PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1381] No. 1381] NEW DELHI, MONDAY, MAY 15, 2017/VAISAKHA 25, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 15 मई, 2017 कय.आ. 1564(अ).—प्रयरुप अधिसूचनय भयरर् के रयजपत्र असयियरण में सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 142(अ), र्यरीख 13 जनवरी, 2016 द्वयरय प्रकयधिर् की गई थी धजसमें अन्र् सभी व्यधिर्ों से, धजनकी उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको अधिसूचनय को अन्र्र्वाष्ट करने वयल े रयजपत्र की प्रधर्र्यं जनर्य को उपलब्ि करय िी गई थीं, सयठ दिन की अवधि के भीर्र सुझयव और आक्षेप आमंधत्रर् दकए गए थ;े और, प्रयरुप अधिसूचनय के उत्तर में सभी व्यधिर्ों और पणियररर्ों से प्रयप्त आक्षेपों और सुक्षयवों पर केन्रीर् सरकयर द्वयरय धवचयर कर धलर्य गर्य ह;ै और, र्यलयकयवेरी वन् र्जीव अभर्यर् र्, कनयाटक रयज्र् के कोडयग ु धजल ेकी पध चमी दििय में वन् र्जीव (संरक्षण) अधिधनर्म, 1972 की ियरय 18 की उपियरय अधिसूचनय सं. के उपबंिों के अिीन 173 87 (1), र्यरीख 31 अगस्र्, 1987 द्वयरय अधिसूधचर् 12017’ 14’’ से 120 26’ 38’’ उत् र्र अक्षयंि और 7 0 2 ’ 23’’ से 7 033’ 1 ’’ पूवा िेियंर्र के बीच धस् थर् ह ैजो 10 . 9 वगा दकलोमीटर के क्षेत्र में फैलय हुआ ह ै;
और, र्यलयकयवेरी वन् र्जीव अभर्यर् र् पध चमी टयट कय केन् र दबंि ुहजि धजसकी धविे र्य 3 प्रधर्िर् से अधिक खडी ढयल वयले अभर्यर् र् क्षेत्र के 8 प्रधर्िर् से अधिक कय भू भयग बबड खयबड ह,ै और धजसमें 6000 धम.धम. से 7000 धम.धम. के बीच अधिक व या होर्ी ह,ै समृद्ध जैव धवधविर्य स्थयधनक वयि के उच् च िर और बयट (पैथयरय टीधिस), एधिर्यई हयथी (एधलफस मैधससमस), मयलयवयर धबलयव(धववेरया), गौर और भयरर्ीर् जंगली भजिसय(बूस गर्रूस), सयंभर(रूसय र्ूनीकोलर), और मुंजक(मुनटीसस मुंनर्जक), दसंह पुच्छ लटु पचु्छ वयनर (मक्कय धसलेनअस), र्वयंगु (लोररस लयडेके्कररअनस), भूरय मुसंग(पैरयडूससुरूस जेरिोनी), र्ेंिआु धबल्ली(मयटेस गवयटदकनधस), नीलधगरी मयटान (मयर्टसा ग्लनै्टीकी), जंगली कुत् र्य(कून अलधपनेस), ओटर (लुर्ेरय पेरसधपधसल्लयटय), र्रवनकोर सूरज- भगर् (पेरटनूमस फूसकोकयधपल्लअस) और अन्र् कोबरय 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ओदफओफगुस हन्नय), इंधडर्न रयक पयर्थन(पयर्थन मुलूरूस मोलुरूस) जैसी क्रयधन्र्क रूप से संकटिस् र् और संकटिस् र् प्रजयधर्र्ों के धलए आश्रर् ह ै;
और, अभर्यर्र् को पधिमी टयटों में एक महत्वपूणा पक्षी क्षेत्रों में से एक पक्षी क्षेत्र के रूप में पहचयनय गर्य ह,ै सर्ोंदक पधिमी टयटों के 16 स्थयधनक पधक्षर्ों में से 13 र्हयं पयर्य जयर्य हजि जैसे मयलयबयर बयंि मरू्र, पेररस मरू्र, मयलयबयर रयवेन, और मयलयबयर स्वेलोवैल मयलयबयर मयलयबयर ि े हॉनाधबल (अनथरयकोकेरूस कोरूनटस), मयलयबयर ट्रोगोन (हयरपेसटेस फसधसअटस), मयलयबयर धवस्टदलंग थ्र (मयर्ोफोनस हयाँसादफल्डी), वयर्यनयि लयफ्फोदनंग थ्रि (गरूा लसैस डेलेस्सरटी), व्हयइट- बेल्डेड ट्री-पयर् (डेंड्रोदकट्टय लीकोगोस्ट्रय), ऑरेंज और कयलय सूरजभगर् (मधस्ककपय धनगरूफय) और नीलधगरी सूरजभगर् (मधस्सकपय अलधबकयआडयटय) अभर्यर्र् भी स्थयधनक और संकटयिस्र् पयधपधलर्धनड धर्र्धलर्ों को भी िरण िरे्य ह;ै और, अभर्यर् र् पट्टी टयट और पयिीनलकनयडु आरधक्षर् वनों जैसे बहुर् से आरधक्षर् वनों से धटरय हुआ होन ेके कयरण अभर्यर् र् एधिर्यई हयथी और बयट जैसे बडे स् र्नियररर्ों के धलए धवस् र्यररर् प्रयकृधर्क वयस की व् र्वस् थय करर्य ह ैऔर हयथी पररर्ोजनय के अिीन टोध र् मैसूर हयथी ररजवा कय भयग ह ैर्थय र्ह कनयाटक में नयगरहोल रयष्ट ट्रीर् पयका र्थय र्यलयकयवेरी वन् र्जीव अभर्यर् र् और केरल रयज् र् में व् र्यनयि र्थय अरयलम वन् र्जीव अभर्यर्र् के बीच टूमन ेके धलए बडे स् र्नियररर्ों के धलए महत् वपूणा गधलर्यरे के रूप में कयर्ा करर्य ह;ै और, संरधक्षर् क्षेत्र कयवेरी निी के धलए आवयह क्षेत्र ह ैजो र्यलयकयवेरी से धनकलर्ी ह ैऔर अभर्यर् र् डोडयहोल, नयडूबेलहोल, धबटेमलेहोल, कुमकेोली और मुडंरयहोल जैसी बयरहमयसी सररर्यओं के धलए एक महत् वपूणा क्षेत्र के रूप में भी कयर्ा करर्य ह ैजो र्यलयकयवेरी वन् र्जीव अभर्यर् र् द्वयरय िी गई पयररधस् थधर्क-प्रणयली सेवयओं के महत् व कय वणान करर्ी हजि;
और, र्यलयकयवेरी वन् र् जीव अभर्यर् र् के चयरों ओर के संरधक्षर् क्षेत्र को, पर्यावरण की िधृष्ट से पयररधस्थधर्क संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय र्थय उि पयररधस्थधर्क संवेिी जोन में उद्योगों र्य उद्योगों के वगो की संदक्रर्यओं र्थय प्रसंस्करण करन ेको प्रधर्ध द्ध करनय आवर्क ह;ै अर्ः, इसधलए, केन्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (3) और उपियरय (2) के खंड (v) और खंड
(xiv) और उपियरय (1) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, कनयाटक रयज् र् में र्यलयकयवेरी वन् र् जीव अभर्यर् र् के चयरों ओर 1 दकलोमीटर से 16 दकलोमीटर के धवस् र्यर र्क धसवयर् उसे दििय के जहयं अभर्यर्र् केरल रयज्र् की सीमय को सयझय करर्य ह ै वहयं र्ह िनू्र् दक. मी. ह,ै के क्षेत्र को र्यलयकयवेरी वन् र् जीव अभर्यर् र् पयररधस्थधर्क संवेिी जोन के रूप में अधिसूधचर् करर्ी ह,ै धजसके ब्र्ौरे धनम्नयनुसयर ह,ै अथयार् ्:--
1. पयररधस्थधर्क सवंिेी जोन कय धवस्र्यर और उसकी सीमयए-ं-(1) पयररधस्थधर्क संवेिी जोन कय कुल भौगोधलक क्षेत्र
213.07 वगा दकलोमीटर ह ैधजसकय र्यलयकयवेरी वन् र्जीव अभर्यर् र् की सीमय के इिाधगिा धवस्र्यर 1 से 16 दकलोमीटर ह,ै धसवयर् उस दििय के जहयं र्ह केरल रयज्र् की सीमय को सयझय करर्य है जहयं र्ह िून्र् दकलोमीटर ह ैऔर ऐसे पयररधस्थधर्क संवेिी जोन की सीमयओं कय वणान उपयबिं I में दिर्य गर्य ह ै।
(2) अक्षयंि और िेियन्र्र के सयथ पयररधस्थधर्क संवेिी जोन की सीमय कय मयनधचत्र उपयबिं II के रूप में उपयबद्ध ह।ै
(3) पयररधस्थधर्क संवेिी जोन की सीमय और र्यलयकयवेरी वन्र्जीव अभर्यर्र् की सीमय के सयथ उसके मुख्र् धबन्िओुं के भू- धनिेियंकों के उपयबिं III के रूप में उपयबद्ध ह।ै
(4) पयररधस्थधर्क संवेिी जोन के भीर्र आन ेवयले ियमों की सूची र्थय आरधक्षर् वन के्षत्र उपयबिं IV में दिए गए ह ै।
2. पयररधस्थधर्क सवंिेी जोन के धलए आचंधलक महयर्ोजनय – (1) रयज्र् सरकयर, पयररधस्थधर्क संवेिी जोन के धलए रयजपत्र में अंधर्म अधिसूचनय के प्रकयिन की र्यरीख से िो व ा की अवधि के भीर्र, स्थयनीर् व्यधिर्ों के परयमिा से और इस अधिसूचनय में दिए गए अनुबंिों कय पयलन करर्े हुए आंचधलक महयर्ोजनय र्ैर्यर करेगी । II (ii) 3
(2) रयज्र् सरकयर द्वयरय पयररधस् थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस अधिसूचनय में र्थय धवधनर्िाष्ट ट ऐसी रीधर् में र्थय सुसंगर् कें रीर् और रयज् र् धवधिर्ों के अनुरुप और कें रीर् सरकयर द्वयरय जयरी मयगाधनिेिों, र्दि कोई हों, द्वयरय र्ैर्यर होगी ।
(3) आंचधलक महयर्ोजनय, पयररधस्थधर्क और पर्यावरणीर् संबंिी बयर्ों को उि र्ोजनय में समयकधलर् करन े के धलए रयज् र् सरकयर के सभी संबद्ध धवभयगों के परयमिा से र्ैर्यर होगी, अथयार् ्--
(i) पर्यावरण;
(ii) वन और वन्र्जीव;
(iii) कृध ;
(iv) रयजस् व;
(v) नगर धवकयस;
(vi) पर्ाटन;
(vii) ियमीण धवकयस;
(viii) दसंचयई और बयढ़ धनर्ंत्रण;
(ix) नगरपयधलकय;
(x) पंचयर्र्ी रयज;
(xi) लोक धन मयाण धव भयग।
(4) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनय और दक्रर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िाष्ट ट न हो और आचंधलक महयर्ोजनय सभी अवसंरचनय और दक्रर्यकलयपों में और अधिक िक्षर्य और पयररधस्थधर्क अनुकूलर्य कय संविान करेगी ।
(5) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मृिय और नमी संरक्षण, स्थयनीर् समुियर्ों की आवर्कर्यओं र्थय पयररधस्थधर्क और पर्यावरण से संबंधिर् ऐसे अन्र् पहलओूं, धजन पर ध्र्यन िेनय आवर्क ह,ै के धलए उपबंि होंगे ।
(6) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय स् थलों, ियमों और नगरीर् बंिोबस्र्ों, वनों के प्रकयर और दकस् मों, कृध क्षेत्रों, बपजयब भूधम, हररर् क्षते्र जैसे उद्ययन और उसी प्रकयर के स् थयन, उद्ययन कृध के्षत्र, फलोउद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी और समथानकयरी मयनधचत्र और धवद्यमयन और प्रस्र्यधवर् भूधम के उपर्ोग की धविे र्यओं के ब्र्ौरे िेर्े हुए मयनधचत्रों द्वयरय समर्थार् होगी ।
(7) आंचधलक महयर्ोजनय पयररधस्थधर्क संवेिी जोन में धवकयस को सयरणी में सूचीबद्ध प्रधर्ध द्ध, धवधनर्धमर् दक्रर्यकलयपों कय पयलन करेगी र्थय धवधनर्धमर् करेगी स् थयनीर् समुियर्ों की जीवकोपयजान सुरक्षय के धलए, पयररधस्थधर्क अनुकूल धवकयस सुधनध चर् करेगी र्थय संवर्िार् करेगी।
(8) आंचधलक महयर्ोजनय क्षेत्रीर् धवकयस र्ोजनय के सयथ सह-धवस्र्यरी होगी ।
(9) इस प्रकयर अनुमोदिर् आंचधलक महयर्ोजनय इस अधिसूचनय के उपबंिों के अनुसयर मयनीटरी के अपने कयर्ों को करन ेके धलए मयनीटरी सधमधर् के धलए एक संिभा िस्र्यवेज र्ैर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार््:--
(1) भू-उपर्ोग – (क) पयररधस् थधर्क संवेिी जोन में आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए वनों, उद्ययन-कृध क्षेत्रों, कृध क्षेत्रों, पयकों और खुल े स्थयनों कय वयधणधज्र्क और औद्योधगक संबद्ध धवकयस दक्रर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय:
परंर् ु पयररधस्थधर्क संवेिी जोन के भीर्र भयग (क) में धवधनर्िाष्ट कृध और अन्र् भूधम से धभन्न कृध और अन्र् भूधम कय संपररवर्ान मयनीटरी सधमधर् की धसफयररि पर और र्थय लयग ू सुसंगर् रयज्र् धवधिर्ों और केन्रीर्/रयज्र् सरकयर के अन्र् 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] धनर्मों र्थय धवधनर्मों के अिीन प्रयधिकयरी के पूवा अनुमोिन से, र्थय इस अधिसूचनय के उपबंिों द्वयरय स्थयनीर् धनवयधसर्ों की धनम्नधलधखर् आवयसीर् जरूरर्ों को पूरय करने के धलए अनुज्ञयर् दकर्य जयएगय, जैसे:-
(i) धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय र्थय नई सडकों कय संधनमयाण;
(ii) अवसंरचनय और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) प्रि ूण उत्पन्न न करने वयल ेलट ुउद्योग;
(iv) कुटीर उद्योगों धजसके अंर्गार् ियमीण उद्योग भी हजि; सुधवियजनक भ्डयर और पयररधस्थधर्क पर्ाटन में सहयर्क स्थयनीर् सुधवियए धजसमें गृह वयस भी ह;ै और
(v) संवर्िार् दक्रर्यकलयप और धजन्ह ेपैरय 4 के अिीन दिर्य गर्य ह ै परन्र् ुर्ह और दक जनजयर्ीर् भूधम कय कोई उपर्ोग रयज्र् सरकयर की सुसंगर् रयज्र् धवधिर्ों र्थय इसके अिीन बनयए धनर्मों और उपधनर्मों के अिीन सक्षम प्रयधिकयरी के पूवा अनुमोिन के धबनय र्थय संधवियन के अनुच्छेि 244 और र्त्समर् प्रवृत्त धवधि धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै के उपबंिों के अनुपयलन के धबनय, वयधणधज्र्क र्य उद्योग धवकयस दक्रर्यकलयपों के धलए अनुज्ञयर् नहीं होगय:
परंर् ुर्ह भी दक पयररधस् थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई तु्ररट, मयनीटरी सधमधर् के धवचयर प्रयप्त करन े के पियर् ्रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि तु्ररट के संिोिन की सूचनय कें रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को िेनी होगी । परंर् ुर्ह और भी दक बपर धनर्िाष्ट तु्ररट के संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू- उपर्ोग कय पररवर्ान सधममधलर् नहीं होगय । (ख) और वनरोपण और वयस जीणोद्धयर दक्रर्यकलयपों वयले अनप्रर्ुस र् र्य अनुत् पयिक कृध क्षेत्रों में पुन वनीकरण करन ेके प्रर्यस दकए जयएंगे ।
(2) प्रयकृधर्क जल स्रोर् -- आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ों, नदिर्ों, चैनलों की पहचयन की जयएगी और उनके संरक्षण और नवीकरण के धलए र्ोजनय समयधवष्ट होगी ।
(3) पर्ाटन/पयररधस्थधर्क पर्ाटन – (क) पयररधस्थधर्क संवेिी जोन के भीर्र धवद्यमयन सभी नए पयररधस्थधर्क दक्रर्यकलयप र्य पर्ाटन संबंिी दक्रर्यकलयप पयररधस्थधर्क संवेिी जोन के धलए पर्ाटन महयर्ोजनय के अनुसयर होंग ेजो दक आंचधलक महयर्ोजनय के भयग रूप में होगी । (ख) पयररधस्थधर्क पर्ाटन महयर्ोजनय पर्ाटन धवभयग, द्वयरय रयज्र् के पर्यावरण और वन धवभयग के परयमिा से र्ैर्यर होगी । (ग) पर्ाटन महयर्ोजनय आंचधलक महयर्ोजनय के एक टटक कय रूप होगी । (ट) पयररधस्थधर्क पर्ाटन संबंिी दक्रर्यकलयप धनम्नयनुसयर धवधनर्धमर् होंगे, अथयार् ् -
(i) वन्र्जीव अभर्यर्र् की सीमय से 1 दक. मी. के भीर्र र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क जो भी धनकट हो और वन्र्जीव अभर्यर्र् की सीमय से एक दक.मी. की िरूी से परे पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क नए होटलों र्थय ररसयटा कय संधनमयाण अनुज्ञयर् दकर्य जयएगय और नए होटलों र्थय ररसयटा की स्थयपनय केवल पर्ाटन महयर्ोजनय के अनुसयर पयररधस्थधर्क पर्ाटन सुधवियओं के धलए अभ्र्ंदकर् और नयमोर्िाष्ट क्षेत्रों में ही अनुज्ञयर् की जयएगी;
(ii) पयररधस्थधर्क संवेिी जोन के भीर्र सभी नए पर्ाटन दक्रर्यकलयपों र्य धवद्यमयन पर्ाटन दक्रर्यकलयपों कय धवस्र्यर कें रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् द्वयरय जयरी मयगाििाक धसद्धयंर्ों र्थय रयष्ट ट्रीर् व् र्यघ्र संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधस्थधर्क पर्ाटन मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधस्थधर्क पर्ाटन को महत्व II (ii) 5 िेर्े हुए होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ाटन के धलए धवकयस और धवद्यमयन पर्ाटन दक्रर्यकलयपों के धवस्र्यर को वयस्र्धवक स्थल धवधनर्िाष्ट संवीक्षय र्थय मयनीटरी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य जयएगय और पयररधस्थधर्क संवेिी जोन क्षेत्र में दकसी नए होटल र्य ररसयटा र्य वयधणधज्र्क स्थयपन संधन्नमयाण अनजु्ञयर् नहीं दकर्य जयएगय ।
(4) नसैर्गाक धवरयसर् -- पयररधस्थधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी स्थलों जैसे सभी जीन कोि आरधक्षर् के्षत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, टयटी मयगों, उपवनों, गुफयए,ं स्थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और र्थय उनकी परररक्षय और संरक्षय के धलए धवरयसर् संरक्षण र्ोजनय र्ैर्यर की जयएगी । ( ) मयनव धनर्मार् धवरयसर् स् थल - पयररधस् थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंस्कृधर्क महत्व के क्षेत्रों की पहचयन करनी होगी और उनके संरक्षण की र्ोजनओं के रुप में आंचधलक महयर्ोजनय र्ैर्यर की जयएगी ।
(6) ध् वधन प्रि ूण - पयररधस्थधर्क संवेिी जोन में ध् वधन प्रि ूण कय धनवयरण और धनर्ंत्रण पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986, के अिीन ध्वधन प्रि ूण (धवधनर्मन और धनर्ंत्रण) धनर्म 2000 के अनुसयर अनुपयलक दकर्य जयएगय ।
(7) वयर् ुप्रि ूण -- पयररधस्थधर्क संवेिी जोन में, वयर्ु प्रि ूण कय धनवयरण और धनर्ंत्रण वयर्ु (प्रि ूण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर अनुपयलन दकर्य जयएगय ।
(8) बधहस्रयव कय धनस्सयरण - पयररधस्थधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनस्सयरण पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986 और उसके अिीन बनयए गए धनर्मों के उपबंिों र्य रयज्र् सरकयर द्वयरय धनर्र् मयनकों के अन्र्गार् आन े वयले पर्यावरणीर् प्रि ूक र्त्वों के धनस्सयरण के सयियरण मयनकों के अनुसयर होगय ।
(9) ठोस अपधिष्ट - ठोस अपधिष्टों कय धनपटयन और प्रबंिन धनम्नधलधखर् रूप में होगय-- (क) पयररधस्थधर्क संवेिी जोन में ठोस अपधिष्ट ट धनपटयन र्थय प्रबंिन, ठोस अपधिष्ट प्रबंि धनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 13 7(अ), र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् दकए गए थे, के उपबंिों के अनुसयर दकर्य जयएगय ; और जैधवक सयमिी कय धनपटयन पयररधस्थधर्क संवेिी जोन के बयहर पहचयन दकए गए स्थल पर स्वीकयर्ा रीधर् में दकर्य जयएगय। (ख) पयररधस्थधर्क संवेिी जोन में ठोस अपधिष्ट टों को जलयनय र्य भष्ट मीकरण और भूधम भरयव के स्थयपनों को अनुज्ञयर् नहीं दकर्य जयएगय ।
(10) जवै धचदकत् सीर् अपधिष्ट ट- जैव धचदकत् सीर् अपधिष्ट ट प्रबंिन धनम्नधलधखर् रूप में होगय— (क) पयररधस्थधर्क संवेिी जोन में जैव धचदकत्सीर् अपधिष्टों कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 343 (अ), र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (ख) पयररधस्थधर्क संवेिी जोन में कोई सयमयन्र् उपचयर सुधविय र्य जलयर्य जयनय अनुज्ञयर् नहीं दकर्य जयएगय ।
(11) प्लयधस्टक अपधिष्ट प्रबिंन - पयररधस्थधर्क संवेिी जोन में प्लयधस्टक अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधस्टक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।

(13) ई–अपधिष्ट:- पयररधस्थधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् द्वयरय प्रकयधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) र्यनीर् पररवहन - पररवहन की र्यनीर् गधर् आवयस के अनुकूलन रीधर् द्वयरय धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धविे उपबंि समयधवष्ट दकए जयएंगे और आंचधलक महयर्ोजनय के र्ैर्यर होने र्क और रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होने र्क, मयनीटरी सधमधर् सुसंगर् अधिधनर्म र्थय र्ििीन बनयए गए धनर्मों और धवधनर्मों के अिीन र्यनीर् गधर् के अनुपयलन को मयनीटर करेगी ।
(15) र्यनीर् प्रि ूण - लयग ूधवधिर्ों के अनुसयर र्यनीर् प्रि ूण की रोकथयम और धनर्ंत्रण कय अनुपयलन दकर्य जयएगय और स्वच्छ ईंिन उियहरण के धलए सीएनजी, एलपीजी, आदि के उपर्ोग के धलए प्रर्यस दकए जयनें हजि ।
(16) औद्योधगक इकयइर्य ं - (i) सरकयरी रयजपत्र में इस अधिसूचनय के प्रकयिन के पर र्य उसके पियर् पयररधस्थधर्क संवेिी जोन के भीर्र दकसी नए प्रिधू र् उद्योगों की स्थयपनय की अनमुधर् नहीं िी जयएगी।
(ii) फरवरी, 2016 में कें रीर् प्रि ूण धनर्ंत्रण बोडा द्वयरय जयरी दिियधनिेिों में केवल गैर- उद्योगों के वगीकरण के अनुसयर, पयररधस्थधर्क संवेिी जोन के भीर्र केवल गैर प्रि ूणकयरी उद्योगों को र्ब र्क अनुज्ञयर् दकर्य जयएगय जब र्क दक इस अधिसूचनय में इस प्रकयर धवधनर्िाष्ट न हो और इसके अलयवय, गैर-प्रि ूणकयरी कुटीर उद्योगों को बढ़यवय दिर्य जयएगय।
(17) पहयडी ढलयनों कय सरंक्षण - पहयडी ढलयनों कय संरक्षण धनम्नयनुसयर होगय:
(क) आंचधलक महयर्ोजनय उन पहयडी ढलयनों पर क्षेत्रों को उपिर्िार् करेगी जहयं दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी । (ख) कटयव के एक उच्च धडिी के सयथ धवद्यमयन खडी पहयडी ढलयनों र्य ढलयनों पर दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी ।
(18) केन्रीर् सरकयर और रयज्र् सरकयर, र्दि र्ह आवर्क समझर्ी ह,ै इस अधिसूचनय के उपबंिों को प्रभयवी करने में अन्र् अधर्ररि उपयर् धवधनर्िाष्ट करेगी।
4. पयररधस्थधर्क संविेी जोन में प्रधर्ध द्ध और धवधनर्धमर् दकए जयन ेवयल ेदक्रर्यकलयपों की सचूी - पयररधस्थधर्क संवेिी जोन में सभी दक्रर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और र्टीर् धवधनर्मन जोन (सीआरजेड), 2011 और पर्यावरणीर् प्रभयव धनियारण (ईआईए) अधिसूचनय, 2006 और वन (संरक्षण) अधिधनर्म, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्म, 1927 (1927 के 16), वन्र्जीव (संरक्षण) अधिधनर्म, 1972 (1972 के 3) र्थय इनमें दकए गए संिोिनों सधहर् अन्र् लयग ू धवधिर्ों द्वयरय ियधसर् होंगे और नीचे िी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार् ्:-- सयरणी क्रम स.ं दक्रर्यकलयप टीकय-रटप्पणी क.प्रधर्ध द्ध दक्रर्यकलयप

(ख) खनन संदक्रर्यएं, मयननीर् उच्चर्म न्र्यर्यलर् की ररट र्यधचकय II (ii) 7 (धसधवल) सं. 1995 कय 202 टी.एन. गौडयबमान धथरुमूलपयि बनयम भयरर् सरकयर के मयमले में आिेि र्यरीख 4 अगस्र्, 2006 और ररट र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन बनयम भयरर् सरकयर के मयमल ेमें र्यरीख 21 अप्रैल, 2014 के अंर्ररम आिेि के अनुसयर की जयएगी ।
2. प्रि ूण (जल र्य वयर्ु र्य मिृय र्य ध् वधन) कयररर् करने वयले उद्योगों की स् थयपनय । पयररधस्थधर्क संवेिी जोन में दकसी भी नए र्य प्रि ूण फैलयने वयल े उद्योगों के धवस्र्यर की अनुमधर् नहीं िी जयएगी । केन्रीर् प्रि ूण धनर्ंत्रण बोडा वगीकरण में हररर् र्य श्वेर् के रूप में वगीकृर् उद्योग धजनमें कृध आियररर् लटु उद्योग भी हजि, धवधनर्मों के अनुसयर धवधनर्धमर् दकए जयएगंे।
3. बृहर् जल धवदु्यर् पररर्ोजनय की स् थयपनय । लयग ूधवधिर्ों के अनुसयर प्रधर्ध द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंग े।
4. दकसी पररसंकटमर् पियथों कय उपर्ोग र्य उत्पयिन । लयग ूधवधिर्ों के अनुसयर प्रधर्ध द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंग े।
5. प्रयकृधर्क जल धनकयर्ों र्य भूधम के्षत्र में अनपुचयररर् बधहस्रयवों कय धनस्सयरण । लयग ूधवधिर्ों के अनुसयर प्रधर्ध द्ध (अन् र्थय उपबंधिर् के धसवयर्) होंग े।
6. फमों, कॉरपोरेट कंपधनर्ों, कंपधनर्ों द्वयरय बडे पैमयने पर वयधणधज्र्क पिुिन और कुसकुट फयमों की स्थयपनय । स्थयनीर् आवर्कर्यओं को पूरय करने के धलए लयग ूधवधिर्ों के अनुसयर प्रधर्ध द्ध (र्थय अन् र्थय उपबंधिर् के धसवयर्) होंगे अन्र्थय नहीं।
7. नई आरय धमलों की स्थयपनय। पयररधस्थधर्क संवेिी जोन के भीर्र नई र्य धवद्यमयन आरय धमलों कय धवस् र्यर अनुज्ञयर् नहीं होगय । ख.धवधनर्धमर् दक्रर्यकलयप
8. होटलों और ररसोटों की स्थयपनय । पयररधस्थधर्क पर्ाटन दक्रर्यकलयपों के धलए अस्थयर्ी लट ु संरचनयओं के धलए संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर र्क र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क, इनमें जो भी धनकट ह,ै नए वयधणधज्र्क होटल और ररसोटा अनजु्ञयर् होंग,े अन्र्थय नहीं । परंर्,ु संरधक्षर् जोन की सीमय से र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क एक दकलोमीटर से ज्र्यिय ह,ै जो भी धनकट ह ैवहयाँ सभी नए पर्ाटक दक्रर्यकलयप र्य धवद्यमयन दक्रर्यकलयप कय धवस्र्यर पर्ाटन महयर्ोजनय और र्थय लयग ूमयगाििी धसद्धयंर्ों के अनरुुप होगय।
9. संधनमयाण दक्रर्यकलयप । (क) संरधक्षर् क्षेत्र की सीमय से एक दकलोमीटर के भीर्र र्य पयररधस्थधर्क संवेिी जोन के धवस्र्यर र्क जो भी धनकट हो, दकसी भी प्रकयर कय वयधणधज्र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय परंर् ु स् थयनीर् लोगों को पैरय 6 के उप पैरय (1) में सूचीबद्ध दक्रर्यकलयपों सधहर् उनके उपर्ोग के धलए उनकी भूधम में संधनमयाण करन े की अनुमधर् स्थयनीर् धनवयधसर्ों की आवयसीर् आवर्कर्यओं को परूय करने के धलए भवन उपधवधिर्ों के अनुसयर िी जयएगी, जैसे ।
(i) धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय र्थय नई सडकों कय संधनमयाण;
(ii) अवसंरचनय और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;

(iii) प्रि ूण उत्पन्न न करने वयल ेलट ुउद्योग;
(iv) कुटीर उद्योगों धजसके अंर्गार् ियमीण उद्योग हजि; सुधवियजनक भ्डयरों और स्थयनीर् सुख सुधवियओं, जो पयररधस्थधर्क पर्ाटन धजसमें िह वयस भी ह,ै सहयर्क हो; और
(v) इस अधिसूचनय में संवर्िार् दक्रर्यकलयपों की सूची परन्र्ु र्ह और दक ऐसे लटु उद्योगों जो प्रि ूण उत् पन् न नहीं करर्े हजि, से संबंधिर् संधनमयाण दक्रर्यकलयप धवधनर्धमर् दकए जयएंगे और लयगू धनर्मों और धवधनर्मों, र्दि कोई हों, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुमधर् से ही न् र्ूनर्म पर रखे जयएंगे । (ख) र्े एक दकलोमीटर से आग े आंचधलक महयर्ोजनय की अनुसयर धवधनर्धमर् होंगे ।
10. प्रि ूण उत्पन्न न करन े वयल े लट ु उद्योग । पयररधस् थधर्क संवेिी जोन से गरै प्रि ूण, गैर पररसंकटमर्, लटु और सेवय उद्योग कृध , पुष्ट प कृध , उद्ययन कृध , र्य कृध आियररर् उद्योग िेिीर् मयल से औद्योधगक उत्पयिों कय उत्पयिन उद्योग और जो पर्यावरण पर कोई प्रधर्कूल प्रभयव नहीं डयलर्े हजि, अनुज्ञयर् होंगे ।
11. ईंट भट्टों की स्थयपनय करनय। लयग ूधवधिर्ों के अनुसयर धवधनर्धमर् (अन् र्थय उपबंधिर् के धसवयर्) होंग े ।
12. वृक्षों की कटयई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन, सरकयरी र्य रयजस्व र्य धनजी भूधम पर र्य वनों में ककंही वृक्षों की कटयई नहीं होगी । (ख) वृक्षों की कटयई, संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर धवधनर्धमर् होगी ।
13. वन उत्पयिों और गैर कयष्ट ठ वन उत्पयिों कय संिहण । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
14. धवदु्यर् और िरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और अन्र् अवसंरचनय। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । भूधमगर् केबल धबछयए जयन े को बढ़यवय दिर्य जयएगय।
15. अवसंरचनय और नयगररक सुधवियओं कय संधनमयाण और नवीकरण। न्र्ूनीकरण की उपयर्ों के सयथ, लयग ू धवधिर्ों धनर्म और धवधनर्धमर् दकए जयएंगे और उपलब्ि दिियधनिेि के अनुसयर दकए जयएंग े।
16. धवद्यमयन सडकों को चौडय करनय और उन्हें सुिढृ करनय र्थय नई सडकों कय संधनमयाण। न्र्ूनीकरण की उपयर्ों के सयथ, लयग ू धवधिर्ों धनर्म और धवधनर्धमर् दकए जयएंगे और उपलब्ि दिियधनिेि के अनुसयर दकए जयएंग े।
17. गमा वयर्ु गुब्बयरें, हलेीकयप्टर, ड्रोन, मयइक्रोलयइटस और अन्र् पर्ाटन दक्रर्यकलयप से संबंधिर् पयररधस्थधर्क संवेिी जोन क्षेत्र के बपर से उडनय जैसे दक्रर्यकलयप करनय। लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
18. पहयडी ढयलों और निी र्टों कय संरक्षण । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
19. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयग ूधवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंग े।
20. स्थयनीर् समुियर्ों द्वयरय चल रही कृध और बयगवयनी प्रथयओं के सयथ स्थयनीर् लोगों के उपर्ोग के धलए लयग ूधवधिर्ों के अिीन अनुज्ञयर् होंग े। II (ii) 9 पिुपयलन, जलकृध , पिपुयलन कृध और मछली पयलन ।
21. प्रयकृधर्क जल धनकयर्ों र्य सर्ही के्षत्र में उपचयररर् बधहस्रयाव कय धनस्सयरण । लयगू धवधिर्ों के अनुसयर उपचयररर् बधहस्रयाव के धनस्सयरण को धवधनर्धमर् दकर्य जयएगय।
22. सर्ह और भूजल के वयधणधज्र्क धनष्टक ाण । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
23. खुले कुआ, बोर कुआ, आदि के धलए कृध और अन्र् उपर्ोग । धवधनर्धमर् और उपर्िु प्रयधिकयरी द्वयरय दक्रर्यकलयपों की सख्र्ी से मयनीटरी की जयएगी।
24. ठोस अपधिष्ट ट प्रबंिन। लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े। 2 . धविेिी प्रजयधर्र्ों को लयनय। लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
26. पयररधस्थधर्क पर्ाटन। लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।
27. पोधलथीन बैगों कय उपर्ोग । लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंग े।

(3) ऐसे दक्रर्यकलयप जो भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची के अरं्गार् आर् ेहजि और इस अधिसूचनय के पैरय 4 के अिीन सयरणी में र्थयधवधनर्िाष्ट प्रधर्ध द्ध दक्रर्यकलयपों के धसवयर् पयररधस्थधर्क संवेिी जोन में आर्े हजि वयस्र्धवक धवधनर्िाष्ट स्थलीर् िियओं पर आियररर् मयनीटरी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण अनयपधत्त के धलए केन्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी ।
(4) ऐसे दक्रर्यकलयपों, धजन्ह े भयरर् सरकयर के र्त्कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ.

(5) मयनीटरी सधमधर् कय सिस्र्-सधचव र्य संबद्ध कलसटर र्य संबद्ध पयका कय उप वन संरक्षक ऐसे व्यधि के धवरूद्ध, जो इस अधिसूचनय के दकसी उपबंि कय उल्लटंन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि फयइल करन ेके धलए सक्षम होगय ।
(6) मयनीटरी सधमधर् मुद्दय िर मुद्दय के आियर पर अपेक्षयओं पर धनभार रहर् ेहुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविे ज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधिर्ों को अपने धवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।

8. कोई अन् र् महत् वपूणा धव र् । 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 15 th May, 2017 S.O. 1564(E).— Whereas, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 142 (E), dated the 13 th January 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And Whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
And whereas, the talacauvery wildlife sanctuary situated in western side of Kodagu District, in the state of Karnataka lies between North Latitudes 12 0 17’ 14” to 12 0 26’ 38” and the East Longitudes 75 0 25’ 23” to 75 0 33’ 15” notified vide 173 87 (I) dated 31 st August, 1987 under the provisions of the sub-section (1) of section 18 of the Wildlife (Protection) Act, 1972 is spread over an area of 105.59 square kilometres;
And whereas, the Talacauvery Wildlife Sanctuary forming the core of Western Ghats is characterised by rugged terrain with more than 85% of the sanctuary area having very steep slope of more than 35%, high rainfall ranging between 6000 mm to 7000 mm. rich biodiversity, high rate of endemism and home for critically endangered and endangered species such as Tiger (Panthera tigris), Asiatic Elephant (Elephas maximus), Malabar Civet (Viverra civettina), Gaur or Indian Bison (Bos gaurus), Sambar (Rusa unicolor), and Barking Deer (Muntiacus muntjak), Lion Tailed Macaque (Macaca silenus), Slender Loris (Loris lydekkerianus), Brown Palm Civet (Paradoxurus jerdoni), Leopard Cat, Nilgiri Marten (Martes gwatkinsii), Wild Dog (Cuon alpines), Otter (Lutra perspicillata), Travancore Flying Squirrel (Petinomys fuscocapillus) and others and wildlife includes King Cobra (Ophiophagus Hannah), Indian Rock Python (Python molurus molurus), etc;
And whereas, the sanctuary has been identified as one of the important bird areas in the Western Ghats as 13 of the 16 endemic birds of the Western Ghats are found here such as Malabar Banded Peacock, Paris Peacock, Malabar Raven, and Malabar Banded Swallowtail Malabar Pied Hornbill (Anthracoceros coronatus), Malabar Grey Hornbill (Ocyceros griseus), Malabar Trogon (Harpactes fasciatus), Malabar Whistling Thrush (Myophonus horsfieldii), Wyanaad Laughing Thrush (Garrulax delesserti), White-bellied Tree-pie (Dendrocitta leucogastra), Orange and Black Fly catcher (Muscicapa nigrorufa) and Nilgiri Fly catcher (Muscicapa albicaudata) and the sanctuary also harbours endemic and endangered Papilionid butterflies.
And whereas, the sanctuary being surrounded by many reserve forests like Patti Ghat and Padinalknadu reserved forests, the sanctuary provides extended habitat for large mammalia like Asiatic Elephant and Tiger and forms part of the Mysore Elephant Reserve declared under the Project Elephant and the said sanctuary acts as an important corridor for large mammals to move between the Nagarahole National Park and Talacauvery Wildlife Sanctuary State of in Karnataka and Wayanad and Aralam Wildlife Sanctuaries in Kerala State;
And whereas, this protected area is catchment for river Cauvery which originates from Talacauvery and the sanctuary also acts as an important catchment area for Perennial streams like Dodda Hole, Nadumale Hole, Betemale Hole, Kume Kolli and Mundra Hole which depicts the importance of eco-system services offered by the Talacauvery Wildlife Sanctuary;
And whereas, it is necessary to conserve and protect the geographical area around the protected area of the Talacauvery Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
Now therefore, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1 kilometer to 16 kilometers around the boundary of Talacauvery Wildlife Sanctuary in the State of Karnataka except along the side where it shares the border with the State of Kerala where it is zero km as the Talacauvery Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The total geographical area of Eco-sensitive Zone is 213.07 square kilometers with an extent varying from 1 to 16 kilometres around the boundary of the Talacauvery Wildlife Sanctuary, except along the side where it shares the border with the State of Kerala where it is zero km and the boundary description of the Eco-sensitive Zone is given in Annexure – I.

(2) The map of the Eco-sensitive Zone boundary together with latitudes longitudes is appended as Annexure II.
(3) The Geo Coordinates of major points on the boundary of the Talacauvery Wildlife Sanctuary and on the boundary of Eco-sensitive Zone is appended as Annexure-III.
(4) The list of villages and the details of reserved forest areas falling within the Eco-sensitive Zone is given at Annexure- IV.
2. Zonal Master Plan for the Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse:-
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Ecosensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under relevant state laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under relevant state laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above referred correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs, rivers, channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.-
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority with emphasis on eco-tourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b)No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:-
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.
(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016,.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.

(13) E-waste.- The E-Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description A. Prohibited Activities
1. Commercial Mining.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.).
No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
Industries categorised as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries, will be regulated as per regulations.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws II (ii) 21
6. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
B. Regulated Activities
8. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
9. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 4 as per building byelaws to meet the residential needs of the local residents such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including homestays; and
(v) promoted activities listed in this notification.
Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10. Small scale industries not causing pollution.
Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
11. Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws.
12. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
13. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.

16. Widening and strengthening of existing roads and construction of new roads.

17. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

18. Protection of Hill Slopes and river banks.

19. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
21. Discharge of treated effluents in natural water bodies or land area.
The discharge of treated effluent shall be regulated as per applicable laws.
22. Commercial extraction of surface and ground water.
Regulated under applicable law.
23. Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
24. Solid Waste Management. Regulated under applicable laws.
25. Introduction of Exotic species. Regulated under applicable laws.
26. Eco-tourism. Regulated under applicable laws.
27. Use of polythene bags. Regulated under applicable laws.
28. Commercial Sign boards and hoardings.
Regulated under applicable laws.
C. Promoted Activities
29. Rain water harvesting. Shall be actively promoted.
30. Organic farming. Shall be actively promoted.
31. Adoption of green technology for all activities.
Shall be actively promoted.
32. Cottage industries including village artisans, etc.
Shall be actively promoted.
33. Use of renewable energy. Bio gas, solar light etc. to be actively promoted.
34. Agro-Forestry. Shall be actively promoted.
35. Skill Development. Shall be actively promoted.
36. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
37. Environmental Awareness. Shall be actively promoted.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
(1) Regional Commissioner, Mysore – Chairman
(2) Hon’ble Member of Legislative Assembly, Madikeri Constituency, Kodagu District – Member
(3) Representative of the Department of Environment, Government of Karnataka – Member
(4) Representative of the Department of Urban Development, Government of Karnataka –Member
(5) Representative of Non-governmental Organizations working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Karnataka– Member
(6) The Regional Officer, Karnataka State Pollution Control Board, Mysore – Member
(7) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka– Member
(8) Deputy Commissioner or his representative, Kodagu District, Madikeri – Member
(9) Member, State Biodiversity Board-Member
(10) The Deputy Conservator of Forests, Madikeri Wildlife Division, Madikeri – Member-Secretary.
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Committee shall be three years.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
