(iii) wffores VI #, W= 7 &, feforfe i daeantue B ST, i - ‘oig wg F o wf ft arens s o /T S, Fe e o8 awer FEAFTT | AT AT T aafers sty fory feam 3 w1t g1 [T, %, 5-11013/30/2007 — o7 . 1 ()] e &, T feroqur ;e wfergEmT @ # @, 1533(%), A 14 fr=w, 2006 1T AT F AT, AT, S 2, @ 3, SUEE (i) ¥ WA 7 T Ar v afergme oA an 1224(), T 28 Wi, 2020 1T wew Ferrer = wm MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 21st May, 2020 S.0. 1562(E).—WHEREAS, the Central Government in the erstwhile Ministry of Environment and Forests, in exercise of its powers under sub-section (1) and clause (v) of sub-section (2) of section (3) of the Environment (Protection) Act, 1986 has published the Environment Impact Assessment Notification, 2006 (hereinafter referred to as the EIA Notification, 2006) vide number S.0.1533 (E), dated the 14" September, 2006, mandating prior Environmental Clearance from the Central Government in the Ministry of Environment and Forests for matters falling under Category ‘A’ in the Schedule and at State level the State Environment Impact Assessment Authority for matters falling under Category ‘B’ in the said Schedule;
AND WHEREAS, the State Environment Impact Assessment Authority and State Level Expert Appraisal Committees shall be constituted by the Central Government under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 for a fixed term of three years;
[RIKpT avs 5(11)) HILA DA S AND WHEREAS, the Ministry of Environment, Forest and Climate Change is in the receipt of representations for extension of tenure of the State Environment Impact Assessment Authority and State Level Expert Appraisal Committees, beyond three years in certain situation like pandemic COVID 19, for uninterrupted dealing the matters under Category “B” proposals;
AND WHEREAS, the Central Government deems it necessary to extend the tenure of the existing State Environment Impact Assessment Authority and State Level Expert Appraisal Committees, in exceptional circumstances;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government after having dispensed with the requirement of notice under clause (a) of sub-rule (3) of the rule 5 of the said rules, in public interest, hereby makes the following further amendments in the EIA Notification, 2006, namely:- In the said notification,-
(i) in paragraph 3, in sub-paragraph (6), the following proviso shall be inserted, namely:- “Provided that wherever considered necessary and expedient, the Central Government may extend the term for a further period not exceeding six months.”
(i) in paragraph 5, for sub-paragraph (c), the following sub-paragraph shall be substituted, namely:- “(c) The Expert Appraisal Committee and State Level Expert Appraisal Committee shall be reconstituted after every three years:
Provided that wherever considered necessary and expedient, the Central Government may extend the term for a further period not exceeding six months.™
(iii) in the APPENDIX VI, in item 7, the following proviso shall be inserted, namely:- “Provided that wherever considered necessary and expedient, the Central Government may extend the term of such member for a further period not exceeding six months.” [F.
