3127 (अ), र्यरीख 20 नवम्बर, 2015 द्वयरय, उन सभी व्यधिर्ों से, धजनके उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको उस रयजपत्र की प्रधर्र्यं, धजसमें र्ह अधिसूचनय अंर्र्वाष्ट ह,ै उपलब्ि करय िी गई थी, सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् करर् ेहुए एक प्रयरुप अधिसूचनय प्रकयधिर् की गई थी;
और, रयजपत्र की प्रधर्र्यं 20 नवम्बर, 2015 जनर्य को उपलब्ि करयई गईं थी;
और, पणियररर्ों से कोई रिप्पणी से प्रयप्त नहीं हुए हैं;
और, ग्रेि इंधिर्न सोहन पक्षी, रोलयपयिू वन् र्जीव अभर्यर्र्, आंध्र प्रििे के करनलू धजले में अक्षयंि 15.72 से
15.75 और िेियंर्र 78.33 से 78.37 के बीच ध थर् ह ैऔर 6.14 वगा दकलोमीिर में फैलय हुआ ह;ै और, वन् र्जीव अभर्यर्र् पूवी घयि को नल्लयमलयई और इरयमलयई पवार् श्रखंलयओं के बीच रयलयपयिू को सूखी ढलयन भूधमर्ों पर अवधथर् ह ैऔर इसमें बेहर्रीन घयस कय मैियन है, जो घयस चरने वयल ेधवधभन्न प्रकयर के पिुओं के धलए एक अत्रु्त्तम पर्यावयस ह;ै और, र्ह अभर्यर्र् धविु्ि् ूपप से एक घयस के मैियन वयलय अभर्यर्र् है। जहयं अ्भुर् प्रकयर की वनपधर् और जीव जंन्र्ु पयर्े जयर् ह ै और इस अभर्यर्र् में पयई जयने वयली सयमयन्र् घयस अधसरििय फ्र्ूधनकलयिय (चेच्पूूप गद्दी), क्रयइसोपोगोन फलवुस (गोलिेन बेअरि ग्रयस), हिेेरोपोगोन प्रजयधर्र्यं(ब्लेक धसपर ग्रयस) (केसरी गद्दी), धसम्बोपयगोन प्रजयधर्र्यं (बोिय गद्दी), सेधहमय नवोसम आदि ह ै जो मौसमों नदिर्ों के दकनयरे मोररंिय रिंकिोररर्य (िगूप), धजजयइफस मौरररिआनय (गोट्टी) और फोनेक्स (ईिय) के सयथ फैली हुई ह;ै और र्ह अभर्यर्र् धवलुप्तप्रयर् ग्रेि इंधिर्न बियिा (चोररओरिस धनगररकेपस) (मेकय बट्टय धपट्टय) कय आश्र्-थल ह,ै जो इस अभर्यर्र् कय एक फ्लैगधिप प्रजयधर् ह ैऔर अन्र् मुख्र् पिु प्रजयधर्र्यं लेसर फ्लोररकैन (सलफेओिीिेस इंधिकय) (नेल्लयलय नेमधल), ब्लैक बक (अनिेलोपे करधवकयपरय)(कर ष्णय धजधनकय), इंधिर्न वुल्फ(कैधनस लूपस पधल्लपस)(िोिेल)ु,और मयंधनिर लैजयिा(वेरनस फलयवीसकेनस), आदि ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ग्रेि इंधिर्न सोहन पक्षी, रोलयपयिू वन् र्जीव अभर्यर्र्, के चयरों ओर के क्षेत्र को, धजसकय धवर्यर और सीमयएं इस अधिसूचनय के पैरय 1 में धवधनर्िाष्ट हैं, पर्यावरण की िरधष्ट से पयररधथधर्क संवेिी जोन के ूपप में सुरधक्षर् और संरधक्षर् करनय र्थय उि पयररधथधर्क संवेिी जोन में उद्योगों र्य उद्योगों के वगो कय प्रचयलन र्थय प्रसंकरण करने को प्रधर्धिद्ध करनय आवश्र्क ह ै;
अर्ः, अब, केन्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के खंि (v) और खंि (xiv) के सयथ परठर् और उपियरय (1) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर् े हुए, आधं्र प्रििे रयज् र् में ग्रेि इंधिर्न सोहन पक्षी, रोलयपयिू वन् र्जीव अभर्यर्र्, में 1.6751 वगा दकलोमीिर र्क धव र्रर् क्षेत्र को ग्रेि इंधिर्न सोहन पक्षी, रोलयपयिू वन् र्जीव अभर्यर्र्, की सीमय से 100 मीिर र्क के क्षते्र को पयररध थधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर्् पयररध थधर्क संवेिी जोन कहय गर्य ह)ै के ूपप में अधिसूधचर् करर्ी ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै अथयार्् :--
1. पयररधथधर्क संविेी जोन कय धवर्यर और उसकी सीमयएं.-(1) पयररध थधर्क संवेिी जोन आधं्र प्रिेि के करनूल धजल े में ग्रेि इंधिर्न सोहन पक्षी, रोलयपयिू वन्र्जीव अभर्यर्र् की सीमय से 100 मीिर क्षेत्र र्क फैलय हुआ ह।ै
(2) पयररधथधर्क संवेिी जोन में कोई ग्रयम सधम्मधलर् नहीं ह ैऔर पूरे पयररधथधर्क संवेिी जोन में कर धि क्षेत्र सधम्मधलर् ह।ै
(3) पयररधथधर्क संवेिी जोन कय सीमय वणान उपयबिं I के ूपप में उपयबद्ध ह ै।
(4) पयररधथधर्क संवेिी जोन सीमय कय मयनधचत्र और उसके अक्षयंि और िेियंर्र उपयबिं II के ूपप में उपयबद्ध ह ै।
(5) ग्रेि इंधिर्न सोहन पक्षी, रोलयपयिू वन् र्जीव अभर्यर्र् और पयररधथधर्क संवेिी जोन के धनिेियंक उपयबिं III के ूपप में उपयबद्ध ह ै।
2. पयररधथधर्क संविेी जोन के धलए आचंधलक महयर्ोजनय – (1) रयज्र् सरकयर, पयररध थधर्क संवेिी जोन के प्रर्ोजन के धलए रयजपत्र में अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से िो विा की अवधि के भीर्र, थयनीर् व्यधिर्ों के परयमिा से इस अधिसूचनय में संलग् न अनुबंिों के सयमंज र् से आंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) रयज्र् सरकयर द्वयरय पयररध थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय इस र्रह, इस अधिसूचनय में धवधनर्िाष् ि रीधर् र्थय सुसंगर् कें रीर् और रयज् र् धवधिर्ों के सयमंज र् और कें रीर् सरकयर द्वयरय जयरी मयगाििाक धसद्धयंर्ों, र्दि कोई हों, सें र्ैर्यर की जयएगी ।
(3) आंचधलक महयर्ोजनय, इसमें पर्यावरणीर् और पयररधथधर्क धवचयरों को समयकधलर् करन ेके धलए रयज् र् सरकयर के सभी संबद्ध धवभयगों के परयमिा से र्ैर्यर होगी, अथयार्् :--
(i) पर्यावरण;
(ii) वन और वन्र्जीव;
(iii) कर धि ;
(iv) रयज व;
(v) नगर धवकयस;
(vi) पर्ािन;
(vii) ग्रयमीण धवकयस;
(viii) ससंचयई और बयढ़ धनर्ंत्रण;
(ix) नगरपयधलकय;
(x) पंचयर्र्ी रयज;
(xi) लोक धन मयाण धव भयग। II (ii) 3
(4) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनयत्मक और दक्रर्यकलयपों पर कोई धनबंिन अधिरोधपर् नहीं करेगी जब र्क दक इस अधिसूचनय में धवधनर्िाष् ि न हो और आचंधलक महयर्ोजनय सभी अवसंरचनय और दक्रर्यकलयपों में और अधिक िक्षर्य और पयररधथधर्क अनुकूलर्य कय संविान करेगी ।
(5) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबंिन, भूर्ल जल के प्रबंिन, मरिय और नमी संरक्षण, थयनीर् समुियर्ों की आवश्र्कर्यओं र्थय पयररधथधर्क और पर्यावरण से संबंधिर् ऐसे अन्र् पहलओूं, धजन पर ध्र्यन िेनय आवश्र्क ह,ै के धलए उपबंि होंगे ।
(6) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थलों, ग्रयमों और नगरीर् बंिोबर्ों, वनों के प्रकयर और दक मों, कर धि क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षते्र जैसे उद्ययन और उसी प्रकयर के थयन, उद्ययन कर धि के्षत्र, फलोउद्ययन, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी । इस र्ोजनय के मयनधचत्र द्वयरय धवद्यमयन और प्रर्यधवर् भूधम के उपर्ोग कय समथान दकर्य जयएगय ।
(7) आंचधलक महयर्ोजनय पयररधथधर्क संवेिी जोन में धवकयस को धवधनर्धमर् करेगी और सयरणी में सूचीबद्ध प्रधर्धिद्ध और धवधनर्धमर् दक्रर्यकलयपों कय पयलन करेगी थयनीर् समुियर्ों की जीवकोपयजान को सुधनधश् चर् करने के धलए, पर्यावरण के अनुकूल धवकयस को सुधनधिर् और प्रोन्नर् भी करेगी।
(8) आंचधलक महयर्ोजनय क्षेत्रीर् धवकयस र्ोजनय के सयथ सह-अंर्क होगी ।
(9) आंचधलक महयर्ोजनय इस अधिसूचनय के उपबंिों के संबंि में अपन ेकयर्ों को करन े के धलए मयनीिरी सधमधर् के धलए एक संिभा िर्यवेज र्ैर्यर करेगी ।
3. रयज्र् सरकयर द्वयरय दकए जयन े वयल े उपयर्-- रयज्र् सरकयर इस अधिसूचनय के उपबंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार्् :--
(1) भू-उपर्ोग – (क) पयररध थधर्क संवेिी जोन में वनों, उद्ययन-कर धि क्षेत्रों, कर धि क्षेत्रों, आमोि-प्रमोि के प्रर्ोजन के धलए धचधन्हर् दकए गए पयकों और खुल ेथयनों कय वरहि वयधणधज्र्क र्य वरहि आवयसीर् कयम्पलैक्स औद्योधगक दक्रर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय:
परंर् ुपयररधथधर्क संवेिी जोन के भीर्र कर धि भूधम कय संपररवर्ान मयनीिरी सधमधर् की धसफयररि पर और क्षेत्रीर् नगर र्ोजनय अधिधनर्म के अिीन सक्षम प्रयधिकयरी के पूवा अनुमोिन के सयथ और केन्रीर्/रयज्र् सरकयर के अन्र् धनर्मों और र्थय लयग ूधवधनर्मों और इस अधिसूचनय के उपबंिों जो थयनीर् धनवयधसर्ों की आवयसीर् जूपरर्ों को पूरय करन ेके धलए ह,ै को पूरय करने के धलए अनजु्ञयर् होगें जैसे:-
(i) धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिरढ करनय र्थय नई सड़कों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुधवियओं कय संधनमयाण और नवीकरण;
(iii) प्रििूण उत्पन्न न करने वयल ेलघ ुउद्योग;
(iv) कुिीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग हैं; सुधवियजनक भ्ियर और थयनीर् सुख-सुधवियओं सहयर्क पयररधथधर्क पर्ािन में सधम्मधलर् ग्रह वयस भी ह;ै और
(v) संवर्िार् दक्रर्यकलयप और अनुच्छेि 4 के अंर्गार् दिर्य गर्य ह:ै परंर् ुर्ह और भी दक क्षेत्रीर् नगर र्ोजनय अधिधनर्म और रयज्र् सरकयर के अन्र् धनर्मों और धवधनर्मों के अिीन सक्षम प्रयधिकयरी के पूवा अनुमोिन र्थय संधवियन के अनचु्छेि 244 और र्त्समर् प्रवरत्त धवधि के उपबंिों के अनुपयलन के धबनय, धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी ह,ै वयधणधज्र्क र्य उद्योग धवकयस दक्रर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय:
परंर् ुर्ह और भी दक पयररध थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई तु्ररि, मयनीिरी सधमधर् के धवचयर प्रयप्त करने के पियर्् रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक बयर संिोधिर् होगी और उि तु्ररि के संिोिन की सूचनय कें रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को िेनी होगी । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंर् ुर्ह और भी दक उपर्ुाि तु्ररि कय संिोिन में इस उप पैरय के अिीन र्थय उपबंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधम्मधलर् नहीं होगय । (ख) परंर् ुर्ह और भी दक धजससे हररर् क्षेत्र में जैसे वन क्षेत्र, कर धि क्षेत्र आदि में कोई पयररणयधमक किौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयिक कर धि क्षेत्रों में पनु: वनीकरण करने के प्रर्यस दकए जयएंग े।
(2) प्रयकर धर्क जल स्रोर् -- आचंधलक महयर्ोजनय में सभी प्रयकर धर्क जल स्रोर्ों की पहचयन की जयएगी और उनके संरक्षण और पुनरु्भूर्करण के धलए र्ोजनय सधम् मधलर् होगी ।
(3) पर्ािन/पयररधथधर्क पर्ािन – (क) पयररधथधर्क संवेिी जोन के भीर्र नए पर्ािन संबंिी दक्रर्यकलयप र्य धवद्यमयन पर्ािन सम्बंिी दक्रर्यकलयपों कय धवर्यर पयररधथधर्क संवेिी जोन के धलए पर्ािन महयर्ोजनय के अनुसयर होंगे । (ख) पर्ािन महयर्ोजनय पर्ािन धवभयग, द्वयरय रयज्र् पर्यावरण और वन धवभयगों के परयमिा से र्ैर्यर की जयएगे । (ग) पर्ािन महयर्ोजनय आंचधलक महयर्ोजनय के एक घिक के ूपप में जयनय जयर्ेगय । (घ) पर्ािन संबंिी दक्रर्यकलयप धनम् नधलधखर् के अिीन धवधनर्धमर् होंग,े अथयार्् :-
(i) वन्र्जीव अभर्यर्र् की सीमय से एक दकलोमीिर र्क र्य पयररधथधर्क संवेिी जोन के धवर्यर र्क इनमें जो भी धनकि ह,ै नर्े वयधणधज्र्क होिल और ररसोिा अनुज्ञयर् नहीं होंगे। र्थयधप, पयररधथधर्क संवेिी जोन के वन्र्जीव अभर्यर्र् की सीमय से एक दकलोमीिर की िरूी से आग ेर्क नर्े होिल और ररसोिा कय थयपन पर्ािन महयर्ोजनय के अनुसयर पयररधथधर्क पर्ािन सुधवियओं के धलए पूवा पररभयधिर् और पियधभधहर् क्षेत्रों के धलए दकर्य जयएगय ;
(ii) पयररधथधर्क संवेिी जोन के भीर्र सभी नए पर्ािन दक्रर्यकलयपों र्य धवद्यमयन पर्ािन दक्रर्यकलयपों कय धवर्यर कें र सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों के द्वयरय र्थय रयष् रीर् ा र्यघ्र संरक्षण प्रयधिकरण, द्वयरय जयरी पयररधथधर्क पर्ािन (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधथधर्क पर्ािन, पर आियररर् होगय;
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयने र्क, पर्ािन के धलए धवकयस और धवद्यमयन पर्ािन दक्रर्यकलयपों के धवर्यर को वयर्धवक थल धवधनर्िाष्ट संवीक्षय र्थय मयनीिरी सधमधर् की धसफयररि पर आियररर् संबंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य जयएगय और पयररधथधर्क संवेिी जोन के भीर्र नर्े होिल/ ररसोिा र्य वयधणधज्र्क थयपनों कय धवधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय ।
(4) नसैर्गाक धवरयसर् -- पयररधथधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी थलों जैसे सभी जीन कोि आरधक्षर् के्षत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घयिी मयगों, उपवनों, गुफयए,ं थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उन्हें संरधक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के धलए उपर्ुि र्ोजनय बनयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय ।
(5) मयनव धनर्मार् धवरयसर् थल - पयररध थधर्क संवेिी जोन में भवनों, संरचनयओं, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंकर धर्क महत्व के क्षेत्रों की पहचयन करनी होगी और उनके संरक्षण की र्ोजनयएं र्ैर्यर करनी होगी र्थय आंचधलक महयर्ोजनय में सधम्मधलर् की जयएगी ।
(6) ध् वधन प्रििूण -- पयररधथधर्क संवेिी जोन में ध् वधन प्रििूण की रोकथयम और धनर्ंत्रण ध्वधन प्रििूण (धवधनर्मन और धनर्ंत्रण) धनर्मों 2000 के अनुसयर पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986, औ उसमें दकए गए संिोिनों के अिीन र्ैर्यर करेगय ।
(7) वयर् ुप्रििूण -- पयररधथधर्क संवेिी जोन में, वयर् ुप्रििूण की रोकथयम और धनर्ंत्रण वयर्ु (प्रििूण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) के उपबंिों और उसके अिीन बनयए गए धनर्मों और उनमें दकए गए संिोिनों के अनुसयर र्ैर्यर करेगय ।
(8) बधहस्रयव कय धनसयरण -- पयररधथधर्क संवेिी जोन में उपचयररर् बधहस्रयव कय धनसयरण सयियरणों मयनकों के धलए पर्यावरणीर् प्रिधूिर् आच्छयदिर् के धनसयरण के अंर्गार् पर्यावरणीर् (संरक्षण) अधिधनर्म, 1986 और उसके अिीन बनयए गए धनर्मों र्य रयज्र् सरकयर द्वयरय धनर्र् मयनकों, जो भी अधिक कठोर हो, के उपबंिों के अनसुयर होगय। II (ii) 5
(9) ठोस अपधिष्ट - ठोस अपधिष्टों कय धनपियन धनम्नधलधखर् ूपप में होगय - (क) पयररधथधर्क संवेिी जोन में ठोस अपधिष्टों कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थय संिोधिर् अधिसूचनय सं. कय.आ. 1357(आ), र्यरीख 8 अप्रैल, 2016 नगरपयधलक ठोस अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ;
(ख) पयररधथधर्क संवेिी जोन में ठोस अपधिष्टों को जलयनय र्य भष्मीकरण और भरयई कय थयपन अनुज्ञयर् नहीं होगय ;
(10) जैव धचदकत् सीर् अपधिष् ि- जैव धचदकत् सीर् अपधिष् ि प्रबंिन धनम्नधलधखर् ूपप में होगय— (क) पयररधथधर्क संवेिी जोन में जैव धचदकत्सीर् अपधिष्टों कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 343 (अ) र्यरीख 28 मयचा 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय । (ख) पयररधथधर्क संवेिी जोन में कोई सयमयन्र् उपचयर सुधविय र्य भष्मीकरण अनुज्ञयर् नहीं दकर्य जयएगय ।
(11) प्लयधिक अपधिष्ट प्रबिंन: - पयररधथधर्क संवेिी जोन में प्लयधिक अपधिष्ट प्रबंि कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयधिक अपधिष्ट प्रबंि धनर्म 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(12) धनमयाण और धवध्वसं अपधिष्ट प्रबिंन: - पयररधथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रबंि कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय सय.कय.धन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय ।
(13) ई–अपधिष्ट:- पयररधथधर्क संवेिी जोन में ई–अपधिष्ट प्रबंि कय धनपियन भयरर् सरकयर के पर्यावरण, वन और जलवयर् ु पररवर्ान मंत्रयलर् द्वयरय समर्-समर् पर र्थयसंिोधिर् ई–अपधिष्ट प्रबंि धनर्म, 2016 के उपबंिों के अनुसयर दकर्य जयएगय।
(14) र्यनीर् पररवहन: - पररवहन की र्यनीर् गधर्धवधिर्यं आवयस के अनुकूल धवधनर्धमर् होंगी और इस संबंि में आंचधलक महयर्ोजनय में धविेि उपबंि अधिकधथर् दकए जयएंगे और आंचधलक महयर्ोजनय के र्ैर्यर होने और रयज्र् सरकयर के सक्षम प्रयधिकयरी द्वयरय के अनुमोदिर् होने र्क, मयनीिरी सधमधर् प्रवरत्त धनर्मों और धवधनर्मों के अनुसयर र्यनीर् गधर्धवधिर्ों के अनुपयलन को मयनीिर करेगी ।
(15) र्यनीर् प्रििूण:- लयगू धवधिर्ों के अनुसयर वयहन प्रििूण की रोकथयम और धनर्ंत्रण कय अनुपयलन दकर्य जयएगय। वच्छक ईंिन के उपर्ोग के धलए दकए गए प्रर्यस उियहरण के धलए सीएनजी, एलपीजी, आदि हैं ।
(16) औद्योधगक ईकयइर्य:ं - (i) रयजपत्र में इस अधिसूचनय के प्रकयिन के पियर् र्य प्रकयिन पर, पयररधथधर्क संवेिी जोन के भीर्र कोई नए प्रिधूिर् उद्योगों की थयपनय की अनुमधर् नहीं िी जयएगी।
(ii) पयररधथधर्क संवेिी जोन के भीर्र कें रीर् प्रििूण धनर्तं्रण बोिा द्वयरय फरवरी, 2016 जयरी में मयगाििाक धसद्धयंर्ों के अनुसयर धसफा गरै- प्रिधूिर् उद्योगों की थयपनय के वगीकरण की अनुमधर् िी जयएगी, जब र्क दक इस अधिसूचनय में धवधनर्िाष्ट न हो । इसके अलयवय, गैर-प्रिधूिर् कुिीर उद्योगों को बढ़यवय दिर्य जयएगय।
(17) पहयड़ी ढलयनों को सरंक्षण: - पहयड़ी ढलयनों के संरक्षण के अंर्गार्:
(क) आंचधलक महयर्ोजनय पहयड़ी ढलयनों पर क्षेत्रों कय संकेर् होगय जहयं दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी । (ख) कियव के एक उच्च धिग्री के सयथ धवद्यमयन खड़ी पहयड़ी ढलयनों र्य ढलयनों पर दकसी भी संधनमयाण की अनुमधर् नहीं िी जयएगी ।

4. पयररधथधर्क संविेी जोन में प्रधर्धिद्ध और धवधनर्धमर् दकए जयन ेवयल ेदक्रर्यकलयपों की सूची - पयररधथधर्क संवेिी जोन में सभी दक्रर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) के उपबंिों और र्िीर् धवधनर्मन जोन (सीआरजेि), 2011 और पर्यावरणीर् प्रभयव आकलन (ईआईए ) अधिसूचनय, 2006 और वन (संरक्षण) अधिधनर्म, 1980 (1980 के 69), भयरर्ीर् वन अधिधनर्म, 1927 (1927 के 16), वन्र्जीव (संरक्षण) अधिधनर्म, 1972 (1972 के 53) संिोिनों सधहर् द्वयरय ियधसर् होंगे और नीचे िी गई र्यधलकय में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंगे, अथयार्् :-- सयरणी क्रम सं. दक्रर्यकलयप िीकय-रिप्पणी

(1) वयधणधज्र्क खनन, पत्थर की खियन और उनको र्ोड़ने की इकयइर्यं । (क) सभी प्रकयर के खनन (लघु और वरहर् खधनज), पत्थर की खयनें और उनको र्ोड़न े की इकयइर्यं वयर्धवक थयनीर् धनवयधसर्ों की घरेलू आवश्र्कर्यओं के धसवयर् नहीं होंगी धजसमें मकयनों के संधन्नमयाण र्य मरम्मर् के धलए भूधम को खोिनय और मकयन बनयने र्थय अन्र् दक्रर्यकलयपों के धलए िेिी ियइलों कय धनमयाण भी सधम्मधलर् है;
(ख) मयननीर् उच्चर्म न्र्यर्यलर् की ररि र्यधचकय (धसधवल) सं. 1995 कय 202 िी.एन. गोसवंिरयमन धथरुमूलपयि बनयम भयरर् सरकयर के मयमल ेमें आिेि र्यरीख 4 अगर्, 2006 और ररि र्यधचकय (सी) सं. 2012 कय 435 गोवय फयउंिेिन बनयम भयरर् सरकयर के मयमले में र्यरीख 21 अपै्रल, 2014 के अंर्ररम आिेि के कठोर अनुसरण कय प्रचयलन होगय ।
(2) आरय धमलों की थयपनय । पयररधथधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धव र्यर अनुज्ञयर् नहीं होगय ।
(3) जल र्य वयर्ु र्य मरिय र्य ध् वधन प्रििूण कयररर् करने वयले उद्योगों की थयपनय । कोई नई र्य पयररधथधर्क संवेिी जोन में प्रििूण फैलयने वयले उद्योगों के धवर्यर की अनुमधर् िी जयएगी। पयररधथधर्क संवेिी जोन के कें रीर् प्रििूण धनर्ंत्रण बोिा द्वयरय फरवरी, 2016 में जयरी मयगाििाक धसद्धयंर्ों के अनुसयर धसफा गैर-प्रिधूिर् उद्योगों की थयपनय के वगीकरण की अनुमधर् िी जयएगी, जब र्क दक इस अधिसूचनय में धवधनर्िाष्ट न हो। इसके अलयवय गैर प्रिधुिर् कुिीर उद्योगों को बढ़यवय दिर्य जयएगय ।
(4) जलयवन लकड़ी कय वयधणधज्र्क उपर्ोग । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
(5) नए बरहर् जल धवद्युर् पररर्ोजनय और ससंचयई पररर्ोजनय की थयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
(6) दकसी पररसंकिमर् पियथों कय उपर्ोग र्य उत्पयिन । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
(7) प्रयकर धर्क जल धनकयर्ों र्य सर्ही के्षत्र में अनुपचयररर् बधहस्रयाव और ठोस अपधिष्टों कय धनसयरण । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) ।
(8) नए कयष् ठ आियररर् उद्योग। पयररध थधर्क संवेिी जोन की सीमयओं के भीर्र नए कयष् ठ आियररर् उद्योग की थयपनय को अनुज्ञयर् नहीं दकर्य जयएगय :
परंर्ु धवद्यमयन नए कयष् ठ आियररर् उद्योग धवधि के अनुसयर चयलू रह सकर्े हैं।
(9) फमों, कॉपोरेि, कंपधनर्ों द्वयरय बड़े पैमयने पर वयधणधज्र्क पिुिन संपिय और कुक्कुि फयमों की थयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धिद्ध (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
(10) ठोस अपधिष्ट धनपियन थल और ठोस और जैव धचदकत्सय अपधिष्ट के धलए सयमयन्र् भष्मीकरण की सुधविय की थयपनय। पयररधथधर्क संवेिी जोन में ठोस अपधिष्ट धनपियन थल कय कोई सयमयन्र् उपचयर सुधविय र्य प्रसंकरण अनुज्ञयर् नहीं दकर्य जयएगय । इसके अधर्ररि औद्योधगक प्रदक्रर्य और वयथ्र् प्रधर्ष्ठयन/अपर्यलों आदि से उत्पन्न दकसी भी ठोस अपधिष्ट के उपचयर के धलए सयमयन्र् र्य व्यधिगर् भष्मीकरण की सुधविय कय अधिष्ठयपन प्रधर्धिद्ध ह।ै धवधनर्धमर् दक्रर्यकलयप
(11) होिलों और ररसोिों की थयपनय । पयररधथधर्क पर्ािन दक्रर्यकलयप छोिी अथयर्ी संरचनयओं के धलए के धसवयर् संरधक्षर् क्षेत्र की सीमय से एक दकलोमीिर र्क र्य पयररधथधर्क संवेिी जोन के धवर्यर र्क इनमें जो भी धनकि ह,ै नर्े वयधणधज्र्क होिल और ररसोिा अनजु्ञयर् नहीं होंगे। II (ii) 7 वन्र्जीव अभर्यर्र् की सीमय से एक दकलोमीिर र्क र्य पयररधथधर्क संवेिी जोन के धवर्यर र्क इनमें जो भी धनकि ह,ै नर्े वयधणधज्र्क होिल और ररसोिा अनुज्ञयर् नहीं होंगे। र्थयधप, पयररधथधर्क संवेिी जोन के वन्र्जीव अभर्यर्र् की सीमय से एक दकलोमीिर की िरूी से आगे र्क नर्े होिल और ररसोिा कय थयपन पर्ािन महयर्ोजनय के अनुसयर पयररधथधर्क पर्ािन सुधवियओं के धलए पूवा पररभयधिर् और पियधभधहर् क्षेत्रों के धलए दकर्य जयएगय।
(12) संधनमयाण दक्रर्यकलयप । (क) संरधक्षर् क्षेत्र र्य पयररधथधर्क संवेिी जोन जो भी धनकि हो, की सीमय से एक दकलोमीिर के भीर्र दकसी भी प्रकयर कय वयधणधज्र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय:
(ख) परंर्ु थयनीर् लोगों को पैरय 3 के उप पैरय (1) में सूचीबद्ध दक्रर्यकलयपों सधहर् उनके आवयसीर् उपर्ोग के धलए उनकी भूधम में संधनमयाण करने की अनुमधर् भवन उपधवधिर्ों के अनुसयर िी जयएगी ।
(i) धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिरढ करनय र्थय नई सड़कों कय संधनमयाण;
(ii) बुधनर्यिी ढयंचों और नयगररक सुख-सुधवियओं कय संधनमयाण और नवीकरण;
(iii) कें रीर् प्रििूण धनर्ंत्रण बोिा द्वयरय फरवरी, 2016 में जयरी मयगाििाक धसद्धयंर्ों के अनुसयर धसफा गैर- प्रिधूिर् उद्योगों की थयपनय के वगीकरण;
(iv) कुिीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग; सुधवियजनक भ्ियर और थयनीर् सुख सुधवियओं पयररधथधर्क पर्ािन गरह वयस सधहर् है; और
(v) इस अधिसूचनय में संवर्िार् दक्रर्यकलयपों की सूची :
(ख) परन्र्ु र्ह और दक ऐसे लघु उद्योगों जो प्रििूण उत् पन् न नहीं करर्े हैं, से संबंधिर् संधनमयाण दक्रर्यकलयप धवधनर्धमर् दकए जयएंगे और लयगू धनर्मों और धवधनर्मों, र्दि कोई हों, के अनुसयर सक्षम प्रयधिकयरी की पूवा अनुमधर् से ही न् र्ूनर्म पर रखे जयएंगे । (ग) एक दकलोमीिर से आगे आंचधलक महयर्ोजनय के अनुसयर धवधनर्धमर् होंगे ।
(13) वरक्षों की कियई । (क) रयज्र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धबनय वन, सरकयरी र्य रयजव र्य धनजी भूधम पर र्य वनों में ककंही वरक्षों की कियई नहीं होगी । (ख) वरक्षों की कियई, संबंधिर् कें रीर् र्य रयज्र् अधिधनर्म र्य उसके अिीन बनयए गए धनर्मों के उपबंिों के अनुसयर धवधनर्धमर् होगी । (ग) आरधक्षर् वनों और संरधक्षर् वनों के मयमले में कयर्ा र्ोजनय धनिेिों कय पयलन दकर्य जयएगय ।
(14) पर्ािन से संबंधिर् दक्रर्यकलयप जैसे हवयईजहयज, गमा वयर्ु गुब्बयरों आदि द्वयरय रयष्ट्रीर् उद्ययन क्षेत्र के ऊपर से उड़नय जैसे दक्रर्यकलयप करनय। लयगू धवधिर्ों के अिीन धवधनर्धमर् (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
(15) प्रििूण उत्पन्न न करने वयले लघु उद्योग । फरवरी, 2016 में कें रीर् प्रििूण धनर्ंत्रण बोिा द्वयरय जयरी उद्योगों के वगीकरण के अनुसयर शे्वर् प्रवगा धनबंधिर् गैर-प्रििूण उद्योग और गैर-पररसंकिमर् लघु उद्योग र्थय पयररधथधर्क संवेिी जोन से सेवय उद्योग, कर धि, पुष्पकर धि, उद्ययन कर धि र्य कर धि आियररर् उद्योग उत्पयि से िेिी-सयमयग्री सक्षम प्रयधिकयरी द्वयरय अनुज्ञयर् दकए जयएंगे।
(16) वयधणधज्र्क जल संसयिन धजसके अंर्गार् भ-ू जल संचर्न भी ह ै। (क) भूधम के अधिभोगी के वयर्धवक कर धि और घरेलू खपर् के धलए जल कय सर्ही और भूधमगर् जल धनष्किाण अनुज्ञयर् होगय । (ख) औद्योधगक र्य वयधणधज्र्क उपर्ोग के धलए सर्ही और भूधमगर् जल के धनष्किाण के धलए संबंधिर् धवधनर्यमक प्रयधिकयरी से पूवा धलधखर् अनुज्ञय अपेधक्षर् होगी धजसके अंर्गार् दकर्ने पररणयम में वह धनष्किाण करेगय, भी ह ै। (ग) सर्ही र्य भूजल कय धवक्रर् अनुज्ञयर् नहीं होगय । (घ) दकसी भी स्त्रोर् से, धजसके अंर्गार् कर धि भी ह,ै जल के संििूण र्य प्रििूण को रोकने के धलए सभी उपयर् दकए जयएंगे ।
(17) धवद्युर् केबलों और िरूसंचयर ियवरों कय पररधनमयाण । भूधमगर् केबलों को बढ़यवय दिर्य जयएगय।

(19) धवद्यमयन सड़कों को चौड़य करनय और उन्हें सुिरढ करनय । उधचर् पर्यावरण समयघयर् धनियारण और न् र्ूनीकरण उपयर् र्थय लयगू अनुसयर होंगे ।
(20) रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणधज्र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।
(21) धविेिी प्रजयधर्र्ों को लयनय लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
(22) पहयड़ी ढयलों और निी र्िों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
(23) प्रयकर धर्क जल धनकयर्ों र्य सर्ही के्षत्र में उपचयररर् बधहस्रयाव कय धनसयरण । उपचयररर् बधहस्रयाव के पुनचाक्रण को प्रोत्सयधहर् करनय और अवमल र्य ठोस अपधिष्टों के धनपियन के धलए धवद्यमयन धवधनर्मों कय अनुपयलन करनय होगय ।
(24) वयधणधज्र्क सयइनबोिा और होर्िंग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
(25) ईंि भट्टों की थयपनय करनय। लयगू धवधिर्ों के अनुसयर धवधनर्धमर् (अन् र्थय उपबंधिर् के धसवयर्) होंगे ।
(26) प्रयकर धर्क जल धनकयर्ों र्य सर्ही के्षत्र में उपचयररर् बधहस्रयाव कय धनसयरण। उपचयररर् अपधिष्ट जल/ बधहस्रयाव के धनसयरण को जल धनकयर्ों में प्रवेि करने में रोकय जयएगय। उपचयररर् अपधिष्ट जल के पुनचक्रा ण और पुन: उपर्ोग कय प्रर्यस दकर्य जयएगय । अन्र्थय उपचयररर् अपधिष्ट जल/ बधहस्रयाव के धनसयरण लयगू धवधिर्ों के अनुसयर होगय।
(27) वन उत्पयिों और गैर-कयष्ठ वन उत्पयिों कय संग्रहण (एन िी एफ पी) । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
(28) वयर्ु और र्यधनक प्रििूण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
(29) ध्वधन प्रििूण। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे।
(30) भूधमगर्-जल परथक्करण। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे।
(31) ठोस अपधिष्ट प्रबंिन । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
(32) प् लयध िक थैलों कय उपर्ोग और अन्र् प्रकयर के प्लयधिक की पैककंग आदि कय उपर्ोग। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे।
(33) कर धि प्रणयली में आमूल में पररवर्ान। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे।
(34) पयररधथधर्क-पर्ािन दक्रर्यकलयप । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । संवर्िार् दक्रर्यकलयप
(35) िेर्री, िेर्री उद्योग और मत् र् उद्योग के सयथ थयनीर् समुियर्ों द्वयरय चल रही कर धि और बयगवयनी गधर्धवधिर्यं । लयगू धवधिर्ों के अिीन अनुज्ञयर् होंगे।
(36) विया जल संचर्न । सदक्र र् ूपप से बढ़यवय दिर्य जयएगय ।
(37) जैधवक खेर्ी । सदक्र र् ूपप से बढ़यवय दिर्य जयएगय ।
(38) सभी दक्रर्यकलयपों के धलए हररर् प्रौद्योधगकी को ग्रहण करनय । सदक्र र् ूपप से बढ़यवय दिर्य जयएगय ।
(39) कुिीर उद्योगों धजसके अंर्गार् ग्रयमीण कयरीगर आदि भी हैं । सदक्र र् ूपप से बढ़यवय दिर्य जयएगय ।
(40) नवीकरणीर् ऊजया स्रोर् कय उपर्ोग । बयर्ो गैस, सोलर लयईि आदि को बढयवय दिर्य जयएगय ।
(41) कौिल धवकयस। सदक्र र् ूपप से बढ़यवय दिर्य जयएगय ।
(42) कर धि वयधनकी । सदक्र र् ूपप से बढ़यवय दिर्य जयएगय ।

5. मयनीिरी सधमधर्- (1) कें रीर् सरकयर, पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 3 की उप-ियरय (3) के अिीन, इस अधिसूचनय के उपबंिों की प्रभयवी मयनीिरी के धलए एक मयनीिरी सधमधर् कय गठन करर्ी ह,ै जो धनम्नधलधखर् से धमलकर बनेगी, अथयार्् :--
(i) धजलय कलेक्िर, करनलू अध्र्क्ष ;
(ii) पर्यावरण के क्षेत्र में कयर्ा करने वयले गैर सरकयरी संगठनों से आंध्र प्रिेि सरकयर द्वयरय नयमधनर्िाष्ट एक प्रधर्धनधि सि र्;
(iii) आंध्र प्रिेि सरकयर द्वयरय प्रधर्धष्ठर् संथयन अथवय रयज्र् के धवश्वधवद्ययलर् से पयररथधर्की धवज्ञयन और पर्यावरण के क्षेत्र में नयधमर् एक धविेिज्ञ। सि र्;
(iv) रयज्र् जैव-धवधविर्य बोिा कय सि र्-सधचव/ सिर् सि र्;

6.धनिेि धनबिंन
(1) मयनीिरी सधमधर् कय कयर्ाकयल र्ीन विा की अवधि के धलए होगय।
(2) मयनीिरी सधमधर् इस अधिसूचनय के उपबंिों के अनुपयलन को मयनीिर करेगी ।
(3) पयररधथधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ.
1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अनुसूची में के अिीन सधम्मधलर् दक्रर्यकलयपों और इस अधिसूचनय के पैरय 4 के अिीन प्रधर्धिद्ध गधर्धवधिर्ों के धसवयर् आन े वयल ेऐसे दक्रर्यकलयपों की ििय में वयर्धवक धवधनर्िाष्ट थलीर् िियओं पर आियररर् मयनीिरी सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपबंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्रीर् सरकयर के पर्यावरण, वन और जलवयर् ुपररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी ।
(4) इस अधिसूचनय के पैरय 4 के अिीन र्थय धवधनर्िाष्ट प्रधर्धिद्ध दक्रर्यकलयपों के धसवयर्, भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ. 1533(अ) र्यरीख 14 धसर्ंबर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दक्रर्यकलयपों, धजन्हें सधम्मधलर् नहीं दकर्य गर्य ह,ै परंर् ुपयररधथधर्क संवेिी जोन में आर् ेहैं, ऐसे दक्रर्यकलयपों की वयर्धवक धवधनर्िाष्ट थलीर् िियओं पर आियररर् मयनीिरी सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संबद्ध धवधनर्यमक प्रयधिकरणों को धनर्िाष्ट दकर्य जयएगय ।
(5) मयनीिरी सधमधर् कय सिर्-सधचव र्य संबद्ध कलक्िर र्य संरधक्षर् पयका कय उप वन संरक्षक ऐसे व्यधि के धवूपद्ध, जो इस अधिसूचनय के दकसी उपबंि कय उल्लंघन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि फयइल करने के धलए सक्षम होगय ।
(6) मयनीिरी सधमधर् मुद्दों के आियर पर अपेक्षयओं पर धनभार रहर्े हुए संबद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविेिज्ञों, औद्योधगक संगमों र्य संबद्ध पणियररर्ों के प्रधर्धनधिर्ों को अपने धवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(7) मयनीिरी सधमधर् प्रत्र्ेक विा की 31 मयचा र्क की अपनी वयर्िाक कयरावयई ररपोिा रयज्र् के मुख्र् वन्र्जीव वयिान को उपयबिं IV में उपबंधिर् ूपप धवियन के अनुसयर उक् र् विा के 30 जून र्क प्रर्ुर् करेगी ।

And Whereas, copies of the Gazette were made available to the public dated 20 th November 2015;
And Whereas, no comments have been received from public/stakeholders;
And Whereas, the Great Indian Bustard, Rollapadu Wildlife Sanctuary is situated between 15.72 to 15.75 Latitudes and 78.33 to 78.37 Longitudes in Kurnool District of Andhra Pradesh and spread over an area of 6.14 square kilometres;
And Whereas, the Wildlife Sanctuary is located in dry rolling lands of Rollapadu between the Nallamalai and Erramalai Hill Ranges of the Eastern Ghats and has one of the finest grasslands, which offers an excellent habitat for varieties of grassland animals;
And Whereas, the Sanctuary is a pure grassland sanctuary with unique floral and faunal characteristics and the common grasses found in the sanctuary are Aristida funiculate (Cheepuru Gaddi), Chrysopogon fulvus (Golden Beard Grass), Heteropogon species (Black Spear Grass) (Kaseri Gaddi), Cymbopogon species (Boda Gaddi), Sehima nervosum etc. interspersed with Morinda tinctoria,(Togaru), Zizyphus mauritiana (Gotti) and Phoenix (Eeta) along the seasonal streams etc.;
And Whereas, the sanctuary harbours the endangered Great Indian Bustard (Choriotis nigriceps) (Meka Batta Pitta) which is a flagship species of the Sanctuary, and the other prominent animal species are Lesser Florican (Sypheotides indica)( Neelaala Nemali)), Black Buck (Antelope cervicapra) (Krishna Jinka), Indian Wolf (Canis lupas pallipes) (Todelu) and Monitor Lizards (Varanus flavescens) (Udumu), etc.;
And Whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the boundary of the protected area of Great Indian Bustard, Rollapadu Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries or and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause
(xiv) of sub – section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 100 m from the boundary of the Great Indian Bustard, Rollapadu Wildlife Sanctuary covering an area of 1.6751 sq km in the State of Andhra Pradesh, as the Great Indian Bustard, Rollapadu Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundary of Eco-sensitive Zone.-(1) The Eco-sensitive Zone has an extent of 100 metres from the boundary of Great Indian Bustard, Rollapadu Wildlife Sanctuary in Kurnool District of Andhra Pradesh.
(2) The Eco-sensitive Zone does not include any village and the complete Eco-sensitive Zone consists of agricultural fields.
(3) The boundary description of the Eco-sensitive Zone is appended as Annexure I.
(4) The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended as Annexure II; and
(5) The co-ordinates of Great Indian Bustard, Rollapadu Wildlife Sanctuary and Eco-Sensitive Zone are given at Annexure-III.
2. Zonal Master Plan for the Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj ; and
(xi) Public Works Department;
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) Promoted activities and given under para 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.
(2) Natural water bodies: The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Ecosensitive Zone area.
(4) Natural Heritage: All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites: Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution: Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.
(7) Air pollution: Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.
(8) Discharge of effluents: Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes: Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b)No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste: Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management: The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management: The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste: The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic: The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution: Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. .
(16) Industrial Units: (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be egulated in the manner specified in the Table below, namely:- 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S.No. Activity Remarks

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs.
UOI in W.P.(C) No.435 of 2012.
2. Setting up of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution.
No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws.
5. Establishment of new major hydroelectric projects and irrigation projects.
Prohibited (except as otherwise provided) as per applicable laws.
6. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.
7. Discharge of untreated effluents and solid waste in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
8 New wood based industry. Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone:
Provided the existing wood-based industry may continue as per law.
9. Establishment of large scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws.
10. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
Regulated Activities
11. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is II (ii) 17 nearer, except for small temporary structures for Ecotourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
12 Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
(b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries;
convenience stores and local amenities supporting eco-tourism including homestays; and
(v) Promoted activities listed in this Notification.
(b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
13. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
(c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
14. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons, etc.
Regulated (except as otherwise provided) as per applicable laws.
15. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
16. Commercial water resources including ground water harvesting.
(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land;
(b) extraction of surface water and ground water for 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority;
(c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
17. Erection of electrical cables and telecommunication towers.

18. Fencing of existing premises of hotels and lodges.
Regulated under applicable laws.
19. Widening and strengthening of existing roads . shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
20. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.
21. Introduction of exotic species. Regulated under applicable laws.
22. Protection of hill slopes and river banks. Regulated under applicable laws.
23. Discharge of treated effluents in natural water bodies or land area.
Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
24. Commercial Sign boards and hoardings. Regulated under applicable laws.
25. Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws
26. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
27 Collection of Forest produce or Non-Timber Forest Produce (NTFP).

28. Air and vehicular pollution . Regulated under applicable laws.

5. Monitoring Committee:- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
(i) District Collector, Kurnool —Chairman
(ii) One representative of Non Governmental Organization working in the field of environment to be nominated by the Government of Andhra Pradesh —Member
(iii) one expert in the area of ecology and environment from reputed Institution or University of the State to be nominated by the Government of Andhra Pradesh —Member
(iv) Member-Secretary/Member of the State Bio-diversity Board —Member
(v) Regional Officer, State Pollution Control Board, Medak —Member.
(vi) Senior Town Planner of the area/Chief Urban Planner/City Planner —Member.
(vii) Deputy Conservator of Forests (In Charge of the Sanctuary) —Member Secretary.
6. Terms of Reference: (1) The tenure of the Committee shall be three years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
