PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY 1417] No. 1417] NEW DELHI, WEDNESDAY, MAY 17, 2017/VAISAKHA 27, 1939 पर्यावरण, वन और जलवयर् ुपररवर्ान मतं्रयलर् अधिसचूनय नई दिल्ली, 17 मई, 2017 कय.आ.1604(अ).–भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. 3121 (अ), र्यरीख 20 नवम्बर, 2015 द्वयरय भयरर् के रयजपत्र, असयियरण में, प्रयरुप अधिसूचनय प्रकयधिर् की गई थी धजसमें उन सभी व्यधिर्ों से, धजनके उससे प्रभयधवर् होने की संभयवनय थी, उस र्यरीख से, धजसको उस रयजपत्र की प्रधर्र्यं, धजसमें र्ह अधिसूचनय अंर्र्वाष्ट ह,ै जनर्य को उपलब्ि करय िी गई थी, सयठ दिन की अवधि के भीर्र आक्षेप और सुझयव आमंधत्रर् दकए थे;
और, प्रयरुप अधिसूचनय के प्रत्र्ुत्तर में सभी व्यधिर्ों और पणियररर्ों से कोई आक्षेप और सुक्षयव प्रयप्त नहीं हुए;
द्यानगंगा वन् र्जीव अभर्यर् र् महयरयष्ट र रय र् के ढुलायनय धजले में 1 ° 58' 40" से 1 ° 58' 42" उत्तर अक्षयंि और 76° 31' 45" स े 76° 31' 56" पूवा ििेयंर्र में ध थर् ह ैऔर र्ह 203.21 वगा दकलोमी र क्षेत्र में लैलय हुआ है;
और अभर्यर् र् में र्ेंिआु (पैंथेरय पयर्ास), रीछ(मेलुरसूस अरसीनूस), भेध़िर्य(कनीस लुपुस पल्लीपेस), लक़िढग् घय(हयेना हयेना), लोम़िी(वोलपेस बेनगालेनसीस), नीलगयर्(बोसेलाफुस टरागोसामेलुस), ढनैलय सूअर(सुस स्क्रोफा), पीलोल( पवो करीसटटुस), कयलय मृग(अनटेलोप सेरवीकापरा) कय आश्रर् ह ैऔर इसमें िुष्ट क पर्झ़ि सयगनन र्थय रे्् कन प्रयर्द्वीप जोन के 6ख-कें द्रीर् पठयर के जैधवक प्रयन् र् के धवधवि प्रकयर के वन हैं ;
और, द्यानगंगा वन् र्जीव अभर्यर् र् के संरधक्षर् क्षेत्र के चयरों ओर के क्षेत्र को, पयररधथधर्क और पर्यावरण की िधृष्ट से पयररधथधर्क संवेिी जोन के रूप में सुरधक्षर् और संरधक्षर् करनय आवश्र्क है ;
अर्ः, अढ, केन्द्रीर् सरकयर, पर्यावरण (संरक्षण) धनर्म, 1986 के धनर्म 5 के उपधनर्म (3) के सयथ परठर् पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (1) और उपियरय (2) के खंर् (v) और खंर् (xiv) और उपियरय (3) द्वयरय प्रित्त िधिर्ों कय प्रर्ोग करर्े हुए, महयरयष्ट र रय र् में द्यानगंगा वन् र्जीव अभर्यर् र् की सीमय से 1.38 ककलोमी र से 8.10 दकलोमी र र्क के धव र्यर वयले क्षेत्र को द्यानगंगा वन् र्जीव अभर्यर् र् पयररधथधर्क संवेिी जोन (धजसे इसमें इसके पश् चयर् पयररधथधर्क संवेिी जोन कहय गर्य ह)ै के रूप में अधिसूधचर् करर्ी ह,ै धजसकय ब्र्नरे धनम्नयनुसयर ह,ै अथयार् :-- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
1. पयररधथधर्क सवंिेी जोन कय धवर्यर और उसकी सीमयएं--(1) पयररधथधर्क संवेिी जोन द्यानगंगा वन् र्जीव अभर्यर् र् की सीमय से 1.380 दकलोमी र से 8.10 दकलोमी र र्क धवर्यर के सयथ 297.85 वगा दकलोमी र के क्षेत्र में लैलय हुआ ह ै और ऐस े पयररधथधर्क संवेिी जोन की सीमय कय वणान उपयढिं I के रुप में उपयढद्ध ह ै।
(2) वन् र्जीव अभर्यर् र् और पयररधथधर्क संवेिी जोन कय मानचित्र इस अधिसूचनय के सयथ उपयढिं-II के रुप में उपयढद्ध ह ै।
(3) वन् र्जीव अभर्यर् र् और पयररधथधर्क संवेिी जोन के भू-धनििेयंक उपयढिं-III के रुप में इस अधिसूचनय के सयथ उपयढद्ध ह ै।
(4) पयररधथधर्क संवेिी जोन, महयरयष्ट र रय र् के ढुलायनय धजले के 37 ग्रयमों र्क लैलय ह ैऔर पयररधथधर्क संवेिी जोन के भीर्र आने वयले ग्रयमों की सूची प्रमुख धढन् िओुं क के चनर्दशेांक के सयथ उपयढिं IV के रुप में उपयढद्ध ह ै।
2. पयररधथधर्क सवंिेी जोन के धलए आचंधलक महयर्ोजनय – (1) रय र् सरकयर, पयररध थधर्क संविेी जोन के प्रर्ोजन के धलए रयजपत्र में इस अधिसूचनय के प्रकयिन की र्यरीख से िो वर्ा की अवधि के भीर्र, थयनीर् व्यधिर्ों के परयमिा से और रय र् के सक्षम प्रयधिकयरी के अनुमोिन के धलए इस अधिसूचनय में दिए गए अनुढंिों कय पयलन करर्े हुए आंचधलक महयर्ोजनय र्ैर्यर करेगी ।
(2) उि र्ोजनय रय र् सरकयर के सक्षम प्रयधिकयरी द्वयरय अनुमोदिर् होगी ।
(3) रय र् सरकयर द्वयरय पयररध थधर्क संवेिी जोन के धलए आचंधलक महयर्ोजनय ऐसी रीधर् में जो इस अधिसूचनय में र्थय धवधनर्िाष्ट ह ैर्थय सुसंगर् कें द्रीर् और रय र् धवधिर्ों के अनुरुप भी और कें द्रीर् सरकयर द्वयरय जयरी मयगाधनििेों, र्दि कोई हों, द्वयरय र्ैर्यर की जयएगी ।
(4) आंचधलक महयर्ोजनय, पयररधथधर्क और पर्यावरणीर् धवचयरों को समयकधलर् करने के धलए रय र् सरकयर के धनम्नधलधखर् धवभयगों के परयमिा से र्ैर्यर की जयएगी, अथयार् :--
(i) पर्यावरण;
(ii) वन और वन्र्जीव;
(iii) कृधर्;
(iv) रयज व;
(v) नगर धवकयस;
(vi) पर्ा न;
(vii) ग्रयमीण धवकयस;
(viii) ससंचयई और ढयढ़ धनर्ंत्रण;
(ix) नगरपयधलकय;
(x) पंचयर्र्ी रयज;और
(xi) लोक धन मयाण धव भयग।
(5) आंचधलक महयर्ोजनय अनुमोदिर् धवद्यमयन भू-उपर्ोग, अवसंरचनय और दिर्यकलयपों पर र्ढ र्क कोई धनढंिन अधिरोधपर् नहीं करेगी जढ र्क दक इस अधिसूचनय में इस धवधनर्िाष्ट न हो और आचंधलक महयर्ोजनय सभी अवसंरचनय और दिर्यकलयपों में और अधिक िक्षर्य और पयररधथधर्क अनुकूलर्य कय संविान करेगी ।
(6) आंचधलक महयर्ोजनय में अनयच्छयदिर् क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकयर्ों के संरक्षण, आवयह क्षते्रों के प्रढंिन, जल-संभरों के प्रढंिन, भूधमगर् जल के प्रढंिन, मृिय और नमी संरक्षण, थयनीर् समुियर्ों की आवश्र्कर्यओं क र्थय पयररधथधर्क और पर्यावरण से संढंधिर् ऐसे अन्र् पहलुओं क, धजन पर ध्र्यन िनेय आवश्र्क है, के धलए उपढंि होंगे ।
(7) आंचधलक महयर्ोजनय सभी धवद्यमयन पूजय थलों, ग्रयमों और नगरीर् ढंिोढर्ों, वनों के प्रकयर और दक मों, कृधर् क्षेत्रों, ऊपजयऊ भूधम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के थयन, उद्ययन कृधर् क्षेत्र, ललोद्ययनों, झीलों और अन्र् जल धनकयर्ों कय अभ्र्कंन करेगी और र्ोजनय समथानकयरी मयनधचत्र द्वयरय और धवद्यमयन और प्रर्यधवर् भूधम के उपर्ोग की धविेर्र्यओं क के ब्र्नरे िनेे वयले मयनधचत्र द्वयरय समर्थार् होगी कय धववरण दकर्य जयएगय । II (ii) 3
(8) आंचधलक महयर्ोजनय पयररध थधर्क संवेिी जोन में धवकयस को धवधनर्धमर् करेगी और सयरणी में सूचीढद्ध प्रधर्धर्द्ध, धवधनर्धमर् दिर्यकलयपों कय पयलन करेगी र्थय पयररध थधर्क अनुकूल धवकयस को थयनीर् समुियर्ों की आजीधवकय की सुरक्षय के धलए भी सुधनधिर् करेगी र्थय उसकय संवािन करेगी । ( ) आंचधलक महयर्ोजनय क्षेत्रीर् धवकयस र्ोजनय के सयथ सह-धवर्यर होगी ।
(10) इस प्रकयर अनुमोदिर् आंचधलक महयर्ोजनय मयनी री सधमधर् के धलए इस अधिसूचनय में दिए गए उपढंिों के अनुसयर मयनी री के कयर्ों के कयर्यान्वर्न के धलए एक संिभा िर्यवेज होगी ।
3. रय र् सरकयर द्वयरय दकए जयन ेवयल ेउपयर्-- रय र् सरकयरें इस अधिसूचनय के उपढंिों को प्रभयवी करने के धलए धनम्नधलधखर् उपयर् करेगी, अथयार् :--
(1) भ-ूउपर्ोग - पयररध थधर्क संवेिी जोन में वनों, उद्ययन-कृधर् क्षते्रों, कृधर् क्षेत्रों, आमोि-प्रमोि के प्रर्ोजनों के धलए अधभधनधिर् दकए गए पयकों और खुले थयनों कय वयधणध र्क और औद्योधगक संढद्ध धवकयस दिर्यकलयपों के धलए उपर्ोग र्य संपररवर्ान नहीं होगय:
परंर्ु पयररधथधर्क संवेिी जोन के भीर्र कृधर् भूधम कय संपररवर्ान मयनी री सधमधर् की धसलयररि पर और रय र् सरकयर के पूवा अनुमोिन से, थयनीर् धनवयधसर्ों की आवयसीर् जरूरर्ों को पूरय करने के धलए र्थय नीचे सूचीढद्ध दिर्यकलयपों को करने के धलए ह,ै जैसे:-
(i) पयररध थधर्क अनुकूल पर्ा न दिर्यकलयपों के धलए पर्ा कों के अ थयर्ी अधिभोग के धलए पयररध थधर्क अनुकूल कु ीरों जैसे ें , लक़िी के मकयन आदि;
(ii) धवद्यमयन स़िकों को चऩिय और सुिढृ़ ढनयनय;
(iii) प्रिरू्ण कयररर् न करने वयले लघु उद्योग ;
(iv) वर्या जल संचर्न; और
(v) कु ीर उद्योग, धजसके अंर्गार् ग्रयमीण उद्योग, सुधविय भंर्यर और थयनीर् सुख-सुधवियएं हैं :
परंर्ु र्ह और दक रय र् सरकयर के पूवा अनुमोिन और संधवियन के अनुच् छेि 244 र्य र्त्समर् प्रवृत्त धवधि के उपढंिों धजसके अंर्गार् अनुसूधचर् जनजयधर् और अन्र् परंपरयगर् वन धनवयसी (वन अधिकयरों की मयन्र्र्य) अधिधनर्म, 2006 (2007 कय 2) भी है, के अनुपयलन के धढनय वयधणध र्क र्य उद्योग धवकयस दिर्यकलयपों के धलए जनजयर्ीर् भूधम कय उपर्ोग अनुज्ञयर् नहीं होगय :
परंर्ु र्ह भी दक पयररध थधर्क संवेिी जोन के भीर्र भू-अधभलेखों में उपसंजयर् कोई त्रुर , मयनी री सधमधर् के धवचयर प्रयप्त करने के पियर् रय र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक ढयर ठीक की जयएगी और उि त्रुर दकर्य जयनय के ढयरे में कें द्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को सूचनय िनेी होगी । परंर्ु र्ह भी दक उपर्ुाि त्रुर को ठीक करने में इस उप पैरय के अिीन र्थय उपढंधिर् के धसवयर् दकसी भी ििय में भू-उपर्ोग कय पररवर्ान सधममधलर् नहीं होगय:
परंर्ु र्ह भी दक हररर् क्षेत्र में जैसे वन क्षेत्र, कृधर् क्षेत्र में कोई पयररणयधमक क नर्ी नहीं होगी और अनप्रर्ु् र् र्य अनुत् पयिक कृधर् क्षेत्रों में पुन: वनीकरण करने के प्रर्यस दकए जयएंगे ।
(2) प्रयकृधर्क जल स्रोर् -- आचंधलक महयर्ोजनय में सभी प्रयकृधर्क जल स्रोर्ों की पहचयन की जयएगी और उनके संरक्षण और नवीकरण के धलए र्ोजनयएं सधम मधलर् होगी और रय र् सरकयर द्वयरय आवयह प्रढंि र्ोजनय ऐसी रीधर् में र्ैर्यर की जयएगी धजसमें दक आवयह क्षेत्र में धवकयस दिर्यकलयप प्रधर्धर्द्ध दकर्य जय सके ।
(3) पयररधथधर्क-पर्ा न – (क) पयररधथधर्क संवेिी जोन के भीर्र पर्ा न संढंिी दिर्यकलयप पर्ा न महयर्ोजनय के अनुसयर होंगे जो दक आंचधलक महयर्ोजनय के भयग होगी । (ख) पयररधथधर्क-पर्ा न महयर्ोजनय पर्ा न धवभयग, महाराष्ट्र प्रर्दशे सरकार द्वारा महयरयष्ट्र सरकयर के रयजव और वन धवभयग, के परयमिा से र्ैर्यर की जाएगी । (ग) पयररधथधर्क-पर्ा न संढंिी दिर्यकलयप धनम्नयनुसयर धवधनर्धमर् होंगे, अथयार् :-
(i) पयररधथधर्क संवेिी जोन के भीर्र सभी नए पर्ा न दिर्यकलयपों र्य धवद्यमयन पर्ा न दिर्यकलयपों कय धवर्यर कें द्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के मयगाििाक धसद्धयंर्ों द्वयरय र्थय रयष्ट रीर् ा र्यघ्र स संरक्षण प्रयधिकरण, 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] द्वयरय जयरी पयररधथधर्क पर्ा न (समर्-समर् पर र्थय संिोधिर्) मयगाििाक धसद्धयंर्ों के अनुसयर, पयररधथधर्क पर्ा न, पयररधथधर्क धिक्षय और पयररधथधर्क धवकयस को महत्व िरे्े हुए पयररधथधर्क संवेिी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय;
(ii) पयररध थधर्क अनुकूल पर्ा क दिर्यकलयपों के संढंि में अथयर्ी अधिभोग के धलए वयस सुधविय के धसवयर् द्यानगंगा वन् र्जीव अभर्यर् र् की सीमय से एक दकलोमी र भीर्र हो ल र्य धवर्यर र्क और ररसो ों कय नर्य संधनमयाण अनुज्ञयर् नहीं होगय ।
(iii) आंचधलक महयर्ोजनय कय अनुमोिन दकए जयन ेर्क, पर्ा न के धलए धवकयस और धवद्यमयन पर्ा न दिर्यकलयपों के धवर्यर को वयर्धवक थल धवधनर्िाष्ट संवीक्षय र्थय मयनी री सधमधर् की धसलयररि पर आियररर् संढंधिर् धवधनर्यमक प्रयधिकरणों द्वयरय अनुज्ञयर् दकर्य होगय ।
(4) नसैर्गाक धवरयसर् -- पयररधथधर्क संवेिी जोन में महत्वपूणा नैसर्गाक धवरयसर् के सभी थलों जैसे सभी जीन कोि आरधक्षर् क्षेत्र, िैल धवरचनयएं, जल प्रपयर्ों, झरनों, घय ी मयगों, उपवनों, गुलयएं, थलों, भ्रमण, अश्वरोहण, प्रपयर्ों आदि की पहचयन की जयएगी और उनके संरक्षण और सुरक्षय के धलए इस अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से छह मयस के भीर्र, र्ोजनय र्ैर्यर की जयएगी और ऐसी र्ोजनय आंचधलक महयर्ोजनय कय भयग होगय ।
(5) मयनव धनर्मार् धवरयसर् थल - पयररध थधर्क संवेिी जोन में भवनों, संरचनयओं क, धिल्प-र्थ्र्, ऐधर्हयधसक, कलयत्मक और सयंकृधर्क महत्व के क्षेत्रों की पहचयन की जयएगी और इस अधिसूचनय के अंधर्म प्रकयिन की र्यरीख से छह मयस के भीर्र उनके संरक्षण की र्ोजनयएं र्ैर्यर की जयएंगी र्थय आंचधलक महयर्ोजनय में सधममधलर् की जयएगी ।
(6) ध् वधन प्रिरू्ण -- पयररधथधर्क संवेिी जोन में ध् वधन प्रिरू्ण के धनर्ंत्रण के धलए रय र् सरकयर कय पर्यावरण धवभयग र्य महाराष्ट्र रय र् प्रिरू्ण धनर्ंत्रण ढोर्ा पर्यावरणीर् (संरक्षण) अधिधनर्म, 1 86 के अिीन ध्वधन प्रिरू्ण (धवधनर्मन और धनर्ंत्रण) धनर्म 2000 में उधल्लधखर् उपढंिों के अनुसयर कयर्याधन्वर् करेगय ।
(7) वयर् ुप्रिरू्ण -- पयररधथधर्क संवेिी जोन में, वयर्ु प्रिरू्ण के धनर्ंत्रण के धलए रय र् सरकयर कय पर्यावरण धवभयग र्य महाराष्ट्र रय र् प्रिरू्ण धनर्ंत्रण ढोर्ा वयर्ु (प्रिरू्ण धनवयरण और धनर्ंत्रण) अधिधनर्म, 1981 (1981 कय 14) और उसके अिीन ढनयए गए धनर्मों के उपढंिों के अनुसयर मयनकों धसद्धयरं्ों और धवधनर्मों को कयर्याधन्वर् करेगय ।
(8) ढधहस्रयव कय धनसयरण - पयररधथधर्क संवेिी जोन में उपचयररर् ढधहस्रयव कय धनसयरण पर्यावरणीर् प्रिरू्कों के धनसयरण पर्यावरणीर् (संरक्षण) अधिधनर्म, 1 86 अंर्गार् आने वयले सयमयन्र् मयनकों के उपढंिों के अनुसयर होगय। ( ) ठोस अपधिष्ट -- ठोस अपधिष्टों कय धनप यन धनम्नधलधखर् रूप में होगय--
(i) पयररधथधर्क संवेिी जोन में ठोस अपधिष्ट धनप यन ठोस अपधिष्ट प्रढंिन धनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं. कय.आ. 1357(अ) र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयधिर् दकए गए थे, के उपढंिों के अनुसयर दकर्य जयएगय ;
(ii) थयनीर् प्रयधिकरण जैव धनम्नीकरणीर् और अजैव धनम्नीकरणीर् संघ कों में ठोस अपधिष्टों के संपृथक्कन के धलए र्ोजनयएं र्ैर्यर करेंगे ;
(iii) जैव धनम्नीकरणीर् सयमग्री को अधिमयनर्ः खयि ढनयकर र्य कृधम खेर्ी के मयध्र्म से पुनःचदिर् दकर्य जयएगय ;
(iv) अकयढाधनक सयमग्री कय धनप यन पयररधथधर्क संवेिी जोन के ढयहर पहचयन दकए गए थल पर दकसी पर्यावरणीर् वीकयर्ा रीधर् में होगय और पयररधथधर्क संवेिी जोन में ठोस अपधिष्ट ों को जलयनय र्य भष्ट मीकरण अनुज्ञयर् नहीं होगय।
(10) जवै धचदकत् सीर् अपधिष्ट - पयररधथधर्क संवेिी जोन में जैव धचदकत्सीर् अपधिष्टों कय धनप यन भयरर् सरकयर के पर्यावरण, वन और जलवायु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोधिर् अधिसूचनय स.कय.धन 343 (अ), तारीख 28 मािच 2016 द्वयरय प्रकयधिर् जैव धचदकत्सीर् अपधिष्ट प्रढंि धनर्म, 2016 के उपढंिों के अनुसयर दकर्य जयएगय ।
(11) प्लयध क अपधिष्ट प्रढिंन:- पयररधथधर्क संवेिी जोन में प्लयध क अपधिष्ट प्रढंि कय धनप यन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयधिर् प्लयध क अपधिष्ट प्रढंि धनर्म 2016 के उपढंिों के अनुसयर दकर्य जयएगय। II (ii) 5
(12) धनमयाण और धवध्वसं अपधिष्ट प्रढिंन:- पयररधथधर्क संवेिी जोन में संधनमयाण और धवध्वंस अपधिष्ट प्रढंि कय धनप यन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अधिसूचनय सं.कय.धन 317(अ), र्यरीख 2 मयचा, 2016 द्वयरय प्रकयधिर् संधनमयाण और धवध्वंस प्रढंि धनर्म, 2016 के उपढंिों के अनुसयर दकर्य जयएगय।
(13) र्यनीर् र्यर्यर्यर्- पररवहन कय र्यनीर् संचलन आवयस के अनुकूल रीधर् में वच्छ ईिन कय प्रर्ोग करर्े हुए धवधनर्धमर् होंगी और इस संढंि में आंचधलक महयर्ोजनय में धविेर् उपढंि समयधवष्ट दकए जयएंग ेऔर आंचधलक महयर्ोजनय के र्ैर्यर होने और उसे रय र् सरकयर के सक्षम प्रयधिकयरी के द्वयरय अनुमोदिर् होने र्क, मयनी री सधमधर् सुसंगर् अधिधनर्म र्थय र्ििीन ढनयए गए धनर्मों और धवधनर्मों के अिीन र्यनीर् संजनल के अनुपयलन को मयनी र करेगी ।
(14) औद्योधगक इकयइर्य ं- (क) प्र र्यधवर् पयररधथधर्क संवेिी जोन के भीर्र नए कयष्ट ठ आियररर् उद्योगों की थयपनय धवधि के अनुसयर थयधपर् धवद्यमयन कयष्ट ठ आियररर् उद्योगों के धलए अनुज्ञयर् की जयएगी अन् र्थय नहीं । (ख) प्र र्यधवर् पयररधथधर्क संवेिी जोन के भीर्र जल, वयर्ु, मृिय, ध् वधन प्रिरू्ण उत् पन् न करने वयले दकसी नए उद्योग की थयपनय अनुज्ञयर् नहीं की जयएगी ।
4. पयररधथधर्क सवंिेी जोन में प्रधर्धर्द्ध और धवधनर्धमर् दकए जयन ेवयल े दिर्यकलयपों की सचूी - पयररधथधर्क संविेी जोन में सभी दिर्यकलयप पर्यावरण (संरक्षण) अधिधनर्म, 1986 (1 86 कय 2 ) र्थय र्ििीन ढनयए गए धनर्मों के उपढंिों द्वयरय ियधसर् होंग ेऔर नीचे िी गई सयरणी में धवधनर्िाष्ट रीधर् में धवधनर्धमर् होंग,े अथयार् :-- सयरणी िम स.ं दिर्यकलयप ीकय-र प्पणी
(1) (2) (3) क.प्रधर्धर्द्ध दिर्यकलयप
1. वयधणध र्क खनन, पत्थर की खियन और उनको र्ो़िने की इकयइर्यं । (क) सभी नए और धवद्यमयन खनन (लघु और वृहर् खधनज), पत्थर की खयनें और उनको र्ो़िने की इकयइर्यं र्ुरंर् प्रभयव से धसवयर् वयर्धवक थयनीर् धनवयधसर्ों की घरेलू आवश्र्कर्यओं क को पूरय करने धजसमें मकयनों के संधनमयाण र्य मरममर् के धलए िरर्ी को खोिनय और आवयसन के धलए ििेी यइलों र्य ईं ों कय धनमयाण करनय भी ह,ै धवद्यमयन धवधनर्मों के अनुसयर प्रधर्धर्द्ध होंगे । (ख) खनन संदिर्यएं, मयननीर् उच्चर्म न्र्यर्यलर् की रर र्यधचकय (धसधवल) सं. 1995 कय 202 ी.एन. गनर्यढमान धथरुमूलपयि ढनयम भयरर् सरकयर के मयमले में आििे र्यरीख 4 अगर्, 2006 और रर र्यधचकय (धसधवल) सं.
2012 कय 435 गोवय लयउंरे्िन ढनयम भयरर् सरकयर के मयमले में र्यरीख 21 अप्रैल, 2014 के अंर्ररम आिेि के अनुसयर की जयएगी ।
2. प्रिरू्ण (जल, वयर्,ु मृिय ध् वधन आकर्द) कयररर् करने वयले उद्योगों की थयपनय । और पयररधथधर्क संवेिी जोन में दकसी नए उद्योग और धवद्यमयन प्रिरू्ण लैलयने वयले उद्योगों के धवर्यर की अनुमधर् नही िी जयएगी। केवल गैर प्रिरू्णकयरी उद्योगों को पयररधथधर्क संवेिी जोन के भीर्र लरवरी, 2016 में केन्द्रीर् प्रिरू्ण धनर्ंत्रण ढोर्ा द्वयरय जयरी मयगाििी धसद्धयरं्ों में उद्योगों के वगीकरण के अनुसयर र्ढ र्क अनुज्ञयर् नहीं दकर्य जयएगय जढ र्क अधिसूचनय में इस प्रकयर धवधनर्िाष्ट नहीं कर दिर्य गर्य हो। इसके अधर्ररि गैर प्रिधूर्र् कु ीर उद्योगों कय संविान दकर्य जयएगय ।
3. ढृहर् जल धवद्युर् पररर्ोजनय की थयपनय । लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपढंधिर् के धसवयर्) होंगे ।
4. दकसी पररसंक मर् पियथों कय उपर्ोग र्य उत्पयिन र्य प्रसंकरण । लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपढंधिर् के धसवयर्) होंगे ।
5. प्रयकृधर्क जल धनकयर्ों र्य भूधम क्षेत्र में अनुपचयररर् ढधहस्रयाव कय धनसयरण । लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपढंधिर् के धसवयर्) होंगे । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
6. ठोस अपधिष्ट धनप यन थल और ठोस की थयपनय और जैव धचदकत्सय अपधिष्ट के धलए सयमयन्र् भष्टमीकरण की सुधविय । पयररधथधर्क संवेिी जोन में ठोस अपधिष्ट धनप यन की कोई नर्य ठोस अपधिष्ट धनप यन थल और अपधिष्ट उपचयर/प्रसंकरण सुधविय की अनुमधर् नहीं ह।ै इसके अधर्ररि औद्योधगक प्रदिर्य और वयथ्र् थयपन/अपर्यलों आदि से उत्पन्न दकसी भी ठोस अपधिष्ट के दकसी भी प्रकयर के उपचयर के धलए सयमयन्र् र्य व्यधिगर् भष्टमीकरण की सुधविय कय संथयपन प्रधर्धर्द्ध ह।ै
7. लमों, कॉपोरे , कंपधनर्ों द्वयरय ढ़ेि पैमयने पर वयधणध र्क पिुिन संपिय और कु्कु लयमों की थयपनय । थयनीर् जरूरर्ों को पूरय करने के चसवाय लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपढंधिर् के धसवयर्) होंगे।
8. नई आरय धमलों की थयपनय। पयररधथधर्क संवेिी जोन के भीर्र नई और धवद्यमयन आरय धमलों कय धव र्यर अनुज्ञयर् नहीं होगय ।
9. ईं भट्टों की थयपनय करनय। लयगू धवधिर्ों के अनुसयर प्रधर्धर्द्ध (अन् र्थय उपढंधिर् के धसवयर्) होंगे । ख.धवधनर्धमर् दिर्यकलयप
10. वयधणध र्क हो लों और ररसो ों कय थयपन । पयररधथधर्क अनुकूल पर्ा न दिर्यकलयप के धलए लघु अथयर्ी संरचनयओं क के धलए ही नए वयधणध र्क हो लों और ररसो ों को संरधक्षर् क्षेत्र की सीमय के एक दक.मी. के भीर्र र्य पयररधथधर्क संवेिी जोन के धवर्यर र्क, जो भी धनक हो अनुज्ञयर् दकर्य जयएगय अन्र्थय नहीं । परन्र्ु संरधक्षर् क्षेत्र की सीमय से एक दकलोमी र से परे र्य पयररधथधर्क संवेिी जोन के धवर्यर र्क, जो भी धनक हो, सभी नए पर्ा न दिर्यकलयपों र्य धवद्यमयन दिर्यकलयपों कय धवर्यर र्थय लयगू पर्ा न महयर्ोजनय र्थय मयगाििी धसद्धयंर्ों के अनुरुप होगय ।
11. संधनमयाण दिर्यकलयप । संरधक्षर् क्षेत्र र्य पयररधथधर्क सवंेिी जोन जो भी धनक हो, की सीमय स े एक दकलोमी र के भीर्र दकसी भी प्रकयर कय नर्य वयधणध र्क संधनमयाण अनुज्ञयर् नहीं दकर्य जयएगय:
परंर्ु थयनीर् धनवयधसर्ों की आवयसीर् आवश्र्कर्यओं क को पूरय करने के धलए थयनीर् लोगों को पैरय 6 के उप पैरय (1) में सूचीढद्ध दिर्यकलयपों सधहर् उनके उपर्ोग के धलए उनकी भूधम में संधनमयाण करने की अनुमधर् भवन उपधवधिर्ों के अनुसयर िी जयएगी जैसे:-
(i) धवद्यमयन स़िकों को चऩिय करनय और उन्हें सुिढृ़ करनय र्थय नई स़िकों कय संधनमयाण;
(ii) ढुधनर्यिी ायंचों और नयगररक सुख सुधवियओं क कय संधनमयाण और नवीकरण;
(iii) कु ीर उद्योगों धजसके अंर्गार् ग्रयमीण उद्योग भी हैं; सुधवियजनक भ्र्यर और थयनीर् सुख सुधवियएं जो पयररधथधर्क पर्ा न धजसमें गृह वयस भी ह ैसहयर्क हो; और
(iv) इस अधिसूचनय में संवर्िार् दिर्यकलयपों की सूची :
12. प्रिरू्ण उत्पन्न न करने वयले लघु उद्योग । लरवरी, 2016 में पयररधथधर्क संवेिी जोन के कें द्रीर् प्रिरू्ण धनर्ंत्रण ढोर्ा द्वयरय जयरी उद्योगों के वगीकरण के अनुसयर धसला गैर- प्रिरू्णकयरी उद्योगों को श्वेर् प्रवगा के रुप में कहय गर्य ह ैऔर पाररचस्क्िचतक संवेर्दी जोन से गैर पररसंकटमय, लघु और सेवा उद्योग, कृधर्, उद्यान कृचि, पुष्टप कृचि या औद्योचगक उत्पार्दों का उत्पार्दन करने वयले कृचि आधाररत उद्योग को सक्षम प्राचधकारी द्वारा अनुज्ञात दकर्य जयएगय।
13. वृक्षों की क यई । (क) रय र् सरकयर में सक्षम प्रयधिकयरी की पूवा अनुमधर् के धढनय वन में र्य II (ii) 7 सरकयरी र्य रयजव र्य धनजी भूधम पर वृक्षों की कोई क यई नहीं होगी। (ख) वृक्षों की क यई संढंधिर् कें द्रीर् र्य रय र् अधिधनर्म र्य उसके अिीन ढनयए गए धनर्मों के उपढंि के अनुसयर धवधनर्धमर् होगी ।
14. जलवयन लक़िी कय वयधणध र्क उपर्ोग। लयग ूधवधिर्ों के अिीन धवधनर्धमर् होंगे ।
15. वन उत्पयिों या गैर कयष्ट ठ वन उत्पयिों एन टी एफ टी कय संग्रहण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
16. धवद्युर् और िरूसंचयर यवरों कय पररधनमयाण और केढलों धढछयनय र्थय अन्र् ढुधनर्यिी ायंचे । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे । भूधमगर् केढल धढछयए जयने को ढढ़यवय दिर्य जयएगय।
17. नयगररक सुख सुधवियओं क सधहर् ढुधनर्यिी ायंचे। न्र्ूनीकरण की उपयर्ों के सयथ, लयग ू धवधिर्ों धनर्मों और धवधनर्मों और उपलब्ि दिियधनििेों के अनुसयर धवधनर्धमर् होंगे।
18. धवद्यमयन स़िकों को चऩिय करनय और उन्हें सुिढृ़ करनय र्थय नई स़िकों कय संधनमयाण । न्र्ूनीकरण की उपयर्ों के सयथ, लयग ू धवधिर्ों धनर्मों और धवधनर्मों और उपलब्ि दिियधनििेों के अनुसयर धवधनर्धमर् होंगे।
19. गमा वयर्ु गुब्ढयरें, हेलीकयप् र, ड्रोन, मयइिोलयइ स द्वयरय पयररधथधर्क संवेिी जोन क्षेत्र के ऊपर से उ़िनय जैसे अन्र् पर्ा न संढंिी दिर्यकलयप करनय। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
20. पहय़िी ायलों और निी र् ों कय संरक्षण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
21. रयधत्र में र्यधनक र्यर्यर्यर् कय संचलन । लयगू धवधिर्ों के अिीन वयधणध र्क प्रर्ोजन के धलए धवधनर्धमर् होंगे ।
22. थयनीर् समुियर्ों द्वयरय चलयई जय रही कृधर् और ढयगवयनी प्रथयओं क के सयथ पिुपयलन, पिुपयलन कृधर्, जल कृधर् और मछली पयलन । थयनीर् लोगों के उपर्ोग के धलए लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
23. प्रयकृधर्क जल धनकयर्ों भू क्षेत्र में उपचयररर् अपधिष्ट/ ढधहस्रयावों कय धनसयरण । उपचयररर् अपधिष्ट जल/ ढधहस्रयावों के धनसयरण को जल धनकयर्ों में प्रवेि नहीं करने दिर्य जयएगय । उपचयररर् अपधिष्ट जल के पुनचिण और पुन:
उपर्ोग के धलए दकए जयने वयले प्रर्यस अन्र्थय लयगू धवधिर्ों के अनुसयर उपचयररर् अपधिष्ट जल/ ढधहस्रयाव कय धनसयरण धवधनर्धमर् दकर्य जयएगय।
24. सर्ह और भूजल के वयधणध र्क धनष्टकर्ाण । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
25. खुले कुआ, ढोर कुआ, आदि के धलए कृधर् और अन्र् उपर्ोग । थयनीर् उपर्ोग के धलए अनुज्ञयर् अन्र्थय अन्र्थय इसे धवधनर्धमर् दकर्य जयएगय और समुधचर् प्रयधिकयरी द्वयरय दिर्यकलयपों की सख्र्ी से मयनी री की जयएगी।
26. ठोस अपधिष्ट प्रढंिन। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
27. धवििेी प्रजयधर्र्ों को लयनय । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
28. पयररधथधर्क-पर्ा न। लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
29. पोधलथीन ढैगों कय उपर्ोग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।
30. वयधणध र्क सयइनढोर्ा और होर्रं्ग । लयगू धवधिर्ों के अिीन धवधनर्धमर् होंगे ।

(1) कें द्रीर् सरकयर ने तीन विच की अवचध के चलए पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 3 की उप-ियरय (3) के अिीन इस अधिसूचनय के उपढंिों की प्रभयवी धनगरयनी के धलए एक धनगरयनी सधमधर् कय गठन दकर्य गर्य, जो धनम्नधलधखर् से धमलकर ढनेगी, अथयार् :-
(i) धजलय कल् र, ढुलायनय -अध् र्क्ष;
(ii) धजलय पररर्ि , ढुलायनय कय प्रधर्धनधि -सिर्;
(iii) महयरयष्ट र सरकयर के रयज व धवभयग कय प्रधर्धनधि -सिर्;
(iv) सिरू संवेिन केन्द्र कय प्रधर्धनधि -सिर्;
(v) पर्यावरण के क्षेत्र में कयर्ा करने वयले गैर सरकयरी संगठन कय महयरयष्ट र रय र् सरकयर द्वयरय नयमधनर्िाष्ट दकए जयने वयले एक प्रधर्धनधि -सिर्;
(vi) पयरर ध थ धर् की और पर्यावरण के क्षेत्र में महयरयष्ट र रय र् सरकयर द्वयरय नयमधनर्िाष्ट दकए जयने वयलय एक धविेर्ज्ञ -सिर्;
(vii) रय र् जैव-धवधविर्य ढोर्ा कय सिर् सधचव/सिर् -सिर्;
(viii) प्रयिधेिक अधिकयरी महयरयष्ट र रय र् प्रिरू्ण धनर्ंत्रण ढोर्ा -सिर्;
(ix) र्ेष्ट ठ नगर र्ोजनयकयर, ढुलायनय -सिर्;
(x) उप वन संरक्षक ( ी), ढुलायनय प्रभयग सिर्-सधचव।
6. धनििे धनढिंन : (1) पयररधथधर्क संवेिी जोन सधमधर् इस अधिसूचनय के उपढंिों के अनुपयलन को मयनी र करेगी और मयनी री सधमधर् कय कयर्ाकयल अधिसूचनय के प्रकयिन की र्यरीख से र्ीन वर्ा की अवधि के धलए होगी ।
(2) पयररधथधर्क संवेिी जोन में भयरर् सरकयर के र्त् कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय सं. कय.आ. 1533(अ), र्यरीख 14 धसर्ंढर, 2006 की अनुसूची में के अिीन सधममधलर् दिर्यकलयपों और इस अधिसूचनय के पैरय 4 के अिीन सयरणी में र्थय II (ii) 9 धवधनर्िाष्ट प्रधर्धर्द्ध गधर्धवधिर्ों के धसवयर् आन ेवयले दिर्यकलयपों की वयर्धवक धवधनर्िाष्ट थलीर् िियओं क पर आियररर् मयनी री सधमधर् द्वयरय संवीक्षय की जयएगी और उि अधिसूचनय के उपढंिों के अिीन पूवा पर्यावरण धनकयसी के धलए केन्द्रीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को धनर्िाष्ट की जयएगी ।
(3) इस अधिसूचनय के पैरय 4 के अिीन र्थय धवधनर्िाष्ट प्रधर्धर्द्ध दिर्यकलयपों के धसवयर्, भयरर् सरकयर के र्त्कयलीन पर्यावरण और वन मंत्रयलर् की अधिसूचनय संख्र्यंक कय.आ. 1533(अ), र्यरीख 14 धसर्ंढर, 2006 की अधिसूचनय के अनुसूची के अिीन ऐसे दिर्यकलयपों, धजन्हें सधममधलर् नहीं दकर्य गर्य ह,ै और जो पयररधथधर्क संवेिी जोन में आर्े हैं, ऐस ेदिर्यकलयपों की वयर्धवक धवधनर्िाष्ट थलीर् िियओं क पर आियररर् मयनी री सधमधर् द्वयरय संवीक्षय की जयएगी और उसे संढद्ध धवधनर्यमक प्रयधिकरणों को धनर्िाष्ट दकर्य जयएगय ।
(4) मयनी री सधमधर् कय सिर्-सधचव र्य संढद्ध कल् र र्य संरधक्षर् क्षेत्र कय प्रभयरी ऐसे व्यधि के धवरूद्ध, जो इस अधिसूचनय के दकसी उपढंि कय उल्लंघन करर्य ह,ै पर्यावरण (संरक्षण) अधिधनर्म, 1986 की ियरय 19 के अिीन पररवयि लयइल करने के धलए सक्षम होगय।
(5) मयनी री सधमधर् मुद्दय िर मुद्दय के आियर पर अपेक्षयओं क पर धनभार रहर्े हुए संढद्ध धवभयगों के प्रधर्धनधिर्ों र्य धविेर्ज्ञों, औद्योधगक संगमों र्य संढद्ध पणियररर्ों के प्रधर्धनधिर्ों को अपन ेधवचयर-धवमिा में सहयर्र्य के धलए आमंधत्रर् कर सकेगी ।
(6) मयनी री सधमधर् प्रत्र्ेक वर्ा की 31 मयचा र्क की अपनी वयर्र्ाक कयरावयई ररपो ा रय र् के मुख्र् वन्र् जीव वयर्ान को उपयढंि V में उपढंधिर् रूप धवियन के अनुसयर उ् र् वर्ा के 30 जून र्क प्रर्ुर् करेगी ।
(7) केन्द्रीर् सरकयर कय पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् मयनी री सधमधर् को अपने कृत्र्ों के प्रभयवी धनवाहन के धलए ऐसे धनििे ि ेसकेगय, जो वह ठीक समझे ।
7. इस अधिसूचनय के उपढंिों को प्रभयवी करने के धलए कें द्रीर् सरकयर और रय र् सरकयर, अधर्रर् र् उपयर्, र्दि कोई हों, धवधनर्िाष्ट कर सकेगी ।

8. कोई अन् र् महत् वपूणा धवर्र् । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 17th May, 2017 S.O.1604(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O.3121(E), dated the 20 th November 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, no objections and suggestions received from all persons and stakeholders in response to the draft notification;
14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, Dyanganga Wildlife Sanctuary situate in Buldhana district in the State of Maharashtra between North latitude from 19 0 58’ 40” to 19 0 58’ 42” and East longitude from 76 0 31’ 45” to 76 0 31’ 56” and is spread over an area
203.21 square kilometres;
AND WHEREAS, the sanctuary harbours Leopard (Panthera pardus), Sloth Bear (Melursus ursinus), Wolf (Canis lupus pallipes), Hyaena (Hyaena hyaena), Fox (Vulpes bengalensis), Nilgai (Boselaphus tragocamelus), Wild Boar (Sus scrofa), Peafowl (Pavo cristatus), Black Buck (Antelope cervicapra) and has dry deciduous teak and miscellaneous forests typical of biotic province 6 B–central plateau of the Deccan Peninsula Zone;
AND WHEREAS, it is necessary to conserve and protect the area around the protected area of the Dyanganga Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view.
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent ranges from
1.38 kilometres to 8.10 kilometres from the boundary of the Dyanganga Wildlife Sanctuary in the State of Maharashtra as the Dyanganga Wildlife Sanctuary Eco-sensitive Zone (herewith after called as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 297.85 square kilometres with an extent of 1.380 kilometres to 8.10 kilometres from the boundary of the Dyanganga Wildlife Sanctuary and the boundary description of the Eco-sensitive Zone is given in Annexure I.
(2) The map of the wildlife sanctuary and Eco-sensitive Zone is appended to this notification as Annexure II.
(3) The Geo-coordinates of the wildlife sanctuary and Eco-sensitive Zone are appended to this notification as Annexure- III.
(4) The Eco-sensitive Zone is spread across 37 villages in Buldhana District in the State of Maharashtra and the list of the villages falling within Eco-sensitive Zone along with coordinates of prominent points is appended as Annexure IV.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the Competent authority of State.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and Eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

(8) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote Eco-friendly development for livelihood security of local communities.
(9) The Zonal Master Plan shall be co-terminus with the Regional Development Plan
(10) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed namely:-
(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities,
(ii) widening and strengthening of existing roads,
(iii) small scale industries not causing pollution,
(iv) rainwater harvesting, and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or restrict development activities within the catchment areas.
(3) Eco-Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Eco-tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation with Department of Revenue and Forests, Government of Maharashtra.
(c) The activities of Eco-tourism shall be regulated as under, namely:-
(i) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on Eco-tourism, Eco-education and Eco-development and based on carrying capacity study of the Eco-sensitive Zone.
(ii) New construction of hotels and resorts shall not be permitted within one kilometre or up to the extent from the boundary of the Dyanganga Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities.
(iii) Till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artifact areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated in the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) The solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016.
(ii) The local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components.
(iii) The biodegradable material shall be recycled preferably through composting or vermiculture.
(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Ecosensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical wastes.- The Bio-Medical waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016.
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016.
(13) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner using clean fuel and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
(14) Industrial Units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based Industries set up as per the Law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:- II (ii) 17 TABLE S. 1. Commercial Mining, stone quarrying and stone crushing.
(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.
(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.).
No new industries and expansion of existing polluting industries in the Eco-sensitive Zone shall be permitted.
Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3. Establishment of major hydroelectric project.
Prohibited (except as otherwise provided) as per applicable laws.
4. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per applicable laws.
5. Discharge of untreated effluents in natural water bodies or land area.
Prohibited (except as otherwise provided) as per applicable laws.
6. Establishment of solid waste disposal site and common incineration facility for solid and bio medical waste.
No new solid waste disposal site and waste treatment/processing facility of solid waste is permitted within Eco sensitive zone. Further installation of common or individual incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospitals etc. is Prohibited.
7. Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.
8. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
10. Commercial establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
11. Construction activities. No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as:* 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) cottage industries including village industries; convenience stores & local amenities supporting Eco-tourism including home stays; and
(iv) promoted activities listed in this Notification.
12. Small scale non-polluting industries. Non-polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
13. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.
14. Commercial use of fire wood. Regulated under applicable laws.
15. Collection of Forest produce or Non- Timber Forest Produce (NTFP).
Regulated under applicable laws.
16. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.
17. Infrastructure including civic amenities.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18. Widening and strengthening of existing roads and construction of new roads.
Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
19. Under taking other activities related to tourism like over flying the Ecosensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law.
20. Protection of Hill Slopes and river banks.
Regulated under applicable laws.
21. Movement of vehicular traffic at night.
Regulated for commercial purpose under applicable laws.
22. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Permitted under applicable laws for use of locals.
23. Discharge of treated waste water/effluents in natural water bodies or land area.
The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.
24. Commercial extraction of surface and ground water.
Regulated under applicable law.
25. Open Well, Bore Well etc. for agriculture or other usage.
Permitted for local use otherwise it shall be regulated and the activity should be strictly monitored by the appropriate authority.
26. Solid Waste Management. Regulated under applicable laws.
27. Introduction of Exotic species. Regulated under applicable laws.
28. Eco-tourism. Regulated under applicable laws.
29. Use of polythene bags. Regulated under applicable laws.
30. Commercial Sign boards and hoardings.
Regulated under applicable laws.
31. Right of way for cattle grazing. Right of way to be specified by concerned Authority for permission to local/villages.
II (ii) 19 Prohibited Activities as specified above shall come into effect from the date of issue of Draft Notification.
5. Monitoring Committee.-
(1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for the effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-
(i) The Collector of Buldhana District Chairman
(ii) A representative of Zilla Parishad, Buldhana Member
(iii) A representative of Department of Revenue, Government of Maharashtra Member
(iv) Representative of Remote sensing centre Member
(v) One representative of Non Governmental Organisation working in the field of environment to be nominated by the Government of Maharashtra Member
(vi) one expert in the area of ecology and environment to be nominated by the Government of Maharashtra Member
(vii)
(viii) Member-Secretary/Member of the State Biodiversity Board The Regional Officer, Maharashtra State Pollution Control Board, Member
(ix) The Senior Town Planner, Buldhana Member
(x) The Deputy Conservator of Forest (T) - Buldhana Division Member Secretary .
6. Terms of Reference:- (1)The Monitoring Committee shall monitor the compliance of the provisions of this Notification and the tenure of Monitoring Committee shall be for three year from date of publication of notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
C. Promoted Activities
32. Rain water harvesting. Shall be actively promoted.
33. Organic farming. Shall be actively promoted.
34. Adoption of green technology for all activities.
Shall be actively promoted.
35. Cottage industries including village artisans, etc.
Shall be actively promoted.
36. Use of renewable energy and fuels. Bio gas, solar light etc. to be actively promoted.
37. Agro-Forestry. Shall be actively promoted.
38. Use of eco-friendly transport. Shall be actively promoted.
39. Skill Development. Shall be actively promoted.
40. Restoration of Degraded Land/ Forests/ Habitat.
Shall be actively promoted.
41. Environmental Awareness. Shall be actively promoted.

(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31 st March of every year by 30 th June of that year to the Chief Wildlife Warden of the State as per pro forma given in Annexure V.
(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of the notification.
8. The provisions of this Notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal (NGT).
