PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1416] ubZ fnYyh] cq/okj] ebZ 17] 2017@oS'kk[k 27] 1939 No. 1416] NEW DELHI, WEDNESDAY, MAY 17, 2017/VAISAKHA 27, 1939 पयार्वरण, वन और जलवाय ुपिरवतर्न मंᮢ ालय अिधसूचना नई िदल्ली, 17 मई, 2017 का.आ. 1603(अ).–भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. 3222 (अ), तारीख 30 नवम्बर, 2015 ᳇ारा भारत के राजपᮢ, असाधारण मᱶ, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने की संभावना थी, उस तारीख से, िजसको उस राजपᮢ की ᮧितयां, िजसमᱶ यह अिधसूचना अंतिवर᳥् है, जनता को उपलब्ध करा दी गई थी, साठ िदन की अविध के भीतर आक्षेप और सुझाव आमंिᮢत करते हुए एक ᮧारूप अिधसूचना ᮧकािशत की गई थी;
और, उᲦ राजपᮢ, िजसमᱶ उᲦ अिधसूचना अंतिवर᳥् ह,ै की ᮧितयां जनता को तारीख 30 नवम्बर, 2015 को उपलब्ध करा दी गई थी;
और, ᮧारूप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधािरयᲂ से कोई आक्षेप और सुक्षाव ᮧा᳙ नहᱭ हुए ह;ᱹ और, फणसाड वन्यजीव अभयारण्य, महारा᳦ राज्य के रायगढ़ िजला मᱶ 72° 54´ से 73° 02´ उ0 अक्षांश के बीच और 18° 20´ पू0 से 18° 28´ पू0 दशेांतर के बीच अविस्थत ह ैऔर 69.79 वगर् िकलोमीटर क्षेᮢ तक फैला हुआ ह;ै और अभयारण्य मᱶ तᱶदआु(पैथेरा पाडर्स), भारतीय िवशालकाय िगलहरी(पेटायुिरसता िफिलपपेनसीस), िम᮲ के िग जैसे कई िग ᮧजाितयां (नेओपहरून पेरचनुपटेरूस), भारतीय ᳡ेत-समिथर्त िग (गपस बेनगालेदसीस), लᲅग िबल्ड िग (गपस इिडक्युस), िसनेरअस िग (ऐगगपीयुस मोनाचुस) रेड हेडेड िग (सरकोगयपस कालवोस), समुᮤी चील (हालीअइटुस लेयकोगासटेर), मालाबार ᮕे धनेश (ओयकेरोस गरीसेयुस), फॉरेस् ट आऊलेट (हटेरोगलायुक्स बलेवीᲵी), के आ᮰य स् थल ह ैऔर इस वन् यजीव अभयारण्य के पि᳟मी छोर के िनकटवतᱮ तटीय क्षेᮢᲂ मᱶ कई पक्षी ᮧजाितयᲂ एवं अन् य वन् यजीवᲂ तथा ओिलव िरडले टटर्ल् स का ᮧजनन अिभिलिखत िकया गया है और, इस वन् यजीव अभयारण्य मᱶ वनस् पित के रूप मᱶ अर् सदाहिरत, सदाहिरत और नम पणर्पाती वन ह ᱹ। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, फणसाड वन्यजीव अभयारण्य के चारᲂ ओर के क्षेᮢ को, िजसका िवस्तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸दर᳥् ह,ᱹ पािरिस्थितक और पयार्वरण की दिृ᳥ से पािरिस्थितक संवेदी जोन के रूप मᱶ सुरिक्षत और संरिक्षत करना तथा उᲦ पािरिस्थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसंस्करण करने को ᮧितिष करना आवश्यक ह;ै अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए, महारा᳦ राज् य मᱶ फणसाड वन्यजीव अभयारण्य की सीमा से 100 मीटर से 2.75 िकलोमीटर तक के िवस् तार तक के क्षेᮢ को फणसाड वन्यजीव अभयारण्य पािरिस्थितक संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस्थितक संवेदी जोन कहा गया ह)ै के रूप मᱶ अिधसूिचत करती ह,ै िजसका िववरण िन᳜ानुसार ह,ै अथार्त् :--
1. पािरिस्थितक सवंेदी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस्थितक संवेदी जोन का िवस्तार फणसाड वन्यजीव अभयारण्य की सीमा से 100 मीटर से 2.75 िकलोमीटर क्षेᮢ तक ह ैऔर इसका क्षेᮢ 10.96 वगर् िकलोमीटर मᱶ फैला हुआ ह ै।
(2) इस अिधसूचना मᱶ अक्षांश और दशेांतर के साथ पािरिस्थितक संवेदी जोन का मानिचᮢ उपाबधं I के रूप मᱶ उपाब ह ै।
(3) पािरिस्थितक संवेदी जोन मᱶ वन्यजीव अभयारण्य के भू- िनदᱷशांक उपाबंध-II के रुप मᱶ उपाब ह ै।
(4) पािरिस्थितक संवेदी जोन महारा᳦ राज्य के िजला रायगढ़ के मुरुद और रोहा तालुका मᱶ 38 ᮕामᲂ तक फैला हुआ ह ै।
(5) पािरिस्थितक संवेदी जोन के अंतगर्त आने वाले ᮕामᲂ की सूची के साथ सवᱷक्षण संख्यांक उपाबंध III के रूप मᱶ उपाब ह ै।
2. पािरिस्थितक सवंदेी जोन के िलए आंचिलक महायोजना – (1) राज्य सरकार, पािरिस् थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन की तारीख से दो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से और राज्य मᱶ सक्षम ᮧािधकारी के अनुमोदन के िलए इस अिधसूचना मᱶ िदए गए अनुबंधᲂ के सामंजस् य से आंचिलक महायोजना तैयार करेगी ।
(2) आंचिलक महायोजना राज् य सरकार के सक्षम ᮧािधकारी ᳇ारा अनुमोिदत होगी ।
(3) राज्य सरकार ᳇ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ यथा िविन᳸दर्ष् ट रीित मᱶ तथा सुसंगत कᱶ ᮤीय और राज् य िविधयᲂ के सामंजस् य से भी और कᱶ ᮤीय सरकार ᳇ारा जारी मागर्िनदᱷशᲂ, यिद कोई हᲂ, ᳇ारा तैयार की जाएगी ।
(4) आंचिलक महायोजना, पयार्वरणीय और पािरिस्थितक िवचारᲂ को समाकिलत करने के िलए राज् य सरकार के सभी संब िवभागᲂ के परामशर् से तैयार की जाएगी, अथार्त्:--
(i) पयार्वरण;
(ii) वन और वन्यजीव;
(iii) कृिष ;
(iv) राजस् व;
(v) नगर िवकास;
(vi) पयर्टन;

(vii) ᮕामीण िवकास;
(viii) िसंचाई और बाढ़ िनयंᮢण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मार्ण िव भाग।
(5) आंचिलक महायोजना अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचना और िᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ िविन᳸दर्ष् ट न हो और आचंिलक महायोजना सभी अवसंरचना और िᮓयाकलापᲂ मᱶ और अिधक दक्षता और पािरिस्थितक अनुकूलता का संवधर्न करेगी ।
(6) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण से संबंिधत ऐसे अन्य पहलूᲐ, िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध हᲂगे ।
(7) आंचिलक महायोजना सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और नगरीय बंदोबस्तᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैसे उ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष क्षेᮢ, फलोउ᳒ान, झीलᲂ और अन्य जल िनकायᲂ का अभ्यकंन करेगी और इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧस्तािवत भूिम के उपयोग का िववरण िकया जाएगा ।
(8) आंचिलक महायोजना स् थानीय पािरिस् थितक संवेदी जोन मᱶ िवकास को िविनियमत करेगी और पैरा 4 मᱶ सारणी मᱶ सूचीब ᮧितिष और िविनयिमत िᮓयाकलाप का पालन करना िजससे समुदायᲂ की जीवकोपाजर्न की सुरक्षा के िलए पािरिस् थितक अनुकूल िवकास का सुिन श् चय िकया जा सके ।
(9) आंचिलक महायोजना क्षेᮢीय िवकास योजना के साथ सह-अंतक होगी ।
(10) आंचिलक महायोजना इस अिधसूचना मᱶ िदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए मानीटरी सिमित के िलए एक संदभर् दस्तावेज तैयार करेगी ।
3. राज्य सरकार ᳇ारा िकए जान े वाल े उपाय-- राज्य सरकारᱶ इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथार्त् :--
(1) भ-ूउपयोग - पािरिस् थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष क्षेᮢ ᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचिन्हत िकए गए पाकᲄ और खुले स्थानᲂ का वािणिज्यक और औ᳒ोिगक संब िवकास िᮓयाकलापᲂ के िलए उपयोग या संपिरवतर्न नहᱭ होगा:
परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न, मानीटरी सिमित की िसफािरश पर और राज्य सरकार के पूवर् अनुमोदन से, स्थानीय िनवािसयᲂ की आवासीय जरूरतᲂ को पूरा करने के िलए सूचीब िᮓयाकलापᲂ को पूरा करने के िलए अनुज्ञात हᲂगे, अथार्त् :-
(i) पािरिस् थितक अनुकूल पयर्टन िᮓयाकलापᲂ के िलए पयर्टकᲂ के अस् थायी आवासन के िलए पािरिस् थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आिद;
(ii) िव᳒मान सड़कᲂ को चौड़ा और सुदढ़ृ बनाना;
(iii) ᮧदषूण कािरत न करने वाले लघु उ᳒ोग ;

(v) कुटीर उ᳒ोग, िजसके अंतगर्त ᮕामीण उ᳒ोग, सुिवधा भंडार और स् थानीय सुख-सुिवधाएं ह ᱹ:
परंतु यह और िक राज्य सरकार के पूवर् अनुमोदन और संिवधान के अनुच् छेद 244 या तत्समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनुज्ञात नहᱭ होगा :
परंतु यह भी िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुिट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को सूचना देनी होगी । परंतु यह भी िक उपयुर्Ღ ᮢुिट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा मᱶ भू- उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा । परंतु यह भी िक िजससे हिरत क्षेᮢ मᱶ जैसे वन क्षेᮢ, कृिष क्षेᮢ आिद मᱶ कोई पािरणािमक कटौती नहᱭ होगी और अनᮧयुक् त या अनुत् पादक कृिष क्षेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए आंचिलक महायोजना मᱶ सिम् मिलत होगी और राज् य सरकार ᳇ारा ऐसे क्षेᮢᲂ पर या उनके िनकट िवकास िᮓयाकलाप ᮧितिष करने के िलए ऐसी रीित से मागर्िनदᱷश तैयार िकए जाएंगे ।
(3) पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर पयर्टन संबंधी िᮓयाकलाप पयर्टन महायोजना के अनुसार हᲂगे जो िक आंचिलक महायोजना के भाग रूप मᱶ होगी । (ख) पयर्टन महायोजना पयर्टन िवभाग, महारा᳦ ᮧदेश सरकार ᳇ारा महारा᳦ सरकार के राजस्व िवभाग और वन िवभाग, के परामशर् से तैयार की जाएगी । (ग) पयर्टन संबंधी िᮓयाकलाप िनम् निलिखत के अधीन िविनयिमत हᲂगे, अथार्त्:-
(i) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार कᱶ ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय के मागर्दशर्क िसांतᲂ के ᳇ारा तथा राष् ᮝीय व् याᮖ संरक्षण ᮧािधकरण, ᳇ारा जारी पािरिस्थितक पयर्टन (समय-समय पर यथा संशोिधत) मागर्दशर्क िसांतᲂ के अनुसार, पािरिस्थितक पयर्टन, पािरिस्थितक िशक्षा और पािरिस्थितक िवकास को महत्व दतेे हुए पािरिस्थितक संवेदी जोन की वहन क्षमता के अध्ययन पर आधािरत होगा;
(ii) पािरिस् थितक अनुकूल पयर्टक िᮓयाकलापᲂ के संबंध मᱶ अस्थायी अिधभोग के िलए वास सुिवधा के िसवाय फणसाड वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर भीतर होटल और िरसोटᲄ का नया संिनमार्ण अनुज्ञात नहᱭ होगा ।
(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार को वास्तिवक स्थल िविन᳸दर᳥् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनुज्ञात िकया होगा ।
(4) नैसिगर्क िवरासत -- पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नैसिगर्क िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आिद की पहचान की जाएगी और उन्हᱶ संरिक्षत िकया जाएगा तथा उनकी सुरक्षा और संरक्षा के िलए इस अिधसूचना के ᮧकाशन की तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(5) मानव िनिमर्त िवरासत स् थल - पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षेᮢ ᲂ की पहचान करनी होगी और इस अिधसूचना के ᮧकाशन की तारीख से छह माह के भीतर उनके संरक्षण की योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सिम्मिलत की जाएगी ।
(6) ध् विन ᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ ध् विन ᮧदषूण के िनयंᮢण के िलए राज् य सरकार का पयार्वरण िवभाग या महारा᳦ राज् य ᮧदषूण िनयंᮢण बोडर् पयार्वरणीय (संरक्षण) अिधिनयम, 1986 के अधीन ध्विन ᮧदषूण (िविनयमन और िनयंᮢण) िनयम, 2000 के अंतगर्त कायार्िन्वत करेगा ।
(7) वाय ुᮧदषूण -- पािरिस्थितक संवेदी जोन मᱶ, वायु ᮧदषूण के िनयंᮢण के िलए राज्य सरकार का पयार्वरण िवभाग या महारा᳦ राज् य ᮧदषूण िनयंᮢण बोडर् वायु (ᮧदषूण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए कड़ा मागर्दशर्क िसांत अपनाया जाएगा िनयमᲂ के उपबंधᲂ के अनुसार वायु ᮧदषूण के िलए पयार्वरण के संरक्षण के िलए और अिधक मागर्दशर्क िसांतᲂ और िविनयमᲂ को कायार्िन्वत करेगा । यिद अपेिक्षत ह ै।
(8) बिह᮲ाव का िनस्सारण -- पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण सामान्य मानकᲂ के िलए पयार्वरणीय ᮧदिूषत आच्छािदत के िनस्सारण के अंतगर्त पयार्वरण (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा।
(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत रूप मᱶ होगा--
(i) पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण, समय-समय पर संशोिधत ठोस अपिशष् ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत िकए गए थे, के उपबंधᲂ के अनुसार िकया जाएगा ;
(ii) स्थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के माध्यम से पुनःचिᮓत िकया जाएगा ;
(iv) अकाबर्िनक सामᮕी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी पयार्वरणीय स्वीकृत रीित मᱶ होगा और पािरिस्थितक संवेदी जोन मᱶ ठोस अपिशष् टᲂ को जलाना या भष् मीकरण अनुज्ञात नहᱭ होगा।
(10) जैव िचिकत् सीय अपिशष् ट- पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की समय-समय पर यथासंशोिधत अिधसूचना स.का.िन 343 (अ), तारीख 28 माचर् 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ।
(11) प्लािस्टक अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(12) संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा।
(13) यानीय यातायात- पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज् य सरकार के सक्षम 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ᮧािधकारी ᳇ारा अनुमोिदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(14) औ᳒ोिगक इकाईया ं- (क) ᮧस् तािवत पािरिस्थितक संवेदी जोन के भीतर नए काष् ठ उ᳒ोगᲂ की स् थापना िविध के अनुसार स् थािपत िव᳒मान काष् ठ आधािरत उ᳒ोगᲂ के िलए अनुज्ञात की जाएगी अन् यथा नहᱭ । (ख) ᮧस् तािवत पािरिस्थितक संवेदी जोन के भीतर जल, वायु, मृदा, ध् विन ᮧदषूण उत् पन् न करने वाले िकसी नए उ᳒ोग की स् थापना नहᱭ की जाएगी ।
4. पािरिस्थितक सवंदेी जोन मᱶ ᮧितिष और िविनयिमत िकए जाने वाले िᮓयाकलापᲂ की सचूी - पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸दर᳥् रीित मᱶ िविनयिमत हᲂगे, अथार्त् :-- सारणी ᮓम स.ं िᮓयाकलाप वणर्न
(1) (2) (3) क. ᮧितिष िᮓयाकलाप
1. वािणिज्यक खनन, पत्थर की खदान और उनको तोड़ने की इकाइयां । (क) सभी ᮧकार के नए और िव᳒मान खनन (लघु और वृहत खिनज), पत्थर की खानᱶ और उनको तोड़ने की इकाइयां वास्तिवक स्थानीय िनवािसयᲂ की घरेलू आवश्यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमार्ण या मरम्मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइल्स या ईंटᲂ का िनमार्ण करना भी सिम्मिलत ह,ै के िसवाय नहᱭ हᲂगी ;
(ख) खनन संिᮓयाएं, माननीय उᲬतम न्यायालय की िरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमर्न िथरुमूलपाद बनाम भारत सरकार के मामले मᱶ आदशे तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतिरम आदशे के अनुसरण मᱶ सवर्दा ᮧचालन होगा ।
2. ᮧदषूण (जल या वायु या मृदा या ध् विन, आिद) कािरत करने वाले उ᳒ोगᲂ की स् थापना । कोई नई या पािरिस्थितक संवेदी जोन मᱶ ᮧदषूण फैलाने वाले उ᳒ोगᲂ के िवस्तार की अनुमित नहᱭ दी जाएगी। पािरिस्थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफर् गैर- ᮧदिूषत उ᳒ोगᲂ की स्थापना के वगᱮकरण की अनुमित दी जाएगी, जब तक िक इस अिधसूचना मᱶ िविन᳸दर᳥् न हो।
3. बृहत जल िव᳒ुत पिरयोजना की स्थापन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
4. िकसी पिरसंकटमय पदाथᲄ का उपयोग या उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
5. ᮧाकृितक जल िनकायᲂ या भूिम क्षेᮢ मᱶ अनुपचािरत ᮧवाह के िनवर्हन । लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे । ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
6. ठोस अपिश᳥ िनपटान स्थल की स्थापना और सामान्य जलाए जाने की सुिवधा के िलए ठोस और जैव िचिकत्सा अपिश᳥। पािरिस्थितक संवेदी जोन मᱶ कोई ठोस अपिश᳥ िनपटान की कोई नई ठोस अपिश᳥ िनपटान स्थल और अपिश᳥ उपचािरत/ᮧसंस्करण सुिवधा की अनुमित नहᱭ है । औ᳒ोिगक ᮧिᮓया और स्वास्थ्य ᮧित᳧ान/अस्पतालᲂ आिद से उत्प᳖ िकसी भी ठोस अपिश᳥ के उपचािरत के िलए सामान्य या ᳞िᲦगत जलावतरण की सुिवधा का अिधकतर ᮧितिष ह ै।
7. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणिज्यक पशुधन संपदा और कुक्कुट फामᲄ की स्थापना । स्थानीय जरूरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे।
8. नई आरा िमलᲂ की स्थापना। पािरिस्थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
9. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष (अन् यथा उपबंिधत के िसवाय) हᲂगे । ख. िविनयिमत िᮓयाकलाप
10. होटलᲂ और िरसोटᲄ की स्थापना । पािरिस्थितक पयर्टन िᮓयाकलापᲂ संबंधी पयर्टकᲂ की लघु संरचनाᲐ के िलए संरिक्षत क्षेᮢ की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक, इनमᱶ जो भी िनकट ह,ै नए वािणिज्यक होटल और िरसोटर् अनुज्ञात हᲂगे, अन्यथा नहᱭ । परंतु, जहाँ पािरिस्थितक संवेदी जोन का िवस्तार एक िकलोमीटर से ज्यादा ह ैवहाँ, एक िकलोमीटर से परे और पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए पयर्टक िᮓयाकलाप या िव᳒मान िᮓयाकलाप का िवस्तार पयर्टन महायोजना और यथा लागू मागर्दशᱮ िसांतᲂ के अनुरुप होगा।
11. संिनमार्ण िᮓयाकलाप । (क) संरिक्षत क्षेᮢ या पािरिस्थितक संवेदी जोन जो भी िनकट हो, की सीमा से एक िकलोमीटर के भीतर िकसी भी ᮧकार का वािणिज्यक संिनमार्ण अनुज्ञात नहᱭ िकया जाएगा:
परंतु स् थानीय लोगᲂ को पैरा 6 के उप पैरा (1) मᱶ सूचीब िᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकी भूिम मᱶ संिनमार्ण करने की अनुमित भवन उपिविधयᲂ के अनुसार दी जाएगी ।
(i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना तथा नई सड़कᲂ का संिनमार्ण;
(ii) बुिनयादी ढांचᲂ और नागिरक सुिवधाᲐ का संिनमार्ण और नवीकरण;
(iii) कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण उ᳒ोग ह;ᱹ सुिवधाजनक भण्डार और स्थानीय सुख सुिवधाᲐ जो पािरिस्थितक पयर्टन िजस मᱶ सहायक हो ᮕह वास; और
(iv) इस अिधसूचना मᱶ संविधर्त िᮓयाकलापᲂ की सूची । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
12. ᮧदषूण उत्प᳖ न करने वाले लघु उ᳒ोग । पािरिस्थितक संवेदी जोन के कᱶ ᮤीय ᮧदषूण िनयंᮢण बोडर् ᳇ारा जारी िदशािनदᱷशᲂ मᱶ फरवरी, 2016 के भीतर िसफर् गैर- ᮧदिूषत उ᳒ोगᲂ की स्थापना के वगᱮकरण की अनुमित दी जाएगी, जब तक िक इस अिधसूचना मᱶ िविन᳸दर᳥् न हो। इसके अलावा, गैर-ᮧदिूषत कुटीर उ᳒ोगᲂ को ᮧितिष िकया जाएगा।
13. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वनᲂ मᱶ ᳴कंही वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶ ᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
14. जलावन लकिड़यᲂ का वािणिज्यक उपयोग । लागू िविधयᲂ के अनुसार िविनयिमत (अन् यथा उपबंिधत के िसवाय) हᲂगे।
15. वन उत्पादᲂ और गैर काष् ठ वन उत्पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
16. िव᳒ुत केबलᲂ और दरूसंचार टावरᲂ का पिरिनमार्ण और केबल िबछाना और अन्य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे (भूिमगत केबल को बढ़ावा िदया जाएगा)।
17. नागिरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार न्यूनीकरण की उपायᲂ के साथ, िनयम और िविनयमन और उपलब्ध िदशािनदᱷश िविनयिमत हᲂगे।
18. िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदढृ करना । लागू िविधयᲂ के अनुसार न्यूनीकरण की उपायᲂ के साथ, िनयम और िविनयमन और उपलब्ध िदशािनदᱷश िविनयिमत हᲂगे।
19. पयर्टन से संबंिधत िᮓयाकलाप जैसे गमर् वायु गुब्बारᱶ, हलेीकाप्टर, ᮟोन, माइᮓोलाइटस और अन्य पयर्टन िᮓयाकलाप आिद ᳇ारा पािरिस्थितक संवेदी जोन के ऊपर से उड़ना जैसे अन्य िᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
20. पहाड़ी ढालᲂ और नदी तटᲂ का संरक्षण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
22. स्थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । स्थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
23. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ उपचािरत/ बिह᮲ार्व का िनस्सारण । उपचािरत बिह᮲ार्व के पुनचर्ᮓण को ᮧोत्सािहत करने और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन िकया जाएगा । अन्यथा लागू िविधयᲂ के अधीन उपचािरत बिह᮲ार्व के पुनचर्ᮓण/ᮧवाह के िनवर्हन को िविनयिमत िकया ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 जाएगा।
24. सतह और भूजल के वािणिज्यक िनष्कषर्ण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
25. खुले कुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा िᮓयाकलापᲂ की सख्ती से मानीटरी की जाएगी।
26. ठोस अपिशष् ट ᮧबंधन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. िवदशेी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. पािरिस्थितक पयर्टन। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
29. पोिलथीन बैगᲂ का उपयोग A लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
30. वािणिज् यक साइनबोडर् और होिडᲈग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । ग. संविधर्त िᮓयाकलाप
31. वषार् जल संचयन । सिᮓय रूप से बढ़ावा िदया जाएगा ।
32. जैिवक खेती। सिᮓ य रूप से बढ़ावा िदया जाएगा ।
33. सभी गितिविधयᲂ के िलए हिरत ᮧौ᳒ोिगकी को ᮕहण करना । सिᮓय रूप से बढ़ावा िदया जाएगा ।
34. कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर, आिद भी ह ᱹ। सिᮓय रूप से बढ़ावा िदया जाएगा ।
35. नवीकरणीय ऊजार् ᮲ोत का उपयोग । बायोगैस, सौर ᮧकाश इत् यािद को बढ़ावा िदया जाना ह ै।
36. कृिष वािनकी । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
37. पािरिस्थितक अनुकूल पिरवहन का उपयोग । सिᮓय रूप से बढ़ावा िदया जाएगा ।
38. कौशल िवकास । सिᮓय रूप से बढ़ावा िदया जाएगा ।
39. िन᳜ीकृत भूिम/वन/ आवास की बहाली । सिᮓ य रूप से बढ़ावा िदया जाएगा ।
40. पयार्वरणीय जागरुकता । सिᮓय रूप से बढ़ावा िदया जाएगा ।
5. मानीटरी सिमित- कᱶ ᮤीय सरकार ᳇ारा, पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 3 की उप-धारा (3) के अधीन इस अिधसूचना के उपबंधᲂ की ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन िकया गया, जो िन᳜िलिखत से िमलकर बनेगी, अथार्त्:--
(i) कलक्टर, िजला रायगढ़ -अध्यक्ष;
(ii) गैर सरकारी संगठन का एक ᮧितिनिध जो पयार्वरण के क्षेᮢ मᱶ कायर् कर रहा ह,ै िजसे महारा᳦ सरकार ᳇ारा नाम िन᳸दर᳥् िकया जाएगा -सदस्य;

(iii) पािरिस्थितक और पयार्वरण के क्षेᮢ मᱶ एक िवशेषज्ञ िजसे महारा᳦ सरकार ᳇ारा नाम िन᳸दर᳥् िकया जाएगा -सदस्य;
(iv) सदस्य सिचव/राज्य जैव-िविवधता बोडर् का सदस्य -सदस्य;
(v) वन संरक्षक, ठाणे िजला -सदस्य;
(vi) क्षेᮢीय अिधकारी, महारा᳦ राज्य ᮧदषूण िनयंᮢण बोडर् -सदस्य;
(vii) क्षेᮢ का ज्ये᳧ नगर योजनाकार -सदस्य;
(viii) उप वन संरक्षक, वन्यजीव ᮧभाग, थाणे -सदस्य सिचव।
6.िनदᱷश िनबधंन:(1) पािरिस्थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(2) मानीटरी सिमित का कायर्काल राजपᮢ मᱶ इस अिधसूचना ᮧकाशन की तारीख से तीन वषर् की अविध के िलए होगा।
(3) पािरिस्थितक संवेदी जोन मᱶ भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना सं. का.आ.
1533(अ), तारीख 14 िसतंबर, 2006 की अनुसूची के अधीन सिम्मिलत िᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸दर्ष् ट ᮧितिष गितिविधयᲂ के िसवाय आने वाले िᮓयाकलापᲂ की वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवर् पयार्वरण िनकासी के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को िन᳸दर᳥् की जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸दर᳥् ᮧितिष िᮓयाकलापᲂ के िसवाय, भारत सरकार के तत्कालीन पयार्वरण और वन मंᮢालय की अिधसूचना संख्यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 की अिधसूचना के अनुसूची के अधीन ऐसे िᮓयाकलापᲂ, िजन्हᱶ सिम्मिलत नहᱭ िकया गया ह,ै और जो पािरिस्थितक संवेदी जोन मᱶ आते ह,ᱹ ऐसे िᮓयाकलापᲂ की वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸दर᳥् िकया जाएगा ।
(5) मानीटरी सिमित का सदस्य-सिचव या संब कलक्टर या संरिक्षत क्षेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवरू, जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता ह,ै पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम होगा।
(6) मानीटरी सिमित मुा दर मुा के आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक संगमᲂ या संब पणधािरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।
(7) मानीटरी सिमित ᮧत्येक वषर् की 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य वन्य जीव वाडर्न को उपाबंध IV मᱶ उपबंिधत रूप िवधान के अनुसार उक् त वषर् के 30 जून तक ᮧस्तुत करेगी ।
(8) केन्ᮤीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय मानीटरी सिमित को अपने कृत्यᲂ के ᮧभावी िनवर्हन के िलए ऐसे िनदशे दे सकेगा, जो वह ठीक समझे ।

8. कोई अन् य महत् वपूणर् िवषय । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 17th May, 2017 S.O. 1603(E).—Whereas, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.
3222(E), dated 30th November, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the Gazette were made available to the public on the 30th November, 2015, And whereas, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;
And whereas, the Phansad Wildlife Sanctuary is situated in the Raigad District of Maharashtra between 72° 54’ to 73° 02’ North latitude and between 18° 20’ to 18° 28’ East longitude and is spread across an area of 69.79 square kilometres;
And whereas, the Phansad Wildlife Sanctuary harbours Leopard (Panthera pardus), Indian Giant Squirrel (Petaurista philippensis), several Vulture species such as Egyptian Vulture (Neophron percnopterus), Indian White- 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] backed Vulture (Gyps bengalensis), Long-billed Vulture (Gyps indicus), Cinereous Vulture (Aegypius monachus ), Redheaded Vulture (Sarcogyps calvus), Sea Eagle (Haliaeetus leucogaster), Malabar Grey Hornbill (Ocyceros griseus), Forest Owlet (Heteroglaux blewitti) and host of birds species and other fauna and a number of Olive Ridley Turtles breeding have been recorded in the adjacent coastal areas along the western side of the said Sanctuary;
And whereas, the flora of Phansad Wildlife Sanctuary is represented by Semi Evergreen, Evergreen, and Moist deciduous Forests;
And whereas, it is necessary to conserve and protect the area,the extent and boundary of which are specified in paragraph 1, around the Phansad Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
Now therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 100 metres to 2.75 kilometres from the boundary of Phansad Wildlife Sanctuary in the State of Maharashtra as the Phansad Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area of 10.96 square kilometres with an extent varying from 100 metres to 2.75 kilometres from the boundary of Phansad Wildlife Sanctuary.
(2) The map of the Eco-sensitive Zone along with latitude and longitude is appended to this notification as Annexure I.
(3) The Geo coordinates of the Phansad Wildlife Sanctuary and Eco-sensitive Zone is appended as Annexure II.
(4) The Eco-sensitive Zone is spread across 38 villages in Murud and Roha Taluka of Raigad District in Maharashtra.
(5) The list of the villages falling within Eco-sensitive Zone along with survey numbers is appended as Annexure III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent Authority in the State.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said Plan-:
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal ;
(x) Panchayati Raj;
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 ensure and promote eco-friendly development for livelihood security of local communities.
(9) The Zonal Master Plan shall be co-terminus with the Regional Development Plan
(10) The Zonal Master Plan shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the following activities namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities;
(ii) widening and strengthening of existing roads;
(iii) small scale industries not causing pollution;
(iv) rain water harvesting;and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit development activities at or near the catchment areas which are detrimental to such area .
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.
(c) The activities of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Ecosensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometre or up to the extent from the boundary of the Phansad Wildlife Sanctuary except for accommodation for temporary occupation of tourists related toe - friendly tourism activities.
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification in the office Gazette and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefact areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification in the office Gazette and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986
(7) Air pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder. If required, standards may be made more stringent for protection of environment.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. -
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016, as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical wastes.- The Bio-Medical waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.
(13) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(14) Industrial units.- (a) No establishment of new wood based Industries within the Eco-sensitive Zone shall be permitted except the existing wood based Industries set up as per the law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco -sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- ¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 19 TABLE Sl. 1. Commercial mining, stone quarrying and crushing units.
(a) New (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for personal consumption.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (water, air, soil, noise, etc.).
(a)No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries may be permitted allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio-medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste shall be permitted within the Eco-sensitive Zone and installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment hospitals etc. shall be prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, companies etc.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.

10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
(a) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as:
(i) Widening and strengthening of existing roads and construction of new roads;
(ii) Construction and renovation of infrastructure and civic amenities;
(iii) Cottage industries including village industries; convenience stores & local amenities supporting eco-tourism including home stays; and
(iv) Promoted activities listed in this Notification.
12. Small scale non polluting industries.
Non polluting industries termed as white category as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, smallscale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority.
13. Felling of trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the relevant concerned Central or State Acts and the rules made thereunder.
14. Commercial use of fire wood . Regulated (except saw mills and other wood based industries) under applicable laws.
15. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).
Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law (underground cabling may be promoted).

17. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules regulations and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules, regulations and available guidelines.
19. Under taking other activities related to tourism like over flying the Eco-sensitive Zone by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
20. Protection of hill slopes and river banks.
Regulated under applicable laws.
21. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
23. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. and efforts shall be made for recycle and reuse of treated waste water. and the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water.
Regulated under applicable law.
25. Open Well, bore well etc. for agriculture or other usage.
Permitted for local use otherwise it shall be regulated and the activity shall be monitored by the concerned authority.
26. Solid waste management. Regulated under applicable laws.
27. Introduction of Exotic species. Regulated under applicable laws.
28. Eco-tourism. Regulated under applicable laws.
29. Use of polythene bags. Regulated under applicable laws.
30. Commercial sign boards and hoardings.
Regulated under applicable laws.
C. Promoted Activities
31. Rain water harvesting. Shall be actively promoted.
32. Organic farming. Shall be actively promoted.
33. Adoption of green technology for all activities.
Shall be actively promoted.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:-
(i) The Collector of Raigad District Chairman;
(ii) One representative of Non Governmental Organisation working in the field of environment to be nominated by the Government of Maharashtra Member;
(iii)
(iv) one expert in the area of ecology and environment to be nominated by the Government of Maharashtra Member-Secretary/Member of the State Biodiversity Board Member;
Member;
(v) Conservator of Forest, Thane district Member ;
(vi) The Regional Officer, Maharashtra State Pollution Control Board, Member;
(vii) The Senior Town Planner of the area Member;
(viii) The Deputy Conservator of Forest, Wildlife Division, Thane Member Secretary .
6. Terms of reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The tenure of the Monitoring Committee shall be for a period of three years form the date of publication in this notification in the office Gazetted .
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 therof, shall be scrutinized by the Monitoring Committee based on site-specific conditions and referred to concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
34. Cottage industries including village artisans, etc.

35. Use of renewable energy and fuels. Bio gas, solar light, etc. Shall be actively promoted
36. Agro-Forestry. Shall be actively promoted.
37. Use of eco-friendly transport. Shall be actively promoted.
38. Skill Development. Shall be actively promoted.
39. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
40. Environmental Awareness . Shall be actively promoted.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
