PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1383] No. 1383] NEW DELHI, MONDAY, MAY 15, 2017/VAISAKHA 25, 1939 पययावरण, वन और जलवयय ुपररवतान मतं्रयलय ऄधधसचूनय नइ ददल्ली, 8 मइ, 2017 कय.अ. 1566(ऄ).—प्रयरुप ऄधधसूचनय, भयरत के रयजपत्र, ऄसयधयरण में भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय संखययंक कय.अ. 3230 (ऄ), तयरीख 26 नवम्बर, 2015, को प्रकयधतत की गइ थी, धजसमें ईन सभी व्यधियों से धजनके ईससे प्रभयधवत होने की संभयवनय थी, ईस तयरीख से, धजसको भयरत के रयजपत्र में प्रकयधतत ऄधधसूचनय की प्रधतययं जनतय को ईपलब्ध करयइ गइ थीं, सयठ ददन की ऄवधध के भीतर अक्षेप और सुझयव अमंधत्रत दकए गए थ;े और, प्रयरुप ऄधधसूचनय के ईत्तर में दकसी व्यधि और पणधयरी से कोइ अक्षपे और सुक्षयव प्रयप्त नहीं हुए थे;
और, रोवय वन्यजीव ऄभययरण्य, 13 जुलयइ, 1988 को वन्यजीव संरक्षण ऄधधधनयम, 1972 (1972 कय 53) की धयरय 18 की ईपधयरय (1) के ऄधीन ऄधधसूचनय सं. एफ. 8 (67)/फयर-डब्ल्यूएल/88/26,948/तयरीख 13 जुलयइ, 1988 के द्वयरय घोधित दकयय गयय और वन्यजीव संरक्षण ऄधधधनयम, 1972 की धयरय 26-ए कय खंड (ख) के ऄधीन वन धवभयग, धत्रपुरय सरकयर की ऄधधसूचनय सं. एफ.8 (67)/फयर-डब्ल्यूएल/2008/2,253/तयरीख 7 मइ, 2009 द्वयरय 85.85 हके्टेयर से धमलकर बने क्षेत्र को रोवय वन्यजीव ऄभययरण्य के रुप में ऄधधसूधचत दकयय गयय ह;ै और, ऄभययरण्य की पुष्प धवधवधतय फूलों की छत के टययरों में ऄधद्वतीय और ऄच्छी तरह से धवतररत की जयती ह ै और जडी-बूरटयों, झयधडयों पवातयरोही और पडेों की प्रजयधतयों की बडी दकस्मों में पययय जयतय ह ैदक ऄभययरण्य में औिधीय मूल्य और ईनकी प्रमुख प्रजयधतययं हैं, जो संघ में होने वयली होती हैं चैंधपयन और सेठ वगीकरण के ऄनुसयर नम पणापयती और ऄधा सदयबहयर जंगल वयलय ऄभययरण्य, ऄकौलररअमयलयकनसीज़ (ऄगयर-वेनयाकूलर), दफक्सस्पेकीआस (बॉट और ऄन्य वेनयाकूलर), होलयररेहने्नयधतदसेंनटेररकय (कूरछय-वनयाकूलर),टमयररनदधूसनधडकय (टेटूल—वेनयाकूलर),टरधमनेधलऄचेबुलय 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (हररतयकी-वेनयाकूलर), धवटेक्पेनदकूुलररस (ऄवल-वेनयाकूलर), ऄलधबधजऄपरोकेरय (करयइ-वेनयाकूलर), जेधमधलन्नयरबोरेऄ (गयमयआर-वेनयाकूलर), ऄरतोकरपूसचेपलयस (चेमल-वेनयाकूलर), धडपतेरोक्यूरपूसजनरधबनयटस (गयमयआर-वेनयाकूलर), ससनोमेटरयपूलयन्र (सपग- वेनयाकूलर),बोमबयक्सधसआबय (धसमूल-वेनयाकूलर), टरधमनयधलऄजुानय (ऄजुान-वनयाकूलर), एगलेमयरमेलोस (बेल-वनयाकूलर), धससीधगयमकुधमन्नी (जेम-वनयाकूलर), जैसे एक संघ महत्वपूणा धनवयसी और प्रवयसी पक्षी अबयदी की एक धवतयल धवधवधतय कय समथान ह;ै और, रोवय वन्यजीव ऄभययरण्य बमबूसयबयलकौअ (बरयक), बमबूसयटूलडय, बमबूसयवलगुररस, बमबूसयकयचरेनधसस (पयईरय), बमबूसयकोधमल्लेआनधसस, मेलोकनयबयक्कफेरय (मुधलल), डे्रडरूकयलयमूसलोनधगसपथेस, जैसे बयंस की धवधतष्टतयओं में प्रजयधतयों की धवधवधतय में समृद्ध ह;ै और, ऄभययरण्य में भूधम के वनस्पधतयों कय धविम धमश्रण धवधभन्न मोनोकॉट्स और धडकट्स, जडी बूटी, झयधडयों, पवातयरोधहयों, फना फैन सहयोधगयों और भूधमगत बल्बों और रहीज़ोम के पुनजान्म के बीच 0.70 से 0.80 कय घनत्व बदलतय ह ै और वन्यजीव ऄभययरण्य में धनम्न ऄनुसूची-I पत ुजैसे तमयतय बंदर, तेंदएु धबल्ली, गंगय नरम कछुअ, पययथन, पहयडी मनैय को देखय गयय ह;ै और, नम भूधम लेसर धहहसस्लग टील जैसे प्रवयसी पधक्षयों के धलए प्रमुख तीतकयलीन पययावयस ह ैऔर 2006 की सर्ददयों में पक्षी प्रजयधतयों के 100 झंुड तथय 2007 में 86 झंुड देखे गए धजनमें बयबेट (कैधपटोनयआडेट), बुलबुल (धपकनोनोटयआडेट), कोयल (कुकुधलडी), बयंकर (फयलयकरोक्यूरयधसडी), डव तथय कबूतर (कोलुमबयआडी), ड्रोन्गोस (डयआकू्रररडी), बत्तख (ऄनयटयआडी), पीलक (ओररयोलयआडी), ईल्लू (स्रयआधत्रडी), परैयकीटस (धसट्टयसयआडी), तीतर (फयधसअधनडी), तकरखोर (नके्टयररनीडी), कठफोडवय (धपधसडी), बययय बयय के पक्षी (प्लोधसटी), री पयइ (कॉबयआडी) और मैनय (स्टूनयआडी) तयधमल हैं;
और, रोवय वन्यजीव ऄभययरण्य, के चयरों ओर के क्षेत्र को, धजसकय धवस्तयर और सीमयएं आस ऄधधसूचनय के परैय 1 में धवधनर्ददष्ट हैं, पययावरण की दधृष्ट से पयररधस्थधतक संवेदी जोन के रूप में सुरधक्षत और संरधक्षत करनय तथय ईि पयररधस्थधतक संवेदी जोन में ईद्योगों यय ईद्योगों के वगों कय प्रचयलन तथय प्रसंस्करण करन ेको प्रधतधिद्ध करनय अवश्यक ह ै;
ऄतः, ऄब, केन्रीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) के सयथ परठत पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की और ईपधयरय (1) और ईपधयरय (3) ईपधयरय (2) के खंड (v) और खंड (xiv) द्वयरय प्रदत्त तधियों कय प्रयोग करत ेहुए, धत्रपरुय रयज्य में रोवय वन्यजीव ऄभययरण्य, की सीमय से 10 मीटर से 100 मीटर तक धवस् ततृ क्षेत्र को रोवय वन्यजीव ऄभययरण्य, पयररधस् थधतक संवेदी जोन (धजसे आसमें आसके पश् चयत् पयररधस् थधतक संवेदी जोन कहय गयय ह)ै के रूप में ऄधधसूधचत करती ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै ऄथयात् :--
1. पयररधस्थधतक सवंदेी जोन कय धवस्तयर और ईसकी सीमयए-ं- (1) पयररधस् थधतक संवेदी जोन कय धवस्तयर रोवय वन्यजीव ऄभययरण्य की सीमय 10 मीटर से 100 मीटर तक ह ैऔर पयररधस् थधतक संवेदी जोन कय क्षेत्र 62.75 एकड ह ै
(2) पयररधस्थधतक संवेदी जोन की सीमय ईपयबधं I के रुप में ईपयबद्ध ह ै
(3) पयररधस्थधतक संवेदी जोन के मयनधचत्र के सयथ आसके ऄक्षयतं और देतयन्तर ईपयबधं II के रुप में ईपयबद्ध ह ै
(4) पयररधस्थधतक संवेदी जोन के धनदेतयंक और आसके ऄक्षयंत और दतेयंतर ईपयबधं III के रुप में ईपयबद्ध ह ै
(5) पयररधस्थधतक संवेदी जोन के भीतर अन े वयल े ग्रयम चमटीलय, रोवय, डेवनेरय, दधक्षणी पदमयधबल (भयग) और रयमनगर (भयग) II (ii) 3
2. पयररधस्थधतक सवंदेी जोन के धलए अचंधलक महययोजनय – (1) रयज्य सरकयर, पयररधस्थधतक संवेदी जोन के प्रयोजन के धलए रयजपत्र में ऄधधसूचनय के प्रकयतन की तयरीख से दो विा की ऄवधध के भीतर, स्थयनीय व्यधियों के परयमता से और रयज्य सरकयर में सक्षम प्रयधधकयरी के ऄनुमोदन के धलए आस ऄधधसूचनय में संलग् न ऄनुबंधों के सयमंजस् य से अंचधलक महययोजनय तैययर करेगी
(2) पयररधस् थधतक संवेदी जोन के धलए अचंधलक महययोजनय आस ऄधधसूचनय में धवधनर्ददष् ट रूप रयज्य सरकयर द्वयरय ऐसी रीधत में तथय सुसंगत कें रीय और रयज् य धवधधयों के सयमंजस् य में भी और कें रीय सरकयर द्वयरय जयरी मयगाधनदेतों, यदद कोइ हों, द्वयरय तैययर होगी
(3) अंचधलक महययोजनय, पययावरणीय और पयररधस्थधतक धवचयरों को समयकधलत करन ेके धलए रयज् य सरकयर के सभी संबद्ध धवभयगों के परयमता से तयैयर होगी, ऄथयात्:--
(i) पययावरण;
(ii) वन और वन्यजीव;
(iii) कृधि ;
(iv) रयजस् व;
(v) नगर धवकयस;
(vi) पयाटन;
(vii) ग्रयमीण धवकयस;
(viii) ससचयइ और बयढ़ धनयंत्रण;
(ix) नगरपयधलकय;
(x) पंचययती रयज;
(xi) लोक धन मयाण धव भयग
(4) अंचधलक महययोजनय ऄनुमोददत धवद्यमयन भू-ईपयोग, ऄवसंरचनय और दक्रययकलयपों पर कोइ धनबंधन ऄधधरोधपत नहीं करेगी जब तक दक आस ऄधधसूचनय में धवधनर्ददष् ट न हो और अचंधलक महययोजनय सभी ऄवसंरचनय और दक्रययकलयपों में और ऄधधक दक्षतय और पयररधस्थधतक ऄनुकूलतय कय संवधान करेगी
(5) अंचधलक महययोजनय में ऄनयच्छयददत क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदय और नमी संरक्षण, स्थयनीय समुदययों की अवश्यकतयओं तथय पयररधस्थधतक और पययावरण से संबंधधत ऐसे ऄन्य पहलओूं, धजन पर ध्ययन दनेय अवश्यक ह,ै के धलए ईपबंध होंगे
(6) अंचधलक महययोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमों और नगरीय बंदोबस्तों, वनों के प्रकयर और दकस् मों, कृधि क्षेत्रों, उपजयउ भूधम, हररत क्षते्र जैसे ईद्ययन और ईसी प्रकयर के स् थयन, ईद्ययन कृधि क्षेत्र, फलोईद्ययन, झीलों और ऄन्य जल धनकययों कय ऄभ्यकंन करेगी और आस योजनय के मयनधचत्र द्वयरय धवद्यमयन और प्रस्तयधवत भूधम के ईपयोग कय धववरण दकयय जयएगय
(7) अंचधलक महययोजनय पयररधस्थधतक संवेदी जोन में धवकयस को धवधनयधमत करेगय और सयरणी में सूचीबद्ध प्रधतधिद्ध, धवधनयधमत दक्रययकलयपो को और स् थयनीय समुदययों की जीवकोपयजान को सुधनधश् चत करने के धलए, पयररधस्थधतक संवेदी जोन में धवकयस को सुधनधित करनय और बढ़यवय देनय भी ह ै 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(8) अंचधलक महययोजनय क्षेत्रीय धवकयस योजनय के सयथ सह-ऄंतक होगी
(9) अंचधलक महययोजनय आस ऄधधसूचनय में ददए गए ईपबंधों के संबंध में ऄपन ेकययों के बयहर ले जयने के धलए धनगरयनी सधमधत के धलए एक संदभा दस्तयवेज तैययर करेगी
3. रयज्य सरकयर द्वयरय दकए जयन े वयल े ईपयय-- रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी करन े के धलए धनम्नधलधखत ईपयय करेगी, ऄथयात्:--
(1) भू-ईपयोग – (क) पयररधस् थधतक संवेदी जोन में वनों, ईद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, अमोद-प्रमोद के प्रयोजन के धलए धचधन्हत दकए गए पयकों और खुले स्थयनों कय वयधणधज्यक और औद्योधगक संबद्ध धवकयस दक्रययकलयपों के धलए ईपयोग यय संपररवतान नहीं होगय :
परंतु पयररधस्थधतक संवेदी जोन के भीतर कृधि भूधम कय संपररवतान मयनीटरी सधमधत की धसफयररत पर और रयज्य सरकयर के पूवा ऄनुमोदन से, क्षेत्रीय नगर योजनय ऄधधधनयम के ऄधीन सक्षम प्रयधधकयरी के पूवा ऄनुमोदन के सयथ और केन्रीय/रयज्य सरकयर के ऄन्य धनयमों और धवधनयमों के रूप में लयग ूहोंगे, जो स्थयनीय धनवयधसयों की अवयसीय जरूरतों को पूरय करने के धलए ह,ै जैसे:-
(i) धवद्यमयन सडकों को चौडय करनय और ईन्हें सुदढृ़ करनय तथय नइ सडकों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) प्रदिूण ईत्पन्न न करन ेवयले लघ ुईद्योग;
(iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण कयरीगर हैं; सुधवधयजनक भण्डयर और स्थयनीय सुधवधयओं सहययक पयररधस्थधतक पयाटन में सधम्मधलत गृह वयस; और
(v) संवर्धधत दक्रययकलयप और परैय 4 के ऄधीन ददयय गयय ह:ै परंत ुयह और भी दक क्षेत्रीय नगर योजनय ऄधधधनयम और ऄन्य धनयमों और धवधनयमों के ऄधीन रयज्य सरकयर के पूवा ऄनुमोदन तथय संधवधयन के ऄनचु्छेद 244 और तत्समय प्रवृत्त धवधध के ईपबंधों के ऄनुपयलन के धबनय, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄन्य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मयन्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी ह,ै वयधणधज्यक यय ईद्योग धवकयस दक्रययकलयपों के धलए जनजयतीय भूधम कय ईपयोग ऄनुज्ञयत नहीं होगय:
परंतु यह और भी दक पयररधस् थधतक संवेदी जोन के भीतर भू-ऄधभलेखों में ईपसंजयत कोइ तु्ररट, मयनीटरी सधमधत के धवचयर प्रयप्त करन ेके पियत् रयज्य सरकयर द्वयरय प्रत्येक मयमल ेमें एक बयर संतोधधत होगी और ईि तु्ररट के संतोधन की सूचनय कें रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को दनेी होगी :
परंतु यह और भी दक ईपयुाि तु्ररट कय संतोधन में आस ईप पैरय के ऄधीन यथय ईपबंधधत के धसवयय दकसी भी दतय में भू-ईपयोग कय पररवतान सधम्मधलत नहीं होगय वनरोपण और प्रयकृधतक वयस पुन:वयपसी दक्रययकलयपों सधहत और ऄनप्रयुक् त यय ऄनुत् पयदक कृधि क्षेत्रों में पुन:
वनीकरण करने के प्रययस दकए जयएंगे
(2) प्रयकृधतक जल स्रोत -- अचंधलक महययोजनय में सभी प्रयकृधतक जल स्रोतों/नदी/नयली की पहचयन की जयएगी और ईनके संरक्षण और पनुरुद्भूतकरण के धलए योजनय अंचधलक महययोजनय में सधम् मधलत होगी
(3) पयाटन/पयररधस्थधतक पयाटन – (क) पयररधस्थधतक संवेदी जोन के भीतर सभी नए पयररधस्थधतक पयाटन दक्रययकलयपों यय धवद्यमयन पयाटन दक्रययकलयपों कय धवस्तयर दक्रययकलयप पयाटन महययोजनय के ऄनुसयर होंग े (ख) पयररधस्थधतक पयाटन महययोजनय पयाटन धवभयग द्वयरय पययावरण और वन धवभयग के परयमता से तैययर होगी II (ii) 5 (ग) पयाटन महययोजनय अंचधलक महययोजनय के एक घटक के रूप में जयनय जययेगय (घ) पयाटन संबंधी दक्रययकलयप धनम् नधलधखत के ऄधीन धवधनयधमत होंग,े ऄथयात ्:-
(i) वन्य जीव ऄभययरण्य की सीमय से एक दकलोमीटर के भीतर यय पयररधस्थधतक संवेदी जोन के धवस्तयर तक आनमें जो भी धनकट ह,ै नये वयधणधज्यक होटल और ररसोटा ऄनजु्ञयत नहीं होंगे परंतु, जहयाँ पयररधस्थधतक संवेदी जोन कय धवस्तयर वन्यजीव ऄभययरण्य की सीमय से एक दकलोमीटर से ज्ययदय ह ै वहयाँ, एक दकलोमीटर से परे और पयररधस्थधतक संवेदी जोन के धवस्तयर तक नए होटलों और ररसोटो की स्थयपनय पयाटन दक्रययकलयपों के धलए पूवा पररधनधित और ऄधभधहत क्षेत्रों में केवल पयाटन महययोजनय के ऄनुसयर ऄनुज्ञयत होगय;
(ii) पयररधस्थधतक संवेदी जोन के भीतर सभी नए पयाटन दक्रययकलयपों यय धवद्यमयन पयाटन दक्रययकलयपों कय धवस्तयर कें रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय के मयगादताक धसद्धयंतों के द्वयरय तथय रयष् रीय ह ययघ्र संरक्षण प्रयधधकरण, द्वयरय जयरी पयररधस्थधतक पयाटन मयगादताक धसद्धयंतों के ऄनुसयर, पयररधस्थधतक पयाटन, को महत्व देनय होगय;
(iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयने तक, पयाटन के धलए धवकयस और धवद्यमयन पयाटन दक्रययकलयपों के धवस्तयर को वयस्तधवक स्थल धवधनर्ददष्ट संवीक्षय तथय मयनीटरी सधमधत की धसफयररत पर अधयररत संबंधधत धवधनययमक प्रयधधकरणों द्वयरय पयररधस्थधतक संवेदी जोन के भीतर कोइ नए होटल/ ररसोटा यय वयधणधज्यक स्थयपनय कय संधनमयाण ऄनजु्ञयत होगय
(4) नसैर्धगक धवरयसत -- पयररधस्थधतक संवेदी जोन में महत्वपूणा नैसर्धगक धवरयसत के सभी स्थलों जैसे सभी जीन कोत अरधक्षत क्षेत्र, तैल धवरचनयएं, जल प्रपयतों, झरनों, घयटी मयगों, ईपवनों, गुफयए,ं स्थलों, भ्रमण, ऄश्वरोहण, प्रपयतों परंपरयगत सुरक्षय योजनय ईनकी सुरक्षय और संरक्षय अदद की पहचयन की जयएगी और योजनय अंचधलक महययोजनय कय भयग होगय
(5) मयनव धनर्धमत धवरयसत स् थल - पयररधस् थधतक संवेदी जोन में भवनों, संरचनयओं, धतल्प-तथ्य, ऐधतहयधसक, कलयत्मक और सयंस्कृधतक महत्व के क्षेत्रों की पहचयन करनी होगी और ईनके संरक्षण की योजनयएं तैययर करनी होगी तथय अंचधलक महययोजनय में सधम्मधलत की जयएगी
(6) ध् वधन प्रदिूण -- पयररधस्थधतक संवेदी जोन में ध् वधन प्रदिूण के धनयंत्रण के धलए रयज् य सरकयर कय पययावरण धवभयग यय रयज् य प्रदिूण धनयंत्रण बोडा ध्वधन प्रदिूण (धवधनयमन और धनयंत्रण) धनयमों के ऄनुसयर पययावरणीय (संरक्षण) ऄधधधनयम, 1986, 2000 ऄतंगात तैययर करेगय
(7) वयय ुप्रदिूण -- पयररधस्थधतक संवेदी जोन में, वययु प्रदिूण के धनयंत्रण के धलए रयज्य सरकयर कय पययावरण धवभयग यय रयज् य प्रदिूण धनयंत्रण बोडा वययु (प्रदिूण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर में मयगादताक धसद्धयंत और धवधनयम तैययर करेगय
(8) बधहस्रयव कय धनस्सयरण -- पयररधस्थधतक संवेदी जोन में ईपचयररत बधहस्रयव कय धनस्सयरण पययावरणीय (संरक्षण) ऄधधधनयम, 1986 और ईसके ऄधीन बनयए गए धनयमों रयज्य सरकयर द्वयरय बतयए गए मयनकों के ऄधीन अन े वयल े पययावरणीय प्रदिूण के धलए सयमयन्य मयनकों के ईपबंधों के ईपबंधों के ऄनुसयर होगय
(9) ठोस ऄपधतष्ट -- ठोस ऄपधतष्टों कय धनपटयन और प्रबंधन धनम्नधलधखत रूप में होगय-- (क) पयररधस्थधतक संवेदी जोन में ईपचयररत बधहस्रयव कय धनस्सयरण, समय-समय पर संतोधधत ठोस ऄपधतष् ट प्रबंधन धनयम, 2016, जो भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं.
कय.अ. 1357 (ऄ) तयरीख 8 ऄप्रैल, 2016 द्वयरय प्रकयधतत दकए गए थ,े के ईपबंधों के ऄनुसयर दकयय जयएगय ;
ऄकयबाधनक सयमग्री कय धनपटयन पयररधस्थधतक संवेदी जोन के बयहर पहचयन दकए गए स् थल पर दकसी पययावरणीय स्वीकृत रीधत में होगय;

(10) जवै धचदकत् सीय ऄपधतष् ट- जैव धचदकत् सीय ऄपधतष् ट प्रबंधन धनम्नधलधखत रूप में होगय— (क) पयररधस्थधतक संवेदी जोन में जैव धचदकत्सीय ऄपधतष्टों कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवयय ु पररवतान मंत्रयलय की ऄधधसूचनय सं.कय.धन 343/ (ऄ), तयरीख 28 मयचा 2016 द्वयरय प्रकयधतत जैव धचदकत्सीय ऄपधतष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय (ख) पयररधस्थधतक संवेदी जोन में कोइ सयमयन्य ईपचयर सुधवधय यय जलययय जयनय ऄनुज्ञयत नहीं दकयय जयएगय
(11) प्लयधस्टक ऄपधतष्ट प्रबधंन: - पयररधस्थधतक संवेदी जोन में प्लयधस्टक ऄपधतष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं.कय.धन 340 (ऄ), तयरीख 18 मयचा, 2016 द्वयरय प्रकयधतत प्लयधस्टक ऄपधतष्ट प्रबंध धनयम 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय
(12) धनमयाण और धवध्वसं ऄपधतष्ट प्रबधंन: - पयररधस्थधतक संवेदी जोन में संधनमयाण और धवध्वंस ऄपधतष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं.कय.धन 317 (ऄ), तयरीख 29 मयचा, 2016 द्वयरय प्रकयधतत संधनमयाण और धवध्वंस प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय
(13) इ–ऄपधतष्ट:- पयररधस्थधतक संवेदी जोन में इ–ऄपधतष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय प्रकयधतत इ–ऄपधतष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय
(14) ययनीय पररवहन: - पररवहन की ययनीय गधतधवधधययं अवयस के ऄनुकूल धवधनयधमत होंगी और आस संबंध में अंचधलक महययोजनय में धवतेि ईपबंध ऄधधकधथत दकए जयएगं ेऔर अंचधलक महययोजनय के तैययर होन ेऔर रयज्य सरकयर के सक्षम प्रयधधकयरी द्वयरय के ऄनुमोददत होने तक, मयनीटरी सधमधत प्रवृत्त धनयमों और धवधनयमों के ऄनुसयर ययनीय गधतधवधधयों के ऄनुपयलन को मयनीटर करेगी
(15) ययनीय प्रदिूण:- लयग ूधवधधयों के ऄनुसयर ययनीय प्रदिूण की रोकथयम और धनयंत्रण कय ऄनुपयलन दकयय जयएगय और स्वच्छक ईंधन के ईपयोग के धलए दकए गए प्रययस ईदयहरण के धलए सीएनजी, एलपीजी, अदद हैं
(16) औद्योधगक इकयआयय:ं - (i) रयजपत्र में आस ऄधधसूचनय के प्रकयतन के बयद यय प्रकयतन में, पयररधस्थधतक संवेदी जोन के भीतर कोइ नए प्रदधूित ईद्योगों की स्थयपनय की ऄनुमधत नहीं दी जयएगी
(ii) पयररधस्थधतक संवेदी जोन के कें रीय प्रदिूण धनयंत्रण बोडा द्वयरय जयरी ददतयधनदतेों में फरवरी, 2016 के भीतर धसफा गैर- प्रदधूित ईद्योगों की स्थयपनय के वगीकरण की ऄनुमधत दी जयएगी, जब तक दक आस ऄधधसूचनय में धवधनर्ददष्ट न हो आसके ऄलयवय, गैर-प्रदधूित कुटीर ईद्योगों को प्रधतधिद्ध दकयय जयएगय
(17) पहयडी ढलयनों को सरंक्षण: - पहयडी ढलयनों के संरक्षण के ऄंतगात:
(क) अंचधलक महययोजनय पहयडी ढलयनों पर क्षेत्रों कय संकेत होगय जहयं दकसी भी संधनमयाण की ऄनुमधत नहीं दी जयएगी (ख)कटयव के एक ईच्च धडग्री के सयथ धवद्यमयन खडी पहयडी ढलयनों यय ढलयनों पर दकसी भी संधनमयाण की ऄनुमधत नहीं दी जयएगी
(18) यदद यह अवश्यक समझय जयतय ह,ै तो आस ऄधधसूचनय के ईपबंधों को प्रभयवी करने में कें रीय सरकयर और रयज्य सरकयर, ऄन्य और ईपयय धनर्ददष्ट करेगय
4. पयररधस्थधतक सवंदेी जोन में प्रधतधिद्ध और धवधनयधमत दकए जयन ेवयल ेदक्रययकलयपों की सचूी - पयररधस्थधतक संवेदी जोन में सभी दक्रययकलयप पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) के ईपबंधों और तटीय धवधनयमन जोन II (ii) 7 (सीअरजेड), 2011 और पययावरणीय प्रभयव अकलन (इअइए ) ऄधधसूचनय, 2006 और वन (संरक्षण) ऄधधधनयम, 1980 (1980 के 69), भयरतीय वन ऄधधधनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) ऄधधधनयम, 1972 (1972 के 53) और आससे दकए गए संतोधनों सधहत तयधसत होंग ेऔर नीचे दी गइ सयरणी में धवधनर्ददष्ट रीधत में धवधनयधमत होंग,े ऄथयात ्:-- सयरणी क्रम स.ं दक्रययकलयप वणान क. प्रधतधिद्ध दक्रययकलयप
(1) वयधणधज्यक खनन (क) सभी प्रकयर के खनन (लघु और वृहत खधनज), पत्थर की खयनें और ईनको तोडने की आकयआययं वयस्तधवक स्थयनीय धनवयधसयों की घरेलू अवश्यकतयओं के धसवयय नहीं होंगी धजसमें धनजी ईपयोग के धलए मकयनों के संधन्नमयाण यय मरम्मत के धलए भूधम को खोदनय और मकयन बनयने के धलए दतेी टयआलों कय धनमयाण भी सधम्मधलत ह;ै (ख) मयननीय ईच्चतम न्ययययलय की ररट ययधचकय (धसधवल) सं. 1995 कय 202 टी.एन. गोसवदरयमन धथरुमूलपयद बनयम भयरत सरकयर के मयमले में अदेत तयरीख 4 ऄगस्त, 2006 और ररट ययधचकय (सी) सं. 2012 कय 435 गोवय फयईंडेतन बनयम भयरत सरकयर के मयमले में तयरीख 21 ऄप्रैल, 2014 के ऄंतररम अदते के कठोर ऄनुसरण कय प्रचयलन होगय
(2) जल, वययु, मृदय ध् वधन अदद प्रदिूण कयररत करने वयले ईद्योगों की स् थयपनय कोइ नइ और पयररधस्थधतक संवेदी जोन में प्रदिूण फैलयने वयले ईद्योगों के धवस्तयर की ऄनुमधत दी जयएगी फरवरी, 2016 में पयररधस्थधतक संवेदी जोन के कें रीय प्रदिूण धनयंत्रण बोडा द्वयरय जयरी ददतयधनदतेों में तब तक धसफा गैर- प्रदधूित ईद्योगों के वगीकरण की ऄनुमधत नहीं दी जयएगी जयएगी, जब तक दक आस ऄधधसूचनय में आस प्रकयर धवधनर्ददष्ट न हो आसके ऄधतररि गैर प्रदधूित कुटीर ईद्योगों कय संवधान दकयय जयएगय
(3) बृहत जल धवद्युत पररयोजनय की स् थयपनय लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे
(4) दकसी पररसंकटमय पदयथों कय ईपयोग यय ईत्पयदन लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे
(5) प्रयकृधतक जल धनकययों यय सतही क्षेत्र में ऄनुपचयररत बधहस्रयाव कय धनस्सयरण लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे
(6) ठोस ऄपधतष्ट धनपटयन स्थल और ठोस और जैव धचदकत्सय ऄपधतष्ट के धलए सयमयन्य जलयए जयने की सुधवधय की स्थयपनय पयररधस्थधतक संवेदी जोन में ठोस ऄपधतष्ट धनपटयन की कोइ नइ ठोस ऄपधतष्ट धनपटयन स्थल और ऄपधतष्ट ईपचयर/प्रसंस्करण सुधवधय की ऄनुमधत नहीं है आसके ऄधतररि औद्योधगक प्रदक्रयय और स्वयस्थ्य प्रधतष्ठयन/ऄस्पतयलों अदद से ईत्पन्न दकसी भी ठोस ऄपधतष्ट के ईपचयर के धलए सयमयन्य यय व्यधिगत जलयवतरण की सुधवधय कय ऄधधकतर प्रधतधिद्ध है
(7) फमों, कॉपोरेट, कंपधनयों द्वयरय बडे पैमयने पर वयधणधज्यक पतुधन संपदय और कुक्कुट फयमों की स्थयपनय स्थयनीय जरूरतों को पूरय करने के धसवयय लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे
(8) नइ अरय धमलों की स्थयपनय पयररधस्थधतक संवेदी जोन के भीतर नइ और धवद्यमयन अरय धमलों कय धवस् तयर ऄनुज्ञयत नहीं होगय
(9) ईंट भट्टों की स्थयपनय करनय लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे ख. धवधनयधमत दक्रययकलयप
(10) होटलों और ररसोटों कय स्थयपन पयररधस्थधतक ऄनुकूल पयाटन दक्रययकलयप से संबंधधत पयाटकों को ऄस्थययी ऄधधभोग के धलए वयस सुधवधय के धसवयय संरधक्षत क्षेत्र सीमय के एक दकलोमीटर 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] के भीतर कोइ नयय वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत नहीं होंगे :
परन्तु वन्यजीव ऄभययरण्य की सीमय से एक दकलोमीटर से परे और पयररधस्थधतक संवेदी जोन के धवस्तयर तक सभी नए पयाटन दक्रययकलयपों यय धवद्यमयन दक्रययकलयपों कय धवस्तयर पयाटन महययोजनय के ऄनुरुप होगय
(11) संधनमयाण दक्रययकलयप (क) संरधक्षत क्षेत्र यय पयररधस्थधतक संवेदी जोन जो भी धनकट हो, की सीमय से एक दकलोमीटर के भीतर दकसी भी प्रकयर कय वयधणधज्यक संधनमयाण ऄनुज्ञयत नहीं दकयय जयएगय:
परंतु स् थयनीय लोगों को पैरय 6 के ईप पैरय (1) में सूचीबद्ध दक्रययकलयपों सधहत ईनके अवयसीय ईपयोग के धलए ईनकी भूधम में संधनमयाण करने की ऄनुमधत भवन ईपधवधधयों के ऄनुसयर दी जयएगी जैसे:-
(i) धवद्यमयन सडकों को चौडय करनय और ईन्हें सुदढृ़ करनय तथय नइ सडकों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) कें रीय प्रदिूण धनयंत्रण बोडा द्वयरय जयरी ददतयधनदतेों में फरवरी, 2016 के भीतर धसफा गैर- प्रदधूित ईद्योगों की स्थयपनय के वगीकरण;
(iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण ईद्योग भी हैं; सुधवधयजनक भण्डयर और स्थयनीय सुख सुधवधयओं जो पयररधस्थधतक पयाटन में धजस सहययक हो ग्रह वयस; और
(v) आस ऄधधसूचनय में संवर्धधत दक्रययकलयपों की सूची :
परन्तु यह और दक ऐसे लघु ईद्योगों जो प्रदिूण ईत् पन् न नहीं करते हैं, से संबंधधत संधनमयाण दक्रययकलयप धवधनयधमत दकए जयएंगे और लयगू धनयमों और धवधनयमों, यदद कोइ हों, के ऄनुसयर सक्षम प्रयधधकयरी की पूवा ऄनुमधत से ही न् यूनतम पर रखे जयएंगे (ख) एक दकलोमीटर से अगे अंचधलक महययोजनय की ऄनुसयर धवधनयधमत होंगे
(12) प्रदिूण ईत्पन्न न करने वयले लघु ईद्योग पयररधस्थधतक संवेदी जोन के कें रीय प्रदिूण धनयंत्रण बोडा द्वयरय जयरी ददतयधनदतेों में फरवरी, 2016 के भीतर धसफा गैर- प्रदधूित ईद्योगों की स्थयपनय के वगीकरण की ऄनुमधत दी जयएगी, पयररधस्थधतक संवेदी जोन से गैर –प्रदिूण, गैर पररसंकटमय, लघु और सेवय ईद्योग, कृधि ईद्ययन, कृधि यय कृधि अधयररत औद्योधगक ईत्पयदों कय ईत्पयदन ईद्योग को सक्षम प्रयधधकयरी द्वयरय ऄनुज्ञयत दकए जयएंगे
(13) वृक्षों की कटयइ (क) रयज्य सरकयर में सक्षम प्रयधधकयरी की पूवा ऄनुमधत के धबनय वन यय सरकयरी यय रयजस्व यय धनजी भूधम पर यय वनों में ककही वृक्षों की कटयइ नहीं होगी (ख) वृक्षों की कटयइ संबंधधत कें रीय यय रयज्य ऄधधधनयम यय ईसके ऄधीन बनयए गए धनयमों के ईपबंध के ऄनुसयर धवधनयधमत होगी
(14) वन ईत्पयदों यय गैर कयष् ठ वन ईत्पयदों एन टी एफ टी कय संग्रहण लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(15) धवद्युत केबलों और दरूसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और ऄन्य बुधनययदी ढयंचे लयगू धवधधयों के ऄधीन धवधनयधमत होंगे भूधमगत केबल को बढ़यवय ददयय जयएगय
(16) नयगररक सुधवधयओं सधहत बुधनययदी ढयंचे लयगू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, धनयम और धवधनयमन और ईपलब्ध ददतयधनदते धवधनयधमत होंगे
(17) धवद्यमयन सडकों को चौडय करनय और ईन्हें लयगू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, धनयम और धवधनयमन II (ii) 9 सुदढृ़ करनय और ईपलब्ध ददतयधनदते धवधनयधमत होंगे
(18) पयाटन से संबंधधत दक्रययकलयप जैसे गमा वययु गुब्बयरें, हेलीकयप्टर, ड्रोन, मयआक्रोलयआटस और ऄन्य पयाटन दक्रययकलयप अदद द्वयरय पयररधस्थधतक संवेदी जोन क्षेत्र के उपर से ईडनय जैसे दक्रययकलयप करनय लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(19) पहयडी ढयलों और नदी तटों कय संरक्षण लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(20) रयधत्र में ययधनक ययतयययत कय संचलन लयगू धवधधयों के ऄधीन वयधणधज्यक प्रयोजन के धलए धवधनयधमत होंगे
(21) स्थयनीय समुदययों द्वयरय चल रही कृधि और बयगवयनी प्रथयओं के सयथ पतुपयलन, पतुपयलन कृधि और मछली पयलन स्थयनीय लोगों के ईपयोग के धलए लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(22) प्रयकृधतक जल धनकययों सतही क्षेत्र में ईपचयररत बधहस्रयाव कय धनस्सयरण ईपचयररत/ बधहस्रयाव के पुनचाक्रण को प्रोत्सयधहत करने और ऄवमल यय ठोस ऄपधतष्टों के धनपटयन के धलए धवद्यमयन धवधनयमों कय ऄनुपयलन दकयय जयएगय ऄन्यथय लयगू धवधधयों के ऄधीन ईपचयररत बधहस्रयाव के पुनचाक्रण/प्रवयह के धनवाहन को धवधनयधमत दकयय जयएगय
(23) सतह और भूजल के वयधणधज्यक धनष्किाण लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(24) खुले कुअ, बोर कुअ, अदद के धलए कृधि और ऄन्य ईपयोग धवधनयधमत और ईपयुि प्रयधधकयरी द्वयरय दक्रययकलयपों की सखती से मयनीटरी की जयएगी
(25) ठोस ऄपधतष् ट प्रबंधन लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(26) धवदतेी प्रजयधतयों को लयनय लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(27) पयररधस्थधतक-पयाटन लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(28) पोधलथीन बैगों कय ईपयोग पयररधस्थधतक संवेदी जोन के भीतर पॉधलथीन बैग के ईपयोग की ऄनुमधत ह ै हयलयंदक, धवधतष्ट अवश्यकतय के अधयर पर, यह लयगू धवधधयों के ऄधीन धवधनयधमत होंगे
(29) वयधणधज् यक सयआनबोडा और होडिंगडग लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ग. सवंर्धधत दक्रययकलयप
(30) विया जल संचयन सदक्र य रूप से बढ़यवय ददयय जयएगय
(31) जैधवक खेती सदक्र य रूप से बढ़यवय ददयय जयएगय
(32) सभी गधतधवधधयों के धलए हररत प्रौद्योधगकी को ग्रहण करनय सदक्र य रूप से बढ़यवय ददयय जयएगय
(33) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण कयरीगर, अदद भी हैं सदक्र य रूप से बढ़यवय ददयय जयएगय
(34) नवीकरणीय उजया स्रोत कय ईपयोग सदक्रय रुप से बययो गैस, सौर प्रकयत अदद को बढ़यवय ददयय जयएगय
(35) कृधि वयधनकी सदक्र य रूप से बढ़यवय ददयय जयएगय
(36) पयररधस्थधतक-ऄनुकूल पररवहन कय ईपयोग सदक्र य रूप से बढ़यवय ददयय जयएगय

(38) धनम्नीकृत भूधम/ वन/ अवयस की बहयली सदक्र य रूप से बढ़यवय ददयय जयएगय

5. मयनीटरी सधमधत- (1) कें न्दीय सरकयर द्वयरय, पययावरण (संरक्षण) ऄधधधनयम, 1986 की धयरय 3 की ईप-धयरय (3) द्वयरय प्रदत्त तधियों कय प्रयोग करते हुए पयररधस्थधतक संवेदी जोन के प्रभयवी धनगरयनी के धलए तीन विा की ऄवधध के धलए एक धनगरयनी सधमधत कय गठन करेगी, जो धनम्नधलधखत से धमलकर बनगेी, ऄथयात:्-- (क) वन्य संरक्षक/ईपवन्य संरक्षक/ईद्ययन और ऄभययरण्य, धत्रपुरय सरकयर - ऄध्यक्ष;
(ख) क्षेत्र कय ज्येष्ठ योजनयकयर – सदस्य;
(ग) धत्रपुरय रयज्य प्रदिूण धनयतं्रण बोडा कय एक प्रधतधनधध -सदस् य;
(घ) पययावरण (धजसके ऄंतगात धवरयसत संरक्षण भी ह)ै के क्षेत्र में कयया करन ेवयल ेगरै सरकयरी संगठनों कय धत्रपुरय रयज्य सरकयर द्वयरय प्रत् येक मयमल ेमें तीन विा के धल ए नयमधनर्ददष्ट एक प्रधतधनधध - सदस्य;
(ङ) पयररधस् थधतक और पययावरण के क्षेत्र में धत्रपरुय सरकयर द्वयरय नयमधनर्ददष् ट प्रत्येक मयमले में तीन विा की ऄवधध के धलए एक धवतेिज्ञ - सदस्य;
(च) रयज्य जैव-धवधवधतय बोडा कय सदस्य - सदस्य;
(छ) प्रभयगीय वन ऄधधकयरी (संरधक्षत क्षेत्र) - सदस् य-सधचव
6. धनदेत - धनबधंन
(1) पयररधस्थधतक संवेदी जोन सधमधत आस ऄधधसूचनय के ईपबंधों के ऄनुपयलन को मयनीटर करेगी
(2) पयररधस्थधतक संवेदी जोन में भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय सं. कय.अ.
1533 (ऄ), तयरीख 14 धसतंबर, 2006 की ऄनुसूची में के ऄधीन सधम्मधलत दक्रययकलयपों और आस ऄधधसूचनय के परैय 4 के ऄधीन प्रधतधिद्ध गधतधवधधयों के धसवयय अने वयल े ऐसे दक्रययकलयपों की दतय में वयस्तधवक धवधनर्ददष्ट स्थलीय दतयओं पर अधयररत मयनीटरी सधमधत द्वयरय संवीक्षय की जयएगी और ईि ऄधधसूचनय के ईपबंधों के ऄधीन पूवा पययावरण धनकयसी के धलए केन्रीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को धनर्ददष्ट की जयएगी
(3) आस ऄधधसूचनय के परैय 4 के ऄधीन यथय-धवधनर्ददष्ट प्रधतधिद्ध दक्रययकलयपों के धसवयय, भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय संखययंक कय.अ. 1533 (ऄ), तयरीख 14 धसतंबर, 2006 की ऄधधसूचनय के ऄनुसूची के ऄधीन ऐसे दक्रययकलयपों, धजन्हें सधम्मधलत नहीं दकयय गयय ह,ै परंतु पयररधस्थधतक संवेदी जोन में अते हैं, ऐसे दक्रययकलयपों की वयस्तधवक धवधनर्ददष्ट स्थलीय दतयओं पर अधयररत मयनीटरी सधमधत द्वयरय संवीक्षय की जयएगी और ईसे संबद्ध धवधनययमक प्रयधधकरणों को धनर्ददष्ट दकयय जयएगय
(4) मयनीटरी सधमधत कय सदस्य-सधचव यय संबद्ध वन/पयका और ऄभययरण्य कय संरक्षण, ऐसे व्यधि के धवरूद्ध, जो आस ऄधधसूचनय के दकसी ईपबंधों कय ईल्लघंन करतय ह,ै पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 19) की धयरय 19 के ऄधीन पररवयद फयआल करने के धलए सक्षम होगय
(5) मयनीटरी सधमधत मुद्दय दर मुद्दय के अधयर पर ऄपेक्षयओं पर धनभार रहत ेहुए संबद्ध धवभयगों के प्रधतधनधधयों यय धवतेिज्ञों, औद्योधगक संगमों यय संबद्ध पणधयररयों के प्रधतधनधधयों को ऄपन ेधवचयर-धवमता में सहययतय के धलए अमंधत्रत कर सकेगी II (ii) 11
(6) मयनीटरी सधमधत प्रत्येक विा की 31 मयचा तक की ऄपनी वयर्धिक कयरावयइ ररपोटा रयज्य के मखुय जीव वयडान ईपयबधं IV में ईपबंधधत रूप धवधयन के ऄनुसयर ईक् त विा के 30 जून तक प्रस्तुत करेगी

3230, dated the 26th November, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, no objections and suggestions received from persons and stakeholders in response to the draft notification;
Whereas, the Rowa Wildlife Sanctuary in the State of Tripura was declared on the 13th July, 1988 vide Notification No.F.8 (67)/For-WL/88/26,948/dated the 13th July, 1988 under sub-section (1) of section 18 of the Wildlife Protection Act, 1972 (53 of 1972) comprising an area of 85.85 hectare was notified as the Rowa Wildlife Sanctuary under clause (b) of section 26-Aof the Wildlife Protection Act, 1972 vide Notification No.F.8 (67)/For-WL- 2008/2,253/dated the 7th May, 2009 of the Forest Department, Government of Tripura;
And whereas, the floral diversity of the sanctuary is unique and well distributed in the tires of floral canopies and the large varieties of the herbs, shrubs climber and tree species found the sanctuary have medicinal value and themajor tree species, occurring in association, found in the sanctuary comprising of Moist Deciduous and Semi Evergreen forest as per Champion and Seth classification are, Aqulariamalacancies (Agar-vernacular), Ficusspecies (Bot and other vernacular), Holarrhenaantidysenterica (Kurcha-vernacular), Tamarindusindica (Tetul-vernacular), Termineliachebula (Haritaki-vernacular), Vitexpenduncularis (Awal-vernacular), Albizziaprocera (Karai-vernacular), Gmelinaarborea (Gamair-vernacular), ArtocarpusChaplasa (Chamal-vernacular), Dipterocurpusturbinatus (Gamairvernacular), Cynometrapolyndra (Ping-vernacular), Bombaxceiba (Simul-vernacular), Terminaliaarjuna (Arjunvernacular), Aeglemarmelos (Belvernacular), Sysygiumcumini (Jam-vernacular) such an association is critical for supporting a large variety of resident and migratory bird population;
And whereas, the Rowa Wildlife Sanctuary is rich in species diversity in bamboo speices like Bambusabalcooa (Barak), Bambusatulda, Bambusavulguris, Bambusacacharensis (Powra), Bambusacomillensis, Melocanabaccifera (Mulil) Dendrocalamuslongispathusetc.are well distributed over the entire area;
And whereas, the heterogeneous mixture of ground flora is in agglomeration of various monocots and dicots, herbs shrubs, climbers, lichens, fens fern allies and regeneration of underground bulbs and rhizomes andthe canopy density varies between 0.70 to 0.80 in the sanctuary and the lowing Schedule- I Animals have been sighted in the Wildlife Sanctuary are, Spectacle monkey, Leopard cat, Ganges soft shelled turtle, Python, Hill Myna;
And whereas, Besides the wet land is a major wintering habitat for migratory birds like lesser whistling teals anda flock of 100 number in 2006 winter and 86 in 2007 winter of the species was spotted comprising of birds like barbets (Capitonidate), Bulbul (Pycnonotidate), Cuckoos (Cuculidae), Darters (Phalacrocuracidae), Doves and pigeon (Columbidae), Drongos (Dicruridae),Ducks (Anatidae), Orioles (Oriolidae), Owls (Strigidae) Parakeets (Psittacidae),Partridges (Phasianidae), Sunbirds (Nectariniidae),Woodpeckers (Picidae), Weaver birds of bayas (Plocitae), Tree pies (Corvidae) and Maynas (Sturnidae);
And whereas, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph one of this notification around the protected area of the Rowa Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.
Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 10 to 100 meters from the boundary of the Rowa Wildlife Sanctuary in the State of Tripura as the Rowa Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.—(1)The extent of the Eco-sensitive Zone is varies from 10 metres to100 metres from the boundary of the Rowa Wildlife Sanctuary and the area of the Eco- sensitive Zone is 62.75 acres.
(2) The boundary description of the Eco-sensitive Zone is appended as Annexure I.
(3) The map of the Eco-sensitive Zone boundary together with its latitudes and longitudes is appended as Annexure II.
(4) The coordinates of the Eco-sensitive Zone with its latitudes and longitudes is appended as Annexure III.

(5) The villages falling within Eco-sensitive Zone are, Chamtilla, Rowa, Deocnerra, South Padmabill (Part), and Ramnagar (Part).
2. Zonal Master Plan for the Eco-sensitive Zone.—
1. The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
2. The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
3. The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
4. The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
5. The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
6. The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.
7. The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
8. The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
9. The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
1. Landuse.—(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than that specified, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant state laws and other rules and regulations of Central/State 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant state laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies.—The catchment areas of all natural springs/rivers/channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/Eco-tourism.—(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority with emphasis on ecotourism.
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel/resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.—Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986.

(7) Air pollution.—Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents.—Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government.
(9) Solid wastes.—Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016;
the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone.
(b) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—Bio medical waste management shall be as under:-
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016.
(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management.—The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340 (E), dated the 18th March, 2016.
(12) Construction and Demolition Waste Management.—The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317 (E), dated the 29th March, 2016.
(13) E-waste.—The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.
(14) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.—Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.—(i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.—The protection of hill slopes shall be as under:-
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.— All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE Sl.

Setting up of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.

3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.

Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6.
Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco-sensitive Zone.
Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
7.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills.
No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities.
(a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution termed as per Classification done by the Central Pollution Control Board of February 2016;
(iv) cottage industries including village industries;
convenience stores and local amenities supporting ecotourism including home stays; and
(v) promoted activities listed in this Notification:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
12. Small scale non polluting industries.
Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and nonhazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
13. Felling of Trees.
(a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
14.
Collection of Forest produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
15.
Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
16. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17.
Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18.
Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
19. Protection of Hill Slopes and river banks. Regulated under applicable laws.
20. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
22.
Discharge of treated waste water/effluents in natural water bodies or land area.

5.Eco-sensitive Zone Monitoring Committee.—(1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, the following namely:-
(a) The Conservator of Forests/Deputy Conservator of Forests/Park and Sanctuary, Government of Tripura– Chairman;
(b) Senior Town Planner of the area - Member;
(c) A representative of Tripura State Pollution Control Board-Member;
(d) A representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Tripura for a term of three year – Member;
(e) One expert in the area of ecology and environment to be nominated by the Government of Tripura for three years - Member;
(f) Member, State Biodiversity Board-Member; and
(g) Divisional Forest Officer (Protected Area) - Member Secretary.
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in waste water/effluent shall be regulated as per applicable laws.
23.
Commercial extraction of surface and ground water.
Regulated under applicable law.
24.
Open Well, Bore Well etc. for agriculture or other usage.
Regulated and the activity should be strictly monitored by the appropriate authority.
25. Solid Waste Management. Regulated under applicable laws.
26. Introduction of Exotic species. Regulated under applicable laws.
27. Eco-tourism. Regulated under applicable laws.
28. Use of polythene bags.
Use of polythene bags are permitted within the Eco-sensitive Zone. However, based on specific requirement, it shall be regulated under applicable laws.
29. Commercial Sign boards and hoardings. Regulated under applicable laws.
C. Promoted Activities
30. Rain water harvesting. Shall be actively promoted.
31. Organic farming. Shall be actively promoted.
32. Adoption of green technology for all activities. Shall be actively promoted.
33.
Cottage industries including village artisans, etc.
Shall be actively promoted.
34. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.
35. Agro-Forestry. Shall be actively promoted.
36. Use of eco-friendly transport. Shall be actively promoted.
37. Skill Development. Shall be actively promoted.
38. Restoration of Degraded Land/Forests/Habitat. Shall be actively promoted.
39. Environmental Awareness. Shall be actively promoted.
II (ii) 23 the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Conservator of Forests/Park and Sanctuary shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

Northern (N) boundary:
Northern side of the proposed Eco-sensitive Zone of Rowa Wildlife Sanctuary consists of Daserkoti to Padmabil Road where proposed Eco-sensitive Zone boundary is kept as 100 meter from the boundary of the sanctuary. The proposed Eco-sensitive Zone boundary is running parallel to Daserkoti - Padmabil Road from North West to North East side. Under RowaMauja, Panisagar Civil Sub-Division.
Southern (S) boundary:
Southern boundary of proposed Eco-sensitive Zone of Rowa Wildlife Sanctuary consists the Brick road Originate from NH-44 to DakshinPadmabill bordering with that bick road. Where the proposed Eco-sensitive Zone boundary is kept as 20 meter from the boundary of the sanctuary. Adjoining Mouja is DakshinPadmabill under Panisagar Civil Sub-Division.
Western (W) boundary:
Western boundary of the proposed Eco-sensitive Zone of Rowa Wildlife Sanctuary consist of RowaMauja and Ramnagar under Panisagar Civil Sub-Division where the proposed Eco-sensitive Zone boundary is kept as 10 meter from the boundary of the sanctuary due to habitation. South Western sides Eco-sensitive Zone boundary originates with NH- 44 RoW.
Eastern (E) boundary:
South Eastern boundary starts from DakshinPadmabill – NH-44 Brick road which is directly connecting with NH-44.
Where the proposed Eco-sensitive Zone boundary is kept as 20 meter from the boundary of the sanctuary.
