PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1230] No. 1230] NEW DELHI, WEDNESDAY, MAY 3, 2017/VAISAKHA 13, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 3 मई, 2017 कय.आ.1393(अ).- भयरर् सरकयर के र्त्कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 19(अ) र्यरीख 6 जनवरी, 2011 (धजसे इसमें इसके पश्चयर्् र्टीर् धवधनर्मन जोन, अधिसूचनय, 2011 कहय गर्य ह)ै कय और संशोिन करने के धलए प्रयरूप अधिसूचनय पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उप-धनर्म (3) की अपेक्षयनसुयर अधिसूचनय सं. कय.आ. 1497(अ) र्यरीख 25 अप्रैल, 2016 द्वयरय भयरर् के रयजपत्र, असयियरण, भयग 2, खंड 3, उप-खंड (ii) में प्रकयधशर् की गई थी धजसमें उन सभी व्यधिर्ों से, धजनकी उससे प्रभयधवर् होने की सभंयवनय ह,ै उस र्यरीख से, धजसको रयजपत्र की प्रधर्र्यं जनर्य को उपलब्ि करय िी गई थीं, सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् दकए गए थे; और उि अधिसूचनय की प्रधर्र्यं जनर्य को 25 अप्रैल, 2016 को उपलब्ि करय िी गई थी; और उि प्रयरूप अधिसूचनय के उत्तर में प्रयप्त आक्षेपों र्थय सुझयवों पर केन्द्रीर् सरकयर द्वयरय धवचयर कर धलर्य गर्य है। अर्ः, अब, केन्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उप-धनर्म (3) के खडं (घ) के सयथ परठर् उि पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उप-ियरय (1) र्थय उप-ियरय (3) के खंड (v) द्वयरय प्रित्त शधिर्ों कय प्रर्ोग करर्े हुए, र्टीर् धवधनर्मन जोन अधिसूचनय, 2011 में धनम्नधलधखर् और संशोिन करर्ी है। र्टीर् धवधनर्मन जोन अधिसूचनय, 2011 में,- (क) पैरय 4 के उप-पैरय 4.2 में, खंड (iii), खंड (vi), खंड (v) और खंड (vi) के स्थयन पर धनम्नधलधखर् खंड रखे जयएंगे, अथयार््:- “(iii) पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् र्य एसआईएए सयठ दिन की अवधि के भीर्र संबंधिर् सीजेडएमए की धसफयररशों के आियर पर अनयपधत्त के धलए ऐसी पररर्ोजनयओं पर धवचयर करेगय।
(iv) पनुगाठन र्य दकन्द् ही अन्द् र् कयरणों से र्दि, सीजेडएमए प्रचयलन में नहीं हो, र्ब उन रयज् र् सरकयरों र्य संघ रयज् र्क्षेत्र प्रशयसनों के पर्यावरण धवभयग, जोदक र्टीर् जोन प्रबंिन र्ोजनयओं के अधभरक्षक हैं, अपनी टीकय रटप् पणी के सयथ, उ् र् अधिसूचनय के उपबंिों के धनबंियनुसयर, प्रस् र्यवों की धसफयररश पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को भेजेंगे।
(v) सीआरजेड अधिसूचनय के अिीन पररर्ोजनों को प्रियन की गई मजंूरी सधिमयाण और प्रचयलन के प्रयरंभ के धलए मंजूरी के जयरी दकए जयने की र्यरीख से पयंच वर्ा की अवधि के धलए धवधिमयन्द्र् होगी। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(vi) मंजूरी प्रयप् र् करने के बयि की मननीटिंरंग हरे्ु- (क) पररर्ोजनय प्रस्र्यवक के धलए र्ह अधनवयर्ा होगय दक वह प्रत्र्ेक कैलेन्द्डर वर्ा के 1 जून र्थय 31 दिसम्बर को संबद्ध धवधनर्यमक प्रयधिकयरी (प्रयधिकयररर्ों) को हयडा और सनफ्ट कनपी में पर्यावरणीर् मंजूरी के धनर्र् धनबंिनों र्थय शर्ों की बयबर् अद्धावयर्र्ाक अनुपयलन ररपोटें प्रस्र्ुर् करे और पररर्ोजनय प्रस्र्यवक द्वयरय प्रस्र्ुर् सभी ऐसी अनुपयलन ररपोटें लोक अधिकयररर्य क्षेत्र में प्रकयधशर् की जयएगी और इसकी प्रधर्र्य ंसंबद्ध सीजेडएमए को आवेिन दकए जयने पर दकसी भी व्यधि को िी जयएंगी। (ख) अनुपयलन ररपोटा संबद्ध धवधनर्यमक प्रयधिकयरी की वेबसयइट पर भी प्रिर्शार् की जयएगी।
(vii) सीजेडएमए के कयर्ाकरण में पयरिर्शार्य बनयए रखने के धलए, सीजेडएमए की र्ह धजम्मेियरी होगी दक वह समर्पार् वेबसयइट सृधजर् करे और कयर्ा सूची, कयर्ावृत्त, दकए गए धवधनश्चर्, अनयपधत्त पत्र, उल्लंघन पर की गई कयरावयई और न्द्र्यर्यलर् मयमलों, धजनके अन्द्र्गार् मयननीर् न्द्र्यर्यलर् के आिशे और संबंधिर् सरकयर र्य संघ रयज्र्क्षेत्र के अनुमोदिर् सीजेडएमपी भी हैं, को वेबसयइट पर डयलेगय”। (ख) पैरय 8 के उप-पैरय (5) में,
(i) ग्रेटर मुंबई की नगरपयधलकय सीमयओं के भीर्र आने वयले सीआरजेड क्षेत्रों से संबंधिर् खंड 1 के उप-खंड (i) में, धनम्नधलधखर् मि अन्द्र्ःस्थयधपर् की जयएगी, अथयार््:- “ई. नगर पयधलकय क्षेत्र से मल उपचयर के प्रर्ोजन के धलए सीआरजेड-1 में मल उपचयर संर्ंत्र कय संधनमयाण, जहयं ऐसी सुधवियएं स्थयधपर् करने के धलए कोई वैकधल्पक स्थयन उपलब्ि नहीं ह,ै वहयं संबंधिर् र्टीर् जोन प्रबंिन प्रयधिकयरी की धसफयररशों और केन्द्रीर् सरकयर के अनुमोिन के अिीन रहर्े हुए केवल अपवयदिक पररधस्थधर्र्ों में नगरपयधलकय प्रयधिकयररर्ों द्वयरय दकर्य जयएगय। सधिमयाण प्रदिर्य के िौरयन धर्गुने क्षेत्र में कयटे गए र्य नष्ट दकए गए मैंग्रोव को पुनः रोधपर् दकर्य जयएगय।”;
(ii) गोवय के सीआरजेड से संबंधिर् खंड 3 में, मि (iii) के पश्चयर््, धनम्नधलधखर् मि अन्द्र्ःस्थयधपर् की जयएगी, अथयार््:- “(iiiक) जून से अगस्र् मयस के िौरयन ऐसी संरचनयओं को हटयर्य और धवखंधडर् नहीं दकर्य जयएगय: परंर्ु इन संरचनयओं में उपलब्ि सुधवियएं जून से अगस्र् मयस के िौरयन पररचयलन में नहीं रहेंगी।”; [फय. सं. 19-27/2015-आईए-III] अरूण कुमयर मेहर्य,संर्ुि सधचव रटप्पण: मूल अधिसूचनय भयरर् के रयजपत्र, असयियरण, भयग II, खंड 3, उप-खंड (ii) में सयं. कय.आ. 19(अ) र्यरीख 6 जनवरी, 2011 द्वयरय प्रकयधशर् की गई थी और र्त्पश्चयर्् उसे धनम्नयनुसयर संशोधिर् दकर्य गर्य थय।

II (ii) 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 3rd May, 2017 S.O.1393(E). – Whereas, a draft notification further to amend the notification of the Government of India in the erstwhile Ministry of Environment and Forests number. S O. 19(E), dated the 6 th January, 2011 (hereinafter referred to as the Coastal Regulation Zone, Notification, 2011) was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide notification number S.O. 1497(E) dated the 25 th April, 2016, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, inviting objections and suggestions from all persons likely to be affected thereby, within a period of sixty days from the date on which copies of Gazette containing the said notification were made available to the public; And whereas, copies of the said notification were made available to the public on 25 th April, 2016; And whereas, objections and suggestions received in response to the said draft notification have been considered by the Central Government. Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the said Environment (Protection) Act, (29 of 1986) read with clause (d) of sub-rule (3) of rule 5 of the said Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the Coastal Regulation Zone Notification, 2011, namely:— In the Coastal Regulation Zone Notification, 2011,-
(a) in paragraph 4, in sub-paragraph 4.2, for clause (iii), (vi), (v) and (vi), the following clauses shall be substituted, namely:- “(iii) MoEFCC or SEIAA shall consider such projects for clearance based on the recommendations of the concerned CZMA within a period of sixty days.
(iv) In case the CZMAs are not in operation due to their reconstitution or any other reasons, then it shall be responsibility of the Department of Environment in the State Government or Union territory Administrations, who are the custodian of the Coastal Zone Management Plans of respective States or Union Territories to provide comments and recommend the proposals in terms of the provisions of the said notification to the Ministry of Environment, Forest and Climate Change.
(v) The clearance accorded to the projects under the CRZ notification shall be valid for the period of five years from the date of issue of the clearance for commencement of construction and operation.
(vi) For Post clearance monitoring.–
(a) it shall be mandatory for the project proponent to submit half-yearly compliance reports in respect of the stipulated terms and conditions of the environmental clearance in hard and soft copies to the regulatory authority(s) concerned, on 1 st June and 31 st December of each calendar year and all such compliance reports submitted by the project proponent shall be published in public domain and its copies shall be given to any person on application to the concerned CZMA.
(b) the compliance report shall also be displayed on the website of the concerned regulatory authority.
(vii) To maintain transparency in the working of the CZMAs it shall be the responsibility of the CZMA to create a dedicated website and post the agenda, minutes, decisions taken, clearance letters, violations, action taken on the violations and court matters including the Orders of the Hon’ble Court as also the approved CZMPs of the respective State Government or Union Territory”.
(b) in paragraph 8, in sub-paragraph (V),
(i) in clause 1 relating to CRZ areas falling within municipal limits of the Greater Mumbai, in sub-clause (i), after item (B), following item shall be inserted, namely:- “C. The construction of sewage treatment plants in CRZ-I for the purpose of treating the sewage from the municipal area shall be taken only by the municipal authorities in exceptional circumstances, where no alternate site is available to set up such facilities, subject to recommendations of the concerned CZMA 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] and approval by the Central Government. Three times the number of mangroves destroyed or cut during construction process shall be replanted”;
(ii) in clause 3 relating to CRZ of Goa, after item (iii), the following item shall be inserted, namely:- “(iiia) such structures shall not be removed and dismantled during the month of June to August:
