञयत होगे ।
(13) वृक्षों की कीयइ । (क) रयज्य सरकयर में सक्षम प्रयधधकयरी की पूवा ऄनुमधत के धबनय वन, सरकयरी यय रयजस्व यय धनजी भूधम पर यय वनों में ककही वृक्षों की कीयइ नहीं होगी । (ख) वृक्षों की कीयइ संबंधधत कें र्द्ीय यय रयज्य ऄधधधनयम यय ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर धवधनयधमत होगी ।
(14) वन ईत्यपयदों और गैर कयष् ठ वन ईत्यपयदों कय संग्रहण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(15) नयगररक सुख सुधवधयओं सधहत बुधनययदी ढयंचे। लयग ू धवधधयों के ऄनुसयर न्यूनीकरण ईपययों धनयम और धवधनयमन और ईपलब्ध ददियधनदिेों के सयथ दकए जयएगें। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(16) पयाीन से संबंधधत ऄन्य दक्रययकलयप जैसे गमा वययु गुब्बयरें, हलेीकय्ीर, ड्रोन, मयआक्रोलयआीस अदद द्वयरय पयररधस्थधतक संवेदी जोन क्षते्र के उपर से ईडनय जसैे दक्रययकलयप करनय। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(17) धवद्युत और दरूसचंयर ीयवरों कय पररधनमयाण । भूधमगत केबल को बढ़यवय ददयय जयएगय।
(18) होीलों और लॉज के धवद्यमयन पररसरों में कयीेंदयर बयड लगयनय । लयग ूधवधधयों के ऄधीन धवधनयधमत होंगे ।
(19) प्रयकृधतक जल धनकययों यय सतही क्षेत्र में ईपचयररत बधहस्रयाव कय धनस्सयरण । ईपचयररत ऄपधिष्ट जलआबधह:स्त्रयव कय धनस्सयरण को जल धनकययों में नहीं जयन ेददयय जयएगय । ईपचयररत ऄपधिष्ट जल के पुनचाक्रण तथय पुनपुायोग के धलए प्रययस की जयएगंी । ऄन्यथय, ईपचयररत ऄपधिष्ट जलआबधह:स्त्रयव कय धनस्सयरण लयग ू धवधधयों के ऄनुसयर धवधनयधमत दकयय जयएगय।
(20) सतह और भूजल के वयधणधज्यक धनष्किाण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(21) खुले कुअ, बोर कुअ, अदद के धलए कृधि और ऄन्य ईपयोग । धवधनयधमत दकए जयएगें और समुधचत प्रयधधकयरी द्वयरय दक्रययकलयपों की सख्ती से मयनीीरी की जयएगी।
(22) वयधणधज् यक सयआनबोडा और होर्डडग । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(23) वययु, ध्वधन और ययधनक प्रदिूण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(24) धवदिेी प्रजयधतयों को लयनय । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(25) पयररधस्थधतक पयाीन। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(26) सुरक्षय बल धिधवर। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(27) नए कयष् ठ अधयररत ईद्योग । पयररधस् थधतक संवेदी जोन के भीतर नए कयष् ठ अधयररत ईद्योग की स् थयपनय ऄनुज्ञयत नहीं होगी :
परंतु पयररधस्थधतक संवेदी जोन में 100% अययधतत कयष् ठ स् ीयक ईपभोग करने वयले नए कयष् ठ अधयररत ईद्योग की स् थयपनय की जय सकेगी ।
(28) पयररधस्थधतक ऄनुकूल पयाीन दक्रययकलयपों हतेु पयाीकों के ऄस्थययी ऄधधभोग हतेु पयररधस्थधतक ऄनुकूल कुीीर जसैे तम्बु, लकडी के अवयस। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
(29) ठोस ऄपधिष् ी प्रबंधन। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे । ग. सवंर्सधत दक्रययकलयप
(30) विया जल संचयन । सदक्र य रूप से बढ़यवय ददयय जयएगय ।
(31) जैधवक खेती। सदक्र य रूप से बढ़यवय ददयय जयएगय ।
(32) सभी गधतधवधधयों के धलए हररत प्रौद्योधगकी को ग्रहण करनय । सदक्र य रूप से बढ़यवय ददयय जयएगय । II (ii) 11
(33) कुीीर ईद्योगों धजसके ऄंतगात ग्रयमीण कयरीगर भी हैं । सदक्र य रूप से बढ़यवय ददयय जयएगय ।
(34) नवीकरणीय उजया स्रोत और ईंधन कय ईपयोग । बययोगैस, सौर प्रकयि आत्य ययदद को सदक्रय रूप से बढ़यवय ददयय जयनय ह ै।
(35) कृधि वयधनकी । सदक्र य रूप से बढ़यवय ददयय जयएगय ।
(36) पयररधस्थधतक ऄनकूुल पररवहन कय ईपयोग । सदक्र य रूप से बढ़यवय ददयय जयएगय ।
(37) कौिल धवकयस । सदक्र य रूप से बढ़यवय ददयय जयएगय ।
(38) धनम्नीकृत भूधम यय वन यय कय जीणोद्धयर । सदक्र य रूप से बढ़यवय ददयय जयएगय ।
5. मयनीीरी सधमधत.—कें र्द्ीय सरकयर के द्वयरय, पययावरण (संरक्षण) ऄधधधनयम, 1986 की धयरय 3 की ईप-धयरय (3) के ऄधीन आस ऄधधसूचनय के ईपबंधों की प्रभयवी धनगरयनी के धलए एक धनगरयनी सधमधत कय गठन दकयय गयय, जो धनम्नधलधखत स ेधमलकर बनेगी, ऄथयात्:--
(i) धजलय कले्ीर, पोरबन्दर ऄध्यक्ष;
(ii) क्षेत्रीय ऄधधकयरी, गुजरयत रयज्य प्रदिूण धनयंत्रण बोडा, पोरबन्दर -सदस्य;
(iii) क्षेत्र कय वररष्ठ नगर योजनयकयर -सदस्य;
(iv) पययावरण एवं वन धवभयग, गुजरयत सरकयर कय प्रधतधनधध -सदस्य;
(v) पययावरण के क्षेत्र में कयया करन े वयले गैर सरकयरी संगठन कय रयज्य सरकयर द्वयरय प्रत्ययेक मयमले में तीन विा के धलए नयधमत एक प्रधतधनधध -सदस्य;
(vi) रयज्य सरकयर द्वयरय प्रधतधष्ठत संस्थयन यय धवश्वधवद्ययलय से पररधस्थधत धवज्ञयन यय वन्यजीव यय पधक्षयों के क्षेत्र से प्रत्ययेक मयमले में तीन विा के धलए नयधमत एक धविेिज्ञ -सदस्य;
(vii) रयज्य जैव-धवधवधतय बोडा कय सदस्य -सदस्य;
(viii) ईप वन संरक्षक (बरदय वन्यजीव ऄभययरण्य कय भयरसयधक), पोरबन्दर –सदस्य सधचव।
6. धनदिे धनबधंन.—
(1) मयनीीरी सधमधत आस ऄधधसूचनय के ईपबंधों के ऄनुपयलन को मयनीीर करेगी ।
(2) पयररधस्थधतक संवेदी जोन में भयरत सरकयर के तत्य कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय सं. कय.अ. 1533(ऄ), तयरीख 14 धसतंबर, 2006 की ऄनुसूची के ऄधीन सधम्मधलत दक्रययकलयपों और आस ऄधधसूचनय के पैरय 4 के ऄधीन सयरणी में धवधनर्ददष् ी प्रधतधिद्ध गधतधवधधयों के धसवयय अन ेवयल ेऐसे दक्रययकलयपों की दिय में वयस्तधवक धवधनर्ददष्ट स्थलीय दियओं पर अधयररत मयनीीरी सधमधत द्वयरय संवीक्षय की जयएगी और ईि ऄधधसूचनय के ईपबंधों के ऄधीन पूवा पययावरण धनकयसी के धलए केन्र्द्ीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को धनर्ददष्ट की जयएगी ।

2991, dated 2 nd November, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND whereas, no comments/ objections and suggestions received from persons and stakeholders in response to the draft notification;
WHEREAS, the Barda Wildlife Sanctuary located in Porbandar, Jamnagar and Devbhoomi Dwarka Districts in the State of Gujarat and lying between latitudes 21 o 40'N and 21 o 55'N and longitudes between 69 o 40'E and 69 o 55'E is spread over an area of 192.31 square kilometres AND WHEREAS, the Barda Wildlife Sanctuary is one of the richest and compact bio-diversity patches covered on all sides by good quality dry deciduous miscellaneous forests, dry thorn forest, shrub lands and wetland forests along with bamboo patches dotted in between and it maintains rich bio-diversity comprising 759 species of 430 genera of tree, herbs, shrubs and climber species, 22 mammal species which include some rare species, 26 species of reptiles, 4 species of amphibians, 55 species of butterfly, more than 3000 species of insects and more than 269 species of birds;
AND WHEREAS, there are main flora‟s in the sanctuary Sitaphal (Annona squamosa), Umda (Miliusa tomentosa), Ashok (Polyalthia longifolia), Venivel (Cissampelos pareira linn), Vevdi, Vadhi (Cocculus hirsutus), Orap, Parwat (Cocculus pendulus), Karipat (Cyclea peltata), Galo vel (Tinospora glabra), Poyanu, kama (Nymphaea 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] pubescens), Darudi (Argemone mexicana lonn), Halim, Ashal (Lepidium sativum linn), Khordu (Cadaba fruticosa), Ghuti,Thikar (Capparis grandis linn.), Kantharo (Cpparis sepiaria linn.), Tanmani (Cleome gynandra.), Bethi Talvan (Cleome simplicfolia), Pili Talvan (Cleome viscosa linn.), Varno,Vayvar (Crateva tapia), Dolo Katkiya (Maerua oblongifolia), Lodri (Lflacourtia indica), Pili Bhoysan (Polygala chinensis linn.) and main fauna is Nilgai (Boselaphustragocamelus), Wild Boar (Susscrofa), Small Indian Civet (Viverriculaindica), Common Mongoose (Herpestesedwardsi), Striped Hyena (Hyaena hyaena), Wolf (Canis lupus), J ackal (Canisaureus), Indian Fox (Vulpesbengalensis), Ratel (Mellivoracapensis), Leopard (Pantherapardus), Jungle Cat (Felischaus), Indian Hare (Lepusnigricollis), Five-striped Palm Squirrel (Funambuluspennanti), Porcupine (Hystrixindica), Spiny Field Mouse (Musplatythrix), House Rat (Rattusrattus), Common Langur (Presbytis entellus) etc.;
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Barda Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of Barda Wildlife Sanctuary, reintroduction and rehabilitation of local species through breeding programmes, promote environmental education and ecological research and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area upto an extent of 4.76 kilometers around the boundary of Barda Wildlife Sanctuary in the State of Gujarat as the Barda Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.—(1) The Eco-sensitive Zone shall be with a peripheral area of 65.58 square kilometers with an extent up to 4.76 kilometers around the boundary of Barda Wildlife Sanctuary.
(2) The boundary description of the Barda Wildlife Sanctuary is appended as Annexure-I and the map of the Ecosensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-II.
(3) The details of Global Positioning System coordinates of the points along the boundary of the Barda Wildlife Sanctuary and its eco-sensitive zone are appended as Annexure-III.
(4) The list of 20 villages falling in Eco-sensitive Zone is appended as Annexure-IV.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Ecosensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue, II (ii) 19
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department.
(5) With a view to conserve the protected area, the State Government needs to obtain closure plan from the miners adjacent to protected area and expenditure involved in it shall be met under the Corporate Social Responsibility activity.
No further mining lease and renewal to be awarded by State Government after its expiry. Based on the closure plan, area to be converted into Biodiversity parks after the closure of mining lease.
(6) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(8) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(9) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.-
(a) The State Government shall not allow renewal of mines adjacent to the protected area in the direction of West, North-West and West-Southern and after their closer, plan to be drawn for development of Bio-diversity Park.
(b) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Ecosensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the Relevant State Laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as;-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 7:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the Relevant State Laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(c) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural Springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism/ Eco-tourism.- (a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage. —All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.—Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986.
(7) Air pollution.—Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.—Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.—Disposal and Management of solid wastes shall be as under:-
(i) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated the8th April, 2016 .
(ii) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone.
(iii) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—Bio medical waste management shall be as under:-
(i) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.
(ii) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Vehicular Pollution.—Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(13) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.
(14) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.

(15) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(16) Industrial Units.—(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.—The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.
4. Prohibited, Regulated and Promoted Activities.— All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone Notification, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. 1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon‟ble Supreme Court dated the 04 August, 2006 in the matter of T.N.

3. Establishment of major hydroelectric project.

6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within the Eco sensitive Zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities:
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Ecotourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Ecosensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as;
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries;
convenience stores and local amenities supporting ecotourism including home stays; and
(iv) promoted activities listed in this Notification.
12. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.

13. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
14. Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
15. Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
16. Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
17. Erection of electrical and telecommunication towers related infrastructure.
Promote underground cabling.
18. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
19. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
20. Commercial extraction of surface and ground water .
Regulated under applicable law.
21. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
(i) Collector, Porbandar Chairman;
(ii) Regional officer Gujarat state pollution control board, Porbandar Member;
(iii) Senior town planner of the area Member;
(iv) Representative of the department of Forests and Environment, Government of Gujarat Member;
(iv) A representative of Non-Governmental organisations working in the field of environment to be nominated by the State Government for a period of three year in each case Member;
(vi) One expert in the area of Ecology and Environment to be nominated by the State Government for a period of three year in each case Member;
(vii) Member State Biodiversity Board Member;
(viii) Deputy Conservator of Forests, Porbandar (Incharge of Barda WLS) Member Secretary.
6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the monitoring committee based on site-specific conditions and referred to concerned Regulatory Authority.
(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure V.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon‟ble Supreme Court of India or the High Court or National Green Tribunal.
