CENTRAL BOARD OF DIRECT TAXES New Delhi, the 30th December, 1978 (INCOME-TAX) S,O. 1441.—-In exercise of the powers conferred by subaction (1) of Section 121 of the Income-tax Act, 1961 (43 rf 1961), the Centra] Board of Direct Taxes hereby makes the 'ollowing amendments to its Notification No. 679 (F No 187/2/74-mAI) dated 20-7-1974 as amended from time to line.

SHASTRI, Under Secy MINISTRY OF COMMERCE, CIVIL SUPPLY AND CO-OPERATION New Delhi, the 5th May, 1979 S.O. 1442.—In exercise of the nowcrs conferred bv section 17 of the Export (Quality Control and Inspection) Act, 1963 f22 of 1963), the Central Government hereby makes the following rules to amend the Export Inspection Council Emp'oyees (Classification, Control and Appeal) Rules, 1978 viz :— l.»(l) These rules may be called the Export InBpection Council Employees (Classification, Control and Appeal) Amendment Rules, 1979.

(2) They shall come into force on their publication in the Official Gazette;

Control and Appeal) Rules, 1978,

(1) in rale 2, the following shall be added, name'y ;—

(1) 'Joint Director' means the Joint Director of the Export Inspection Council ;

f2) for sub-rule (4) of rule 12 the following sub-ru'e shall be substituted, namely :— "(4) Tf the disciplinary authority having reffai-d to its findings on all or any of the article? of charge and on the basis of the evidence aduced during the Inquiry is of the opinion that any of the nena'ti's specified in clauses (v) to (ix) of rule 8 should be imposed on the Council employee, it shall make nn order imposing such penalty and it shall not be necessary to give the Council emp'oyee anv opportunity of making representation on th* penalty proposed to be imposed."

No. 3(Jl)/76-ET&EPl 1386 THE GAZETTE OF INDIA : MAY 5, 1979/VA1SAKHA 15, 1901 [PART II—SBC. 3(ii)] S.O. 1443.-—Tti exercise of the powers conferred by Section 17 of the Export (OuaHty Control and Inspection) Act, 1963 (22 of 1963), the Central Government hereby makes the following Rules to amend the Export Inspection Agency Employees (Classification, Control and Appeal) Rules 1978 viz :—i

1. (1) These Rules may b« called the Export Inspection Agency Employees (Classification, Control and Appeal) Amendment RuieSy/1979.

(2) They shall come into froce on their pub'icatlon in the Official Gazette.

2. Rules 10 and 9 of the Export Inspection Agency Employees (Classification, Control and Appeal) Rules 1978 shall be re-aligned as 9 and 10.

3. In sub-ru1e (k) of Rule 2 of the said Rules, the words "or Agency" shall be added at the end.

4. Tn sub-rule fl) of Rule 9 of the said Rules, the word "Council" appearing )n second line shall be substituted as "Agency",

5. In sub-rule (2) of Rule 9 of the said Rules, the word "Council" oppearing in third line shall be Substituted as "Agency".

6. For sub-rule (4) of Rule 12 of the said Rules, the following sub-rule shall be substituted namely :— "(4) If the disciplinary authority having regard to it") r findings on all or any of the articles of charge and on the basis of the evidence adduced during the inquiry Is of the opinion that any of the penalties specified in Clauses (v) to (ix) of Rule 8 should be imposed on the Agency employee, it ••hall make an order imposing such penalty and it shall not be necessary to give the Agency employee any opportunity of making representation on the penalty proposed to be imposed".

Allahabad Bank Building , 17 Parliament Street, New Delhi-110001 were granted Tmport licence No. P/D/2206927/ C/XX/62/H/43-44/Paper dated 1-2-77 for import of Raw materials and Components as per list attached to its valuted in Rs. 25,700 from G.C.A.

2. They have requested for issue of duplicate Customs Purposes copy of the above said licence on the ground that the original Customs copy has been lost/misplaced without having been registered with any Customs authority. It has been further reported by the licensee that the licence WHS not utilised at all.

3. In support of the contention, the applicant have filed an Affidavit. The undersigned is satisfied that the ordinal Customs Purposes copy of Imports licence No. P/D/2206927 dt.

1-2-77 has been lost or misplaced ,ind hence directs that a duplicate Customs Purposes copy of the licence should he jssued to the applicant. The original Customs Purposes copy is hereby cancelled.

4. The duplicate Customs Purposes copy of the licence is befng issued separately.
